BEFORE ME, the undersigned authority personally appeared Stephanie Stanley, known

to me to be the person whose name is subscribed hereto, and who, after being first duly sworn,

stated as follows:

1. "I live at 5505 GastonAvenue, Dallas, Texas 752l4.Ihave lived atthis address

since 2000. My mother, Mable Stanley, has owned this home since April 2000.

My mother is 91 years old. I am her power of attomey.

2. I live behind the Aldredge House, 5500 Swiss Avenue.

3. The use of the Aldredge House as a venue for for-profit private parties and

weddings has an adverse effect on my property for the reasons articulated in

Barbara McDaniel's Application to the Board of Adjustment to Set a Compliance

Date for the Nonconforming Use.

4. I should live on a quiet, residential street; instead, I feel as though I am living

behind a nightclub.

5. Thêre are dozens of weddings and parties each year atthe Aldredge House, most

of which occur late in the evenings. There are multiple parties and weddings in a

weekend, and sometimes there are multiple parties and weddings on the same day.

My mother has been driven from her home and now lives in a secondary

residence because of the excessive noise at the Aldredge House and the traffic

that the very large parties create.

The parties have a large number of guests, and the guests' cars are parked up and

down Swiss Avenue, Parkmont, and Bryan Street. In addition, the cars are parked

on both sides of Parkmont Street, making access for emergency service trucks

impossible.

Cars frequently use my driveway to turn around to return to the Aldredge House's

circle drive on Parkmont.

The noise from the parties bothers me and has woken me up on numerous

occasions. There are numerous delivery trusts that go up and down Parkmont

before, after, and during an event. These trueks are very loud and idle frequently.

When tents are used for events at the Aldredge House, the noise of putting up the

tent and taking down the tent bothers me. The tents are taken down either late.in

the night after an event or very early the next morning. The banging and clanging

that tear down of one of these large tents creates is very noisy and has woken me

up on mrmerous occasions.

The Aldredge House only has two bathrooms inside. Some of the parties are

attended by over 200 guests. On numerous occasions, party attendees have

urinated near my back fence.

The alley behind my house is frequently the area where the musicians take smoke

breaks. Their conversations create noise that disturbs me. Additionally, they leave

their cigarette butts and other trash in the alley for me to have to pick up later.

13. Because no one lives in the Aldredge House, any normal homeowner issue takes

longer to identifii, address, and resolve.

14. I am familiar with my mother's signature. My mother's name was forged on an

application for a Tent Permit that was submitted to the City of Dallas on Aprll23,

2013. See Exhibit l, p.3, No. 12.

15. My mother's name was forged on an application for a Tent Permit that was

submitted to the City of Dallas on October 3,2013. S¿e Exhibit2,p.3, No. 6.

16. The exact signature described in the above-numbered paragraph was cut and

pasted onto a Tent Permit application submitted to the City of Dallas on April 28,

2014. Se¿ Exhibit 3, p. 5, No. 6. The eleven signatures on the April 28, 2014,

application are aî exact replica of the eleven signatures on the October 3,2013,

application, with the exception that the date next to the.neighbors' signatures

signed has been whited out. Compare Exhibit 3, p. 5, No. 6, with Exhibit 2, p. 3,

No.6.

17. In a Tent Permit application submiued to the City of Dallas on January 14,2015,

my mother's signature was forged. See Exhibit4,p.6, No. 12.In addition, the

address listed next to my mother's forged signature is 5507 Gaston, which is not

our address. 1d

18. Moreover, the exact signature described in the above-numbered paragraph was

cut and pasted onto a Tent Permit application submitted to the City of Dallas on

April 8, 2015. ,See Exhibit 5, p. 9, No. 9. A close inspection of this signature and

the handwriting for *5507 Gaston Ave" shows that it is an exact replica of the

signature listed on the January 14,2015 application. Compare Exhibit 4, p. 6, No.

have lived at this address since December 1998.

2. The Aldredge House, 5500 Swiss Avenue, is across the street from me.

3. The use of the Aldredge House as a venue for for-profit private parties and

weddings has an adverse effect on my property for the reasons articulated in

Barbara McDaniel's Application to the Board of Adjustment to Set a Compliance

Date for the Nonconforming Use.

4. I should live on a quiet, residential street in the middle of the Swiss Avenue

Historic District; instead, I feel as though I am living across the street from a

nightclub.

5. There are dozens of weddings and parties each yeu at the Aldredge House, most

of which occur late in the evenings. There are multiple parties and weddings in a

weekend, and sometimes there are multiple parties and weddings on the same day.

6. The parties have a large number of guests, and the guests' cars are parked up and

down Swiss Avenue, Parkmont, and Bryan Sheet. They frequently park in front

The noise from the parties bothers me. The parties frequently have very late

"send-ofß," where party goers gather outside to shout, cheer, and honk horns for

the departing bride and groom. The noise from the send-offs bothers me. After the

send-offs, party attendees loudly go to their cars, some of which are parked in

front of my house.

Even when the events at the Aldredge House have valet parking, the valet

attendants park cars along Bryan Street. They park cars around Savage Park,

which is across the street from my house, prior to parking in the Gaston street lot.

Beginnipg as a gift to a bride in the earþ 1900's, the history of Aldredge flouse has

been that of a true love story. Construction of the house began in 1915 whenprominent rancher/banker, William J. Lewis, secured architect Hal Thomas to builda Southern mansion for William's 2O-year-old bride, Willie Newbury Lewis, one ofDallas' first debutantes.

Today, that tradition of romance continues as brides from all over the country make

Aldredge flouse a"paftof their own pefsonal history. From summef morningweddings on the tenace to spring and fall ceremonies in the garden to the sparkle ofa holiday celebration, this Grand Dame of Swiss Avenue provides a lovely setting forweddings and receptions throughout the year.

Our Gift for the new Mr.& Mrs.

,4. gift basket of late night nibbles & libations including wedding cake & groom'scake for two, a bottle of champagne, & botded water will be ready for you to takewith you to share following your reception.

Removing any reception food or beverage is not permissible. Food prepared priorto a reception and displayed on a buffet for two hours or more presents a healthhazard if proper temperature for storage or consumption is not maintained.

Rental Items Our Catering Director will be huppy to assist with arrangements for specialty linenand rentals for your event.

Rental Rates Please consult with your Catering Director regarding rental rates as t^tesvarydepending on day of the week and time of day. Rental rates are based on a fourhour event-time. In addition to the event time, three hours resen'ed for set-up andt hour for vendor break-down are included and complimeî:.:qc, Extra event andset-up hours beyond those outlined here may be purchased. Please contact yourCatering Director for fruther pdcing and information.

Deposits Once you have decided you will host your event at Aldredge House; the CateringDirector will prepare a catenng contract for you. A deposit of 30o/o of the estimatedfood and beverage charges is required and due with the sþed contract to secure

your catering with Food Glorious Food. In addition, a sþed House rentalagreemeflt and firll rental payment is due to secure your wedding date at theAldredge House.

Service Fee 20o/o service charge is additional to all food and beveraç. Occasionally extra staffingcharges may be necessary 1f ¡J;Le 20o/o service charge does not cover all labor neededfor your event. Please consult the Catering Dircctor should you have any questionsregarding staffing.

8.25% Sales tax will be added to your food, beverage, service charge and rentals.

Valet Parking Valet parking is required, at an additional fee, for all events with more than 40guests. One (1) valet parker is required for every fifteen (15) vehicles anticþated.Valet parkers are $26.00 per hour for each valet, and a four hour minimum isrequired. Valet services will be arranged through Food Glorious Food.

One (1) security guard is required per 100 guests. Security is $40.00 perhour, and a four hour minimum is required. Valet services will be arrangedthrough Food Glorious Food.

Attendant Fee Each Chef attendant is $150.00. ,{t least one chef attendant is required perbuffet andf or station. Please consult your Catering Director for an

estimate.

Bartender Fee Each Bartender is $155.00.

Ceremony Fee The Aldredge House and Gardens are available for wedding ceremorues.There is a $500.00 ceremony fee for all ceremonies. The fee includesrehearsal time, assistance with your wedding ceremony planning, setting upand breaking down of the ceremony site. This fee is in addition to the rentalcost of the house.

Rehearsals Wedding rehearsals are scheduled for a one-hour period between thehours of 3:30pm and 5:00pm, and are scheduled at the convenience ofthe Flouse. Please consult with your Director of Catering when schedulingyour wedding rçhearsal.

Floral Decor All floral and décor must arrive at the house fully assembled. Floralassembly on site is strictly prohibited.

Cake Vendor Frosted Art Bakery is the PREFERRED bakery of the Aldredge House,and you save a $4.00 per slice cake-cutting fee by selecting their deliciousservices! You may select another bakery for your wedding cake(s),

however, a $4 per slice cake cutting fee will be required.

Bridal Portraits The house rental fee for bridal portraits is waived for brides hosting theirceremony at,{.ldtedge House. Aldredge House brides choosing to havetheir bridal portrait photo shoots at Aldredge House must schedule themMonday- Thursday between the hours of 9:30am-5:00pm and must pay a

$100 staffing fee.

SPECIAL CONDITIONS

lf the tent is to be erected in or adjacent ro aresidentially zoned district, an approvingpetition must be submitted on a formprovided by Building lnspection. lt must alsobe signed by all propert), owners within 100feet of the site, including streets and alleys,measured from the properq/ lines of thepremises on which the tent is to be erected.The petition form can be obtained fromBuilding lnspections'web site (see reverse ofside of this pamphlet).

lf the tent is being used for a special eyent,no permit application is required to be madeto Building Inspection. For more informationabout obtaining a special event permit, callthe Ofüce of Special Events at2l4l939-2701.

lf the tent is to be erected on City parkproperty or in Fair Park, wr¡ttenauthorization must be obtained from thePark and Recreation Department. Call thePark and Recreation DepartmentReservation Office et 21 4-67 0-8890.

A permit is not required for a tent, whicheither:

WHAT IS A MASTER PERMIT?

Building lnspection issues a "master permit"which represent the authorization for all typesof work on e construct¡on project. Erecting atent is normally the only type of work to bedone, but it could be part of a project. lneither case, a master permit is required.

WHAT ARE THE PROCEDURES?

Complete and submit a permit application toBuilding Inspection. The application mustinclude two (2) copies of a site plan, drawn toscale, showing the location of each tent andpermanent improvements on the premises,setbacks from adjacent property lines, guywires and stakes, the number of off-streetparking spaces as required by the DallasDevelopment Code. A floor plan showingseat¡nt arrangements and at least two exits isrequired for each rent 750 sq. ft. or greater inarea.

2. Each tent must be constructed of flame-resistive materials as specifìed in the DallasFire Code. Two copies of the certificate-offlame-resistance must be submitted-

3. Every part of the teng including guy wires andstakes, must be set back a minimum of l0 feetfrom all properry lines and adjacent buildingsand must comply with all building lines andminimum yard areas as required by the DallasDevelopment Code.

3902.f Definitions. The fbllowing terms used in this chapter shall have the meanings indicatedin this section:

PREMISES. A lot or unplatted tract of land that is reflected in the plat books of the buildinginspection division of the city. Refer to Section 51-4.601 or 514-4.601 of the DailalDevelopment Code.

TENT. Any structure, enclosure or shelter conshucted of fabric or other pliable materialsupported by any manner exce,pt by afu or the contents protected by the material.

PERMIT REQUIREMENTS FOR TENTS

3903.1 Offense. A person commits an offense if he or she erects or maintains a tent covered bythis chapter without having a valid tent permit issued by the buílding official.

3903.2 Permit required. A person who desires to erect and maintain a tent shall fïle a writtenapplication for a tent permit with the buildíng fficíal on a form fumished for that purpose.

Exception: A tent permit is not required for a tentthat either:

1. Covers an atea of less than 400 square feet (37.1612 ^'),

including all connectingareas or spaces with a common means of egress or entrance; or

2. Has an occupant load of less than l0 persons; or

3. Is included as part of a special events permit.

3903.3 Applícation. The application shall include all of the following:

1. Three copies of a plan drawn to scale showing the location of each tent and permanent

improvement on the premises, the number of off-street parking spaces as required by the

Dallas Development Code, and adequate details regarding the seating capacity and thelocation of exits in each tent.

2. If the tent is to be erected in or adjacent to a residentially zoned district, an approvedpetition, on a form provided by the building official, signed by all owners of land within100 feet (30,480 mrn), including streets and alleys, measured from the boundary of thepremises on which the tcnt is to be erected.

3. A fee as specified in Section 303 of Chapter 52 of the Dallas Cíty Code.

4. Any additional information required by the building official to ensure the provision ofadequate safeguards for the preservation of public health, peace, comfort and safety.

3903.4 Issuance of permit.

3903.4.1 Maximum duration of pernrit. The buildíng official may issue a tent pennit for a

period not to exceed 30 consecutive days.

Exception: The building fficíal may extend a tent permit for additional 30-day periods

if the tent is located on public property and being used for a demonstrated public purpose

and does not create a threat to the public safety. In no event may a tent petrratt be issuedfor more than a total of nine months within any l2-consecutive-month period. A fee inthe amount of the initial tent permit fee shall be paid for each 30-day period a tent pennitis extended.

2916 I3903.4.2 Limit on permÍts on sâme property within any l2-consecutive-month period, Atent permit may not be issued for the same property more than once in any l2-consecutive-month period.

Exception: More than one tent permit may be issued for the same properry in a !2-consecutive-month period if the total time period for all tent permits issued on thatproperty does not exceed 60 days in any l2-consecutive-month period.

3903.4.3 Multiple tents under one permit. A tent permit may be issued for more than onetent if all tents are on the same property at the same time for the same event or purpose andmeet the provisions of Section 3904.5.

sEcTroN 3904USE CONDITIONS

3904.1 Compliance with other laws. The use and placement of atent and all operations within atent shall comply with all city ordinances and other applicable laws.

3904.2 Privilege. The granting of a tent perrnit is a privilege that may be revoked at any timeupon violation of anyprovision of this chapter.

3904.3 Other permits. Electrical permits, plumbing permits, mechanical permits, foodestablishment permits, alcoholic beverage licenses and all other permits and licenses required bycity ordinance or other law shall be applied for separately in accordance with the applicableordina¡rce or law.

3904.4 Placement Every part of a tent, including guy wires, deadmen, stakes and equipment,shall be set back a minimum of t0 feet (30a8 mm) from all property lines and adjacent buildingsand shali comply with all building lines and minimum yard areas as required by the DøllasDevelopment Code.

Exception: Tents complying with the location provisions of Section 2403,8 of the DallasFíre Code in addition to the requirernents of the Dallas Development Code.

3904.5 Lot coverage. No tent may be ereeted to covqr more than 75 percent of the premlses onwhich it is located.

3904.6 Structural requirements. AII supporting members shall be of sufficient size andstrength to adequately support the tent. The supporting members shall be guyed and braced towithstand a wind pressure of not less than 20 pounds per square foot of the projected area of thetent.

3944.7 Nuisances. Loud speakers or amplifiers, when used, shall not be used so as to create anuisance as described in the city ordinances and other applicable laws.

291 61 1317333904.8 Electricity. All electrical wiring shall comply with the Dallas Electrical Code. Eachpremíses on which a tent ís to be erected shall be provided with a separate, individual electricalservice from the power source.

3904.9 Construction. Each tent shall be constructed of flame-resístive materials as specified inthe Dallas Fit'e Code.

3904.10 Parking. The number of parking spaces for a tent shall be provided in accordance withthe Dallas Development Code.

Exception: A tent that is on the same lot as and is accessory to a main use need not be

provided with additional parking.

SECTION 3905EXITS

3905.1 General requirements. Arrangement of seats, aisles, passageways and exits shall

conform to Chapter 10.

39A5.2 AdditÍonat requirements. Every tent shall be provided with exits meeting all of the

following additional provisions contained in this section.

3905.2.1 Line of travel, The line of travel to an exit shall not be greater than 100 feet (30

480 mm).

3905.2.2 lfeight. The height of doors, aisles or passageways may be no less than 7 feet

(2133.6 mm).

3905.2.3 Obstructions. No stakes, guy wires or guy ropes may obstruct an exit way.

3905,2.4 Exit openings. Exit openings from any tent shall remain open or may be covered bycanvas, provided:

1. The coverings are free-sliding on a proper support, and the support shall not be less

rhan 12 inches (304.8 mm) above the top of the opening;

2. The coverings shall be so arranged that, when open, no part of the coverings obstructthe opening; and

3. The coverings shall be of a color or colors that definitely contrast with the color of the

tent.

3905.2.5 Lighting. Exits, aisles and passageways leading to exits shall be adequately lightedat all times when the structures are occupied. Artificial light shall be provided whenever

natural light is inadequate.

3905.2.6 Exit signs. Signs reading "EXIT" in red letters on a white background or in otherapproved distinguishable colors shall adequately indicate exit doorways. Exit signs shallbe illuminated in tents with occupant loads over 100 persons in the manner specified below:

l. Two separate electrical sources are required for occupant loads over 600.

2. Two separate electrical circuits, one of which shall be separate from other circuits, arerequired for occupant loads of600 or less.

SECTION3906CLEARANCE OF PREMISES

3906.1 General. The operator of prerníses for which a tent permit has been issued shall removeall structures, materials and debris within two days after the expiration or revocation of a tuntpermit."
