Rules that apply to the LPG Operator 2. TASMANIAN GAMING COMMISSION

RULES

1. PRELIMINARY 

1.1 These Rules apply to the conduct of gaming in all licensed premises operating

under a Licensed Premises Gaming Licence (Licence), and are in addition to theconditions imposed on the Licence by the Tasmanian Gaming Commission andthe Gaming Control Act 1993 (the Act).

 3. DURATION OF HOURS OF GAMING

3.1 Gaming can only be conducted at the licensed premises within the hours ofoperation specified in the liquor licence or permit issued under the LiquorLicensing Act 1990.

3.2 Gaming facilities can only be operated at the licensed premises for a maximum of20 hours within any 24-hour period. There must be at least four continuoushours each day when gaming machines and/or keno are not in use.

Rules that apply to the LPG Operator and Special Employees

4. ENTRY OF PATRONS

4.1 No fee of any kind (direct or indirect) can be charged for entry into a Restricted

Gaming Area.

4.2 No Minor (whether employed by the LPG operator or working at a licensedpremises) can take part in the conduct of gaming or enter a Restricted Gaming Area.

5. PROCEDURES FOR THE RESOLUTION OF DISPUTES

5.1 The Commission’s complaint form must be displayed and available to patronsduring operating hours.

6. COMPLIANCE WITH THE VENUE OPERATING PROCEDURES

6.1 The Rules and procedures found in the document entitled “Venue OperatingProcedures - Gaming Machines and Keno” (as approved by the Commissionfrom time to time) must be adhered to at all times. This document is availablefrom the gaming operator.

6.2 Any matters concerning non-compliance with any requirements of the Act, or anylicence, directions or Rules made under the Act must be reported to theCommission within 24 hours of being identified.

7. VENUE STAFF

7.1 At least one Special Employee who holds a certificate of competence as aGaming Machine Supervisor must be on duty and present at the licensedpremises at all times that gaming machine operations are conducted.

7.2 At least one Special Employee who holds a certificate of competence as a SeniorWriter must be on duty and present at the licensed premises at all times thatkeno operations are conducted.

 7.3. An LPG operator must ensure that a person who is employed or working, whether

for remuneration or reward or not, in the licensed premises complies with theseRules, the conditions of their Special Employee licence (if applicable), theconditions of the Licence and the Act.

7.4. All Special Employees who are employed or working, whether for remuneration orreward or not, in the licensed premises must undertake the Responsible Conductof Gaming (RCG) training course within 90 days of commencing work at thepremises. Copies of RCG training certificates must be retained at the licensedpremises and made available to Liquor and Gaming Inspectors when requested.

7.5. All staff performing the duties of a Special Employee in the licensed premisesmust have a Special Employee licence that is current and appropriate for theduties that the employee is required to undertake.

8. PROVISION OF CASH TO PATRONS

8.1. LPG operators must not provide, authorise or permit anyone to provide, anautomatic teller machine or other cash-dispensing device for use in or on thelicensed premises. The LPG operators must not provide, authorise or permitanyone to provide, an automatic teller machine or other cash-dispensing devicefor use in any adjoining premises which are owned, operated, occupied, leased orotherwise controlled by the LPG operator.

8.2. EFTPOS terminals must not be accessible within a Restricted Gaming Area orlocated in a coin change area, unless otherwise approved by the Commission.

8.3. (a) EFTPOS transactions must not be used for the provision of cash from creditaccounts.

(b) No more than one EFTPOS transaction is permitted to be provided to eachpatron each day for gaming purposes and any EFTPOS transaction that isprovided for gaming purposes must only be made from a debit or non-creditaccount.

(c) Staff must take all reasonable steps to observe the gaming behaviour of theirpatrons and must not provide funds to a patron requesting any EFTPOStransaction for gaming purposes if that patron is experiencing difficultiescontrolling his or her gaming.

8.4 If a patron has already had one EFTPOS transaction for gaming purposes in anyday, staff must refuse any further EFTPOS transactions requested by a patron forthe purchase of gaming services.

8.5 If cash is provided in good faith in accordance with Rule 8.4 and the patron usesthe cash for gaming, staff must ensure that the patron leaves the RestrictedGaming Area immediately and does not bet on keno or return to the RestrictedGaming Area during the same day.

8.6 Cash provided as part of an EFTPOS transaction for gaming purposes must, as

far as possible, be provided as notes, not coins.

8.7 Subject to Rule 6.1 and clause C3.3 of the “Venue Operating Procedures –Gaming Machines and Keno” (to which rule 6.1 refers), a Licensed PremisesGaming operator must not cash more than one cheque per patron per day.

8.8 A sign must be displayed at each keno terminal which states:

‘It is an offence under the Gaming Control Act 1993 for a licensed person to make

a loan or extend credit for the purpose of gaming. Heavy fines apply.’ 

9 MISCELLANEOUS

9.1. A surveillance system that meets the Commission’s “Technical Standards forRecorded Surveillance in Gaming Premises” must be operating at the licensedpremises at all times that gaming is operating.

9.2. A coin change area must only be used in connection with gaming, and food ordrink must not be served from this area. The public must be prevented from

accessing any approved equipment located in this area (including the sitecontroller) and approved equipment must be protected from liquid spills.

9.3. The public must not be permitted to enter any coin change area.

9.4. A security system must be operating at the licensed premises at all times thatgaming is operating.

9.5. Where keno is operated in an area outside the Restricted Gaming Area, a noticein the following form must be displayed at a prominent position visible fromoutside each entrance to that area:

‘A person under the age of 18 must not play TASKeno. Penalties apply.’ 

9.6. Keno must not be operated in an area that is used primarily for liquor off-sales inconnection with the licensed premises.
