Dear Joyce Mazur from Terry Nelson

February 25, 2013

Dear Joyce Mazur

I have been told that the Custom Council passed a motion this last week that barred

myself Terrance Nelson, Keith Henry, Evelyn Patrick and Michael Littlejohn from

running in the election in March 2013. The motion was typed and ready for passage

before the meeting. It was put forward by Hector Pierre and seconded by Felix

Antoine. I would remember you that none of us has been convicted of a crime and

there is no grounds to bar us from running in the election.

Four people, Ed Hayden, Evelyn Patrick, Alfred Hayden and the secretary of the

Custom Council asked the Chairman of Custom Council Leo Hayden for a copy of the

motion. He refused saying that it will be a court document. I want to know if you as

the electoral officer will deny us from running in the Chief and Council Election.

The Government of Canada wants to ensure that I am not Chief of Roseau River. In

March 2011, the release of the forensic audit was timed to have maximum press

impact. It was released a week or so from the Chief and Council election. I still won.

The only authority that counts is the people themselves. The nine people who ousted

me do not want the people to have a say in this matter. The Custom Council and Ken

Henry Jr have spent ten million dollars from the 1903 Surrender revenue in the last 11

months.

The government has had two years to act upon the forensic audit. They have done

nothing. There is no criminal activity in the forensic audit, it is only there to put as

much mud on me as possible.

I will be there on Thursday February 28th in the morning to be nominated for Chief. I

expect you to have a decision on whether or not my nomination stands or not. To

deny me and the other three members of the previous council an opportunity to stand

before the judgement of the people is an abuse.

The Custom Council and Chief Ken Henry have had two of the finest and most

expensive law firms in Manitoba on their side. We were self represented. The court

decision was not unexpected given the limits of the information in front of the judge.

Chief Ken Henry threatened Aboriginal Affairs with Trespass if Aboriginal Affairs set

foot in Roseau River to conduct a referendum of the people on governance. That

letter was introduced into court but the judge ignored it. Also Judge Russel was

informed of the offer of Judge Mandamin to try to mediate. The Custom Council and

Ken Henry refused the Court mediation offer. They absolutely refused to allow the

judge to go to Roseau River to hear from the people. The lawyers objected to my

telling Judge Russel because the agreement before Judge Mandamin was "without

prejudice"

Already you as Electoral officer has overlooked the rules of the Election Act. It states

clearly in the election act that there is to be only one poll. The voting poll was to be at

Roseau River on election day. There is no provision in the current election act to have

a poll in Winnipeg. The election act has an order in council from the government of

Canada. To change the election act without a referendum of the people is illegal. The

Custom Council held a referendum. Their amendments to the election act were

defeated by the people. To change the election act by simple motion of the Custom

Council is not legal.

The government of Canada grants contracts to the two law firms who represented

Chief Ken Henry and the Custom Council. I will be seeking a freedom of information

to find out how much these two law firms received from the federal government. If the

amounts are substantial, it will become an issue. I will file an appeal to Judge

Russel's decision on Thursday afternoon after the nominations.

I have been in Iran, been on a railway blockade and been one of the lead Chiefs in

Canada who takes action on the illegal theft by immigrants who occupy our land and

deny us our rights, I don't expect sympathy from the court and I realize that the

government of Canada will do everything to keep me from becoming Chief again.

They will do what they can to support my opposition, including denying our people

the right to decide our own governance.

If you deny me my right to run as Chief, you have will have conducted an illegal

election.I have been elected five times in a row and the only reason Ken Henry is

Chief is because they conducted a by election where only a small group of people

participated. To deny the right of the people to decide this matter is what the Custom

Council and Ken Henry want. The court may side with the nine people on Custom

Council and if you deny the people their right to decide you will make the government

of Canada happy. Did you receive legal advice on this matter?

Terrance Nelson
