Chapter 1 Preamble
The petitioner named above respectively showeth under
1.1. Tamil Nadu Electricity Board was a State Electricity Board constituted under
section 5 of the Electricity (Supply) Act, 1948 and was in the business of
Generation, Transmission and Distribution of Electricity in the State of Tamil
Nadu.
1.2. TNEB was restructured into TNEB Ltd and two subsidiary companies viz. Tamil
Nadu Generation and Distribution Corporation Ltd and Tamil Nadu Transmission
Corporation Ltd.
1.3. Tamil Nadu Generation and Distribution Corporation Ltd., (TANGEDCO) was
incorporated on 01.12.2009 and the Certificate for commencement of business
was obtained on 16.03.2010.

1.4. The Government vide G.O.(Ms.) No.100, Energy (B2) department, dt
19.10.2010 has issued Tamil Nadu Electricity (Reorganisation and Reforms)
Transfer Scheme, 2010 for the purpose of transfer and vesting of property,
rights and liabilities of the Tamil Nadu Electricity Board in the State Government
and re-vesting thereof by the State Government into corporate entities and also
for the transfer of personnel of the Tamil Nadu Electricity Board to corporate
entities and for determining the terms and conditions on which such transfer
and vesting will be made. The opening balances of assets and liabilities are
transferred based on the 2008-09 un-audited balance, which was the latest
available data at that time. TANGEDCO started functioning independently from
1.11.2010 onwards.
1.5. Final transfer scheme transferring the assets and liabilities to successor entities
of erstwhile Tamil Nadu Electricity Board has been notified by Government of
Tamil Nadu vide GO.MS. No 49 (Energy Department) dated 13.08.15 and
incorporated in 2015-16 audited accounts.
1.6. As per Section-46 of Electricity Act, 2003, the State Commission may, by
Regulations, authorise a Distribution Licensee to charge from a person requiring
a supply of electricity in pursuance of Section-43 any expenses reasonably
incurred in providing any electric line or electrical plant used for the purpose of
giving that supply.
1.7. In addition to Revenue from sale of power, TANGEDCO is collecting
Miscellaneous charges from consumers on account of service connection
charges, Meter Rent, Meter caution Deposit, Re-connection charges,
Registration charges etc.
1.8. Accordingly,as submitted by TNEB the Hon’ble Tamil Nadu Electricity Regulatory
Commission has issued Order on Non- Tariff related Miscellaneous Charges dt
31.08.2004 (w.e.f.01.10.2004) without any increase for the rate prevailed from
1999.TANGEDCO has filed petition for Non- Tariff related Miscellaneous Charges
and the same was admitted by the Hon’ble Commission on 31.07.2012 and
numbered as M.P. No.16 of 2012 .The Hon’ble Commission has ordered that the
petition filed by TANGEDCO is dismissed as withdrawn, based on the
TANGEDCO’s submission in view of poor power situation prevailing at that time.

1.9. This application for the revision of Miscellaneous charges, is being filed before
the Honourable Tamil Nadu Electricity Regulatory Commission and it is prayed
to approve the proposed miscellaneous charges and TANGEDCO requests the
same may be effective from 01.04.2018 or earlier.
1.10. Need
It is submitted that the need for which revision now requested for the Meter
Caution Deposit, Security Deposit, Development charges, service connection
charges and also for the various services provided by the TANGEDCO. The Cost
of service rendered by the utility increased over 13 years. The marginal
increase of these charges would compensate a portion of the capital cost/cash
flow requirement of TANGEDCO for the year 2018-19.

Chapter 2 Proposed Miscellaneous Charges
1. Service Connection Charges
2.1. In accordance with section 45 of the Electricity Act 2003, the Hon’ble
Commission authorise the Distribution licensee TANGEDCO to collect
service connection charges in Regulation 45 of Tamil Nadu Electricity
Distribution Code.
Service connection charges is
(i) For connecting up an installation, the Licensee shall be entitled to
charge the consumer the actual cost of materials upto meter board,
labour, transport plus overhead charges. (ii) Extension, improvement
or alteration to service lines to meet any additional demand will be
charged on the same basis. In each case, the consumer will be
furnished with an estimate of the cost of the work and this amount is
payable in advance. On completion of the work, a bill for the actual
amount payable will be forwarded to the consumer and any difference
shall be paid by the consumer or will be refunded by the Licensee as
the case may be. (iii) The estimate for service connection charges
may also include the service connection charges for metering referred
to in regulation 45(2). The licensee shall give due credit for the
materials if any supplied by the consumers
2.2. In the existing order on the Non- Tariff related Miscellaneous Charges w.e.f.
01.10.2004, the service connection charges for three phase LT services with a
connected load (CL) up to 112 kW are charged equally. Based on the prevailing
estimate sanction procedures, it is submitted that it is proposed to charge
seperate SC charges for
a) Low Tension Three Phase service connections with less than 18.6 kW.
b) Low Tension Three Phase service connections with Connected Load between
above 18.6 kW and up to 50 kW.
c) Low Tension CT service connections with Connected Load between above 50
kW and up to 112 kW.

2. Meters2.4. It is submitted that Regulation 5 (11) of Tamil Nadu Electricity Supply
Code, authorise the Distribution licensee TANGEDCO to collect meter
related charges as specified below:
“Meter rental charges shall be payable by the consumer, unless the
consumer elects to purchase a meter, in accordance with the rates as
the Commission may fix from time to time for different categories of
consumers. The Licensee shall, besides meter rent where payable,
collect charges towards changing of meters and boards, testing of
meters, testing of installations, inspection charges etc., at the rates
specified by the Commission from time to time.”
2.5. Under the heading of Meters, at present the following charges are being
collected :
(a) Meter Rent(b) Meter Related Charges(i) Changing of Meter Board(ii) Changing of meter at the request of the consumer not due to increase in
consumption(iii) For Testing, if it is proved to be correct within the prescribed limit (challenge
Test)(iv) Installation Testing2.6. Now under the heading of Meters, the following charges including above
charges /modification of above charges and new charges are submitted for
collection from the consumers:
(a) Meter Rent(b) Meter Related Charges(i) Changing/Shifting of Meter Board/ Meter box for LT, LTCT & HT and(ii) Changing of Meter at the request of the consumer without any dispute in
accuracy of the meter(iii) Inspection and Testing of Meter when dispute arises in the accuracy (Challenge
test)(iv) Installation Testing arising out of failure or replacement.(v) Charges for rating / re-rating of installation at the instance of the
Consumer(vi) Resealing charges where seals are found broken/temporary disconnection
charges.

(vii) Replacement of Glass and Meter(viii) Charges for replacement of damaged / burnt meter(ix) Special meter reading charges as per the request of the consumer
3. Meter Rent2.7. It is submitted that, as per the provision under section 47 (1(b)) and section 55
(1) of the Electricity Act, 2003, the TANGEDCO is entitled to collect a meter
rent. As per section 47(4) of the Electricity Act, 2003, the consumer is entitled
to receive interest at the bank rate to be specified by the Commission for the
meter security deposit paid by the consumer.
2.8. In Para:3.3 (Meter Rent) of Tariff order on non-tariff related miscellaneous
charges w.e.f.1.10.2004, it has been stated that the meter rent for LT services
and the interest on MCD will be a meagre amount and it is proposed to match
both charges. Further, this will eliminate considerable accounting works in
computing the interest for small amounts and issuing credits through
consumption bills or cash payment and accordingly, no meter rent has been
collected and in turn no interest has been paid for the Meter Caution Deposit.
It is proposed to continue with the existing status.

2.14. Fees for Periodical Inspection:
It is submitted that, as per Central Electricity Authority (Measures relating toSafety and Electric Supply) regulations, 2010, Chapter III (General Safetyrequirements) regulation 30, every installation shall be periodically inspectedand tested at intervals not exceeding five years either by the ElectricalInspector or by the supplier as may be directed by the State Government. Theinspection and testing fees was last notified by the Government videG.O.No.31,Energy (B1) Department, dt.01.04.2002 . Therefore, the feesprescribed for inspection of installation i.e., low, medium, high voltage or anyother charges to be fixed from time to time shall be collected from theconsumer concerned , whenever the service was inspected by Board’s Officialsduring mass inspections or any other inspection conducted as per the formsprescribed by CEA under regulation 30, sub regulation (3) and the same maykindly be approved.

2.18. Note Submission no. :- 1. This amount will be charged without prejudice
to the right of the TANGEDCO to take any other action or impose penalty on
the consumer as per the prevailing rules. Since, in such case, the meter has to
be sent for testing , the meter changing charges shall be levied additionally.
2.19. Note Submission no.: -2. This amount will be charged without prejudice
to the right of the TANGEDCO to recover the estimated cost of theft of energy.
Principles of natural justice shall invariably be followed and opportunity of being
heard shall be given to the consumer before levying such charge.

2.20. Charges for replacement of damaged/burnt meter
The cost of burnt out meter shall be collected and shall be replaced by a
good meter immediately without any lapse of time. The released burnt meter
shall be examined by MRT wing of the Licensee. If the meter is burnt out
due to mistake of Consumer or fault in the Consumer premises, there shall
be no refund of the cost of meter collected by the Licensee and if it is due to
the technical reasons like voltage fluctuation etc, attributable to the system
constraints, the cost of meter collected by the Licensee shall be adjusted
against the future consumption charges of the Consumer under intimation to
the Consumer.

2.24. In case, the licensee’s seal are damaged by the consumers and request
disconnection of services temporary, it is prayed to approve the proposed

5. Meter Caution Deposit
2.28. The provision under section 55 of the Electricity Act, 2003 stipulates that
the licensee may require the consumer to give him security for the price of a
meter.
It is prayed to approve the proposed Meter Caution Deposit as below:

7. Reconnection Charges:
2.30. It is submitted that as per Regulation 5 (8) of Tamil Nadu Electricity Supply
Code ,the Licensee shall collect reconnection charges from LT/HT consumers at
the rates specified by the Commission from time to time. It is prayed to
approve the proposed reconnection charges as submitted below:

2.32. LTCT Services: Reconnection charges for the LTCT services is being
proposed as Rs. 1200/ per service. Further, in respect of LTCT services remain
disconnected for more than 6 months, testing of meter by MRT personnel
would be required. Hence, it is proposed to charge an amount of Rs.4100/- per
service to the LTCT services remains disconnected for more than 6 months.

2.33. HT Consumers: Reconnection charges for the HT services is being
proposed to be revised from Rs.3000/ per service to Rs 5000/- per service.
Further, in respect of HT services remain disconnected for more than 6 months,
testing of meter by MRT personnel would be required. Hence, it is proposed to
charge an amount of Rs. 8100/- per service to the HT services remains
disconnected for more than 6 months. it is prayed to approve the proposed
reconnection charges for LTCT and HT consumers as submitted below:

8. Replacement of Consumer Meter card:
2.34. It is submitted that as per Regulation 5 (9) of Tamil Nadu Electricity Supply
Code, the licensee shall collect charges at the rate specified by the Commission
for replacement of consumer meter card if lost or damaged.
2.35. Further, it is submitted that there is no changes proposed for existing
charges, it is prayed to approve the same and equivalent charges effecting
service connections , for replacement, lost or damaged card and used up as
follows:

9. Charges for dishonoured cheque:
2.36. It is submitted that as per Regulation 5 (10) of Tamil Nadu Electricity Supply
Code, the licensee shall collect service charges as specified by the commission
time to time from the consumer, when a cheque given by the consumer is
returned by the bank for any reason whatsoever.
2.37. When Cheques given by the Consumers either for current consumption
charges or towards any other charges of current consumption
deposit/additional current consumption deposit are returned by the Bank for
any reason, a service charges of Rs.250/- is being collected for both LT and HT
consumers.
2.38. Even though the no. of HT consumers are less compare to LT consumers,
the energy consumed by the HT consumers are more and hence the current
consumption charges payable by the HT consumers are also high. Moreover,
they are paying the charges for the energy already consumed by them. As
such, when the cheque issued by a LTCT consumer / HT consumer for the
energy already consumed by them, is returned by the Bank as dishonoured, the
day to day financial planning of the TANGEDCO gets affected very much and
the resulting financial hardship would be considerable.
2.39. In this connection, it is submitted that in Regulation 15 (4) of Tamil Nadu
Electricity Supply Code, differentiation has been made between LT and HT
consumers as regards to the minimum levy of additional service charges in the
event of dishonour of cheque.

2.40. Hence, it is prayed to approve the proposed charges for dishonoured cheque
depending upon the cheque amount for the financial hardship caused for LT
CT/HT services plus service charges in respect of HT/LT consumers as
submitted below:

10. Charges for Name Transfer of Service
2.41. It is submitted that as per regulation 4 (2) of Tamil Nadu Electricity Supply
Code of Hon’ble commission, Name Transfer Charges shall be recoverable from
the consumers, by the Licensee. In Regulation 5 (7) of the above Supply Code,
the details of documents to be furnished for considering the name transfer have
been indicated.
2.42. In order to effect name transfer, it would be essential to verify all the
necessary documents mentioned in Regulation 5(7) of the Supply Code and to
ensure whether the service is live or under disconnection. Based on the
activities involved and the man power requirement, it is prayed to approve the
proposed Name Transfer Charges as submitted below:

11. Development Charges
2.43. LT Category
It is submitted that as per section 46 of the Electricity Act 2003, the State
Commission shall authorise a distribution licensee to charge from a person
requiring supply of electricity in pursuance of Section 43 any expenses
reasonably incurred in providing any electric line or electrical plant used for the
purpose of giving that supply. Accordingly , for connecting up an installation,
the TANGEDCO shall be entitled to collect the entire cost of the service lines
including material, transport and labour from the consumers.
2.44. It is submitted that the development charges are being collected to recover
at least a part of the cost of creation of necessary infrastructure facility for
extension of supply. it is prayed to approve the proposed development Charges
as submitted below:

2.49. Further it is submitted that the above development charges at the
appropriate rate may also be permitted to collect as and when the consumer
approaches the TANGEDCO for the following services in addition to the new
service connections also.
(i) Whenever the consumer applies for additional loads in the existing service
connection.
(ii) When application for conversion of single phase service into three phase
service is received, the difference between the charges fixed for three phase
service and single phase service may be collected.
(iii) As regards, temporary supply one fourth of the Development charges for the
respective category may be collected.
12. Registration Charges:
2.50. It is submitted that as per Regulation 5(12) of Tamil Nadu Electricity Supply
Code Licensee shall collect the Registration Charges at the rates specified by
the Commission. In this connection, the following is submitted before the
Hon’ble Commission for consideration:
2.51. The Registration of application involves not only the registration of
application but also involves the investigation for processing the application. On
investigation only, it can be ascertained whether the application involves any
extension or improvements to the distribution network which is necessary to
prepare the necessary estimate and obtaining the sanction accordingly.
2.52. Similarly, in the case of HT services also, preliminary investigation is
considered necessary to ascertain the technical feasibility for considering the
request of the consumer as per the application.
2.53. Hence, it is submitted to change the nomenclature as “Registration – cum –
Processing Charges”.
2.54. Considering the activities involved and the man power requirement, the
following is submitted

15. Security Deposit:
2.59The Earnest Money Deposit collected is converted to Security Deposit Charges
after the service is effected.
2.60 In order to safeguard the interest of the Licensee, the initial CCD equivalent to
3 months estimated current consumption charges for LT services and 2 months
estimated current consumption charges for HT services are being collected at
the time of extending supply for sanctioned load for LT services /demand
