4.2. Call for Projects for a possible renewal/reauthorization for Measure M: Results *

Seana Gause recalled this call for projects is a response to a request by the SCTA Measure M Ad Hoc

committee. $100mil was selected as a goal for the two program’s potential: Local Road and Highways and Bicycle/Pedestrian.

Staff received almost $1.5 billion in requests. The Measure M Ad Hoc expressed underwhelming reaction to the submitted projects.

Staff requested big ticket items that are included in the Countywide Transportation Plan, and that are the highest priority for a given jurisdiction.

Given the high volume of projects contained on the list, and the uncertainty of the outcome of Regional Ballot Measure 3 (RM3) on the June ballot, and the possible repeal of Senate Bill 1 (SB-1) the Measure M Ad Hoc committee decided it would be difficult to craft a message that would resonate with the voters, and thus will recommend to the Board that the reauthorization/renewal not be put on the ballot in November 2018.

Eydie Tacata commented that as jurisdictions reevaluate and update their general plans, this could help inform what would types of projects would reduce VMT and those that can complement emerging technologies.

The committee continued discussing the project list, priority projects, and the next steps moving forward with the reauthorization of Measure M. This issue will be brought back as a future item.

4.3. FY 18/19 Citizens Advisory Committee Project presentation schedule *

Seana Gause presented the FY 18/19 Citizen’s Advisory Committee Project presentations to the committee.

Each year, this schedule is assembled and distributed so each jurisdiction is aware when they

are expected to go before the CAC to give an update to their project that has received funding, either programmed or open to appropriations, from Measure M.

This schedule will be taken to the CAC in June for their approval. Staff requests the TAC to provide input on the schedule and approve the submitted schedule.

The committee unanimously approved the schedule.

5. Regional Information Update – Discussion

5.1. Regional ATP Workshops: June 1, 4, 2018 in Napa and San Francisco

This item is included for the committee’s awareness. An email from MTC was sent informing about the statewide and regional guidelines have been approved for the next round of ATP.

5.2. BUILD (Formerly TIGER) grant opportunity*

This is an informational item for grant opportunities.

5.3. Federal Inactive Obligations list updated weekly

The link was included with the agenda packet. Seana Gause encouraged the committee to check regularly to ensure compliance with Caltrans’ needs are met.

6. Sonoma County Travel Behavior Study Cost Sharing Proposal * Discussion/Action

Chris Barney reported to the committee the Sonoma County Travel Model validation has begun. TJKM has been contracted to do the validation work.

Mr. Barney announced that TJKM may be contacting each jurisdiction to request recent traffic counts.

Mr. Barney described the model calibration and validation task, and further described two optional tasks: a travel behavioral study and optional model improvements.

These additional portions of the travel model were discussed at the recent SCTA Planning Advisory Committee and the committee had expressed an interest in moving forward with these two options. The cost sharing proposal for these optional tasks was described.

The travel behavioral study is poised to collect and summarize travel trends in Sonoma County. The idea is to collect mobile source data to have a better understanding of origin and destination data. Similar travel behavior studies have been conducted in Napa and Marin Counties.

Additionally, the optional model improvements are aimed to include tourism travel, weekend travel, incorporating agricultural lands, expanding the boundaries of the model, and to provide tools and resources to support SB 743 implementation.

Mr. Barney requested the committee to review and provide feedback on the cost sharing proposal that was included in the agenda packet.

The TAC discussed the cost sharing proposal and was generally interested in moving forward with this work, but pointed out that 2018-2019 budgets are already set and contributions would need to be pushed out to future years.

7. Rail Update – Discussion

Joanne Parker announced to the committee on SMART’s recent award from the California Transportation Foundation for the Rail Project of the Year.

Furthermore, Ms. Parker described ongoing construction for the Larkspur Ferry station, which is aimed to be open for service in September 2019. The grant from the FTA funds has been executed.

Additionally, staff has also been working on the extension north to Healdsburg and Windsor.

Item: Local Partnership Program (LPP) Formulaic Funds FY19/20

Issue:

Shall the TAC approve the proposed project for inclusion in the 2019 Local Partnership Formulaic Program?

Background:

On October 18, 2017 the California Transportation Commission adopted the 2018 Local Partnership Program Guidelines in response to the Road Repair and Accountability Act. The objective of the Local Partnership Formulaic Program is to reward counties, cities, districts, and regional transportation agencies in which voters have approved fees or taxes solely dedicated to transportation improvements.

SCTA programmed the first round of LPP funding to projects that were immediately ready to receive funding in order to meet the tight turn around in the 2018 Program. The first round projects needed to be able to receive allocation and incur expenditures in FYs 17/18 and 18/19. Projects selected were focused on Fire Recovery (funding went to bicycle and pedestrian improvements in the area of Coffey Park and Highway 101 to ease congestion to already plagued commute ways that were further burdened by the loss of housing).

Recently, the CTC published the updated guidelines for the LPP formulaic portion that included a revised schedule for delivery of the next round of the program. In order to provide the most visible benefit to the state’s aging roads and highways, the schedule was accelerated somewhat to have projects programmed prior to the November election cycle. Delivery of the 2019 LPP formulaic funds follows the schedule below:

Again, the turn-around for submittals is very short. The SCTA Board needs to adopt the program prior to any submittals from Sonoma County to the CTC. The SCTA does not meet in August, thus the LPP projects to be

submitted need to be approved by the Board no later than the July Board meeting. Staff, in coordination with the County of Sonoma, has selected a project to propose for approval by the TAC and subsequently the Board for submittal to the CTC in order to make this extremely constricted schedule for application submittal. The project has two components:

Pedestrian safety improvements at two locations and pavement of various roadways in and around low income housing areas of unincorporated Sonoma County. The pedestrian improvements are to install High Intensity Activated Crosswalks (HAWK) on Airport Blvd near the SMART station and Old Redwood Highway at Lark Center Drive. The total amount of funding expected to be available to Sonoma County for FY 19/20 is $551,000 and requires a 1:1 match of non-SB-1 funding.

Policy Impacts:

None, it is within Policy for the TAC to make recommendations for funding to the SCTA Board.

Fiscal Impacts:

Funding in the amount of $551,000 would be made available to the County Transportation and Public Works Department for the above referenced project. If SB-1 is repealed in November, the funds would no longer be available.

Staff Recommendation:

Staff recommends that the TAC approve the above referenced project for consideration and approval by the SCTA Board in July.

RE: 2017 Regional Pavement Condition Summary Report – Final

MTC’s Regional Streets & Roads Program staff has completed the 2017 regional pavement condition summary report. The PCI numbers presented in the 2017 regional pavement condition summary report reflect the information contained in each jurisdiction’s StreetSaver® database. The 2017 PCI scores are weighted by pavement section area. Please be aware that the PCI scores are based on pavement conditions as of 12/31/2017. Reports generated for a different date may vary from what is shown in this report. 2017 Regional Pavement Condition Summary In 2017, there were 43,374 lane-miles of local streets and roads reported in the San Francisco Bay Area, an overall network increase of 93 lane-miles as compared to 2016. This increase was driven primarily by new sections being added to the StreetSaver® database. The Bay Area’s average network pavement condition index (PCI) in 2017 was 67, out of a maximum possible of 100, and the three-year moving average PCI is also 67. As shown in the following chart, Bay Area roads in Excellent or Very Good category have increased from 34 percent in 2016 to 37 percent in 2017. This indicates that major effort is being made around the Bay Area to preserve and improve roadways using best pavement management practices. Countywide, the greatest improvement is in the city and county of San Francisco with a gain of five PCI points, followed by the County of Santa Clara with a gain of two PCI points. Conversely, the County of Sonoma has slipped three PCI points. This report does not reflect improvements related to Senate Bill 1 funding which was approved in April 2017. It is anticipated that any gains in condition resulting from SB1 funding will not show up until the 2020 report. MTC’s goal is to provide information that accurately reflects current pavement conditions in the region. Any condition assessment or road repairs and maintenance completed after 12/31/2017 are not included in this report and will be included in the 2018 PCI scores reported next year. You will also find more information in the attachments regarding the break-down of Bay Area roadways by condition category and functional class, as well as a year-over-year comparison of pavement conditions, countywide comparison and jurisdiction ranking summary.

RE: FY 2018-19 Preliminary Annual Obligation plan for FHWA-funded projects

The regional project delivery policy (MTC Resolution 3606) establishes certain deadlines and requirements for agencies accepting Federal Highway Administration (FHWA) funding and including these funds in the federal Transportation Improvement Program (TIP). The intent of the regional funding delivery policy is to ensure implementing agencies do not lose any funds due to missing a federal or state funding deadline, while providing maximum flexibility in delivering transportation projects. It is also intended to assist the region in managing Obligation Authority (OA) and meeting federal financial constraint requirements. MTC has purposefully established regional deadlines in advance of state and federal funding deadlines to allow implementing agencies, Bay Area County Transportation Agencies BACTAs), transit operators, Caltrans, and MTC to resolve project delivery issues before losing funds due to a missed funding deadline.

One of the most important features of the delivery policy, and a key to the success of on-time delivery, is development and implementation of the annual obligation plan which identifies the projects that will be delivered in the federal fiscal year. Regional discretionary funding, as well as other FHWA funds programmed in the TIP, must meet the Obligation/FTA Transfer/E-76/Authorization deadline established in the Policy and as identified in the Obligation plan. This ensures federal funds are being used in a timely manner, and funds are not lost to the region.

The annual obligation plan is finalized by October 1 of each year and includes the FHWA-funded local projects to be delivered that federal fiscal year. Projects included in the plan must have funds obligated by FHWA or transferred to FTA by the obligation/FTA transfer deadline of January 31, 2019. State and federal funds requiring an allocation by the CTC must be allocated by January 31, 2019.

Attached for action and consideration are the proposed updated annual obligation plan requirements; preliminary FFY 2018-9 Annual Obligation Plan; and listing of OBAG 2 projects agencies may choose from to delivery in FFY 2018-19. Sponsors wishing to deliver their OBAG STP/CMAQ funded projects in FY 2018-19 must have their Single Point of Contact (SPOC) contact the applicable Bay Area County Transportation Agency staff and John Saelee of MTC at [email protected] by the end of August to have their project added to the delivery plan.

Revisions to the attached FFY 2018-19 Annual Obligation Plan Requirements document are marked in bold underscore and include the following:

• Emphasizes that the project sponsor Single Point Of Contact (SPOC) is responsible forsubmitting a request to the appropriate BACTA and MTC staff for including an OBAGSTP/CMAQ funded project in the delivery plan;

It is also intended to assist the region in managing Obligation Authority (OA) and meeting federal financial constraint requirements. MTC has purposefully established regional deadlines in advance of state and federal funding deadlines to provide the opportunity for implementing agencies, Bay Area County Transportation Agencies (BACTAs), Caltrans, and MTC to solve potential project delivery issues and bring projects back in-line in advance of losing funds due to a missed funding deadline. The policy is also intended to assist in project delivery, and ensure funds are used in a timely manner.

As the federally designated Metropolitan Planning Organization (MPO) and the agency serving as the Regional Transportation Planning Agency (RTPA) for the nine-counties of the San Francisco Bay Area, the Metropolitan Transportation Commission (MTC) is responsible for various funding and programming requirements, including, but not limited to: development and submittal of the Regional Transportation Improvement Program (RTIP); managing and administering the federal Transportation Improvement Program (TIP); and project selection for designated federal funds (referred collectively as ‘Regional Discretionary Funding’); As a result of the responsibility to administer these funding programs, the region has established various deadlines for the delivery of regional discretionary funds including the regional Surface Transportation Program (STP), Congestion Mitigation and Air Quality Improvement (CMAQ) Program, regional Transportation Alternatives Program (TAP) and Regional Transportation Improvement Program (RTIP) to ensure timely project delivery against state and federal funding deadlines. MTC Resolution 3606 establishes standard guidance and policy for enforcing project funding deadlines for these and other FHWA-administered federal funds

One of the most important features of the delivery policy, and a key to the success of on-time delivery, is the obligation deadline. Regional discretionary funding, as well as other FHWA funds in the TIP, must meet the Obligation/E-76/Authorization deadline established in the Policy. This ensures federal funds are being used in a timely manner, and funds are not lost to the region.

FY 2015-16 Delivery Status In 2014, the regional obligation deadline was changed from March 31 to January 31 for projects listed in the FY 2015-16 annual obligation plan. Although FY 2015-16 was a transition year (meaning unobligated funds will not be redirected to other projects until after March 31) it was still expected that project sponsors would meet the new obligation deadline. However, the delivery rate was not as good as hoped. As of January 31 less than 30% of the targeted STP/CMAQ OA had been obligated. In examining the low delivery rate, MTC staff noticed many projects were not ready to proceed when placed in the FY 2015-16 Annual Obligation Plan, and therefore many project sponsors were unable to meet the November 1 Request for Authorization (RFA) deadline, even though the annual obligation plan was made final only a month earlier.

FY 2016-17 Delivery Status The delivery rate for FY 2016-17 improved over FY 2015-16. As of January 31, 2017 45% of the targeted STP/CMAQ OA had been obligated, compared with 30% in 2016. By March 31, 2017 115% of the STP/CMAQ OA had been delivered. However, the goal is still to have 100% OA delivery by January 31, so that projects may capture favorable bids and proceed to construction over the summer construction season.

FY 2017-18 Delivery Status The delivery rate for FY 2017-18 improved over FY 2015-16 and FY 2016-17. As of January 31, 2018, 75% of the targeted STP/CMAQ OA had been obligated, compared with 30% in 2016 and 45% in 2017. By March 31, 2018 112% of the STP/CMAQ OA had been delivered. However, the goal is still to have 100% OA delivery by January 31 so that projects may capture favorable bids and proceed to construction over the summer construction season.

Increased Importance of Annual Obligation Plan In recent years other regions and the state-managed local programs have improved upon their own annual delivery rate, and the region is once again hitting apportionment limits prior to the end of the fiscal year. These factors are reducing the flexibility the region has in advancing funds and allowing projects to move forward when ready. As a result, the annual obligation plan is becoming increasingly important to prioritize the funding available for projects to be delivered in a given year. It is anticipated that moving forward, the obligation plan will become a more vital tool in managing the delivery of FHWA-funded projects each year

Proposed Annual Obligation Plan Conditions and Requirements To address the issues of projects being included in the annual obligation plan that are not yet ready to proceed, and to better manage the availability of funds (primarily STP/CMAQ) for projects that are ready for delivery, and to facilitate timely project delivery within the region, MTC staff is proposing certain conditions and requirements for projects to be included the Annual Obligation Plan as outlined in Attachment 1. The obligation plan will serve to prioritize delivery of FHWA-funded projects, and assist Caltrans Local Assistance in managing its workload for the federal fiscal year.

FY 2018-19 Annual Obligation Plan Schedule The schedule for development and implementation of the FY 2017-18 Annual Obligation Plan is as follows:

Annual Obligation Plan Conditions and Requirements To facilitate timely project delivery within the region, the following proposed conditions and requirements must be met for projects to be included in the Annual Obligation. The obligation plan will serve to prioritize delivery of FHWA-funded projects for the federal fiscal year.

Projects automatically included in PlanTo the extent known, projects with required federal/state funding delivery deadlineswithin the fiscal year will be added to the annual plan. These include but are not limitedto STIP, ATP, HSIP and Local Bridge Seismic projects. It is the responsibility of theSingle Point of Contact (SPOC) to ensure the Plan includes all projects from their agencythat have delivery deadlines within the fiscal year

SPOC InvolvementRequests for OBAG STP/CMAQ projects to be included in the annual obligation plan mustcome from the Single Point of Contact (SPOC) for that agency. This ensures the SPOC isaware of the federal-aid projects to be delivered that year, and to be available to assist theProject Manager(s) through the federal-aid delivery process. In addition, subsequentcommunication to MTC or applicable BACTA regarding potential delays or missed deadlinesof any project in the annual obligation plan must include the SPOC. To add a project to theplan, email the request to the applicable Bay Area County Transportation Agency staffand to John Saelee of MTC at [email protected]

Missed Past Delivery DeadlinesFor project sponsors that have missed delivery deadlines within the past year, the agencymust prepare and submit a delivery status report on major delivery milestones for allfederally active projects with FHWA-administered funds, and all projects with FHWA-administered funds programmed in the current TIP, before their OBAG 2 project(s) areadded to the annual obligation plan. Furthermore, once projects for such agencies areaccepted in the final obligation Plan, the Single Point of Contact (SPOC) for the agencymust report monthly to the applicable BACTA and MTC staff on the status of all agencyproject(s) in the annual obligation plan, until the funds are obligated/authorized. Field ReviewFor the PE phase of a project to be included in the draft plan, a field review must be scheduledto occur by June 30. To remain in the final plan the field review and related/requireddocumentation, including the Preliminary Environmental Study (PES) if applicable, mustbe completed and accepted/signed off by Caltrans by September 30.

For the Right Of Way or Construction phase of a project to be included in the draft Annual Obligation Plan, the project must have undergone a field review with Caltrans AND all field review related/required documentation, including the Preliminary

HSIP Delivery RequirementsBecause of the importance of timely delivery of safety projects, the following applies toagencies with Highway Safety Improvement Program (HSIP) projects programmed in thefederal TIP.

For project sponsors with HSIP funds in the PE phase of a project: A complete and accurate Request for Authorization (RFA) must be submitted to Caltrans for the PE phase of all of the agency’s HSIP project(s) prior to any OBAG 2 STP/CMAQ project being added to the Annual Obligation Plan for that agency. The Caltrans-managed HSIP program has an obligation deadline for the PE phase of September 30. To meet this deadline, sponsors must have a field review (with all requireddocumentation including the Preliminary Environmental Study (PES) if applicable, accepted by Caltrans) and submit the RFA for PE by June 30.

For project sponsors with HSIP funds in the CON phase of a project: A complete and accurate Request for Authorization (RFA) must be submitted to Caltrans for the CON phase of all of the agency’s HSIP project(s) subject to the delivery deadlines noted below, prior to any OBAG 2 STP/CMAQ project being added to the Annual Obligation Plan for that agency.

Waiver request for unforeseen project delays: A jurisdiction that has been proceeding with a project in good faith and has encountered unforeseen delays may request special consideration. A sponsor may be allowed to add projects into the annual obligation plan even if it has an outstanding project delay, if Caltrans Local Assistance, MTC and the applicable BACTA reach consensus that the delay was unforeseen, beyond the control of the project sponsor, and not a repeated occurrence for the agency. NOTE: Poor project management is not considered an unforeseen delay.

OBAG 2 RequirementsProjects funded in the One Bay Area Grant 2 Program (OBAG 2) will not be included inthe annual obligation plan until the project sponsor has met applicable OBAG 2requirements, such as submittal of the annual housing element reports to HCD by April 1of each year or fully participating in the statewide local streets and roads needsassessment survey or providing updated information to the Highway PerformanceMonitoring System (HPMS).

Request for Authorization Review PeriodFor purposes of delivery of projects within the annual obligation plan, it is expected thatsponsors schedule at least sixty to ninety days for Caltrans/FHWA review and approval ofthe Request for Authorization (RFA). This is to ensure delivery schedules adequatelyaccount for federal-aid process review.

SPOC ChecklistStarting in 2017, jurisdictions must have the SPOC checklist filled out and on file prior toprojects being included in the annual obligation plan. A new checklist must be filled outwhenever a new SPOC is assigned for that agency.

The following are proposed new Annual Obligation Plan requirements:

ATP and SB1 Reporting and AccountabilityAgencies receiving SB1 and ATP funds are required to report on the status of theprojects on a regular basis. To ensure agencies meet the deadline, MTC expectsreports to be submitted at least 15 days in advance of the CTC deadline. This helps

ensure any errors or omissions can be corrected before the reports are due to the CTC/Caltrans. Agencies that miss the reporting/accountability deadline(s) will have OBAG funds subject to re-programming.

CTC AllocationsProjects with funds requiring a CTC allocation, such as STIP, ATP and RMRA (SB1),must receive the CTC allocation by January 31 of the year programmed unlessthere is a special circumstance (such as coordinating the delivery timeline withother fund sources or project schedules) agreed to by the respective Bay AreaCounty Transportation Agency and MTC staff. Sponsors missing the regional CTCallocation deadline are subject to OBAG projects being removed from the AnnualObligation plan and reprogrammed to a later year in the federal TIP, and will havelow-priority for including their OBAG 2 projects in the following annual obligationplan, until the sponsor can demonstrate the ability to meet regional and statedelivery deadlines.

CTC ExtensionsSponsors with projects requiring a CTC extension are subject to OBAG projectsbeing removed from the Annual Obligation plan and reprogrammed to a later yearin the federal TIP, and will have low-priority for including their OBAG 2 projects inthe following annual obligation plan, until the sponsor can demonstrate the abilityto meet regional and state delivery deadlines.

Local Bridge Seismic Retrofit Program (LBSRP) Delivery RequirementsThe Highway Safety, Traffic Reduction, Air Quality and Port Security Bond Act of2006 (Prop 1B) includes $125 million of state matching funds to complete LBSRP.These funds provide the required local match for right of way and constructionphases of the remaining seismic retrofit work on local bridges. Several projectswithin the program have not yet proceeded to construction – 12 years after votersapproved funding for the program and 24 years after the Northridge Earthquakeand 29 years after the Loma Prieta Earthquake.

Each project in the LBSRP is monitored by Caltrans at the component level for potential scope, cost, and schedule changes to ensure timely delivery of the full scope as approved and adopted. Projects are “locked” by Caltrans for delivery at the beginning of each federal fiscal year (FFY) and local agencies are not allowed to change the schedules. Projects programmed in the current FFY, for which federal funds are not obligated by the end of the FFY, may be removed from the fundable element of the TIP at the discretion of the Caltrans.

Because of the interest of the California Transportation Commission (CTC) with delivery of the remaining projects in the Local Bridge Seismic Retrofit Program, project sponsors with remaining seismic bridge projects will need to provide MTC and the respective Bay Area County Transportation Agency with updated status reports at least twice a year.

Sponsors with seismic bridge projects in the current FFY that do not deliver by the end of the FFY will have low-priority for including their OBAG 2 projects in the next Annual Obligation plan. OBAG 2 funds will only be included if capacity is available after all other requests have been considered, and the agency has demonstrated the ability to meet regional and state delivery deadlines.

As reported to the CTC in March 2018, the following agencies have local seismic bridge projects programmed for delivery in FY 2017-18: Oakland 23rd Ave over UPRR Oakland Leimert Blvd over Sausal Creek Pittsburg North Parkside Drive over Willow Pass SFCTA On east side of Yerba Buena Island, Reconstruct ramps on and off of I-80

Inactive ObligationsFHWA has expressed significant concern regarding inactive project obligations. Atno time are more than 2% of obligated funds to be inactive. The state, and bayarea, are consistently over this maximum threshold. Under federal regulations,FHWA-administered projects must receive an invoice and reimbursement againstfederal funds at least once every 12 months following obligation. Projects thathave not received a reimbursement of federal funds in the previous 12 months areconsidered inactive with the remaining un-reimbursed funds subject to de-obligation by FHWA with no guarantee the funds are available to the projectsponsor.

Caltrans requires project sponsors to submit invoices at least once every 6 monthsfrom the time of obligation (E-76 authorization) to ensure the invoice may beprocessed and the funds reimbursed in time to meet the federal deadline.

To ensure funds are not lost in the region, regional deadlines have beenestablished in advance of state and federal deadlines. Under the regional project-funding delivery Policy (MTC Resolution 3606) project sponsors must submit avalid invoice to Caltrans Local Assistance at least once every 6 months and receive areimbursement at least once every 9 months.

Agencies with projects that have not been invoiced against at least once in theprevious 6 months or have not received a reimbursement within the previous 9months have missed the invoicing/reimbursement deadlines and are subject torestrictions placed on future regional discretionary funds and the programming ofadditional federal funds in the federal TIP until the agency can demonstrate theability to meet regional, state and federal requirements.

Specifically, project sponsors with continued history of missing the Caltrans andregional 6-month invoice submittal deadline and the region’s 9-monthreimbursement deadline are subject to OBAG projects being removed from the

FAST Act RescissionThere is a nationwide rescission of over $8 billion based on unobligatedapportionment balances at the end of the FFY 2018-19. To ensure funds are notrescinded within the region, MTC will seek to advance projects from future years tocapture any unused apportionment after the January 31 obligation deadline.Sponsors with projects scheduled for delivery in FY 2018-19 should note thatunused funds after January 31 may be used up more quickly than prior years. Also,sponsors that commit to delivery in FY 18-19 may possibly see their fundsrescinded if other projects cannot be advanced to obligate all the remainingapportionment.
