Medical Cost Projections – What Are The Advantages? The impact of medical expenses on a company’s financial experience cannot be understated. With annual medical inflation approaching 10% never before has predicting medical exposure been so important, or so daunting. This class will instruct you on how to project future medical costs, which may be used to assist in setting reserves, obtaining settlement authority or as a mediation tool. Medical Cost Projection can also be used as a cost effective alternative to a Life Care Plan since an appropriate medical cost projection includes both Medicare allowable and Non Medicare allowable future injury related medical costs. Barbara will share her proven methods to accurately project medical cost and discuss the advantages of employing these strategies.

Berndt W. Anderson Berndt Anderson has been staff counsel at The Beacon Mutual Insurance Company in Warwick, Rhode Island since 2001. He is responsible for representation of insureds in the defense of workers’ compensation claims, and advising claims personnel in evaluation, defense and settlement of claims. Prior to coming to Beacon, Mr. Anderson was a shareholder with the firm of Roberts, Carroll Feldstein and Peirce, Inc. in Providence, Rhode Island for 21 years. His practice consisted primarily of representing defendants at the request of their insurance carriers. His primary areas of practice were medical malpractice, products liability, computer law, commercial litigation, admiralty and workers’ compensation Mr. Anderson graduated from Clark University in Worcester, Massachusetts, Cum Laude, with a Bachelor’s Degree in economics and international relations, and from Boston College Law School with a J.D. decree. Mr. Anderson is a member of Rhode Island and Massachusetts state and federal courts. He has lectured to attorneys, claims personnel and risk managers on discovery, insurance coverage, torts, workers’ compensation and civil litigation. Polly B. Baca Former Colorado State Senator Polly Baca is the President and CEO of the Latin American Research and Service Agency (LARASA). LARASA is a non-profit organization created in 1964 to lead and influence change to improve the quality of life for Latinos throughout Colorado with the belief that when you improve the lives of Latinos in Colorado, you improve the lives of all Coloradoans. A small businesswoman for three years prior to joining LARASA, Ms. Baca was the Chief Executive Officer of Sierra Baca Services, a consulting firm specializing in multicultural leadership development, diversity training, motivational presentations, policy development, and governmental relations. During 1994, Ms. Baca served as Special Assistant to President Bill Clinton and Director of the United States Office of Consumer Affairs in Washington, D.C. As the chief consumer advocate for the Clinton Administration, Ms. Baca served as the Chair of the Consumer Affairs Council that consisted of representatives of 41 different federal agencies, chaired the U.S. delegation to the Organisation for Economic Co-operation and Development’s Committee on Consumer Policy, and represented consumers on the federal Information Infrastructure Task Force. Before joining the Clinton Administration, Ms. Baca was the Executive Director of the Colorado Hispanic Institute, a nonprofit institute whose mission was to promote multicultural leadership. Among Ms. Baca’s primary responsibilities was the development of Visiones, a statewide multicultural leadership enhancement program aimed at assisting community leaders from different ethnic and racial groups to broaden their leadership potential by becoming skilled in cultural competence. Ms. Baca was born on a small farm in Weld County and grew up in Greeley, Colorado where she graduated from College High School with a joint honor scholarship. She graduated from Colorado State University with a B.A. degree in political science and subsequently did graduate work at Colorado State University, the American University in Washington, D.C., and the University of Colorado at Denver. She received an honorary Doctor of Humane Letters from the University of Northern Colorado, Greeley, in August 1992, and an honorary Doctor of Laws degree from Wartburg College, Waverly, Iowa, in May 1989.

Lisa Blodgett Lisa Blodgett presently serves as General Counsel with CompSource Oklahoma. Prior to appointment as General Counsel, she was CompSource’s Vice-President of Administrative Services. In addition to practicing workers’ compensation law, Ms. Blodgett has extensive experience in the areas of insurance, employment and business litigation. Ms. Blodgett graduated from the University of Oklahoma College of Law with honors and is a member of the Oklahoma Bar Association. She spends her time away from work with her children and husband in Norman, Oklahoma where she is active with church and community activities. Toti Cadavid Toti Cadavid, a native of Colombia and co-founder of Xcelente Marketing and Public Relations, is a marketing & PR strategist with far-reaching experience in both domestic and international arenas. Toti has extensive communications expertise in international marketing, campaign development, and market expansion into U.S. Hispanic markets. Additionally, she is experienced in design and implementation of marketing plans and fully integrated global marketing campaigns, as well as, community outreach and public relations, corporate training, event planning and trade shows. Some of her former corporate experience included: Inasco, Colorado Department of Education, American United Mortgage, Media One (now Comcast) and The Hallmark Channel. Toti holds a BA in International Business, a Masters degree in Marketing, a second Masters degree in Management, and a Certificate in Entrepreneurship, all from the University of Colorado. In addition, Toti is a graduate of the Harvard’s Kennedy School of Government Executive Management Program, 2004 Leadership Program of the Rockies, 2005 Leadership Denver program, 2005 National Hispana Leadership Institute, as well as of the 2005 Dartmouth University’s Tuck Minority Business Executive Program. Toti grew up, and began her career, in Cali, Colombia. Toti, her husband Luis Colón (a member of Denver Mayor John Hickenlooper’s Cabinet), and their children live in Centennial, Colorado. Susan Canny, RN Susan Canny is a Strategic Nurse Case Manager with Pinnacol Assurance. Canny specializes in identifying and resolving complex medical and claims issues, with a particular emphasis on claims older than three years. Canny joined Pinnacol in 1994 as an early intervention nurse case manager and was promoted to her current position in 2004. Prior to joining Pinnacol Assurance Canny was supervisor of case management services for a multi-clinic occupational health provider. She received her bachelor of science in nursing from Regis University and her RN from Presbyterian Medical Center School of Nursing. In 2006, Canny received the Professionals in Workers’ Compensation Outstanding Nurse Case Manager of the Year award.

James Christian James Christian, a partner for 25 years at Patton Boggs, LLP, Washington, D.C., engages in legislative and policy making projects encompassing a wide range of domestic and international issues. He has assisted clients with mature public policy programs, as well as advised clients in the development of advocacy programs. In conjunction with this representation, he advises clients with respect to compliance with Federal Election law, Lobbying Disclosure Act, and Foreign Agents Registration Act matters. Adrian R. Escalante Adrian R. Escalante is the President and CEO of Daily Dose Learning Systems, providing language and safety training programs for foreign-born workers. Mr. Escalante is a native of Argentina and has been a citizen of the United States for over 30 years. He came to the country at the age of 15 and went through the challenging process of learning the English language and integrating himself in the new culture. Mr. Escalante has over 20 years of experience in corporate training, business management, and diversity consulting. He is the founder of the Cultural Integration Advisory Council organized under the Department of Workforce Services (DWS) and past president of the Utah Hispanic Chamber of Commerce. Mr. Escalante holds an MBA from Brigham Young University and a B.S. in Health Administration from California State University at Northridge.

Barbara Fairchild Barbara Fairchild has 24 combined years of experience in business, marketing, insurance, catastrophic case management, utilization review and critical care nursing. Barbara currently holds the position of Senior Account Executive for NuQuest/Bridge Pointe, a national provider of Medicare Set-Aside Allocation and Professional Administration services.

Barbara’s professional credentials include Registered Nurse with a Bachelor’s Degree in Nursing, Certified Life Care Planner, Medicare Set-Aside Consultant Certified and Florida licensed Life Insurance agent.

Barbara has published several articles and speaks nationally to many diverse groups about protecting Medicare’s interests in the settlement of future medical benefits. She is committed to shared knowledge and the advancement of the Medicare Set-Aside Allocation profession. Barbara was included as adjunct faculty at the Medicare Set-Aside Program curriculum presented by the University of Florida in New Orleans, June 2003.

Terry Frakes Terry has been with Texas Mutual for over 15 years. He heads the Public Affairs Division and has responsibility for government affairs, regulatory affairs and corporate communications. Terry's background includes over 25 years in government affairs at both the state and federal levels. He has worked in both the Texas Senate and the Texas House of Representatives as well as the Texas Department of Insurance. Terry spent 10 years with a national trade association representing cigarette manufacturers in 7 states in the South and Western United States. Paul C. Godfrey Paul C. Godfrey currently serves as an Associate Professor of Strategic Management in the Marriott School of Management at Brigham Young University. Paul has taught at Brigham Young University since 1994, teaching strategic management, strategy implementation (business policy), and business ethics for MBA, Executive MBA, Masters of Accounting, and undergraduate business students. His primary area of research expertise and interest is the relationship between Corporate Social Responsibility (CSR) (specifically philanthropy, community investment, and community relations) and Corporate Financial Performance (CFP), and his work has appeared in the Academy of Management Review, the Strategic Management Journal, and the Journal of Management Inquiry. He currently serves as the Associate Academic Director of the Center for Economic Self-Reliance at the Marriott School and is turning his research attention increasingly to economic development in the third world and poverty alleviation. Paul is married to the former Robin Anderson and they are the parents of five children. They make their home in Salt Lake City, Utah, and enjoy cooking and eating good food, reading, hiking Utah’s beautiful deserts, and spending time with each other.

Neville Kenning Neville Kenning is a Senior Consultant and National Director, State Compensation Fund Consulting Practice, based in the Irvine, CA office of the Hay Group. During his 20 years with Hay, 17 of which have been in the USA, Neville has consulted extensively with a variety of industries on a wide range of human resources projects. He has expertise in such areas as job measurement and compensation plan design, incentive pay design, organization design, performance management, pay-for-performance and top talent selection. Neville has consulted with a number of members of AASCIF over the past 18 years. AASCIF clients with whom Neville has worked include Arizona, Missouri, Kentucky, Utah, Rhode Island, Idaho, Texas, Louisiana, Maryland, Montana, Oregon, Colorado, North Dakota and Minnesota. In addition, he conducts the annual AASCIF CEO and Executive Compensation survey. Neville has spoken numerous times at AASCIF Conferences, including the HR Symposium, the IT Symposium, National Issues and the Annual National Conference. Neville is a native of New Zealand and holds a degree in Business Administration from the Victoria University of Wellington, New Zealand. Paul D. Larimore Paul Larimore is Director of Legal Services for Missouri Employers Mutual Insurance. In this role, Larimore is responsible for general corporate legal work, including providing legal guidance on corporate issues. He also manages MEM’s captive law firm, Larimore, Brown & Strobing, and represents MEM and policyholders on workers compensation litigation.

Before coming to MEM in 2002 as Managing Attorney, Larimore was a partner since 1996 at Evans & Dixon, L.L.C. in St. Louis, where he also served as associate since 1987. Larimore earned his bachelor’s degree in English from the University of Missouri-Columbia in 1984 and his law degree from St. Louis University School of Law in 1987.

Licensed to practice law in Missouri and Illinois, Larimore is a member of the Association of Corporate Counsel, Missouri Bar Association and Bar Association of Metropolitan St. Louis.

Dr. Gideon Letz Dr. Gideon Letz obtained his M.D. degree from UCSF in 1976 and is Board Certified in Occupational Medicine. He has an MPH degree in environmental health from UC Berkeley and has post-graduate training in Emergency Medicine, Clinical Pharmacology and Toxicology. From 1980 - 1987, he was a Public Health Medical Officer with the California Department of Health Services and since 1987 has been Medical Director at the State Compensation Insurance Fund. He is an Assistant Clinical Professor in the Department of Medicine at UCSF and is a part-time physician with Kaiser Permanente, Occupational Medicine in San Francisco. Dr. Letz’s current research interests include risk factors for delayed recovery after industrial injury and interventions to facilitate successful return to work.

Debra S. Magures As associate vice president, Debby Magures anticipates the needs of Colorado businesses as she oversees our third party administrative services, leads three multidisciplinary business teams and manages our professional employer organization services. Magures also oversees Pinnacol’s’ loss prevention department. Passionate about superior customer service, she works tirelessly to establish long-term business relationships. She joined Pinnacol Assurance in 1993 and has worked as a field auditor, claims representative, claims specialist, and business director. Prior to Pinnacol, she worked at the California State Compensation Insurance Fund. Magures has a Bachelor of Science in business administration from University of Montana. She is a past board member of Professionals in Workers’ Compensation and Colorado Workers’ Compensation Claims Conference. She is also chairperson of Pinnacol in Action, the employee volunteer program. Mary Barrow Nichols Mary Barrow Nichols is the Senior Vice President/General Counsel for the Texas Mutual Insurance Company. The Company is the largest writer of workers' compensation insurance in Texas. As General Counsel, Ms. Nichols manages three separate departments (Legal, Special Investigations, and Subrogation); she supervises six in-house lawyers, approximately 30 non-attorney staff, and a variety of outside counsel working in such areas as litigation, employment law, administrative law, insurance law, extracontractual matters, appeals, taxation and civil and criminal fraud prosecutions. As a member of senior management, she reports to the President and participates in the Company’s Executive Council, which is responsible for the overall management of and strategic planning for the Company. Ms. Nichols has held her position with the Company since September 1995. Before becoming the Company’s General Counsel, Ms. Nichols practiced law for ten years with the Austin office of Vinson & Elkins, LLP, first as an associate and then as Of Counsel. She began her practice at V&E as a public finance attorney, then moved into litigation with an emphasis on insurance-related matters. While in private practice, she was a frequent speaker on workers' compensation insurance and related labor topics. More recently, Ms. Nichols has been a speaker at various national conferences on the topic of law department management. Ms. Nichols received her B.A. and M.A. in English at the University of Texas, where she also was awarded a J.D. with honors in 1985. She is a member of the State Bar of Texas and the Travis County Bar Association and is admitted to practice in the Western District of Texas. She is AV rated.

Daniel F. O’Neil Daniel O’Neil joined Pinnacol Assurance in 2006 as general counsel. Later that year, he was named Vice President of the strategic operations group. His responsibilities include oversight of the company’s quality improvement programs, its statewide network of health care providers (SelectNet), and its fraud investigation unit. He also oversees Pinnacol’s legal, medical payment, and performance improvement teams, and he plays an active role in the company ’s efforts in the legislative and regulatory arenas. Prior to joining Pinnacol, O’Neil was a litigation attorney with Zurich North America, handling workers’ compensation and general defense litigation. Before that, he worked as a plaintiff’s attorney handling workers’ compensation claims, as well as a business attorney for small companies. O’Neil is a member of the American Bar Association, the Colorado Bar Association, and the Denver Bar Association. He has a bachelor’s degree from Miami University in Oxford, Ohio, with a double major in economics and history. He earned his law degree at Capital University Law School in Columbus, Ohio, and also holds a master’s degree in business administration from the University of Colorado at Denver. Married and the father of three children, O’Neil enjoys reading, running, skiing, and golfing, as well as coaching his sons’ soccer teams. He and his family live in Evergreen, Colo. Joseph Paduda Joseph Paduda is a nationally recognized expert on insurance and managed care issues with a specialty in workers’ compensation. His expertise covers analyzing cost drivers in health care, recommending solutions to reduce overall costs, pinpointing problems in traditional managed care, and recommending solutions. Paduda consults with managed care organizations, self-insured employers, workers’ compensation organizations, group health networks, and software and systems companies and stays up-to-date on real-world issues facing the industry. He is an excellent source, able to sort through the hype and identify the important issues in health care. Paduda also frequently speaks at industry conferences and writes articles for such publications as Risk and Insurance, National Underwriter, Business Insurance, The Journal of Workers’ Compensation and Compensation & Benefits Review. Prior to becoming a consultant, Mr. Paduda was responsible for marketing, sales, and account management for MetraComp, a United HealthCare Company specializing in the application of managed care techniques to the group disability and workers’ compensation industry. Previous positions include vice president, product development at the Travelers Health Company; managed care product development at Liberty Mutual; sales at Liberty Mutual, and marketing director for American International Healthcare, the managed care subsidiary of American International Group.

Pat Quintana Pat Quintana is the Government Relations Officer for the California State Compensation Insurance Fund. She has been with State Fund since 1983. Pat has taught workers’ compensation classes for the Insurance Education Association and has served on various boards and commissions in the area of Public Safety. She holds a Bachelor’s degree in Political Science from California State University, Pomona; a Masters degree in Public Administration from California State University, Fullerton and a specialization in Risk Management from the University of California at Riverside. Paul S. Rogers A founding member of the Tetris Group, Mr. Rogers entered the lobbying business in 1989. He is the pre-eminent legislative lobbyist in Utah. Rogers has represented the “Who’s Who” in Utah business for the last 21 years and is listed year after year as Utah’s most effective lobbyist. During the past two decades, Rogers has been influential in the outcome of numerous major public policy issues in the state of Utah. For 10 years, Mr. Rogers served in the Utah State Legislature as a Representative and Senator from Orem. There he served as chair of the Senate Rules Committee and sat on several other committees. His integrity, knowledge of the issues and hard work are legendary among Utah legislators. While the faces in the legislature change, administrations come and go, and different departments have turnover in personnel, Mr. Rogers has continued his effective representation throughout the years.

Mr. Rogers served three terms as a member of Utah’s Board of Regents governing the system of higher of education. Cecil A. Rudd Cecil Rudd is the Director of Claims for New Mexico Mutual. New Mexico Mutual is the largest writer of voluntary workers’ compensation insurance in the state with writings in excess of $75MM through 2005. In addition, New Mexico Mutual administers claims for one half of the Assigned Risk Pool for the state. Originally from Indiana, Mr. Rudd has worked in the insurance industry for over 31 years and holds a professional designation of Certified Workers’ Compensation Professional from Michigan State University. Beginning as a claims trainee at Farm Bureau Insurance in Indiana, Mr. Rudd enjoyed growing as a claim professional while employed by regional and national insurers throughout the Midwest. He held positions as diverse as Field Supervisor, Claims Manager, Regional Claims Manager, Director and Chief Operating Officer for these employers. Cecil has been a guest speaker at regional and national conferences throughout the country and has become established as an expert in claims management practices. In his current position as Director of Claims, Mr. Rudd oversees the daily operation of a claims department comprised of 37 claims and bill review professionals.

Jose Ruiz Jose Ruiz is the Claims Operations Manager at the California State Compensation Insurance Fund. Jose oversees the functions of the general claims operations and the legislative and regulatory analysis staff who are the centralized source of claims expertise in the development and implementation of corporate claims policies, guidelines, and procedures.

From 2004-2005, Jose was the Medical Reimbursement Manager at State Fund. He directed the adoption of mandated medical fee schedules and managed a dedicated team of bill review experts.

Jose is currently a member of the California Workers' Compensation Institute's Medical Care Committee and chairs this year’s AASCIF Claims/Rehabilitation Committee. Jose has an Economics degree from the University of California, Berkeley. Dan G. Smith Dan Smith is originally from Malden, Massachusetts. In 1984 he moved to Maine to attend universities and military training. From 1990 to 2000 Dan attended Airborne Parachute School and served as Battalion Construction Officer for the Maine Army National Guard 133rd Engineers. Dan’s insurance career started in the Maine workers’ compensation industry in 1992 at Hanover Insurance. He joined Maine Employers Mutual Insurance Company (MEMIC) in 1994 and has been the Director of Claim Operations since 2002. Dan is active in MEMIC’s United Way campaign, a volunteer for the Friends of Scouting program and a campaign manager for the Strike Out Cancer in Kids program. He is former President of the Maine Claims Management Council and current President of the Casco Bay Sunrise Rotary where he was recognized as Rotarian of the year in 2004. Dan is a member of the Maine Children’s Cancer Program Board of Directors and is actively mentoring a Westbrook High School sophomore. Dan and his wife Andrea enjoy working on home improvement projects and raising their 3 year old son Bennett and 2 year old daughter Caroline in Falmouth, Maine. Dan's other interests include ducks unlimited events, jogging, trading on the NYSE, chess matches and music from the 1940’s. Lane is married to the former Marilyn Segerstedt, and they are the parents of six children, and have eleven and one-half grandchildren. Lane A. Summerhays Lane A. Summerhays joined Workers Compensation Fund in 1992 as President, Chief Executive Officer, and Director. Prior to joining WCF, he was Senior Vice President and Chief Financial Officer at ALTA Health Strategies, Inc. A Certified Public Accountant, Lane has also worked in public accounting with two national accounting firms, Deloitte Haskins & Sells, and Arthur Andersen. He is active in the community, currently serving on the Board of Directors for several organizations. Lane was honored as “Father of the Year” by American Diabetes Association’s Father’s Day Council in 2005, and “Outstanding CPA in Business and Management” for 2005 by the Utah Association of Certified Public Accountants. WCF was recently honored as one of “Utah’s Most Admired Companies”. Lane is married to the former Marilyn Segerstedt, and they are the parents of six children, and have eleven and one-half grandchildren. Hobbies include fly-fishing, tennis, horses, boating, and golf. Jeff Tetrick, Chief Financial Officer Jeff Tetrick came to Pinnacol Assurance in 1989 as chief financial officer after amassing 17 years of experience in accounting and financial operations in the insurance industry. His responsibilities at Pinnacol include overseeing financial reporting, business planning, audits, investments, and actuarial functions. Tetrick began his career in the Minneapolis office of Ernst & Young, a public accounting firm with client focus on life insurance, and then spent four years as vice president of group operations for Capitol Life Insurance in Denver. He followed that with four years as senior vice president at Preferred Benefit Services, an administrator of group employee benefits in Denver. For three years immediately preceding his employment at Pinnacol, Tetrick was controller at Denver’s Health Care United, an IPA model nonprofit health maintenance organization. Tetrick received his MBA from the University of Denver and is a certified public accountant. His bachelor’s degree is in accounting from Southwest Minnesota State University. He earned the ACCREDITED INVESTMENT FIDUCIARY™ (or AIF®) professional designation, awarded by the Center for Fiduciary Studies, which is associated with the University of Pittsburgh. He serves on the board of directors for the Colorado Business Committee for the Arts, Lowry Foundation, and the Pinnacol Foundation. Richard J. Tingley, Q.C. Richard Tingley is the Corporate Secretary and General Counsel for the Workplace Health, Safety and Compensation Commission of New Brunswick. He has been General Counsel for the past 15 years. Mr. Tingley was admitted to the New Brunswick Law Society in 1967 and was appointed a Queen’s Counsel in 1984. He practiced law between 1967 and 1992 in Campbellton, specializing in insurance defence litigation. He has appeared before all the levels of Courts in New Brunswick and the Supreme Court of Canada. Mr. Tingley is a member of the Law Society of New Brunswick; The Canadian Bar Association, the Canadian Association of Workers Compensation Lawyers and is a member of the Law Committee of the American Association of State Compensation Insurance Funds. He is a former Mayor of the City of Campbellton; past Chair of the New Brunswick Sports Hall of Fame and a Paul Harris Fellow of Rotary. Mr. Tingley has lectured at the University of New Brunswick Law School and to various regional Law Societies on Workers Compensation matters. Laura Tobler Laura Tobler is a nationally recognized expert on state health care policy issues. Currently, Laura serves as a Program Director in the Health Program at the National Conference of State Legislatures (NCSL). She has been with NCSL since 1997 and serves as the lead staff person on health reform, access to health care and the health care safety net issues. Laura has authored many papers, articles, books, and issue briefs on a variety of health topics. She received her Bachelor of Science in Nutrition and Biochemistry from Pennsylvania State University and her Masters of Public Policy from Rutgers University. Mark Wentworth Mark Wentworth is a Corporate Discovery Specialist at LexisNexis® Applied Discovery® for the Western United States. Mr. Wentworth consults with corporate legal departments to navigate the entire electronic discovery process; from Consulting, Data Gathering, Media Restoration, Data Processing, Online Review and Document Production. His clients include many Fortune 500 corporations. Prior to joining Applied Discovery, Mr. Wentworth was a Senior Account Executive with IKON Office Solutions, working with AMLAW law firms and Fortune 500 corporations in Southern California. Mr. Wentworth then joined Syngence LLC, a litigation technologies company as their West Coast Regional Manager and then their Channel Sales Manager. At Syngence, Mr. Wentworth consulted with law firms and corporate legal departments to assist them in streamlining their document review processes and to reduce discovery costs. Mr. Wentworth is a frequent speaker on the topic of electronic discovery. He received his B.B.A. in Finance from Loyola Marymount University in Los Angeles, and his M.B.A. in International Business and Marketing from Loyola Marymount University.
