The documents provided by King havebeen filed in the evidence section of the case file. Copies of those documents areattached hereto and a summary follows:(1 )Coles. Red Carpet Club documentation for the membership for Mayor Brent

    (2) Letter to Jonathan Howe from John Anderson, dated 6/8/00. Andersonunsuccessfully attempted to obtain Mayor Coles as a speaker in Santiago de Chile on11/06 to 11/09/00. Anderson advised during the interview by Buie that Coles wantedthis trip because he (Coles) had served a mission in Santiago de Chile and wanted toreturn for personal reasons.(3) Grant C. Let me know if you need anymore or not.Expenditures From $5,000 To $25,000These require informal, written bids and issuance of a Purchase Order with bid summary sheet, letterbids, and other bid documentation attached to the order form. The contemplated cost is defined astheestimated full acquisition cost including all purchases for the time period reasonably associated with thepurchase.Follow procedures described in the instructions for Expenditures from $1.500 to $5.000. except thatspecifications for these purchases must be in writing, and written bids are required. If specialcircumstances exist which, in the Department's opinion, preclude receiving written bids, the Departmentmay request that the Purchasing Agent authorize solicitation of telephone bids. Coordination withTechnical Advisors is required as outlined below for "Expenditures over $25,000."Projects under $10,000Work under $10,000 is not considered to be "Public Works" as defined by Idaho Code (54-1903). Whilewe are not required to comply with the Public Works laws for work under $10,000, the code DOES NOTprovide a means to award the work if the low bid comes in over the $10,000 threshold. For example, ifyour estimate for a project is under $10,000, and the actual bids are all over $10,000, you must follow therulesas they apply to over $10,000 transactions, even though you may not have included thoserequirements in your bid specifications. If you solicit bids from contractors that do not have a public workslicense, and the bids come in over $10,000, you cannot award the bid. The best solution is to obtain bidsfrom only contractors that have the appropriate Public Works License, but there are times when thatstandard is difficult to follow.There are no requirements that you obtain performance or payment bonds for these projects, but you maychoose to as common sense dictates. You should require, at a minimum, a letter contract, that describesthe work, the terms and conditions, and the insurance and indemnification requirements. All constructioncontractors should provide proof of general liability insurance, and workers compensation insurance (seepage 6 of this memorandum). The City Risk Manager has compiled a users manual for determininginsurance and indemnification requirements. Please contact the Risk Manager for a copy (394-3784).There are no other "public works" requirements for work under $10,000.

    10. Projects from $10,000 to $25,000State licensing laws, contractor and subcontractor naming laws, the bona fide Idaho residence law,performance and payment requirements, win all apply to construction projects in excess of $10,000 thatare bid by the departments.Purchasing has developed a revised informal construction" bid document. If you use this document for allyour informal construction work, you will comply with the laws and requirements without the need tointerpret the code and become an expert. That document has been sent to all the project managers wewere able to identify; please let us know if you did not receive a copy. We will send out additional copiesupon request. The document is available electronically, in WP.For your use, The following are State Code requirements for Public Works construction:Sec. 44-1001. Employment ofresidents of Idaho (requires that Idaho residents be employed on projects

Terms of employment and wage contracts

    . In all contracts hereafter let for state, county, municipal, and school construction, repair, and maintenancework under any of the laws of this state there shall be inserted in each of said contracts a provision bywhich the contractor must employ ninety-five percent (95%) bona fide Idaho residents as employees onany job under any such contract except where under such contracts fifty (50) or less persons areemployed the contractor may employ ten percent (10%) nonresidents, provided, however, in all casesemployers must give preference to the employment of bona fide residents in the performance of saidwork, and no contract shall be let to any person, firm, association, or corporation refusing to execute anagreement with the above mentioned provisions in it; provided, that, in contracts involving the expenditureof federal aid funds this act shall not be enforced in such a manner as to conflict with or be contrary to thefederal statutes prescribing a labor preference to honorably discharged soldiers, sai lors, and marines,prohibiting as unlawful any other preference or discrimination among citizens of the United States.Sec. 54-1218. Public work (requires that a licensed engineer or architect prepare the plans and specs forwork over $10,000)It shall be unlawful for this state, or for any county, city, school district, irrigation district, drainage district,highway district, or other subdivision of the state, having power to levy taxes or assessments againstproperty situated therein, to engage in the construction of any public work when the public health or safetyis involved unless the plans and specmcanons and estimates nave been prepared by, and the constructionreviewed by a registered professional engineer. DefinitionsFor the interpretation of this act, unless the context indicates a different meaning:

    a. "Person" includes any individual, f irm, copartnership, corporation, association or otherorqanlzation, or any combination thereof acting as a unit.

    b. "Public works contractor," which term is synonymous with the term "builder," "sub-contractor"and "specialty contractor: and in this act referred to as "contractor" or "licensee," includes any personwho, in any capacity, undertakes, or offers to undertake, or purports to have the capacity to undertake anyconstruction, repair or reconstruction of any public work, or submits a proposal to, or enters into a contractwith. the state of Idaho, or any county, city, town, village, school district, irrigation district, drainage district,sewer district, fire district, or any othertaxlnq subdivision or district of any public or quasi-publiccorporation of the state, or with any agency of any thereof, or with any other public board, body,commission, department or agency, or officer or representative thereof, authorized to let or awardcontracts for the construction, repair or reconstruction of any public work .

    c. "Public works construction" includes any or all of the following branches:

    (1) Heavy construction, which is defined as constructing substantially in itsentirety any fixed works and structures (not Including "building construction"), without limitation, for any orall of the following divisions of subjects: irrigation, drainage, sanitation, sewerage, water power, watersupply, reservoirs, flood control, reclamation, inland waterways, railroads, grade separations, subways,track elevation, elevated highways, hydro-electric developments. aqueducts. transmission lines. duct lines.pipelines, locks, dams, dykes, levees, revetments, channels, channel cutoffs, intakes, drainage,excavation and disposal of earth and rocks, foundations, piers, abutments, retaining wails, viaducts,shafts, tunnels, airports, air bases and airways, and other facilities incidental to the same;

    (2) Highway construction, which is defined as all work included in highwayconstruction contracts, including, without limitation, highways, roads, streets, bridges, tunnels, sewer andstreet grading, street paving, curb setting, surfacing and other facilities incidental to any of the same;

    (3) Building construction, which is defined as all work in connection with any structure. now built, being built, or hereafter built , for the support, shelter and inclosure of persons, chattels, personaland movable property of any kind, requiring in its construction the use of more than two (2) unrelatedbuilding trades or crafts.

    (4) Specialty construction, which is defined as any work in connection withany public works construction, requiring special skill and the use of specially skilled trades or crafts. (Forexample, landscaping, irrigat ion system instal lation, paving, etc. There are over 509 different categories.)IF you are not sure whether a trade is governed by the licensing laws, please call Purchasing forassistance.

    d. "Federal aid funds" mean a direct grant in aid, matching funds, or loan from an agency of thefederal government and designated for a specific public works project. Revenue sharing funds, federalimpact funds, timber stumpage fees, and similar indirect allowances and subsidies not designated for aspecific public works project shall not be regarded as "federal aid funds" within the meaning of thissection.

    e. "Bid" or "bidder" means any proposal submitted by a public works contractor to a public entityin competitive bidding for the construct ion, alterat ion, repair or improvement of any public worksconstruction.Sec. 54-1902. Unlawful to Engage in Public Works Contracting without license (requires the appropriatelicense for work over $10,000. and that the general contractor perform at least 20% of the work)It shall be unlawful for any person to engage in the business or act in the capacity of a public workscontractor within this state without first obtaining and having a license therefor, as herein provided, unlesssuch person is particularly exempted as provided in this act, or for any public works contractor tosubcontract in excess of eighty per cent.(80%) of the work under any contract to be performed by him assuch public works contractor according to the contract prices therein set forth, unless otherwise providedin the specifications of such contracts. Nor shall a public works contractor accept a bid from any personwho at that time does not possess the appropriate license for the project involved. Nor shall a publicworks contractor accept bids to sublet any part of any contract for specialty construction from a specialtycontractor who at that time does not possess the appropriate license in accordance with this act;provided, however, that no contractor shall be required to have a license under this act in order to submita bid or proposal for contracts for public works financed in whole or in part by federal aid funds, but at orprior to the award and execution of any such contract by the state of Idaho, or any other contractioqauthority mentioned in this act, the successful bidder shall secure a license as provided in this act.Sec. 54-1926. Performance and payment bonds required of contractors for public buildings and publicworks of the state, political subdivisions and other public instrumentalities - Requirements for bonds -Govemmental obligations (requires performance -and payment bonds for work over $10,000; in an amountequaling 100% of the value of the project)

    Before any contract for the construction, alteration, or repair of any public building or public work orimprovement of the state of Idaho, or of any county, city, town, municipal corporation, townShip, schooldistr ict, public educational institut ion, or other political subdivision, public authority, or publicinstrumentality, or of any officer, board, commission, institution, or agency of the foregoing, is awarded toany person, he sha11umish to the state of Idaho, or to such county, city, town, municipal corporation,township, school district, public educational institution, or other political subdivision, public authority, orpublic instrumentality, or to such officer, board, commission, institution, or agency thereof, bonds whichshall become binding upon the award of the contract to such person, who is hereinafter designated as"contractor";

    1. A performance bond in any amount to be fixed by the contracting body, but in no eventless than fifty per cent (50%) of the contract amount conditioned upon the faithful performance of thecontract in accordance with the plans, specifications and conditions thereof. Said bond shall be solely forthe protection of the public body awarding the contract. (On most formal bid projects, the City normally. requires a performance bond in the amount of 100% of the contract. For informal bids, you may elect torequire only the 50% amount)

    2. A payment bond in an amount to be fIXed by the contracting body but in no event lessthan fifty per cent (50"10) of the contract amount, solely (or the protection of persons supplying labor ormaterials, or renting, leasing, or otherwise supplying equipment to the contractor or his subcontractors inthe prosecution of the work provided for in such contract. (On most formal bid projects, the City normallyrequires a payment bond in the amount of 100% of the contract. For informal bids, you may elect torequire only the 50% amount)

    3. Public bodies requiring a performance bond or payment bond in excess of fifty per cent(50%) of the total contract amount shall not be authorized to withhold from the contractor or subcontractorany amount exceeding five per cent (5%) of the total amount payable as retainage. Further, the publicbody shall release to the contractor any retainage for those portions of the project accepted by thecontracting public body and the contractors as complete within thirty (30) days after such acceptance.Contractors, contracting with SUbcontractors pursuant to contract work with a public body, shall not beauthorized to withhold from the subcontractor any amount exceeding five per cent (5%) of the total amountpayable to the subcontractor as retainage. The contractor shall remil the retain age to the subcontractorwithin thir ty (30) days after completion of the subcontract.

    Each bond s ha ll b e executed by a surety company or companies duly authorized to dobusiness in this state, or the contractor may deposit any of the type of government obligations listed insubsectlon (h) of section 54-1901, Idaho Code, in lieu of furnishing e surety company performance orpayment bond or bonds. In the case of contracts of the state or a department, board, commission,institution, or agency thereof the aforesaid bonds shall be payable to the state, or particular state agencywhere authorized. In case of all other contracts subject to this act, the bonds shall be payable to thepublic body concerned.

    Said bonds shall be filed in the office of the department, board, commission, institution,agency or other contracting body awardlng the contract.Nothing in this section shall be construed to limit the authority of the state of Idaho or

    other public body herein-above mentioned to require a performance bond or other security in addition tothese, or in cases other than the cases specified in this act.

    It shall be illegal for the invitation for bids, or any person acting or purporting to act, onbehalf of the contracting body to require that such bonds tie furnished by a particular surety company, orthrough a particular agent or broker.67~2309.Written plans and specifications for work to be made by officials - Availability. and Design BuildauthorityAll officers of the state of Idaho, the separate counties, cities, towns, villages or school districts within the

    state of Idaho, all boards or trustees thereof or other persons required by the statutes of the state of Idahoto advertise for bids on contracts for the construction, repair or improvement of public works, publicbuildings, public places or other work, shall make written plans and specifications of such work to beperformed or materials furnished, and such plans and specifications shall be available for all interestedand prospective bidders therefor, providing that such bidders may be required to make a reasonabledeposit upon obtaining a copyof such plans and specifications; all plans and specifications for saidcontracts or materials shall state, among other things pertinent to the work to be performed or materialsfurnished, the number, size, kind and quality of materials and service required for such contract, and suchplans and specifications shall not speclfy or provide tile use of any artlcles of a specific brand or mark, orany patented apparatus or appliances when other materials are available for such purpose and when suchrequirements would prevent competitive bidding on the part of dealers or contractors in other articles ormaterials of equivalent value, utility or merit. The design-build method of construction may be employedby public officials in contracts for the construction, repair, or improvement of public works, public buildings,public places or other work. For purposes of this section, a design-build contract is a contract between apublic entity and a non-governmental party in which the non-governmental party contracting with the publicentity agrees to ootn Clesign and build a structure, roadway or other item specified in the contract. In anyaction which shalt arise under this section, the court may assess a civil penalty not to exceed five hundreddollars ($500) to be paid by the public entity.Sec. 67M 231D. Subcontractors to be Listed on Bid of General Contractor: (requires that the "big three"subs be listed, HVAC, Electrical, and Plumbing)Hereafter, before the state of Idaho, the separate counties, cities, towns, villages or school districts withinthe state of Idaho shalf let contracts for the construction, alteration or repair of any and all buildings,improvements or public works, and such construction. alteration or repair requires plumbing, heating andair-conditioning work, or electrical work, the general contractor shall be required to include in his bid thename, or names and address, or addresses, of thc subcontractors who shall, in the event the contractorsecures the contract, subcontract the plumbing, heating and air-conditioning work, and electrical workunder the general contract; provided, however, that this act shall not apply to the construction, alterationor repair of public buildings under the jurisdiction of the board of regents of the University of Idaho; furtherthat this act shall have no application to the preparation and submission of plans and specificationspursuant to section 50-1105 [50-316], Idaho Code.Failure to name subcontractors as required by this section shall render any bid submitted by a generalcontractor unresponsive and void. Subcontractors named in accordance with the provisions of this sectionmust possess an appropriate license or certificate of competency issued by the state of Idaho covering thecontractor work classification in which the subcontractor is named.Sec. 67-2348. Preference for Idaho domiciled contractors on public works.To the extent permitted by federal laws ana regulations, whenever the state of Idaho, or any department,division, bureau or agency thereof, or any city, county, school district, irrigat ion district, drainage district ,sewer district, highway district, good road district, fire district, flood district, or other public body, shall letfor bid any contract to a contractor for any public works, the contractor domiciled outside the boundaries ofIdaho shall be required, in order to be successful, to submit a bid the same percent less than the lowestbid submitted by a responsible contractor domiciled in Idaho as would be required for such an Idahodomiciled contractor to succeed over the bidding contractor domiciled outside Idaho on a like contractbeing let in his domiciliary state.
