Either a category 3 certification or LHA certification will be required, proof of liability insurance of at least $300,000 and a certification number displayed in the applicator’s vehicle plus on any trailer used in the business. A person operating under this special Limited Herbicide Applicator certification is not authorized to advertise the application of herbicides or any other pesticide application nor supervise the application of any pesticide by an uncertified person. To prepare for the Limited Herbicide Applicator exam, one must study the ‘Core’ Applying Pesticides Safely plus be able to read a pesticide label. You must send in proof of insurance along with your certification application first to John Ewell. He can be reached at 615-837-5340 or fax 615- 837-5012. You do not have to be licensed and chartered to apply plain fertilizer, but you would need to be if you apply fertilizer impregnated with a herbicide or other pesticide (‘weed & feed’) due to the pesticide in the product. The license exam dates for 2016 are Jan. 12th—13th, April 5th— 6th July 12th—13th and Oct. 4th - 5th. The Board always meet on the Monday before the license exams. The HLT, HRI, FUS, FUM, WEC, AQW, AGE & PHMC are given on the first day and the rest of the exams-the WDO, GRC & BDC are given on the second day. **Certification Information: A new certification cycle has begun as of January 1, 2015 and extends through December

31, 2017. Each certification year now ends on December 31st of each year. You must earn the required number of ceu’s/

points in more than one certification year. No more than 50% of the total required number of points can be “In-House”

which includes training by one’s own company or anything done online. No more than 75% of the total point requirement

can be earned at any one meeting.

Legislation – Amendment to 62 -21-119

(a) If the commissioner has reason to believe that any person has violated this chapter or rules promulgated pursuant to this chapter, or has used economic poison in violation of the Tennessee Insecticide, Fungicide, and Rodenticide Act, compiled in title 43, chapter 8, parts 1 and 2, or rules promulgated pursuant to the act, the commissioner may deny, revoke, suspend, or modify any license, charter, or certification. The commissioner may also impose civil penalties of up to one thousand dollars ($1,000) for each violation or issue a warning notice.

SECTION 2. This act shall take effect July 1, 2015, the public welfare requiring it.

The section previously read as follows:

62-21-119. Denial, suspension or revocation of charter, license or certificate - Penalties - Warnings.

(a) If the commissioner has reason to believe that a charter holder, licensee or certificate holder has violated any provision of this chapter, including its rules and regulations, or has used any economic poison in violation of the provisions of the Tennessee insecti-cide, fungicide, and rodenticide law, compiled in title 43, chapter 8, parts 1 and 2, including its rules and regulations, the commission-er shall conduct a hearing to determine if any license, charter or certification should be denied, revoked, suspended or modified, and/

or impose civil penalties of up to one thousand dollars ($1,000) for each violation, or the commissioner may issue a warning notice.

One of the many questions received by TDA is: What labeling is required on application tanks? As per 62-21-117. Labeling of pesti-cides this is what is required.

(a) It is illegal to store or transport any pesticide chemicals unless the containers for such chemicals are labeled to show the:

(1) Name of the pesticide; and

(2) Concentration of the pesticide.

(b) When pesticides are stored or transported in containers other than those in which they were placed by the manufacturer or formu-lators, the label must also show the name of the chartered person, firm or corporation.

*Pest Control Professionals, Renewals for Charted Companies and Non-Chartered persons L through Z will be mailed in November 2015* If you have not renewed by February 1, 2016 late fees will begin accruing if any fee imposed under this part is not paid within (15) days of the due date, a penalty of five percent (5%) of the amount due shall at once and added to the amount due. Thereafter, on the first day of each month during which any part accrued penalty remains unpaid, an additional penalty of five percent (5%) of then unpaid balance shall accrue and be added to the unpaid balance. In addition, the fees not paid within fifteen (15) days after the due date shall bear interest at the maximum lawful rate from the due date to the date paid or you will be subject to enforcement action.

October 6, 2015 In This Update: EPA Signs Cooperative Agreement with UC Davis Extension for Tribal Pesticide Program Support

EPA has entered into a cooperative agreement with University of California, Davis Extension (UC Davis) to provide technical support to the Tribal Pesticide Program Council (TPPC) for a five-year period. The cooperative agreement will provide financial assistance for UC Davis to support the TPPC as it:

raises tribal pesticide program implementation issues to EPA;

offers input on EPA pesticide rules, guidance, policies, programs, etc. that affect tribes and Alaska Native Villages;

offers a network for tribal pesticide officials to share information;

promotes and enhances tribal pesticide program development; and,

builds and maintains effective partnerships among a variety of tribal, state and non-governmental organizations to advance tribal pes-ticide programs and target solutions to specific situations. The total funding for the five-year period of the cooperative agreement is about $1.1 million. About $195,000 is expected to be availa-ble for the first year of the agreement.
