Hi Anthony,

I haven't seen this specific piece of info but one of the concerns about e-cigarettes, orbs, snus, etc is the lack ofstandardization of nicotine content and about the non-tobacco contents which are often unknown and potentiallyhazardous.

I just saw on this webpage http://tobaccoproducts.org/index.php/Camel_Sticks,_Camel_Orbs_and_Camel_Stripsthat the amount of nicotine from these products can be much higher (and last longer) than a cigarette. Sounds bad tome.

Unless you have a pressing feeling that one of the three directions take precedence, I think it makes sense to waituntil Jan or Feb (it may take a month to have committee assignments worked out) and to continue any internalreorganization or strategic planning.

For the BOH meeting, I think we just need to respond in a timely fashion to the request to learn more about e-cigarettes, Orbs, Strips, and Sticks. It could simply be: show some pictures of what they are, quote literature aboutthe public health concerns, and state that we will see how it fits into our work plan after we come back to the BOHnext year.

Let me know what you think.

Hi Anthony,

Joby sent an email yesterday asking about an e-cigarette presentation. I spoke with Steve about it. Steve and I feelthat you, Steve, Joby and I should meet to discuss next steps with the Board since we really didn't have anopportunity to get direction from them at the study session. Steve believes we should wait until at least Januarybefore raising additional tobacco policy issues with the board since we'll have new board members in 2011.

I can prepare a brief presentation on e-cigarettes if you would like. I think the question is then, what we'll we expectfrom the Board? Will the purpose be solely for information sharing or do we expect them to take a stance or givedirection on e-cigarettes? If we don't expect them to give us direction at the November board meeting it might makemore sense to give the e-cigarette presentation at a future study session where we can better discussion policyoptions.

We need to reach closure on the decisions from the last BOH SS (BOH did not really answer the question).

Also, will you be doing a presentation on e-cigarette and tobacco/nicotine alternatives for BOH Mtg?

If you're a nonsmoker who lives in an apartment, your health may be at risk from your neighbors who smoke, says anew study.

Researchers at Roswell Park Cancer Institute in Buffalo, N.Y., analyzed air quality data from 30 apartments within11 buildings and found that secondhand smoke can travel from the apartments of smokers to hallways andapartments of nonsmokers.

The extent of the secondhand smoke transfer depends on a number of factors, including ventilation and distancebetween apartments, the investigators found.

The researchers said the best way to protect apartment residents from secondhand smoke is to have smoke-freebuildings.

"This study suggests that individuals who live in apartment buildings are particularly susceptible to secondhand smokeexposure in their homes," lead investigator Brian King, of RPCI's department of health behavior, said in a newsrelease from the institute. "Since many factors can impact the amount of secondhand smoke transfer betweenapartments, smoke-free building policies are the most effective way to protect apartment residents and their visitorsfrom exposure."

The study appears online ahead of print in the journal Nicotine & Tobacco Research.

Hi Anthony,

One idea would be to send them info on the alternative tobacco products in their BOH packets or via email. There'sa great demonstration of e-cigarettes on YouTube. This would be timely follow-up and would prevent us from havingto repeat the presentation with new board members. Even if there's only two new board members their votes couldbe key to passing a policy or resolution.

Hi Anthony,

I checked with Cheryl the other day. The Board of Health packets for next week's meeting have already gone out.

Below is a draft email that could be sent to Board members from you which contains links to info on the webregarding e-cigarettes and other alternative tobacco products.

Let me know your thoughts and how you would like to proceed.

Thanks.

Dear Board Members,

This email is in follow-up to tobacco policy information shared with you at previous Board of Health study sessions.

One of the policy options, shared with you at the October 20th study session, is to take action which will result in thereduced use of tobacco by youth in Pierce County. As stated in the October presentation results from theWashington State Department of Health's Healthy Youth Survey indicates that the rate of tobacco use in 2008among 12th grade youth in Pierce county is 21%. The current adult tobacco use rate in Pierce County is 16.9%.

A specific policy option presented on October 20th would be to ban the sale of e-cigarettes to youth in PierceCounty. E-cigarettes do not actually contain tobacco so they can currently be sold to youth. Unfortunately, e-cigarettes do contain nicotine and other chemicals that are hazardous to health and, while promoted as a way to stopsmoking, when taken up by non-smoking youth could be the start of a tobacco addiction.

Below are some internet links that provide information related to e-cigarettes and alternative tobacco products usedby youth.

Smoking Everywhere is the name of the company that distributes/makes e-cigs. This link is to a video on YouTubethat demonstrates how e-cigarettes work.

On October 5, 2010 the Spokane Regional Health District's board of health unanimously passed a resolutionrequesting that jurisdictions in Spokane County adopt policies prohibiting the sale of electronic cigarettes and theircomponent parts to minors. This is the first resolution of its kind in Washington state. I've been told by staff at WAState Dept of Health Spokane is now in the process of preparing an ordinance to ban the sale of e-cigarettes inSpokane County. (Note; I have an email to staff at Spokane to confirm this. I hope to know before sending thisemail. )

Annie......our Director (Dr. Anthony LT Chen) recently provided to all of the members of the Board of Health someinformation about e-cigs, including information about the resolution passed on Oct 5 by the board of the SpokaneRegional Health District regarding "requesting that jurisdictions in Spokane County adopt policies prohibiting the saleof e-cigs and their component parts to minors." Dr. Chen went on to note that Spokane health department staff weredrafting ordinances for use/adoption by local towns and cities.

So from my perspective Dr. Chen could be priming our board to consider a similar resolution. Unlike Spokane andKing County health departments, we have yet to take the necessary steps to allow for full enforcement and theissuing of civil fines for violations of 70.160. But.....I do have as an assignment from my boss to start working on aresolution. I advised him that my first cut would probably include any and all of the harshest terms and the most fines(the reinspection fees can be very expensive once you start doing a full costing of staff time) implemented by otherhealth departments in Washington State. I have 7-8 examples of resolutions/practices from other counties. If you, oranyone you know, have some examples please send them my way.

It would be great if you could join us at our December 3 TAP Summit meeting. Your work and insight about what'sgoing on (or should be going on) in the anti-tobacco world would be very beneficial.

King 5's Eric Wilkerson called to ask whether TPCHD was going to ban e-cigarettes now that PHSKC has doneso. I talked with Dr. Chen and gave Eric this statement:

"TPCHD is concerned about e-cigarettes and the dissolvable nicotine candy (e.g., Orbs). We're especiallyconcerned about the health impacts on youth. We're exploring options on how to address these concerns."

I shared that and he followed up with "and are you in agreement with PHSKC's ban?" "Are you going to follow suit?"I explained that we had presented information to the Board of Health last month about the health impacts of e-cigarettes and nicotine candy but were still in the exploration phase to determine our options.

He asked for a timeline and I said we did not have one but were actively engaged in exploring what we could doabout the health impacts on youth of e-cigarettes and the nicotine candy.

From: Public Health Law & Policy [mailto:[email protected]]Sent: Thursday, December 16, 2010 11:47 AMTo: Bruce RytkonenSubject: New Court Ruling on E-Cigarettes

Dear Bruce,

A federal appeals court recently issued a decision allowing e-cigarettes to continue to be legally sold in the UnitedStates under federal law. (E-cigarettes are battery-powered devices that provide inhaled doses of nicotine and, whenused, emit vapor rather than smoke.)

In 2009 the U.S. Food and Drug Administration (FDA) moved to establish authority over e-cigarettes as drugs ordrug delivery devices by blocking the import of new e-cigarette shipments into the U.S. However, this month thecourt ruled in Sottera v. FDA that the FDA does not have the authority to continue to block the shipments.

The court's decision does not necessarily apply to all e-cigarettes on the market. If an e-cigarette company marketsits products as a smoking cessation aid, the FDA may still have the authority to regulate it as a drug or drug deliverydevice. The ruling also does not diminish the power of state or local governments to pass laws restricting e-cigarettes'sale or use. The FDA may choose to appeal the ruling to the U.S. Supreme Court.

Today I visited The Vaporium in Lakewood. It's a new e-cig retailer. The owner smoked for 20 years and the onlyway that she was able to quit was with using e-cigs. She said that so far she has about 20 customers. I told her thatthe BOH was considering a law prohibiting the sale of e-cigs to anyone less than 18. She said that she doesn't sell toanyone less than 18. She's hopeful that the BOH doesn't enact all of the prohibitions on using e-cigs as wasapproved by the King County BOH. I took the opportunity of this visit to provide her with one of my normaltobacco business kits. She said that she would be putting up one of the Mtn cling signs.

Hi Anthony,

You asked me about this just prior to the last BOH mtg on Dec. 15. It looks like they passed this restriction on Dec.16th.

King County put restrictions on e-cigarettes that includes:

* restrict the sales of e-cigarettes or any other unapproved nicotine delivery devices only to people 18 and older;

* prohibit free or highly discounted electronic smoking devices or unapproved nicotine delivery products;

* prohibit the use of e-cigarette devices in places where smoking is prohibited by law.

Hi Kirsten,

I left you a voice mail message earlier today regarding pending tobacco-related legislation. I indicated I had it prettymuch covered but need to update you.

What I don't have covered is the legislative tracking form. I believe George has been completing the bill summarydocument, but someone, either you or George, should go to Sharepoint, click on "Legislative Tracking" and click on"EH" and enter the info for the bills mentioned below. These are the only ones that I'm aware of that pertain toTobacco. Anthony and Steve routinely go to this spreadsheet to see check on bills.

Also, are there any PAN related bills that we should be tracking? If so, it would be good to designate someone fromPAN to track in Sharepoint.

Thing should slow down by Feb. 18th. For non-budget related bills that don't make it out of committee, they'reeffectively dead. The number of surviving bills really dwindles at this point.

Thanks.

Subject: bills related to tobacco

Theresa, here's the pertinent bills and local policies that you asked about. Christopher or Scott may have better localinformation than what I provided below.

1246/ 5380 would

1) Ban flavored tobacco (this appears to include e-cigarettes)

2) Require tobacco to be behind the counter

3) Remove preemption so locals could pass more restrictive tobacco ordinances and/or have local taxes

1246 just got a hearing yesterday

5016 would ban smoking in cars with kids under 18. Penalty would be a secondary infraction. Got a hearing and isscheduled for executive action today, so we'll see if it moves or not at 3:30 pm.

5039 would require insurance policies to cover cessation benefits. Got a hearing and was scheduled for executiveaction, but the lengthy testimony on marijuana pushed it off the agenda.

HB 1683 and SB 5542 would allow cigar bars and tobacco retailers to have an endorsement allowing smoking.Cigar bars would have a $15,000 fee and tobacco shops would have a $5000 fee. One bill would deposit themoney into education legacy fund that provides scholarships. The other bill puts money into a trust fund for basichealth plan. No hearing scheduled yet.

At the local level,

King County put restrictions on e-cigarettes that includes:

* restrict the sales of e-cigarettes or any other unapproved nicotine delivery devices only to people 18 and older;

* prohibit free or highly discounted electronic smoking devices or unapproved nicotine delivery products;

* prohibit the use of e-cigarette devices in places where smoking is prohibited by law.

http://www.kingcounty.gov/council/news/2010/December/JP_Ecig.aspx

I wasn't able to find any definitive document that the City of Spokane has passed its ban on sale of e-cigarettes tominors, but it is in the works. If you find out some details, please pass them along. The current posting on the SRHDweb site says that their sale is unregulated. http://www.srhd.org/topics/e-cigarettes.asp

Subject: RE:Attachments: SIPP SeaKing Title 19 Dec 2010.pdf

I now sort of have an idea of how PHSKC adopts new policies and regulations. The actual final wording will becontained in different "Title" sections in the "Code of the Board of Health Seattle King County." Changes to Titlesections are document using the type of form dated Sept 17, 2010, that Frank just provided. In December anotherform of this type, or "resolution," was passed by the PHSKC BOH adopting terms limiting the sale of e-cigs andwhere they can be used.

I believe that then all of the changes to their smoking policies (Sept 2010 and Dec 2010) got incorporated into anupdated version of their Title 19.

The terms that PHSKC adopted on e-cigs were included in my second draft on the resolution that I provided toFrank on Dec 28.

Kirsten.....I'll provide a hard copy of this for your information.

Kirsten The Tobacco Program (now without any funding from the State) is being developed. The primary areas willbe secondhand smoke, youth and cessation.

3. January TAP Minutes Approved

4. Drug Free Community Program

Leonard has been working on one of the local Drug Free Community Programs. They are very comprehensive andrequire a substantial amount of involvement and work. The programs generally include the following:

· Are funded at the rate of $125,000 per year for 10 years

· There are several local projects in process at this time

· Each project has broad community involvement and commitments

· The Milton-Fife project is related to ZIP codes……which causes some problems.

· The projects are coalition driven

· The priorities of the projects need to deal with marijuana, alcohol and tobacco.

There are five groups with new applications in process. Maybe TAP could get involved with one or more of theseprojects if they are selected for funding.

5. Legislative News

Annie SB5039 Requiring private insurance companies to cover tobacco cessation treatment.

A hearing was held with testimony by Heidi, Meghan Sullivan (TOGETHERThurston),

Pat sent a letter of support. Joanna was in attendance. Joanna wrote a letter to her local Sen. Carol (a Republican)seeking his support. The bill moved on to the Rules Committee. Twenty groups showed support for the bill. Theinsurance companies had four representatives who testified against it.

Heidi/George SB5016 bans smoking in cars with kids. Testimony provided by Heidi, Meghan and John from UWT.

5. Discussion and Planning 2011 Goals and Objectives

Before getting the discussion on our 2011 Goals and Objectives, Annie wanted to pose to the TAP

members some questions about TAP that could help us with our planning:

1. Where is TAP right now in the scheme of things?

2. Where does TAP want to go?

3. How can we improve?

TAP has many strengths: -we have powerful voices

-we can be quick to act….we are action oriented

-we are goal oriented

Some things that we could do-be more organized

Page 4

8_19_2011

Page 74: Tacoma-Pierce County Health Department -- E-Cigarette E-Mails Oct. 2010 - Feb 2011

-better marketing of our name (eg. a better letterhead)

-increase our membership

She developed a quick survey which will be sent to all persons on the TAP e-mail listing to see if we can get someinsight on improving TAP’s role in the community (and beyond). A quick response to the survey is appreciated. Itwill come under separate email.

Attachments: TAB Min 11 02 Feb 4 2011.doc

Good Valentine's Day everyone. Attached are the minutes for the February TAP meeting.

The other day we sent everyone the TAP survey that is intended to help figure out some new directions for TAP. Ifyou've already submitted your survey responses back to Annie Holt then a "thank you very much" is in order. If youhaven't yet made your submission, then for your convenience noted below are the three survey questions.

1. How do you think TAP is seen in the community?

2. How do you want TAP to be recognized in Pierce County, the region and the State?

3. What do we need to do to move TAP to where we are to where we want to be?

It would be appreciated if you could send your responses by Feb 21 to Annie at anna.k.holt@pfizer and to me [email protected].

Thank you very much.

We'll see you at the next TAP meeting on March 4 at Allenmore hospital from 9:00 to 11:00 in Conference Room D.

We considered this for October BOH study session but didn't pursue it due to the limited time for the Tobacco partof the meeting.

I don't really feel it's necessary for February's meeting. It could be more of distraction than it's worth.

Kirsten,

I plugged in the following suggestions. Let me know if you have any questions.-Tutrecia

} Challenge:

o Rates of adult tobacco use in PC are declining, but youth rates have remained stable.

o Youth appear to be targeted with alternative tobacco products.

o Most addiction to tobacco begins among youth under the age of 18.

o A person who hasn't started smoking by age 19 is unlikely to ever become a smoker.

As it pertains to your fourth bullet, there was some discussion about young adult tobacco initiation(18-24) fromFrank and Liz. Liz said that there was research stating that there was initiation after the age 18. I still believe that thestatement is true, but some people may start later.

} Overall, nearly 80 percent of all adult smokers first become regular smokers before the age of

18 and 90 percent do so before leaving their teens.15 15 SAMHSA, Calculated based on data in 2006 NationalHousehold Survey on Drug Use and Health, http://www.oas.samhsa.gov/nsduh.htm,

} Goal: Implement policy strategies that prevent or reduce tobacco use among youth.

} Recommended Policy Action:

o Ban sale of E-cigarettes to youth.

o Other Recommended Strategies:

Page 1

8_19_2011

Page 101: Tacoma-Pierce County Health Department -- E-Cigarette E-Mails Oct. 2010 - Feb 2011

o Ban sale of E-cigarettes to youth------Repeated

o Possible- Enforcement of existing tobacco sales regulations

o Multi-media and social marketing campaigns

o Support school based interventions and policy actions

o Pros

* Focus on primary prevention with long lasting health implications.* Reduced tobacco use.* High return on investment.* Support from local businesses.

Cons

* If e-cigarettes are ban, the logistics of the enforcement of the ban* Fines for retailers who sell to minors.

George- I haven't added any results from your Housing Assessment so if you would be interested and feel it'sappropriate to add one slide in there with data, that would be great.

I'd appreciate your edits by end of day today.

Thanks,

Kirsten

Greg......here are the Ordinances for SIPP for Sea-King and Kitsap***. For Spokane attached is their "DraftEnforcement Procedure" dated July 19,2010. I have a request in to them for an updated or final version of thisprocedure. I don't think that they did an ordinance in the same manner as SeaKing and Kitsap. I believe that theydecided on their own that they had the authority to issue citations for violations and the $100 civil fine. When they'vedetermined that someone gets a violation letter, they always then do a follow-up first reinspection and charge thebusiness $100. If the business fails that first reinspection, they get another $100 civil fine and a second reinspectionwith a cost of $200 (I think). It goes up from there.

The Spokane Board of Health did pass Resolution #10-05 regarding restrictions on e-cigs. Copy attached.

***I'm having trouble getting transfer access to the Kitsap ordinance. If you Google "Kitsap County Board of HealthOrdinance 2006-2" you'll get to this document and you or someone more expert in your office can either just print itout or put it in an accessible e-file. Sorry about that.

As a result of the Spokane Health Dept's Resolution 10-05 (copy attached) "asking/proposing" that the legaljurisdictions in Spokane County adopt policies prohibiting/restricting the sale and/or use of e-cigs, the City ofSpokane and the County of Spokane have drafted ordinances (copies attached).

Bruce,

I am not sure what Christopher has sent you. Here is some information on e-cigs from our BOH and from theCounty and City.

I will have to get the final signed versions of the ordinances from the city and county. The city made a couple ofamendments prior to passing in relation to the fines so that it matched the county. Also, our attorneys are looking atadding an amendment that gives police/SRHD authority to confiscate the items from youth.

I think that Christopher probably already gave you everything we have on enforcement. I will check with him later

Hi Chris.....yeah.....me again. I've drafted a resolution/ordinance to get from our BOH authorization to actually doenforcement. My draft is now with senior management and that then also means outside legal counsel. My draftincluded (from wherever I could find them) some of the more stringent or broader terms used by other LHJ's aroundthe State. I did review and include some of what you provided previously to me. General counsel has asked that Iobtain current policies and ordinances from King, Kitsap and Spokane. So could I ask if you could forward to meanything that you have that today serves as the policy, ordinance, procedure, etc. that is associated with 70.160 ande-cigs, as we were discussing yesterday. Thank you very much for all of your time and help.
