Attention us invited to Department of Personnel and Administrativei'Je.:forms (now Department of Personnel & Training) O.M. NO.36011/16/80-::::j\~.(SCT) dated 27th February, 1981 which provides that the appointingauthorities should verify the caste status of a Scheduled CastefTribe candidate~~':.~ time of initial appointment and promotion against a vacancy reserved for

•••.•.• 1' ~~t1etfuled CastesfTribes. The O.M. clarifies that a candidate who entered Intob ervlce as an SC/ST candidate may discontinue to be so if the caste/community

.;~.. jo which he belongs is descheduted subsequently. A Scheduled Caste candidate~. '\ Ua1so loses his status of Scheduled Caste if he embraces a religion other than. "'<i; Hinduism, Sikhism or Buddhism. Though such officers who lose the status of SC

or ST after entering into service are required to inform the Government .about it,many of them do not do so. lnthe absence of necessary vigil, there arepossibilities of non-SC/STcandidates getting benefit of reservation and variousconcessions in the matter of promotion. Therefore, verification of caste status atevery important upturn of employee's career is necessary so that the benefit of .reservation and other schernesof concessions, etc. meant for SCs/STs go only to .the rightful claimants and not those who become disentitled to them. With a viewto fadli ating such verification, the caste/community to .whlch the SC/ST personbelongs, his place of residence and the name of the State should be pasted onthe top of the Service Book, personal file and other rele~ant documents relatingto -the employee. Attention~-is' also invited to this Department's O.M.No.36033/4/97-Estt.(Res.) dated zs" July, 2003 which provides thatcaste/community status and creamy layer status of OBC candidates should beverified at the time of initial appointment.

2. This Department's C.M. No.3601216/88-Estt.(SCT) dated 24th April, 1990provides that the appointing authorities should, in the offer of appointment to thecandidates claiming to be belonging to Scheduled Castes/Scheduled Tribes,include a clause as follows:

"The appointment is provisional and is subject to the caste/tribe certificatebeing verified through the proper channels and if the verification revealsthat the claim to belong to Scheduled Caste/Scheduled Tribe. as the casemay be, is false. the services will be terminated forthwith without assigningany further reasons and without prejudice to such further action as may betaken under the provleicns of the Indian Panel Code for production of falsecertificates." .

Likewise this Department' ~O,M. No.36033/4/97-Estt.(Res.) dated 25th July, 2003i;;~')Yid.esthat in case of the offer of appointment to the candidates claiming to~~0!;::'~!Jtt} Other Backward Classes. a clause as follows should be included: .

"The appointment is provlslonal and is subject to the community certificatebeing· verified through the proper channels. If the verification reveals thatthe claim of the candidate to belong to Other Backward Classes or not tobelong to creamy layer is false, his/her services wilt be terminatedforthwith without assigning any further reasons and without prejudice tosuch further action as may be. taken under the provisions of Indian Pa~elCode for production of false certificates."

3. It has been brought to the notice of the Government that some candidatesmanage to secure employment under the Government against the vacanciesreserved for SCslSTs/OBCs by producing false caste/community certificates andsome candidates continue to get the benefits available to the SCheduledCastes/Scheduled Tribes even afierlosing th-e-statu50tSC/ST:The undersignedis directed to say that instructions referred to above should be scrupulouslyfollowed so that it may not be possible for any non-Se/ST/OaC candidate tosecure employment or get benefit of promotion or concessions on the basis of afalse claim tobelong to these categories and if any person gets an appointmenton the basis. of such false claim, -his -serviGes-may be terminated as perconditions contained in the offer of appointment.
