Organization and Function of BIRBURDEN OF PROOF IN PRE-ASSESSMENT PROCEEDINGSThere is a presumption of correctness and good faith on the part of the CIR; thus, the burden lies on the taxpayer. Otherwise, the finding of the CIR will be conclusive and he will assess the taxpayer. The same is true even if the CIR is wrong, if the taxpayer does not controvert.
