BEFORE ME, the undersigned authority personally appeared David Dean, known to me

to be the person whose name is subscribed hereto, and whoo after being first duly sworn, stated as

follows:

1. 'I live at 5420 Swiss Avenue, Dallas, Texas 75214.I and my spouse Jean Maier

Dean have owned this property since May 2000 and have lived at this address

continuously since Septerrber 2003.

2. The Aldredge House, 5500 Swiss Avenue, is next door to me right across

Parkmont Street.

3. The use of the Aldredge House as a high volume venue for high end, exclusivg

expensive for-profit, private parties and weddings has a continuing adverse effect

on my property for the reasons articulated in Barbara McDaniel's Application to

the Board of Adjustment to Set a Compliance Date for the Nonconforming Use.

4. I should live on a quiet, residential street in the middle of the Swiss Avenue

Historic District; instead, I feel as though I am living next to a nightclub or the

clubhouse of a very large country club or next to a party barn or a for profit

fraternity house.

5. There are dozens and dozens and dozens of extremely large weddings, parties and

events each year at the Aldredge House, most of which occur until late in the

weekday evenings and on weekends and holidays. There are multiple parties and

weddings in a weekend, and sometimes there are multiple parties and weddings

on the same day.

The noise from the parties bothers me and has woken me up on numerous

occasions. The commercial delivery trucks idle outside my home and the fumes

and noise come into my yard and home. In addition, the idling of the delivery

trucks is noisy and disrupts my enjoyment of my home and my neighborhood.

The early morning and late night outside noise associated with deliveries, set up

and pick up cofirmercial trucks and crews of people involved in food service,

floral deliveries, tent erection and take down, AV and PA equipment, tables and

chairs, serving paraphernalia and related to support events that routinely exceed

150-200 people not counting the servers, valets, musicians, AV technicians etc is

very loud and incompatible with the quiet enjoyment of my residential home.

These deliveries always precede and follow the actual events and in manytases

by several days although many occur on the same day as the events which make

for constant activity from eady in the morning to very late at night. Then the same

and different noises and commotion occurs during the actual events themselves.

The parties have a large number of guests, and the guests' cars are parked up and

down Swiss Avenue, Parkmont, and Bryan Street. They frequently park in front

of the fire hydrant on Parkmont that is the primary service for my home in the

event of a fire. The cars are parked on both sides of Parkmont and Swiss and

Bryan, making access for fire, emergency and EMS service trucks and vehicles

impossible.

The Aldredge House has asked me to be quiet in mv own backvard during their

outdoor for profirt wedding ceremonies and related events.

My name has been forged on an application for a Tent Permit that was submitted

to the City of Dallas on March 6,2012. See Exhibit 1, p. 3, No. 7.

My name has been forged on an application for a Tent Permit that was submitted

to the City of Dallas on Septernber 16,2014.,See Exhibit 2, þ. 5, No. 7.

In an application for a Tent Permit submitted to the City of Dallas on April 23,

2013, it was represented that Kenny Bruce, identified as a Tenant, signed as

consenting to the erection of a tent next to my address, 5420 Swiss. I have never

had a tenant at my address. ^See Exhibit 3, p. 3, No. 11.

In addition, the exact signature described in the above-numbered paragraph was

cut and pasted onto a Tent Permit application submitted to the City of Dallas on

January 14,2015. ^See

Exhibit 4, þ. 5, No. 11. The twelve signatures on the

January 14, 2015, application are an exact replica of the twelve signatures on the

April 23,2013, applicatior¡ with the exception that the date next to the neighbors'

signatures signed has been whited out. Compare Exh;Í:rrt 4, p. 5, No. 11, with

Exhibit 3 p.4,No. 11.

Moreover, the exact signature described in the above-numbered paragraph was

cut and pasted onto a Tent Permit application submitted to the City of Dallas on

April 8, 2015. See Exhibit 5, Þ. 9, No. 8. A close inspection of this signature and

the handwriting for "5420 Swiss AVE" shows that it is an exact replica of the

signature listed on the Aprll 23, 2013, and January 14, 2015 applications.

14. The unusually high incidence of violent crimes including brutal beatings, deathby

hanging, aggavatd robberies, thefts and break-ins occurring at 5500 Swiss

Avenue is troubling to me and I believe reflects the poor and absentee

management ofthe for profit business that is being run there.

15. The Aldredge House is owned and controlled by the Dallas County Medical

Society Auxiliary (DCMSA), a private corporation of very wealthy ladies whose

primary charitable purpose based upon their bylaws, website and other public

sources is stated to be the preservation of the house located at 5500 Swiss

Avenue. That purpose is daily provided by all other actual residents of the Swiss

Avenue Historic District. The membership of the DCMSA consists of over 700

members who have access according to DCMSA rules, regulations, policies and

procedures to the Aldredge House as their personal or private "clubhouse." These

members are all from professional and ge,nerally very affluent families and have

the ability to have large and very expensive parties and events at the Aldredge

House and other clubs to which they may belong. Additionally apparently for well

over a decade the DCMSA has had a master exclusive catering lease with

Culinaire International, Richard Gussoni, President and CEO and variously

through several of Culinaire's operating companies including Food Glorious Food

and Catering at the Aldredge House for very high end and expensive events,

parties and operations that last well into the night in this residential neighborhood.

A casual review of the well prepared and maintained websites used by these

e,ntities for booking events at the Aldredge House indicates that the facility is

availàble for a large fee to anyone virtuaþ at any time for large and expensive

events.

16. That loud and lengthy outdoor send offs and outdoor demonstrations fueled many

times by lengthy open bars and unlimited access to liquor and alcoholic beveraggs

at events are held by scores and scores of customers of Culinaire Intemational and

its affiliate Food Glorious Food and occur under the direction and supervision of

paid employees and representatives ofthose two organizations and in the presence

ofpaid rqrresentatives and volunteers and officers ofthe Dallas County Women's

Auxiliary, demonstrates their disregard for my right to the quiet enjoyment of my

home and is very offensive to me and is adverse to my property and ownership

rights.

17. Lauren Twichell is currently the director of catering at the Aldredge House for

Food Glorious Food (FGF) and V/endy Hansen is the officer, volunteer

representative of the Dallas County Women's Auxiliary (DCSMA) who are o'in

charge" as best we can tell of onsite operations. Their focus seems to be

exclusively on insuring the profitability of their events and that their paying

customers have a good time and experience with their events at the Aldredge

House and mainly at the expense of the surrounding property owners. Indeed

there are mrmy, many web postings by numerous brides and other event sponsors

who testiff as to the incredible experience they have had in my neighborhood,

complete with large outdoor crowds, fireworks, outdoor lighting and improperþ

permitted tents. Indeed the websites for Culinaire International and the Aldredge

House until recently proudly heralded this outdoor reveþ. Ms. Twichell and Ms.

Hansen are the same representatives who have been very active in and the

supervision of soliciting signatures and approvals from me and property owners

adjacent to the Aldredge House for tent permits required by the city for fire and

safety reasons, many of which unfortunately have turned out to be falsified,

forged and illegally filled with the city of Dallas. Many of these same permit

applications have falsely and incorrectly represented that no alcohol would be

provided or cnnsumed during these events.

The continuous for profit, non-conforming use and operation of this residential

structure in a residential Historic District, constitutes a very adverse impact on my

property. It has become a nuisance that needs to be immediately shut down and

the property use made to conform in all respects to a single family residence in an

Historic District.

BEFORE ME, the undersigned authority personally appeared Jean Dean, known to me to

be the person whose name is subscribed hereto, and who, after being first duly sworn, stated as

follows:

1 . "I live at 5420 Swiss Avenue, Dallas, Texas 7 5214. I have owned this home since

May 2000 and lived in it since September 2003.

2. The Aldredge House, 5500 Swiss Avenue, is next door to me.

3. The use of the Aldredge House as a venue for for-profit private parties and

weddings has an adverse effect on my property for the reasons articulated in

Barbara McDaniel's Application to the Board of Adjustment to Set a Compliance

Date for the Nonconforming Use.

4. I should live on a quiet, residential street in the middle of the Swiss Avenue

Historic District; instead, I feel as though I am living next to a nightclub or

fraternity house.

5. There are dozens of weddings and parties each year al the Aldredge House, most

of which last late in the evenings. There are multiple parties and weddings in a

weekend, and sometimes there are multiple parties and weddings on the same day.

6. The noise from the parties bothers me and has woken me up or I was unable to

sleep on numerous occasions. The delivery trucks idle outside my home and the

fumes come into my yard and home. In addition, the idling of the delivery trucks

is noisy and disrupts my enjoyment of my home, my yard and my neighborhood.

At the end of many of these parties there is a celebratory "send-off' which is

always very loud. On numerous occasions the "send-off'has included not only

all the guests lined up in the front yard yelling but using sparklers and fireworks.

After the guests leave the noise continues with the clean-up. The large trucks

return idling either in the alley or on Parkmont, the beeping from the trucks

backing up starts occurring, the slamming of the trucks' back gates, loading the

trucks, and trash with glass bottles being tossed in the trash all are a nuisance.

The parties have a large number of guests, and the guests' cars are parked up and

down Swiss Avenue, Parkmont, and Bryan Street. They frequently park in front

of the fire hydrant on Parkmont that would service my home in the event of a fire.

The cars are parked on both sides of Parkmont and Swiss, making access for

emergency service trucks impossible.

The Aldredge House has asked me to be quiet in my own backvard during their

outdoor wedding ceremonies.

I have had to endure hours of bag pipe music numerous times. Most recently it

began early on a Sunday morning.

In an application for a Tent Permit submitted to the City of Dallas on April 23,

2013, Kenny Bruce signed for 5420 Swiss Avenue. Mr. Bruce is a contractor that

occasionally works for us. One time several years ago we gave him permission to

sign one tent permit for us. I am not sure of the actual date and not having the

Moreover, the exact signature described in the above-numbered paragraph was

cut and pasted onto a Tent Permit application submitted to the City of Dallas on

April 8, 2015. See Exhibit3,p.9, No. 8. A close inspection of this signature and

the handwriting for *5420 Swiss AVE" shows that it is an exact replica of the

signature listed on the April 23, 2013, and January 14, 2015 applications.

No. 11. The numbering to the left of the signatures on the dpril 8,2015,

My name was forged on an application for a Tent Permit that was submitted to the

City of Dallas on October 3,2013.,See Exhibit4,p' 4, No. 5.

In an application for a Tent Permit submiued to the City of Dallas on April 28,

2014, my forged signature from October 3,2013, was cut and into a new Tent

Permit. See Exhibit 5, p. 4, No. 5. The eleven signatures on the April 28, 2074,

BEFORE ME, the undersigne{ authority personally appeared Anne Hamilton, known to

me to be the person whose name is subscribed hereto, and who, after being first duly sworn,

stated as follows:

1. "I live at 5521 Swiss Avenue, Dallas, Texas 75214.I have lived at this address

since October 2011.

2. I live across the street from the Aldredge House, 5500 Swiss Avenue.

3. The use of the Aldredge House as a venue for for-profit private parties and

weddings has an adverse effect on my property for the reasons articulated in

Barbara McDaniel's Application to the Board of Adjustment to Set a Compliance

Date for the Nonconforming Use.

4. I should live on a quiet, residential street; instead, I feel as though I am living

across the street from a nightclub.

5. There are dozens of weddings and parties each year atthe Aldredge House, most

of which occur late in the evenings. There are multiple parties and weddings in a

weekend, and sometimes there are multiple parties and weddings on the same day.

6. The noise from the sendoffs at the parties bothers me and has woken me up on

numerous occasions. It has also woken up my now 3-year old son on numerous

occasions. It is difficult to put a child back to sleep after they wake up because of
