    PROVINCE.

    Under and by virtue of the powers and authorities vested in me by sub-section (2) of section th1'ee of the Fencing Act, 1912, I do hereby order that for thc purpose of obtaining repayment of the advance (and payment of interest thereon) which has been made by the Gpvernment for repairs to a divid-ing fence between the property and native location specified in the attachel Schedule, the rate set opposite the said location shall be levied and collected from each adult male inhabitant of the said location during the calendar years mentioned.

    And I do further fix the dates appearing in the said Schedule as the dates upon which the said rate shall be respectively levied and collected.

    And I do hereby provide that the amounts of the said rate shall be recoverable in the same manner as any Native Poll Tax or Hut Tax is by law recoverable in the Province con-,cerned from natives liable to pay such tax.

    KAAP PROVINSIE.

    Onder en kragtens die mag en bevoegdheid my verleen deur subartiekel (2) van artiekel drie van die Omheiningswet, 1912, beveel ek hiermee dat, met die doel om terugbetaling van die voorskot (en betaling van rente daarop) te verkry wat deur die Regering gemaak is vir reparasies aan 'n skeidingsom-heining tussen die eiendom en die naturellelokasie uiteengesit in die aangehegte bylae, die belasting teenoor die genoemde lokasie aangetoon sal van elke meerderjarige manlike inwoner van die genoemde lokasie gehef en ingesamel word gedurende die bepaalde jare.

    En ek bepaal verdeI' die datums wat in die gemelde bylae voorkom, as die datums waarop die genoemde belasting respek-tiewelik gehef en ingesamel sal word,

    En ek maak hiermee voorsiening dat die bedrae van die genoemde belasting herkrybaar sal wees op dieselfde wyse soos enige Naturelle Hoofbelasting of Hutbelasting deur wet in die betrokke Provinsie van naturelle verantwoordelik VIr die betaling van sodanige belasting herkrybaar is.

    under and by virtue of the powers vested in him in that behalf declared bv Proclamation bearing date the twentieth day of December~ 1921, that as and from the first day of January, 1921, the High Commissioner for South Africa s~ould be the Administrator of .that part of the Mandated Terntory of South-West Africa east of longitude 21° east, known as the Caprivi Zipfel, and by the said Proclamation delegated to the High Commissioner full authority for that purpose:

    And whereas it is now expedient that the Caprivi Zipfel be administered as a portion of the said Mandated Territory;

    Now therefore, under and by virtue of the authority vested in me bv the Treaty of Peace and South-West Africa Mandate Act, 1919 (Act 1'\0, 49 of 1919), I do hereby declare, proclaim and make known that as and from the first day of September, 1929:

    (a) Governor-General's Proclamation No. 12 of 1922, dated the twentieth day of December, 1921, is hereby repealed;

    (/» The Caprivi Zipfel shall be administered as a part of' the Mandated Territory of South_West Africa; and

    (c) The Administra,tor of the said Mandated Territory shall . be the Administrator of the Caprivi Zipfel, and I do

    hereby delegate to him authority conferred in para-graphs (a) and (b) of section two of the said Act to repeal, alter, amend or modify any laws in force within that area and to make new laws applicable to the said area;

    Afrika ingevolge en kragtens die bevoegdhede hom vir daardie doel verleen by Proklamasie gedateer die twintigste dag van Desember 1921, verklaar het, dat vanaf die cerate dag van Januarie 1921, die Hoe Kommissaris vir Suid-Afrika die Administrateur sou wees van daardie gedeelte van die Man-daatgebied Suidwes-Afrika gelee aan die oostekant van lengte-graad 21 oos, bekend as Cal?rivi Zipfel, en by bedoelde Pro-klamasie aan die Hoe Kommlssaris volle mag daartoe oorgedra het;

    .En nademaal dit nou dienstig is dat die Caprivi Zipfel as 'n gedeelte van die bedoelde Mandaatgebied geadministreer word;

    So is dit dat ek, ingevolge en kragtens die bevoegdheid my verleen deur die Vredesverdrag en Zuidwest-Afrika Mandaat Wet, 1919 (Wet No. 49 van 1919) hiermee verklaar, proklameer en bekend maak dat vanaf die eerde dag van September 1929 :

    (1) Goewerneur-Generaals Proklamasie gedatecr die twin-tigste dag van Desember 1921 herroep is;

    (2) Die Caprivi Zipfel geadministreer word as 'n gedeelte van die Mandaatgebied Suidwes-Afrika; en

    (3) Die Administrateur van die bedoelde Mandaatgebied die Administrateur van die Capri vi Zipfel is, en ek dra hierby aan hom 001' die mag, verleen by paragrawe (a) en (b) van artiekel twee van bedoelde Wet, om enige wette van krag in daardie streek te herroep, te ver-ander, te wysig, of te verbeteren nuwe wette te maak toepaslik op (laardie streek;

    So is dit dat ek, ingevolge en kragtens die bevoegdhede my verleen soos ,-oorheen vermeld, verklaar, proklameer en hiermee bekendmaak dat die ondergemelde artiekels gevaar-like wapens is volgens die betekenis van bogenoemde artiekel-

    "Tear-gas pens" en ander iDstrumente wat traanver-wekkende, verstikkende of bedwelmende gasse afgee, en patrone daarvoor.

    It is hereby notified for general information that His' Excellency the Governor-General has been pleased, in terms of section ninety-eight of the Public Service and Pensions. Act, 1923, to approve of the following amendments to the Public Service Regulations, with effect from the dates indicated:

    (a) With effect from the 1st March, 1929:-

    PAR'!: II. Regulation No. 55 is hereby amended by the addition of

    the following proviso to paragraph (7):-"Provided that any such teaeher who was, under the

    eonditions of service applicable to him prior to the date on which he became eligible for the leave privileges under the~ regulati~ms, eligible for leave after, a fixed· period of servwe may In respect of tbe completed port;on of any such period be granted a proportionate leave eredit cal-culated on the basis of the leave that would have accrued to him on the completion of such fixed period." (6) With effect from the 11th March, 1929:-

    PART VI. Begulation No. 157 is hereby amended by the insertion of

    " (1)" aft€r "157" and the addition of the f.allowing new paragraph: -" (2) Any clerk listed for Sunday or Public holiday duty or

    for overtime necessitated by absences, staff shortages, etc., shall under normal conditions be notified before 6 p.m. on the day preceding that on which the over-time is scheduled to be performed if it be fonnd necessary to alter or cancel such listed duty, provided that when it is not praeticable to. give the required notice in cases of cancellation the clerk may b3 granted: (0,) One hour's overtime when advice of cancellation

    of listed overtime duty is given after 6 p.m. on the preceding day and before he actually assumes duty;

    (b) full overtime for the whole listed overtime period when no advice of cancellation has been given and he attends for duty at the scheduled hour."

    (c) With effect from the 1st January, 1926:-

    PART 1. Regulation No. 42 is hereby amended' by the addition of

    the following proviso at the end of the regulation:-"Provided further that any officer who has passed an

    examination which in the opinion of the Commission, is of a standard as high as, or higher than, the prescribed examination shall be deemed to have passed the prescribed examination. "

    pleased to approve, in terms of section eight of the Van \Vyk's VIei Settlement (Local Board of Management) Act, 1929 (Act No. 10 of 1929), of the subjoined regulations relating to the Van Wyk's Vlei Settlement Board.

    1. The Magistrate, Carnarvon, shall, as soon as may be after the publication of these regulations, cause a notice con-vening a meeting of registered owners of the lots within the Van Wyk's Vlei Settlement (herein after called the" settle-ment") for the purpose of electing the members of the Van Wyk's Vlei Scttlement Board (herein after called the " Board") to be posted at the office of the Magistrate, Car-narvon, at the Police Post and Public School at Van Wyk's Vlei, and at such other convenient places as he may determine. Such notice shall appoint the place, date and hour of the proposed mee~ing, and be posted at the aforesaid places at least one month prior to the date of the meeting.

    2. An officer in the Public Service designated by the Minister of Lands shall preside at the meeting convened in terms of regulation No. 1.

    3. Any registered owner of a lot on the Settlement may be nominated for membership of the Board: Provided that no such nomination shall be valid unless it has been duly seconded.

    4. (1) At the election of members of the Board, every regis-tered owner shall, subject to the provisions of sub-section (2) of section one of Act No. 10 of 1929, have one vote in respect of every lot owned by him.

    . (2) If any, lot is owned by two or more persons Jointly or In partnershIp, the person authorized in writing by the joint owners or partnership shall be entitled to record the vote or votes which may be exercised in respect of any lot or lots so owned.

    5. (1) If not more than three candidates are nominated by the registered owners of sowing lots, each such candidate shall be deemed to have been duly elected as a member of the Board.

    (2) If more than the required number of candidates are nominated by the registered owners of sowing lots the officer referred to in regulation No.2 shall take forthwith by ballot a poll 01' the owners present at the meeting, and the three candidates nominated for election who respectively gain the highest number of votes shall be declared to be duly elected as members of the Board.

    (3) If in taking such ballot an equal number of votes be polled for two or more candidates, the presiding officer shall forthwith publicly determine by lot which of such candidates shall be members of the Board.

    * No. 1492.J [23 Augustus 1929. Hiermee word kennis gegee dat dit die Minister van Lande

    behaag het om ooreenkomstig artiekel ag van die Van Wyks Vlei Nedersettings (Plaaslike Bestuursraad) Wet, 1929 (Wet No. 10 van 1929) die onderstaande regulasies op die Raad van die Van wyks Vlei Nedersetting betrekking hebbende, goed te keur.

    1. Die Magistraat, Carnarvon, moet so spoedig doenlik na publikasie van hierdie regulasies 'n kennisgewing, 'n ver-gadering van geregistreerde eienaars van die persele binne die Van Wyks V1ei Nedersetting (hierna genoem die Neder-

    ,setting), vir die doel van die verkiesing van die lede van die Van Wyks Vlei Nedersettingsraad (hierna genoem die u Raad ") byeenroepende, aan die kantoor van die Magistraat, ~arnarvon, aan die Poliesiepos en Publieke Skool te Van "\Vyks Viei en op sodanige ander gerieflike plekke as hy mag vasstel, laat aanplak. Sodanige kennisgewing moet die pIek, datum en uur van die voorgestelde vergadering bepaal, en moet minstens een maand voor die datum van die vergadering by die voornoemde plekke aangeplak word.

    2. 'n Amptenaar van die Staatsdiens, deur die Minister van Lande benoem, salop die vergadering, wat ingevolge regu-lasie No. 1 bele is, as voorsitter optree.

    3. Enige geregistreerde eienaar van 'n perseel in die Neder-setting kan vir lidmaatskap van die Raad genomineer word: Met die verstande dat geen sodanige nominasie gel dig sal wees nie tensy dit behoorlik gesekondeer is.

    4. (1) By die verkiesing van Ie de van die Raad sal iedere geregistreerde eienaar, behoudens die bepali ngs van' sub-artiekel (2) van artiekel een van Wet No. 10 van 1929, een stem he ten aansien van iedere perseel waarvan hy die eienaar is.

    (2) Ingeval enige perseel die eiendom van twee of meer persone, gesamentlik of in deelgenootskap, is, sal die persoon wat deur die gesamentlike eienaars of deelgenootskap skrifte-lik gemagtig is, geregtig wees die stem of stemme uit te bring wat teu opsigte van enige perseel of persele, aldus gebou, uitgebring mag word.

    5. (1) Ingeval nie meer dan drie kandidate deur die ge· registreerde eienaars van saaipersele genomineer word nie, sal iedere sodanige kandidaat geag word behoorlik as lid van die Raad gekies te wees.

    (2) lngeval meer dan die vereiste getal kandidate deur die geregistreerde eienaars van saaipersele genomineer word, moet die amptenaar, bedoel in regulasie No.2, onmiddellik 'n vcr-kiesing deur middel van stemming deur die eienaars wat op die vergadering aanwesig is laat hou, en die drie kandidate, vir verkiesing genomineer, wat respektieflik die hoogsto aantal stemme verwerf, moet verklaar word behoorlik as lede van die Raad gekies te wees.

    (3) Ingeval met die stemming 'n gelyke aantal stemme op twee of meer kandidate word uitgebring, moet die voorsit-tende amptenaar onmiddellik in die openbaar deur loting laat beslis wie van sodanige kandidat€ Ie de van die Raad sal wees.

    (4) Die bepalings v~an subartiekels (1), (2) en (3) sal mutatis m'u.tandis van toepassing wees op die verkiesing van lede van die Raad deur die geregistreerde eienaars van tuin- en bou-persele.

    6. Die voorsittende amptenaar moet die uitslag van die stemming aan die vergadering bekend maak en moet, vir doeleindes van aantekening, die Raad voorsien van 'n serti-fikaat wat die besonderhede van die stemming vermeld.

    7. Nie later dan een maand nie voor die verstryking van die dienstyd van die Raad en van enige daaropvolgende Raad moet die voorsitter van die Raad, of by sy afwesigheid die vise-voorsitter, '11 vergadering van die geregistreerde eienaars

    lots within the settlement for the purpose of electing the members of the Board for the ensuing year. The provisions of regulations Nos. 1 to 6 shall apply mutatis mutarndis to any such election.

    8. (1) If any member of the Board ceases to be a registered owner of a lot on the settlement or if a member of the Board dies or resigns from the Board, the chairman, or in his absence the vice-chairman, shall call forthwith a special meeting of the registered owners concerned in the election of a person to fill the vacancy so caused. If, in accordance with the pro-visions of sub-section (2) of section one of .Act No. 10 of 1929, the vacating member wat; elected by the registered owners of sowing lots the election to fill the vacancy shall be confined to ewners of sowing lots, and likewise if the vacating member was elected by the registered owners of garden and building lots the election shall be confined to owners of garden and building lots. The provisions of regulations Nos. 1 to 6 shall apply mutatis mutandis to the said election.

    (2) .Any person elected in terms of this regulation shall hold office for the remainder of the period for which the other members of the Board were elected. "

    9. The Board shall at its first meeting elect a vice-chairman (who must be a member of the Board), and appoint a secretary and treasurer.

    10. The Board shall meet for the dispatch of business at such times and such place or places as the chairman, or in his absence the vice-chairman, may determine.

    11. The chairman, or in his absence the vice-chairman, shall preside at meetings of the Board. In the absence of both the chairman and vice-chairman, the, members of the Board present at any meeting thereof shall a:ppoint one of their number to act as chairman for the duratlOn of such meeting, and he shall, while so acting, perform 1\11 the functions of the chairman.

    12. The secretary of the Board shall be responsible for all the books and records of the Board, and he shall enter all the proceedings of the Board at each meeting in a minute-book to be kept for that purpose.

    13 . .All moneys received by the Board shall be paid into a special banking account, and cheques issued on the said account shall be signed by the chairman of the Board, or any member of the Board authorized thereto by the Board, and the secretary and treasurer.

    14. The Board shall at each meeting confirm, after amend-ment, if necessary, the minutes of the previous meeting, which shall thereafter be signed by the chairman and shall constitute the official record of the decisions of such previous meeting.

    15. The Board shall, at the end of each calendar year, render a report, accompanied by a statement of accounts, in respect of its operations during such year, which report shall be filed with the records of the Board. The secretary shall allow any registered owner of a lot on the Settlement to see the report and inspect the statement of accounts at such place and tImes as the Board may determine.

    16; In framing any rules or by-laws for the area of .the Settlement under the Settlements (Committee of Manage-ment) .Act, 1925 (.Act Xo. 21 of 1925), or the Irrigation and Conservation of Waters .Act, 1912 (.Act No.8 of 1912), or any amendment thereof, the Board shall be governed by the pro-visions of the aforesaid .Acts and the regulations framed thereunder.

    .Applications will be received at the Department of Lands, Pretoria, for a period of six weeks from the date of the publication of this notice (thus expiring on the 4th October, 1929), and for such time thereafter as the holdings or any of them remain una110tted, for the undermentioned holdings to be disposed of on lease for a period of five (5) years, with the option of acquiring the land at any time during the currency of the lease, or at the expiration thereof, on terms of Con-ditional Purchase Lease extending over a period of forty (40) years; under and subject to the provisions of the Land Settlement Act, No. 12 of 1912, and amending Acts, and any regulations published thereunder.

    The Government reserves the right at any time to withdraw any or all of the holdings offered for disposal by this notice.

    All previous notices advertising any of these holdings are hereby withdrawn in so far as the advertisement of the said holdings is concerned.

    After the expiry of this notice intending applicants should ascertain from the Department of Lands which holdings are still available before proceeding to inspect any of them.

DIe bepallngs van regulasle!! Nos. I tot 6 sal mutatis mutandis op die genoemde verkiesing van toepassing wees.

    (2) Iemand wat ooreenkomstig hierdie regulasie gekies is, sal die amp beklee gedurende die res van die tydperk waanoor die ander lede van die Raad gekies was.

    9. Die Raad moet op sy eerste vergadering 'n vise-voor-sitter (wat 'n lid van die Raad moet wees) kies, en 'n sekre-taris en penningmeester aanstel.

    10. Die Raad sal vir die verrigting van sake op sodanige tye en op sodanigeplek of plekke byeenkom, as die voorsitter, of by sy afwesigheid die vise-voorsitter, mag bepaal.

    11. Die voorsitter./ of by sy afwesigheid die vise-v?orsitterj moet op die vergaaerings van die Raad die vooorsittersto~

    inneem. Hy afwesigheid van die vporsitter sowel as ~he vise-voorsitter moet die lede van die Raad, wat op emge vergadering daarvan aanwesig is, een lid uit· hulle midde ben oem om tydens die duur van sodanige vergadering as voor-sitter op te tree, en hy moet solank as hy sodanig optree al die funkies van die voorsitter verrig.

    12. Die sekretaris van die Raad sal vir alIe boeke en doku-mente van die Raad verantwoordelik wees en hy moet aHe verrigtings van die Raad op iedere vergadering in 'n notule-boek, wat vir daardie doel aangehori moet word, aanteken.

    13 . .AlIe gelde wat deur die Raad ontvang word moet in 'n spesiale bank-rekening inbetaal word. en tjeks wat op die gesegde rekening getrek word moet dour die voorsit:ter van die Raad of enig lid van die Raad wat daartoe deur dIe Raad gemagtig is, en die sekretaris en penningmeester onderteken word.

    14. Die Raad moet die notule van die voorafgaande ver-gadering, indien nodig na wysiging, qp iedere vergadering bekragtig, wat daarna deur die voor:sitter ?nderteken m?et word en wat die offisiele notule van dIe beslUlte van sodamge voorafgaande vergadering sal uitmaak.

    15. Die Raad moet aan die end van elke kalenderjaar 'n verslag vergesel van 'n rekeningstaat, uitbring, met betrek-king t~t sy verrigtings gedurende· sodanige jaar, watter ver-slag met die dokumente van die Raad bewaar moot word. Die sekretaris moet enige geregistreerde eienaar van 'n perseel in die nedersetting toestaan om op sodanige plek en ty~ as die Raad mag vasstel, insage van die verslag en rekenmg-staat te neem.

    16. By optrekking van enige reels of verordenings, k.ragtens die ,Nederzettingen (Komitee van Beheer) Wet, 1925 (Wet No. '21 van 1925) " of die" Besprooiings- en Waterbewarings-wet 1912 (Wet No.8 van 1912) " of enige wysiging daarvan, vir 'die streek van die N edersetting, sal die Raad .gebind w~es deur die bepalings van die genoemde Wette en die regulasies wat daaronder opgetrek is.
