CLIENT MEET AND GREET SERVICES AND PRE-SAFARI BRIEFINGS Southern Cross Safaris’ staff meets each and every client arriving at both Nairobi and Mombasa airports. Our travel professionals are on hand to facilitate seamless arrival and departure formalities as well as to ensure that onward flight reservations are reconfirmed. After a short transfer and on arrival at their respective hotel, a representative from Southern Cross Safaris briefs all our clients. The briefing covers useful facts about local customs, currency and general advice regarding their safari itinerary. Our Staff are also available to assist with any additional requirements that our clients may have or simply to give advice on shopping and eating out. CORPORATE RESPONSIBILITY

Southern Cross Safaris supports a number of good causes including an orphanage in Kisauni with over 40 children. We also through our safari camps operate the Satao Wildlife and Community Trust whose mandate it is to try and better the lives of communities in wildlife areas and to educate them on the benefits of wildlife to them and their families. Southern Cross Safaris and Satao Camp have also been supporters of the Rhino Ark Charitable Trust for over 15 years supporting work done on protecting Kenya’s forests and key water towers. OUR SAFARI VEHICLES Our clients visiting East Africa are ensured that they will always be travelling in up-to-date and immaculately kept vehicles appropriate for the territory and itinerary at hand. Our extensive fleet of vehicles consists of custom-built and specially modified 7 window seat safari microbuses and custom-built four-wheel drive safari Land Cruiser and Land Rovers on all escorted programmes in Kenya and Tanzania. Our vehicles have sliding windows; roof hatches and high ground clearance to optimise all round visibility for game viewing and photography. For maximum comfort and optimum enjoyment of the safari, it is our policy to ensure that all our clients be offered a window seat, which means a maximum of seven passengers per vehicle. For the convenience of all our clients, a cool box, a pair of binoculars and wildlife reference books are standard equipment in all vehicles. In addition, each vehicle is equipped with an HF radio set, giving countrywide communication with our radio room that is manned 24 hours a day. Southern Cross Safaris adheres to a strict self-imposed policy, of high maintenance standards and a solid reliable service delivery for all transportation at all times.

OUR SAFARI DRIVER/GUIDES The success of any safari tour in Africa largely depends upon the calibre of your Safari driver/guide. In this respect the greatest care is taken in selecting responsible, qualified people who are capable of providing a cheerful, caring and attentive service to our clients. To this end, all our Safari driver guides at Southern Cross Safaris are qualified to KPSGA (Kenya Professional Safari Guides Association) Bronze level. This is a minimum requirement before we will consider hiring in this field. All of our guides have undertaken rigorous training and refresher courses and are experts in their chosen fields. Some of our guides are bi-lingual, and all have an in-depth knowledge of routes, conditions, local attractions and practical mechanics. In addition, their ability as game spotters is outstanding and they are highly proficient in the identification of the animals and birds of Kenya and Tanzania. We also have a number of silver guides, respected as being the best in the country. Clients can book these for a small extra cost per day, which ensures the standard of guide they are getting is unsurpassed in Kenya.

REGULAR DEPARTURE SAFARI TOURS Southern Cross Safaris offers a large number of regular departure tours, which appeal to a wide range of nationalities and budgets. These safaris offer an ideal opportunity to experience the highlights of Kenya and Tanzania without incurring the expense of an exclusive private safari. Southern Cross Safaris has designed a selection of tours by road and air, featuring all of the major game parks and reserves throughout the region. These tours range from a one-night stay at a “tree lodge” to a comprehensive fifteen-day safari incorporating the very best of both Kenya and Tanzania. With a wide selection of tours operating throughout the week, it is easy to plan a safari according to preference and time available. SCHEDULED AIR SERVICES AND PRIVATE CHARTER. Regular departures by air are by far the more popular type of safari on offer. East Africa has a comprehensive and reliable network of internally scheduled flight services operating between all major towns, cities and National Parks and Reserves. These services are offered on a per seat basis and operated in either single, twin or quadruple engine aircraft. These range from the larger DH Dash 7 & DH6 Twin Otter, to the smaller single turbine engine C208 Cessna Grand Caravan. For the ultimate of convenience, a wide range of aircraft are available for private charter. Your own personal aircraft offers accessibility to those airstrips not serviced by scheduled flights, with total flexibility as to timing and routing and the ultimate in relaxed travel. Many of the smaller camps, lodges and boutique hotels that we offer to our tailor-made clients are so ‘off the beaten track’ that it is only practically possible to fly in. CAR HIRE Officially all you need to drive in Kenya is a valid international driving license. Vehicles available for hire, range from 5-door Toyota Corolla’s to the larger and more robust four wheel drive Land Rover Defender and the popular and versatile Suzuki Sierra 4x4. ACCOMMODATION As you traverse the length and breadth of Kenya and Tanzania you'll find a wide and varied range of accommodation. No matter how off the beaten track you go, you will surely find elegance, ambiance and top quality service in East Africa. Ranging from opulent private homesteads, luxury tented camps and 5 star boutique beach villas and hotels to the larger game lodges and beach hotels. Our staff regularly ‘spot check’ many of the regions, locations and establishments, not only to build their product knowledge, but also to ensure that standards are maintained all round. Should an establishment introduce a new product, or even change its management, we will always be the first to know.

HOTELS Kenya and Tanzania present an impressive range of excellent hotels to suit every taste. Ranging from elegant boutique style 5-star hotels that cater for the more discerning traveller or businessman to the more affordable, medium range family hotels. For travellers on a specific budget, we do offer an excellent choice. Meals throughout are of a universally high standard - these range from an eclectic smorgasbord of local fare, to buffet lunches, four course bush dinners under the stars and international cordon bleu delights. GAME LODGES Game lodges are luxurious and are situated in exciting surroundings, in or close to National Parks and Reserves. They are built utilising natural local materials and are designed to blend harmoniously with their surroundings. Lodge accommodation can vary, some have all modern conveniences – glazed windows, air-conditioning, satellite TV and minibars in every room. Some lodges are very comfortable with simple Banda’s surrounding a central dining room and bar area. Other lodges combine the best of everything and could be best described as ‘authentic bush chic’ rather than 5 star luxury. All lodges have private en-suite facilities, most have swimming pools and some overlook floodlit waterholes for superb nocturnal game viewing.

LUXURY TENTED CAMPS For those who prefer the thrill of a safari and hanker to get close to Africa in true safari style, a few nights under canvas in a luxury tented camp is a must. Contrary to popular belief safari camps don’t mean ‘outward bound’, but in fact offer luxurious standards of comfort and personal service. Spacious insect-proof tents are provided with twin beds, fresh linen, hot and cold running water and flush toilets. Meals are fresh cooked fare everyday, wines are imported and your hosts are professional guides. One will also find full dining and bar facilities under a central tent or attractive open buildings. Most safari camps are located within prime wilderness areas and offer an intimacy with the surrounding bush incomparable to any other form of accommodation.

GAME LOOKOUT LODGES More commonly known as 'tree-hotels', these architectural masterpieces usually stand high above the ground in secluded forest glades, overlooking wildlife waterholes. Quite different in style, they are all designed to offer a totally unique game viewing experience and an opportunity to watch as wildlife visits the floodlit waterhole, oblivious to the close proximity of fascinated visitors within the lodge.

COMMUNITY ECO-LODGES

Community Eco-tourism lodges are fast becoming the ‘alternative’ safari experience in East Africa. Many large areas of previously unattended wilderness alongside working ranches were once the scourge of poachers and are now havens for big game. These areas provide safe migratory corridors between major wildlife reserves and great migratory herds of elephant have recently once again become accustomed to use these corridors as a matter of course. Ranchers and conservationists have realised the potential of these areas and assisted their local communities in constructing small intimate lodges, totally in-tune with the environment in which they are located. These small lodges offer guests direct access to the local indigenous tribal cultures and the chance to understand and be involved with community conservation. Your local hosts provide all services for the camp attired in their colourful traditional dress. Their naturally friendly demeanour and knowledge of the bush are a highlight of any eco-lodge experience. During the day there are many activities to choose from, providing a special opportunity to witness daily rural living, including livestock keeping, traditional hunting skills, rites, rituals and dances.

Day 4 You do have to wake extra early to catch the African Wild Dog hunting packs in action. You & your Wild Dog expert and embark on an adventure to track possibly the rarest of Africa’s mammals. Stay sharp and you might see a pack out tracking its breakfast. Together with an expert on this amazing species and the help of telemetry, watch how data is collected from sightings of Wild Dog, some of whom are fitted with radio collars for this research. As the Dogs’ territories are huge, they do roam vast distances. For this reason, sightings an be fleeting, and not always be guaranteed. All meals and overnight at LOISABA TENTED CAMP.

Day 5 Wake early for a game drive to track Wild Dog with your expert guide. Loisaba is also home to large numbers of the vulnerable Reticulated Giraffe, the endangered Grevy’s Zebra (Equus grevyi) Hippo, Buffalo, Warthog, Lion, hyenas, Bat-eared foxes and lots of antelope species are all commonly seen. Return to Camp for lunch. After lunch transfer to the Loisaba airstrip for your flight to the Lewa Wildlife Conservancy. On arrival at the Lewa Conservancy, you will be met by your driver guide who will take you to the Lewa marshlands. GENERAL INFORMATION ENTRY AND HEALTH REGULATIONS Visitors must be in possession of a valid visa (if applicable to your nationality) together with relevant health documentation, upon arrival to both Kenya and Tanzania. Different regulations do apply according to nationality and country of origin. It is recommended that all perspective visitors check with their nearest tourist office or diplomatic mission before any travel details are made. Medical centres in your country of origin will provide the necessary professional medical advice on all relevant health requirements. CUSTOMS, ENTRY AND EXIT REGULATIONS Generally, personal effects such as Cameras, laptop computers and film may be imported temporarily free of duty into Kenya and Tanzania. However, a customs bond may be required for professional video equipment, sound recording instruments, radio communication equipment, musical instruments and souvenirs from other countries. This is to ensure that goods can be re-exported. Firearms need a special permit, which must be obtained well in advance. Excess baggage is strictly monitored by all airlines and charges for excess weight can be very high. Expect customs officials to inspect baggage on arrival and departure. CURRENCY. Currency control regulations prohibit the export of local currency. There is no restriction however, to the amount of foreign currency a visitor may import. Only authorised foreign exchange bureaus and banks are permitted to exchange foreign money. Kenya and Tanzania currencies are interchangeable MEDICAL ADVICE Both Kenya and Tanzania enjoy a healthy, invigorating climate and visitors need feel no concern for their general health during the course of their stay. By far the biggest risk is Malaria, which is endemic in certain areas. Anti-Malarial medication should be taken according to the advice of your local medical practitioner. Visitors requiring special medication should pack sufficient supplies in their hand luggage. Chemists and pharmacies are generally well stocked, however the names of some generic medication, can differ. Consult your medical practitioner for advice on alternative medication to take, as some medication is not readily available. Tap water is generally safe within Nairobi, and mineral water is available in most camps, lodges and hotels, throughout Kenya and Tanzania. (In many, purified or filtered drinking water is provided free). SECURITY Visitors to the region should take the same care as they would normally take, whilst visiting any destination worldwide. By keeping vigilant, visitors can reduce the risk of anything-untoward happening. We do advise our clients not to take expensive jewellery on holiday with them and to watch handbags, wallets and cameras when walking in crowed places. Walking at night in unlit areas is not advisable. We strongly recommend that all our visitors utilize safety deposit boxes when and where they are available, for own peace of mind. SUPPLEMENTS. Supplemental charges will be applied to all safari tours operating between 16 December and 03rd January each year as well as over the Easter Weekend.

42. GENERAL INFORMATION All Southern Cross Safaris tours are based upon hotel, lodge or tented camp accommodation and as such do not require any level of strenuous effort. This said, East Africa is, for the most part, a developing region. It is therefore important to understand and accept that even the most meticulously planned safari or travel arrangements can go wrong and that conditions can dictate that there may be moments of discomfort and delay to your journey. Clients booking any of the arrangements in our tariff, implicitly accept the above and make any such booking subject to the booking conditions and general information within this tariff. It is our policy to constantly review the services of the handling agents, hotels, lodges and camps we use. We cannot however, be held responsible for the results of delays and alterations, other than in these circumstances outlined within our booking conditions. SPECIAL NEEDS We will endeavour, wherever possible to meet any special needs that our clients may have. In the case of special dietary requirements, most hotels, camps and lodges within the region are prepared (given sufficient notice) to cater for these. For persons who are disabled in any way, we will do our utmost to cater for whatever needs may apply. We do require advance notice of any requirements, so please ensure that we are made aware at the time of making a booking. PRIVACY We at Southern Cross Safaris, recognise that many of our travellers may wish to take their safari or enjoy their beach resort in an atmosphere of complete privacy and anonymity. If you require special privacy arrangements, please advise us well in advance. Thereafter we assure you that the appropriate privacy protection will be put in place. TOUR COSTS INCLUDES The tour cost includes all details as listed within this tariff. Accommodation - in first class game lodges, tented camps and private homesteads. Meals - on a full board basis (breakfast, lunch & dinner) whilst on safari each day, except in main towns where the meal plan is specified in the tour outline. Collection / Transfers – all tours start and end with the collection from and return to any centrally located hotel in Nairobi and north or south coast Mombasa unless otherwise stated. Where air transportation is part of the itinerary, transfer service between hotels and airports is included Transportation by road – Individual seats in safari microbuses Transportation by Air – Based upon scheduled internal air services and all known costs. Services in single or multi engine aircraft, inclusive of domestic airport departure taxes and service charges. Guides -Services of qualified and caring English speaking driver/guides, some of whom speak other European languages. All driver/guides qualified through Kenya Professional Safari Guide Association (KPSGA). Taxes and Fees - All government taxes, hotel levies and service charges. Entrance fees to parks, reserves and museums. TOUR COST EXCLUDES Porterage, gratuities to driver/guides, game rangers and local guides, incidental tips to Hotel/lodge, bar and waiting staff. All items of a personal nature such as laundry, drinks, airport arrival and departure transfers and any optional excursions not indicated for in your itinerary. PRICES All prices are correct at the time of going to press. However, these are subject to increase in cases of force majeure, Government Tax and Park Entry Fee increases and fuel surcharges. The correct price will be advised at the time of booking. Prices will also be quoted separately where Safaris run from one season into another.

SOUTHERN CROSS SAFARIS LIMITED BOOKING CONDITIONS 1. BOOKING, AGENTS LIABILITY, DEPOSIT, REFUNDS AND MINORS 1.1 A booking of any of the arrangements offered in this brochure or Agents Manuals may be made by you verbally provided it is immediately confirmed in writing by email (“Booking”) (provided always that for the purposes of the payment of the Deposit and/or the Price the time that the Booking shall be deemed to have been effected shall be the time that the SCSL organised tour (“Tour”) was booked verbally and not the time that it was confirmed in writing) 1.2 A deposit of an amount requested by SCSL’s duly authorised member of staff or agent at the time of Booking shall be payable immediately upon receipt of your Booking. Deposit amount may vary depending on tour and supplier 1.3 The person who shall make the Booking hereby warrants that he or she is duly authorised to do so and does so on behalf of all of you. 1.4 If a Booking shall be made or brokered through a travel or booking agent (“Agent”) such Agent hereby agrees to be bound by these conditions and confirms that it makes any Booking as a fully authorised agent for and on behalf of each member of the party. To the extent that SCSL shall incur any loss or damage arising directly or indirectly from the Agent’s signing the Booking on behalf of each member of a Tour, the Agent shall immediately indemnify SCSL against any such claims, costs, demands and expenses whatsoever, wheresoever and whensoever made. 1.5 Each of you shall joint and severally indemnify SCSL against any claims, costs, demands and expenses whatsoever and whensoever made by any of you who may be a minor (that is under age of eighteen years) arising out of or in connection with the Tour. 1.6 An itinerary specifying the details of your Tour, will be sent to the person making the Booking as soon as is reasonably practicable following receipt by SCSL of your Booking (the “itinerary”). 1.7 If SCSL is unable to confirm you on a tour, it will refund you your Deposit in full. However, it is possible that SCSL may not be able to confirm you on the precise itinerary stated by SCSL in the Itinerary in which event, if SCSL proposes (what it considers to be) a reasonably similar alternative to that requested by you prior to the Due Date (as specified below) then it will not refund you the Deposit. 1.8 All prices for tours are calculated on costs prevailing at the date of your Booking although SCSL reserves the rights to change such prices without notice up untilthe Due Date (as defined below). 2. FINAL PAYMENT 2.1 The total cost of the Tour as specified in the Itinerary (the “Price”) shall be paid so as to be received in cleared funds by SCSL not later than 60 days before the date of such Tour (the “Due Date”) except when the date of your Booking is less than 60 days before the departure of your Tour, in which event full payment shall be due immediately upon receipt of SCSL’s invoice. Availability of the Tour is dependent upon your having paid the Price in accordance with this condition. 2.2 In the event that the Price shall not have been received by the Due Date, SCSL reserves the right to cancel the Tour or as a condition of providing the Tour to recost the Itinerary (including imposing a surcharge in respect of our additional costs). 2.3 Provided that the Price shall have been paid by the Due Date SCSL shall be bound unconditionally to the Price quoted from that time unless the Price shall be affected by any factor beyond the control of SCSL which frustrates this Agreement in which case SCSL reserves the right to adjust the Price accordingly. 2.4 GORILLA PERMITS (Applies to Rwanda and Uganda) – Gorilla permits are confirmed once full payment has been made to SCSL and SCSL has managed to purchase and secure the permits from the respective authority as permits are on first come first served basis. SCSL will not b responsible if at any time of receipt of payments the permits are not available. Cancellation terms and conditions below do not apply to Gorilla permits so all payment for Gorilla permit payments are non-refundable. 3. CANCELLATION/ALTERATIONS 3.1 If you wish to cancel or alter your Booking you must do so in writing in which event the following fees or percentages will be charged, calculated with reference to the date of receipt of notification in writing by email to SCSL. If such Booking shall be cancelled or (in the opinion of SCSL) be altered materially by you SCSL reserves the right to charge the following cancellation fees: KENYA & TANZANIA 3.1.1 within the period of 120 to 61 days of the date of the commencement of the Tour, a fee of 10% of the total land arrangements; 3.1.2 within the period of 60 to 46 days of the date of commencement of the Tour, a fee of 25% of the total land arrangements; 3.1.3 within the period of 45 to 31 days of the date of commencement of the Tour, a fee of 50% of total land arrangements; 3.1.4 within the period of 30 days up to the date of commencement of the Tour, a fee of 100% of the Price. RWANDA & UGANDA 3.1.5 101 days or more prior to the date of the commencement of the Tour, a fee of 20% of the total land arrangements; 3.1.6 within the period of 100 to 61 days of the date of commencement of the Tour, a fee of 30% of the total land arrangements; 3.1.7 within the period of 60 to 46 days of the date of commencement of the Tour, a fee of 50% of total land arrangement; 3.1.8 within the period of 45 to 30 days of the date of commencement of the Tour, a fee of 80% of total land arrangement; 3.1.9 within the period of 30 days up to the date of commencement of the Tour, a fee of 100% of the Price. Please note some properties have unique terms & conditions specific to them. In circumstances where there terms and conditions are not covered under the SCSL Terms and conditions outlined above, then SCSL will advise the valid terms and conditions for that specific property at the time booking is made. 3.2 Your Deposit and any other payments on account will be applied against your liability under sub-clause 3.1, otherwise towards the part payment of the Price if for any reason it had not been paid in full by the Due Date. 3.3 In respect of the balance of the Deposit and other payments on account not retained by SCSL pursuant to the preceding two sub-clauses, SCSL will refund such amount to you: 3.3.1 any charges that have been made for reservations which have already been contacted, any cancellation fees imposed by hotels, lodges or transporters and for any other expenses which SCSL may have incurred. 3.4 In relation to any request by you to alter your Tour after it has commenced, whilst SCSL will use its reasonable endeavours to implement such request, you will be liable for any cancellation or additional charges that may be levied for the Tour originally booked. 3.5 SCSL reserves the right at anytime and without incurring any liability whatsoever or howsoever to make changes to your Tour arrangements (including flights, accommodation, transport or services), to offer substitute facilities (in SCSL’s view) of equal value and reputation, or to cancel any scheduled tour. If SCSL shall cancel the Tour it shall make a full refund except in respect of any cancellation caused by war or threat of war, insurrection, riots, strikes, civil actions, decisions by governments or governing authority, natural disaster, bad weather, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers or other similar circumstances beyond SCSL’s control. 4. WHAT THE PRICE INCLUDES 4.1 The Price includes: 4.1.1 transport including excursions from hotels (such as launch trips and game drives) as indicated in the Itinerary; 4.1.2 accommodation with fullboard table d’hôte meals as specified in the Itinerary; 4.1.3 government hotel taxes; 4.1.4 hotel service charges; 4.1.5 sight-seeing, game bird walks as specified in the Itinerary 4.1.6 the cost of all charter flights indicated in the Itinerary and any scheduled flight indicated in the Itinerary as being included in the Price. 4.2 The Price does not include: 4.2.1 visa fees and international and domestic airport taxes (unless indicated otherwise in the Itinerary, gratuities (other than service charges specified in sub-clause 4.1.4 above), beverages, laundry and other items of a personal nature, any communications cost (such as telephone calls or fax transmissions); 4.2.2 any supplementary charges imposed by hotels/lodges; 4.2.3 any Park (or other) entry fees except where these are specifically quoted in the Itinerary. 5. ACCOMMODATION 5.1 Without any acceptance of liability for failure to do so, SCSL shall endeavour to book rooms for you with private baths on the basis of two persons sharing a double room. Single rooms shall be available at a supplementary price. However SCSL does not guarantee the availability of either a private bathroom or a single bedroom, even when a private bathroom or single bedroom had been specifically requested by you. 5.2 Whilst SCSL will use its best endeavours to ensure that you stay in the hotel, lodge or camp of your choice, it reserves the right to alter the identity of your destination provided that it shall reserve rooms for you in hotels/lodges/camp which, in its view, are of similar value and standing. SCSL accepts no

responsibility or liability in the event that it has offered the services of an establishment of similar price and standing which have been declined by you. 6. TRANSPORTATION AND GUIDES 6.1 SCSL shall provide such aircraft, safari minibuses, safari cruisers, cars, four-wheel drive vehicles or coaches as it considers necessary to transport you, based on considerations such as the route to be taken, the condition of the roads and the number of clients on the proposed journey. SCSL reserves the right to alter any such arrangements made, including the proposed route to be taken. 6.2 SCSL reserves the right to employ the services of sub-contractors to effect your transportation. 6.3 SCSL shall provide the services of a driver-guide. 7. SCSL’S RIGHT OF REFUSAL 7.1 SCSL reserves the right to: 7.1.1 refuse any Booking from persons whom it considers unsuitable for the type of travel to be undertaken; 7.1.2 decline to accept or retain you as a member of any Tour at any time. 7.2 If SCSL exercises its right under sub-clause 7.1.2 in circumstances in which you shall not have been in fault, then SCSL may refund you an amount it considers equitable taking into account all of the circumstances. 8. YOUR RESPONSIBILITIES 8.1 You shall ensure that you have obtained adequate insurance cover against personal accident, medical expenses and loss of your baggage. 8.2 You shall ensure that all your travel documents, full passports, visas, vaccination certificates, currency and travellers’ cheques are in order and that the name that appears on your airline ticket (if relevant) shall be the name that appears on your passport, and that you reconfirm all your international flight departures at least 72 hours prior to departure, unless SCSL shall have agreed by prior arrangement to reconfirm on your behalf. 8.3 You shall be responsible for informing SCSL when the Booking is made of any requests for special diets or facilities for the disabled or for any other special needs. Whilst every effort will be made to meet such requests, SCSL does not guarantee that such requests will be met. 8.4 You shall inform SCSL when you make the Booking of any medical condition or disability, which may materially affect your ability to enjoy or suitability for the Tour. 9. SCSL RESPONSIBILITIES 9.1 Except where SCSL shall transport you in its own vehicles, SCSL and its agents act only as your agent in all matters relating to your transportation or the provision of any other services to you regardless of whether you are transported by aircraft, rail, road, motor-coach, ship, boat or any other means. 9.2 SCSL shall not be liable for any injury, delay, loss or damage howsoever arising from your transportation, accommodation or from any other services provided to you or from any act or omission of any person (or their sub-contractors agents or employees whether acting within the scope of their contractual obligations agency or employment or not) who shall provide any such service other than for death, injury or illness caused by the negligent acts and/or omissions of SCSL or its employees and agents (other than air and sea carrier agents performing any domestic, internal or international carriage of any kind) whilst acting within the scope, or in the course, of their employment. The amount of damages SCSL shall pay to you under this clause shall be such damages as might have been claimed irrespective of death, injury or illness caused by the negligence of SCSL, its employees or agents as aforesaid as accepted under the laws of the country in which the event giving rise to the loss took place. 9.3 In respect of any other loss not specifically referred to in this clause you, your property and baggage travel entirely at your risk. 9.4 You will keep SCSL indemnified against any claims except as provided for in this condition. 10. JURISDICTION All matters concerning these conditions shall be subject to the laws of the Republic of Kenya. You submit to the exclusive jurisdiction of the courts of Kenya which shall be the sole forum for the hearing of any claims other than those which shall be referred to arbitration pursuant to clause 11. 11. ARBITRATION A dispute or difference between us relating to the validity, construction or performance of this agreement shall be referred to an Arbitrator to be appointed (in default of agreement between us) within 21 days of notification of such dispute by one of us to the other by the Chairman for the time being of the Chartered Institute of Arbitrators, Kenya Branch, upon the application of either of us. Such

arbitration shall be at a venue in Nairobi in accordance with the Arbitration Act (Cap.49).
