SUBJECT: UNIVERSAL FARE SYSTEM CONTRACT MODIFICATION

ACTION: APPROVE CONTRACT MODIFICATION

RECOMMENDATIONS

Approve modification authority for Contract OP02461 010 with Cubic Transportation Systems, Inc for an amount not to exceed$~ $7.8 million for TAP system enhancements. The recommended actions detailed below will be funded through the existing Life of Project (LOP) balance for the Universal Fare System (200225), the Regional Transit Access Pass System (200351) and the Metro Rail Gating (21 0094) Capital Projects (CP's). No additional funds are being requested.

ISSUE

Customer Experience, Municipal and Metro Support and Fare Enforcement are 3 areas that require immediate attention in order to facilitate TAP compatibility with the Municipal Operators and to improve fare enforcement and collection.

DISCUSSION

Background:

Contract OP02461 010 was originally awarded to Cubic in March of 2002 for an amount totaling $84,003,444. In its 10 year duration, it has undergone multiple modifications and the contract amount total to date is at $160,446,339 $160,416,339 (Please see the Procurement Summary included as Attachment A). The currently requested contract modification will utilize pre-existing funds included in the FY13 Budget and will increase the contract amount to $175,010,114 $168,301,237. This modification will address the specific areas detailed below. Full listing of itemized Change Notices (CN) for this modification request is included in Attachment B.

Customer Experience:

To ensure safety, improve user interface and to make the fare purchasing experience easier and more intuitive, staff recommends the following:

1. Safety: • Install additional reinforcements to ensure the proper function of the

emergency swing gates at high-traffic rail stations (CN 157). • As Vermont Station falls under the jurisdiction of 2 different fire departments,

Fire Life and Safety requested that Metro install additional Fire Key Locks to ensure that fire departments from different jurisdictions have gate access (CN 147). As Fire Life and Safety complete their inspection and testing, requests to add locks at other stations may be requested.

2. Screen Display Modifications and TAP Vending Machine (TVM) installation (CN162): • Simplify TVM screens to make them more user-friendly. • Update and clarify the existing "Help" options and directions • Incorporate up to six languages in addition to the existing English and

Spanish options currently provided. • Enable the purchase of multiple rides on a single TAP card and/or the

purchase of multiple TAP cards in a single cash/credit card transaction for families and groups.

• Install an additional TVM next to the Metro Customer Center in the East Portal at Union Station to help expedite customer purchases and provide service when the center is closed, as well as an additional TVM at the Culver City station (CN150.02).

Municipal and Metro Support:

To complete the transition of the Municipal Operators to TAP and address Metro Division infrastructure concerns, staff recommends the following actions be taken:

• Purchase mobile validators for the Municipal Operators (CN 158) that need to transition to TAP. These low cost TAP enabled mobile validators are now available and work independently of the operator's fare box. They are capable of accepting TAP fare products such as the EZ transit pass and stored value.

• In conjunction with the transition, Municipal Operators have requested improvements in data collection and reporting (CN 146, 156) and a modification to allow the use of multiple fares on one card for group travel (CN 155). To fulfill this request, software modifications are required and would be included in contract modifications.

• For internal Metro support, staff recommends the relocation of bus division vaults (CN 153A, 1538) in preparation of construction and infrastructure changes at Metro Bus Divisions.

• Management Audit Services Department audit recommended enhanced 'Nifi security for bus fare box communications (CN159).

Fare Enforcement:

The current handheld devices used by the Los Angeles Sheriffs Department have reached the end of their life cycle and are no longer supported. Staff recommends the following: • Engineer and Design features for new handheld devices to replace the obsolete

hardware (CN 160). • Expand the features and capabilities of the handheld devices to enable fare

validation, data collection for creating detailed activity reports and the possibility of issuing citations (CN 160).

• Relocate Stand Alone Validators (SAVs) (CN 145) to align with passenger traffic. This allows for a smoother flow of patrons while facilitating the tapping of the fare media cards.

DETERMINATION OF SAFETY IMPACT

A number of these recommendations positively impact safety on our system. Reinforcing the emergency swing gates at high volume stations ensures that they remain in a state of good repair in the event they are needed. The installation of additional fire key locks facilitates the ability of multiple fire departments from different jurisdictions to respond to an emergency at the Vermont Station. Also, relocating SAVs improves and controls the flow of passenger traffic, which is key in high volume stations during peak hours.

FINANCIAL IMPACT

The combined remaining LOP balance of $14.6M for the Universal Fare System (200225), the Regional Transit Access Pass System (200351) and the Metro Rail Gating (21 0094) CP's will support the recommended actions for $7.8M. No additional funds are being requested.

The source of funds will come from Federal 5307, Prop1 B- Security Grant, Prop C 40% and other local funding sources to be distributed against the affected projects. Since this is a multi-year project, the Executive Director, Management, Budget and Local Programming shall be responsible for budgeting future years.

ALTERNATIVES CONSIDERED

The Board may choose not to approve contract modification authority. This is not advised as it will negatively impact customer service improvements, Municipal and Metro support efforts and further delay implementation of Metro's Fare Enforcement policy targets.

This Board Action is for a contract modification in support of the Universal Fare System Contract. This modification includes Change Notices 145-148, 150.02, 153A&B, 155-158, 160 and 162 (See Attachment B for full descriptions of the change notices). These change notices were issued to Cubic to perform a variety of service and safety improvements, equipment relocations and additions, and to help make the system easier to use for our patrons.

B. Evaluation of Proposals/Bids

Proposals submitted in response to issued change notices have been reviewed for technical compliance and have been determined to be technically acceptable. The recommended not-to-exceed price for these changes is in compliance with Metro Procurement Policies and Procedures as described below

C. Cost/Price Analysis

The final negotiated amount for the changes listed in Attachment A will comply with all requirements of Metro Procurement policies and procedures, including fact­finding, clarification, cost analysis, technical evaluation, and negotiations to determine a fair and reasonable price before the change is executed.

D. Background on Recommended Contractor

Cubic Transportation Systems, Inc., a wholly owned subsidiary of Cubic Corporation, is located in San Diego, California. Cubic Transportation Systems, Inc. (Cubic) has been in business since 1949. Cubic specializes in two areas of business: Defense and Transportation. Cubic is currently under contract with LACMTA to provide additional equipment for upcoming projects and to provide System Support Services for currently installed equipment. Cubic's performance under this contract has been satisfactory. Cubic is a world-leader in automated fare collection equipment with installations in New York, Chicago, Washington, London and in a number of other countries around the world.
