3. Background

3.1 The property at 691 Holloway Road has had a premises licence in force since 2005 when it was converted from the previous Justice’s licence.

3.2 The property at 693 Holloway Road has been licensed since 2005 when the licence was converted from the previous Justice’s Licence.

3.3 The current premises licence holder Umut Gundogan transferred on to the premises licence in December 2012 and he also varied on to the premises licence as the Designated Premises Supervisor for both 691 and 693 Holloway Road.

3.4 The application is subject to representations from Islington’s Licensing Authority, Police, Public Health and 2 local Ward Councillors.

4. Planning Implications

4.1 The property has been used as a retail use class A1, for over 10 years and is therefore immune from enforcement action with regards to the use.

4.2 The property is not listed but is located within the St John’s Grove Conservation Area CA28 that is subject to an Article 4 Direction removing certain permitted development rights.

4.3 There is no relevant planning history for this site and therefore no planning conditions restricting hours.

4.4 There are no open enforcement cases in relation to the property.

5. Recommendations

5.1 To determine the application for a new premises licence under Section 17 of the Licensing Act 2003.

5.2 These premises are located in the Archway Cumulative Impact Area therefore the Licensing Committee will need to consider Licensing Policy 3, which states that there is a presumption of refusal unless the Committee is satisfied that there will be no adverse cumulative impact on the licensing objectives.

5.3 If the Committee grants the application it should be subject to:

i. conditions prepared by the Licensing Officer which are consistent with the Operating Schedule (see appendix 4); and

ii. any conditions deemed appropriate by the Committee to promote the four licensing objectives. (see appendix 4)

6. Reasons for recommendations

6.1 The Council is required to consider this application in the light of all relevant information, and if approval is given, it may attach such conditions as appropriate to promote the licensing objectives.

List here steps you will take to promote all four licensing objectives together.

The Licensee, that is the person in whose name the premises licence is issued, shall ensure that all times when the premises are for any licensable activity, there are sufficient competent staff on duty at the premises for the purpose of fulfilling the terms and conditions of the licence and for preventing crime and disorder. The Licensee shall ensure that all staff will undertake training in their responsibilities in relation to the sale of alcohol, particularly with regard to drunkenness and underage persons. Records will be kept of training and refresher training.

b) The prevention of crime and disorder

Any incidents of a criminal nature that may occur on the premises will be reported to the Police. The Licensee will install comprehensive CCTV coverage at the premises and it is operated and maintained at the premises. The CCTV system shall conform to the following points: 1. Cameras must be sited to observe the entrance and exit doors both inside and outside. 2. Cameras on the entrances must capture full frame shots of the heads and shoulders of all people entering the premises i.e. capable of identification. 3. Cameras viewing till areas must capture frames not less than 50% of screen. 4. Cameras overlooking floor areas should be wide angled to give an overview of the premises. 5. Be capable of visually confirming the nature of the crime committed. 6. Provide a linked record of the date, time and place of any image. 7. Provide good quality images –colour during opening times. 8. Operate under existing light levels within and outside the premises. 9. Have the recording device located in a secure area or locked cabinet. 10. Have a monitor to review images and recorded picture quality. 11. Be regularly maintained to ensure continuous quality of image capture retention. 12. Have signage displayed in the customer area to advise that CCTV is in operation. 13. Digital images must be kept for 31 days. 14. Police will have access to images at any reasonable time. 15. The equipment must have a suitable export method, e.g. CD/DVD writer so that the police can make an evidential copy of the data they require. This data should be in the native file format, to ensure that no image quality is lost when making the copy, if this format is non-standard (i.e. manufacturer proprietary) then the manufacturer should supply the replay software to ensure that the video on the CD can be replayed by the police on a standard computer. Copies must be made available to Police on request.

c) Public safety

Appropriate fire safety procedures are in place including fire extinguishers, internally illuminated fire exit signs, numerous smoke detectors and emergency lighting (see enclosed plan for details of locations). All appliances are inspected annually. All emergency exits shall be kept free from obstruction at all times.

d) The prevention of public nuisance

All customers will be asked to leave quietly. Clear and legible notices will be prominently displayed to remind customers to leave quietly and have regard to our neighbours.

e) The protection of children from harm

The licensee and staff will ask persons who appear to be under the age of 25 for photographic ID such as proof of age cards, the Connexions Card and Citizen Card, photographic driving licence or passport, an official identity card issued by HM Forces or by an EU country, bearing the photograph and date of birth of bearer. All staff will be trained for UNDERAGE SALES PREVENTION regularly. A register of refused sales shall be kept and maintained on the premises.

NOTES ON DEMONSTRATING ENTITLEMENT TO WORK IN THE UK

Entitlement to work/immigration status for individual applicants and applications from partnerships which are not limited liability partnerships: A licence may not be held by an individual or an individual in a partnership who is resident in the UK who:

• does not have the right to live and work in the UK; or • is subject to a condition preventing him or her from doing work relating to the carrying on of a licensable activity.

Any premises licence issued in respect of an application made on or after 6 April 2017 will become invalid if the holder ceases to be entitled to work in the UK. Applicants must demonstrate that they have an entitlement to work in the UK and are not subject to a condition preventing them from doing work relating to the carrying on of a licensable activity. They do this in one of two ways: 1) by providing with this application copies or scanned copies of the documents listed below (which do not need to be certified), or 2) by providing their 'share code' to enable the licensing authority to carry out a check using the Home Office online right to work checking service (see below). • An expired or current passport showing the holder, or a person named in the passport as the child of the holder, is A British citizen or a citizen of the UK and Colonies having the right of abode in the UK [please see note below about which sections of the passport to copy].

• An expired or current passport or national identity card showing the holder, or a person named in the passport as the child of the holder, is a national of a European Economic Area country or Switzerland.

• A Registration Certificate or document certifying permanent residence issued by the Home Office to a national of a European Economic Area country or Switzerland. • A Permanent Residence Card issued by the Home Office to the family member of a national of a European Economic Area country or Switzerland.

• A current Biometric Immigration Document (Biometric Residence Permit) issued by the Home Office to the holder indicating that the person named is allowed to stay indefinitely in the UK, or has no time limit on their stay in the UK.

• A current passport endorsed to show that the holder is exempt from immigration control, is allowed to stay indefinitely in the UK, has the right of abode in the UK, or has no time limit on their stay in the UK.

• A current Immigration Status Document issued by the Home Office to the holder with an endorsement indicating that the named person is allowed to stay indefinitely in the UK or has no time limit on their stay in the UK, when produced in combination with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer.

• A birth or adoption certificate issued in the UK, when produced in combination with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer.

• A birth or adoption certificate issued in the Channel Islands, the Isle of Man or Ireland when produced in combination with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer.

• A current Residence Card issued by the Home Office to a person who is not a national of a European Economic Area state or Switzerland but who is a family member of such a national or who has derivative rights or residence.

• A current Immigration Status Document containing a photograph issued by the Home Office to the holder with an endorsement indicating that the named person may stay in the UK, and is allowed to work and is not subject to a condition preventing the holder from doing work relating to the carrying on of a licensable activity when produced in combination with an official document giving the person’s permanent National Insurance number and their name issued by a Government agency or a previous employer.

• A Certificate of Application, less than 6 months old, issued by the Home Office under regulation 18(3) or 20(2) of the Immigration (European Economic Area) Regulations 2016, to a person who is not a national of a European Economic Area state or Switzerland but who is a family member of such a national or who has derivative rights of residence.

• Reasonable evidence that the person has an outstanding application to vary their permission to be in the UK with the Home Office such as the Home Office acknowledgement letter or proof of postage evidence, or reasonable evidence that the person has an appeal or administrative review pending on an immigration decision, such as an appeal or administrative review reference number.

• Reasonable evidence that a person who is not a national of a European Economic Area state or Switzerland but who is a family member of such a national or who has derivative rights of residence in exercising treaty rights in the UK including:-

• evidence of the applicant’s own identity – such as a passport, • evidence of their relationship with the European Economic Area family member – e.g. a marriage certificate, civil partnership certificate or birth certificate, and • evidence that the European Economic Area national has a right of permanent residence in the UK or is one of the following if they have been in the UK for more than 3 months:

(i) working e.g. employment contract, wage slips, letter from the employer, (ii) self-employed e.g. contracts, invoices, or audited accounts with a bank, (iii) studying e.g. letter from the school, college or university and evidence of sufficient funds; or (iv) self-sufficient e.g. bank statements.

Family members of European Economic Area nationals who are studying or financially independent must also provide evidence that the European Economic Area national and any family members hold comprehensive sickness insurance in the UK. This can include a private medical insurance policy, an EHIC card or an S1, S2 or S3 form. Original documents must not be sent to licensing authorities. If the document copied is a passport, a copy of the following pages should be provided:- (i) any page containing the holder’s personal details including nationality; (ii) any page containing the holder’s photograph; (iii) any page containing the holder’s signature; (iv) any page containing the date of expiry; and (v) any page containing information indicating the holder has permission to enter or remain in the UK and is permitted to work.

If the document is not a passport, a copy of the whole document should be provided. Your right to work will be checked as part of your licensing application and this could involve us checking your immigration status with the Home Office. We may otherwise share information with the Home Office. Your licence application will not be determined until you have complied with this guidance. Home Office online right to work checking service As an alternative to providing a copy of the documents listed above, applicants may demonstrate their right to work by allowing the licensing authority to carry out a check with the Home Office online right to work checking service. To demonstrate their right to work via the Home Office online right to work checking service, applicants should include in this application their 9-digit share code (provided to them upon accessing the service at https://www.gov.uk/prove-right-to-work) which, along with the applicant's date of birth (provided within this application), will allow the licensing authority to carry out the check. In order to establish the applicant's right to work, the check will need to indicate that the applicant is allowed to work in the United Kingdom and is not subject to a condition preventing them from doing work relating to the carrying on of a licensable activity. An online check will not be possible in all circumstances because not all applicants will have an immigration status that can be checked online. The Home Office online right to work checking service sets out what information and/or documentation applicants will need in order to access the service. In terms of specific regulated entertainments please note that:

• Plays: no licence is required for performances between 08:00 and 23.00 on any day, provided that the audience does not exceed 500.

• Films: no licence is required for ‘not-for-profit’ film exhibition held in community premises between 08.00 and 23.00 on any day provided that the audience does not exceed 500 and the organiser (a) gets consent to the screening from a person who is responsible for the premises; and (b) ensures that each such screening abides by age classification ratings.

• Indoor sporting events: no licence is required for performances between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000.

• Boxing or Wrestling Entertainment: no licence is required for a contest, exhibition or display of Greco-Roman wrestling, or freestyle wrestling between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000. Combined fighting sports – defined as a contest, exhibition or display which combines boxing or wrestling with one or more martial arts – are licensable as a boxing or wrestling entertainment rather than an indoor sporting event.

• Live music: no licence permission is required for: o a performance of unamplified live music between 08.00 and 23.00 on any day, on any premises. o a performance of amplified live music between 08.00 and 23.00 on any day on premises authorised to sell alcohol for consumption on those premises, provided that the audience does not exceed 500. o a performance of amplified live music between 08.00 and 23.00 on any day, in a workplace that is not licensed to sell alcohol on those premises, provided that the audience does not exceed 500. o a performance of amplified live music between 08.00 and 23.00 on any day, in a church hall, village hall, community hall, or other similar community premises, that is not licensed by a premises licence to sell alcohol, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance from a person who is responsible for the premises. o a performance of amplified live music between 08.00 and 23.00 on any day, at the non-residential premises of (i) a local authority, or (ii) a school, or (iii) a hospital, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance on the relevant premises from: (i) the local authority concerned, or (ii) the school or (iii) the health care provider for the hospital.

• Cross activity exemptions: no licence is required between 08.00 and 23.00 on any day, with no limit on audience size for:

o any entertainment taking place on the premises of the local authority where the entertainment is provided by or on behalf of the local authority; o any entertainment taking place on the hospital premises of the health care provider where the entertainment is provided by or on behalf of the health care provider; o any entertainment taking place on the premises of the school where the entertainment is provided by or on behalf of the school proprietor; and o any entertainment (excluding films and a boxing or wrestling entertainment) taking place at a travelling circus, provided that (a) it takes place within a moveable structure that accommodates the audience, and (b) that the travelling circus has not been located on the same site for more than 28 consecutive days.

Annex 1 - Mandatory conditions

1. No supply of alcohol may be made under the premises licence-

a) at a time when there is no designated premises supervisor in respect of the premises licence, or

b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Annex 2 - Conditions consistent with the Operating Schedule

1. The restrictions on hours during which the sale of alcohol is authorised does not prohibit:

a) during the first 20 minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of alcohol so ordered;

c) the sale of alcohol to a trader or club for the purposes of the trade or club;

d) the sale of supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval military.

2. Alcohol shall not be sold in an open container or be consumed in the licensed premises.

3. Persons under the age of 18 will not be served alcohol.

4. Persons over 18 will not be served alcohol for the consumption of persons under 18.

5. The licensee shall produce and implement a plan outlining how to prevent under age sales.

6. The licensee shall undertake the following:

Check that staff know what current proof of age documents look like.

Ensure that staff understand how difficult it is to accurately judge the age of young people

Instruct staff to ask for proof of age when dealing with young people

Display a notice next to the till or have a till sticker to remind staff about age restricted products.

Train staff about age restricted products and ensure that they sign to confirm that they have understood the training. Keep records of training and instruction given to staff.

Keep a record book of refused sales and instruct staff to complete the details when sales are refused. Regularly review these records and sign that you have done so

In premises where items are scanned at the till, use the bar codes on age restricted goods to activate a till prompt and alert staff to check the age of the purchaser.

Regularly monitor staff to check how they are dealing with age restricted products.

7. Alcohol for sale shall be marked identifying the premises.

8. The premises shall adopt a Challenge 25 policy.

Annex 1 - Mandatory conditions 1. No supply of alcohol may be made under the premises licence:

a) at a time when there is no designated premises supervisor in respect of the premises licence, or

b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

There are further ‘Mandatory conditions’ applicable to licences authorising the supply of alcohol. A full list of the current mandatory conditions is available from the licensing pages on Islington’s web site, www.islington.gov.uk. This list is subject to change by order of the Secretary of State and licensees and other responsible persons are advised to ensure they are aware of the latest conditions.

Annex 2 - Conditions consistent with the Operating Schedule

1) The restrictions on hours during which the sale of alcohol is authorised does not prohibit:

a) during the first 20 minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of alcohol so ordered;

c) the sale of alcohol to a trader or club for the purposes of the trade or club;

d) the sale of supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval military.

2) Alcohol shall not be sold in an open container or be consumed in the licensed premises

Annex 3 - Conditions attached after a hearing by the licensing authority

1. No alcoholic goods will ever be purchased or taken from persons cold calling to the

shop. 2. The licensee will immediately report to Trading Standards any instance of a caller to

the shop attempting to sell alcohol. 3. Invoices (or copies) for all alcoholic goods on the premises will be kept at the shop

and made available to officers from the council, police or HMRC upon request. 4. A stock control system will be introduced, so that the licensee can quickly identify

where and when alcohol goods have been purchased. 5. An ultra-violet light will be available at the premises for the purpose of checking the

UK Duty Stamp on spirits as soon as practical after they have been purchased. 6. If any spirits bought by the company have UK Duty Stamps that do not fluoresce

under ultra-violet light, or are otherwise suspicious, the licensee shall identify the supplier to Islington Trading Standards and HMRC as soon as possible.

7. The licensee shall adopt Challenge 25, the Retail of alcohol Standard Groups advice for off-licences.

8. The licensee shall ensure that staff are trained about age restricted products and ensure that they sign to confirm that they have understood the training. The licensee shall keep records of training and instruction given to staff.

9. The licensee shall put arrangements in place to ensure that before serving alcohol to young persons, staff ask to see accredited proof of age cards for example, proof of age cards carrying the ‘PASS’ logo (and no others) a Passport, or UK Driving Licence bearing the photograph and date of birth of the bearer.

10. The licensee shall require staff to note any refusals to sell to young people in a refusals log. The refusals log shall be checked and signed monthly by the

designated premises supervisor. The refusals log shall be made available for inspection by the licensing team, police or trading standards.

11. Full training will be given to all employees including full written instructions on how to comply with matters set out in the licence conditions.

I am submitting a representation on behalf of the Licensing Authority with respect to the premises

licence application, submitted by Umut Gundogan.

The application is seeking to allow the premises to provide the sale by retail of alcohol, off supplies

only, Mondays to Sundays from 00:00 until 00:00.

The grounds for the representation are:

Prevention of Crime & Disorder;

Protection of Children from Harm; and

Prevention of Public Nuisance.

Background

The applicant is the premises licence holder at both 691 Holloway Road which already has a 24-

hour licence and at 693 Holloway Road where the premises licence allows the sale of alcohol until

23:00 hours and 22:30 hours on Sundays. The applicant wishes to combine both premises and

hold one premises licence.

If approved, the applicant will surrender the two currently held premises licences.

Issues of Concern

1. The premises are located within the Archway Cumulative Impact policy area (LP’s 2&3).

One of the main issues of concern in the Archway Cumulative Impact area is the number of

off licences operating in the area and the impact that widely available alcohol is having on

local residents in terms of nuisance and antisocial behaviour.

Not only does the area have one of the highest concentrations of off licences of any ward in

the borough, with an average of one off licence per 317 residents, the area is home to

Whittington Hospital, mental health facilities as well as a busy transport hub.

2. The onus is on the applicant to demonstrate that these premises will not add to the

cumulative impact. The applicant has made no reference to this policy in relation to their

proposed licensable activities and their potential impact on the local area.

3. The applicant has not mitigated the local area concerns in relation to shops selling alcohol

(LP4) and how it could add to the cumulative impact of such premises on local area

problems such as the high level of street drinkers. The operating schedule (LP7) put

forward within the application has not referenced this issue or put forward appropriate

controls.

4. The application makes no reference to the fact that the hours sought are in excess of the

suggested hours as laid out within LP5 & 6 of the Council’s Licensing Policy or provide any

justification for seeking such.

5. The Licensing Authority seeks to encourage the highest standards of management in

licensed premises and expects this to be demonstrated through the operating schedule.

While the operating schedule (LP7) does reference some controls there is little detail in

areas of Operational policies, staff training and management support or recognition of the

potential for harm linked to the sale of high strength alcohol, a specific local area issue

contributing to Anti-Social Behaviour (LP14).

Summary

The Licensing Authority is frustrated to have had to assess an application that is deficient in

terms of the Council’s Licensing Policy and expects the applicant to respond to the issues

raised within this representation in good time prior to the expected Licensing Sub-Committee

The Licensing Authority believes that it is therefore appropriate for the Licensing Sub-Committee to

determine this application based on any additional supporting information provided and the

perceived suitability of the applicant to effectively operate the proposed licensable premises.

We discussed your intentions, layout alterations, and the current status of work being undertaken to

the address. As I understand it you have taken on both 691 and 693, (the previous tenant at 693

having vacated the address), and have agreement from the landlord to open both as a single

store under 1 new licence, the current 2 (LN/2567-121212 and LN/3088-121219 respectively), to be

surrendered upon successful grant of the new one.

As I explained during my visit, police hold responsibility for ensuring that with any application the

local authorities licensing objectives are adhered to, and that proposals do not invite any

heightened risk or likelihood of crime, disorder or anti-social behaviour.

Further, (and specific to your intended convenience store/off licence operation), there are

significant issues both across Islington borough in general and in your local vicinity with regard to

street drinking, anti-social behaviour, and crime & disorder. You will no doubt also be aware of the

saturation of off-licence premises across Islington and in the vicinity of your premises.

As discussed during our meeting, we the police would not necessarily seek to oppose your

intended operation, usurping as it does a 24hr licence already in existence. However, such an

operation does invite heightened risk and challenge. Will that in mind, and having looked through

the current schedules for the separate licences in operation for both premises, please consider the

following conditions, to be entered under the annex 2 schedule:

1. No beers, lagers or ciders of above 5.5% ABV shall be sold at the premises save for premium beers

and ciders supplied in glass bottles.

2. At any given time no more than 10% of the total sales area shall be used for the sale or display of

alcohol.

3. No spirit miniatures or other bottles below 33cl shall be sold from the premises at any time.

4. No spirits or other alcohol of greater than 18% ABV shall be displayed anywhere other than

behind the til, to be selected from the shelf by a member of staff only.

5. An incident log shall be kept on the premises and will be produced to the Police or other

relevant officers of a responsible authority upon reasonable request. Every entry will be date and

time stamped. Said log will record:

(a) Any refusal of alcohol

(b) Any and all allegations of crime or disorder reported at the venue

(c) Any and all complaints received by any party

(d) Any faults in the CCTV system

(e) Any visit by a relevant authority or emergency service

6. On all dates when Arsenal Football Club is playing at home (accepted as being when the male

1st team is playing at the Emirates Stadium), the following will apply:

a) There shall be no sales of beer, lager or cider in glass containers during the period commencing

2 hours before kick-off and ending 1 hour after the game finishes.

b) No more than four cans or plastic bottles of beer, lager or cider shall be sold to any individual

customer.

c) All persons buying alcohol are to be advised by way of a written/printed notice in the premises

window, and verbally where necessary, of the relevant controlled drinking/street drinking ban.

d) The management undertakes to agree to cease the sale of all alcohol if requested to do so by a

police officer.

7. CCTV shall be installed, operated, and maintained, to function all times that the

premises is open for licensable activities. Said CCTV will comply with the following criteria

(a) The licensee will ensure that the system is checked every week to ensure that the system is

working properly and that the date and time are correct.

(b) A record of these checks, showing the date and name of the person checking, will be kept

and made available to the police or other authorised officer on request;

(c) The Police will be informed if the system will not be operating for longer than one day of

business for any reason;

(d) One camera will show a close-up of the entrance to the premises, to capture a clear facial

image of anyone entering;

(e) The system will provide full coverage of the interior of the premises and any exterior part of

the premises accessible to the public;

(f) The system will record in real time and recordings will be date and time stamped;

(g) The system will be specified so as to operate satisfactorily regardless of lighting conditions;

(h) During opening hours, at least 1 member of staff on duty will be able to operate the system

sufficiently to allow Police or authorised Council officers to view footage on request;

(i) Recordings will be kept for a minimum of 31 days;

(j) Footage will be provided free of charge to the police or other authorised officers upon

request (subject to the Data Protection Act 1998) within 24 hours of any request.

8. The licence holder shall at all times maintain adequate levels of staff and security. There shall at

no time be less than 2 members of staff on duty. There shall be ongoing review as to the need to

employ store detectives and/or security guards at the venue, taking into account the advice both

of the police and any other relevant external advisory agency. Said review will be recorded (in

paper and/or digital form), and made available to the police or local authority upon request.

9. Any and all security/store detective staff employed shall be licensed by the Security Industry

Authority, and will be suitably attired, with accreditation clearly and openly displayed.

10. All sales of alcohol shall be in sealed containers, for consumption away from the premises only

and shall not be consumed on the premises or in the immediate vicinity. Staff will be aware of this

condition and take active steps to uphold it.

11. The premises licence holder shall ensure that all sales staff receive appropriate training in

relation to managing conflict and health and safety of the public and staff.

Training documents shall be signed and dated and will be held in a suitable

hard-copy log, to be made available to a Police Officer or Council Officer upon

request. Said records shall be retained for at least 12 months.

12. In the event that crime or serious disorder is, or appears to have been, committed on the

premises, the management will immediately ensure that:

(a) the police and, where appropriate, the London Ambulance Service, are called immediately.

(b) As far as is safe and reasonable practicable, all measures will be taken to preserve any

identified crime scene pending the arrival of police

13. There shall be no advertising or marketing of alcohol products in the store windows.

14. The licensee shall train and instruct the management and staff to prevent the admission of, and

ensure the immediate and orderly departure of:

a) any and all persons who appear to be drunk and/or disorderly

b) any and all persons displaying signs of other substance abuse.

15. There shall be "CCTV in Operation" signs prominently displayed at the premises.

16. All sales tills will offer a Challenge 25 reminder / prompt the cashier making an alcohol sale to

verify that the customer is over 18.

17. The premises shall operate the Challenge 25 proof of age scheme, whereby the only forms of

acceptable identification shall be:

- Photographic driving licence;

- Valid passport;

- Military/ UK Services Photo ID;

- PASS Hologram ID

18. The premises will be fitted with a burglar alarm system.

19. The premises licence holder shall ensure that the appropriate fire safety, and health and safety

regulations are applied at the premises.

20. A complaints procedure will be maintained, details of which will be made available in store

and upon request.

We are submitting a representation following the application for a licence to permit the sale of alcohol outside framework hours (24 hours) from the above premises. This representation is on behalf of Islington’s Public Health Department, which is a responsible authority.

The impact of alcohol is particularly great in Islington with some of the greatest levels of alcohol-related problems in London1, including:

The third highest rate of alcohol-related hospital admissions in London in 2018-19

The fifth highest rate of alcohol-specific hospital admissions in London in 2018-19

The third highest rate of alcohol-related mortality of all London boroughs in 2016-18

The premises are on Holloway Road, which is located in Junction ward. The location is within the Archway Cumulative Impact Area described in Islington’s Licensing Policy 2018-2022 with a particular focus on the density of off-licence premises (paragraph 58 and 59). The area already experiences significant alcohol-related harm, as described below.

We are concerned that if this application for extended hours is granted, it will increase the availability of alcohol for consumption off premises. This could lead to an increase in public nuisance, crime and disorder and impact adversely on the health of both those buying and consuming the alcohol but also the health of others who come in contact with them.

Alcohol and health Alcohol misuse imposes a major preventable burden to health and the effect of this in Islington is felt across all health services. There is a growing body of evidence that an increased number of alcohol outlets results in significant increases in both alcohol consumption3 and alcohol-related harm, including injury, violence and medical harm. Evidence from a number of countries indicates reducing alcohol outlet

density can have an impact on reducing violence and problem drinking4. There is also evidence that changes in hours or days of trading can have a significant impact on volume of alcohol consumed and rates of alcohol related problems5.

We are concerned that should this application for a 24 hour licence across 691 and 693 Holloway Road be granted, this will increased the frontage and act as a bigger draw to those looking to purchase alcohol including those leaving on-license premises in the area.

Impact of alcohol on health in Islington The impact of alcohol on health in Islington is particularly severe. Alcohol-specific hospital admissions are those which are wholly related to alcohol (e.g. alcoholic liver disease or alcohol overdose). Islington has the fifth highest rate in London for hospital admissions where alcohol is the specific cause of admission8. The rate is also significantly worse than England. Junction Ward, where Aksu Food Centre is located, has a significantly higher rate of alcohol specific hospital admissions than the rest of Islington.

Conclusion Islington experiences some of the highest levels of alcohol-related harm in London and the cumulative availability of alcohol is one area that is likely to be impacting on this.

As detailed in licencing policy (paragraph 59), there is already good availability of alcohol in the area around N19 5SE. There is evidence that increased availability of alcohol, both in terms of the time period in which alcohol is available (hours of sale) and number of premises from which alcohol is available, results in an increase in alcohol-related harm. One effect of this is increased pressure and costs to the NHS. The impacts are also felt across a range of groups including the council, policing and the community as a whole.

Recommendation Islington’s Public Health Department recommends that the application for a licence to permit the sale of alcohol outside framework hours (24 hours) at Aksu Food Centre, 691-693 Holloway Road, Islington, London, N19 5SE is to be refused on the grounds that there is already sufficient supply in an area which already experiences high levels of alcohol-related harm.

Public Nuisance

Junction Ward is designated a Cumulative Impact area, because there is a large number of outlets in the area where alcohol can be purchased. The area also attracts beggars and homeless. The Archway area was designated a Cumulative Impact area because, along with the other Areas, Islington

• was the second highest London Borough and well above the London average,

for violent crimes attributable to alcohol per head of population

• was above average in London for sexual offences in which the suspect had

been drinking alcohol

• had the highest hospital admission rates in London due to alcohol attributable

conditions

• had the sixth highest rate of alcohol related ambulance calls in London

• had 40% of its alcohol-related ambulance calls between 11pm and 4am with a

peak callout on Fridays and Saturdays.

I I oppose granting a new licence in the area. There is no call for another licensed premise and would go against the Council’s Licensing Policy.

Should a licence be granted, which I hope will not happen, then I strongly object to the request for 24 hour sales. Any new licence must comply with the hours set out in our Licensing Policy.

Crime and Disorder

Junction Ward, particularly the Archway area, is one of the worst areas in Islington for almost every type of crime. Crime is frequently fuelled by alcohol use.

See above for other impacts of alcohol on crime.

Public Nuisance

Junction Ward is designated a Cumulative Impact area, because there is a large number of outlets in the area where alcohol can be purchased. The area also attracts beggars and homeless. The Archway area was designated a Cumulative Impact area because, along with the other Areas, Islington

• was the second highest London Borough and well above the London average,

for violent crimes attributable to alcohol per head of population

• was above average in London for sexual offences in which the suspect had

been drinking alcohol

• had the highest hospital admission rates in London due to alcohol attributable

conditions

• had the sixth highest rate of alcohol related ambulance calls in London

• had 40% of its alcohol-related ambulance calls between 11pm and 4am with a

peak callout on Fridays and Saturdays.

I I oppose granting a new licence in the area. There is no call for another licensed premise and would go against the Council’s Licensing Policy.

Should a licence be granted, which I hope will not happen, then I strongly object to the request for 24 hour sales. Any new licence must comply with the hours set out in our Licensing Policy.

Crime and Disorder

Junction Ward, particularly the Archway area, is one of the worst areas in Islington for almost every type of crime. Crime is frequently fuelled by alcohol use.

Appendix 3

Suggested conditions of approval consistent with the operating schedule

1 . All emergency exits shall be kept free from obstruction at all times.

2. Clear and legible notices will be prominently displayed to remind customers to leave quietly and have regard to the neighbours.

3. All staff shall be trained regularly in the prevention of underage sales.

Conditions proposed by the Metropolitan Police

4. No beers, lagers or ciders of above 5.5% ABV shall be sold at the premises save for premium beers and ciders supplied in glass bottles.

5. At any given time no more than 10% of the total sales area shall be used for the sale or display of alcohol.

6. No spirit miniatures or other bottles below 33cl shall be sold from the premises at any time.

7. No spirits or other alcohol of greater than 18% ABV shall be displayed anywhere other than behind the till, to be selected from the shelf by a member of staff only.

8. An incident log shall be kept on the premises and will be produced to the Police or other relevant officers of a responsible authority upon reasonable request. Every entry will be date and time stamped. Said log will record:

a) Any refusal of alcohol

b) Any and all allegations of crime or disorder reported at the venue

c) Any and all complaints received by any party

d) Any faults in the CCTV system

e) Any visit by a relevant authority or emergency service

9. On all dates when Arsenal Football Club is playing at home (accepted as being when the male 1st team is playing at the Emirates Stadium), the following will apply;

a) There shall be no sales of beer, lager or cider in glass containers during the period commencing 2 hours before kick-off and ending 1 hour after the game finishes.

b) No more than four cans or plastic bottles of beer, lager or cider shall be sold to any individual customer.

c) All persons buying alcohol are to be advised by way of a written/printed notice in the premises window, and verbally where necessary, of the relevant controlled drinking/street drinking ban.

d) The management undertakes to agree to cease the sale of all alcohol if requested to do so by a police officer.

10. CCTV shall be installed, operated, and maintained, to function all times that the premises is open for licensable activities. Said CCTV will comply with the following criteria

a) The licensee will ensure that the system is checked every week to ensure that the system is working properly and that the date and time are correct.

b) A record of these checks, showing the date and name of the person checking, will be kept and made available to the police or other authorised officer on request;

c) The Police will be informed if the system will not be operating for longer than one day of business for any reason;

d) One camera will show a close-up of the entrance to the premises, to capture a clear facial image of anyone entering;

e) The system will provide full coverage of the interior of the premises and any exterior part of the premises accessible to the public;

f) The system will record in real time and recordings will be date and time stamped;

g) The system will be specified so as to operate satisfactorily regardless of lighting conditions;

h) During opening hours, at least 1 member of staff on duty will be able to operate the system sufficiently to allow Police or authorised Council officers to view footage on request;

i) Recordings will be kept for a minimum of 31 days;

j) Footage will be provided free of charge to the police or other authorised officers upon request (subject to the Data Protection Act 1998) within 24 hours of any request.

11. The licence holder shall at all times maintain adequate levels of staff and security. There shall at no time be less than 2 members of staff on duty. There shall be ongoing review as to the need to employ store detectives and/or security guards at the venue, taking into account the advice both of the police and any other relevant external advisory agency. Said review will be recorded (in paper and/or digital form), and made available to the police or local authority upon request.

12. Any and all security/store detective staff employed shall be licensed by the Security Industry Authority, and will be suitably attired, with accreditation clearly and openly displayed.

13. All sales of alcohol shall be in sealed containers, for consumption away from the premises only and shall not be consumed on the premises or in the immediate vicinity. Staff will be aware of this condition and take active steps to uphold it.

14. The premises licence holder shall ensure that all sales staff receive appropriate training in relation to managing conflict and health and safety of the public and staff. Training documents shall be signed and dated and will be held in a suitable hard-copy log, to be made available to a Police Officer or Council Officer upon request. Said records shall be retained for at least 12 months.

15. In the event that crime or serious disorder is, or appears to have been, committed on the premises, the management will immediately ensure that;

a) the police and, where appropriate, the London Ambulance Service, are called immediately.

b) As far as is safe and reasonable practicable, all measures will be taken to preserve any identified crime scene pending the arrival of police

16. There shall be no advertising or marketing of alcohol products in the store windows.

17. The licensee shall train and instruct the management and staff to prevent the admission of, and ensure the immediate and orderly departure of:

a) any and all persons who appear to be drunk and/or disorderly

b) any and all persons displaying signs of other substance abuse.

18. There shall be "CCTV in Operation" signs prominently displayed at the premises.

19. All sales tills will offer a Challenge 25 reminder / prompt the cashier making an alcohol sale to verify that the customer is over 18.

20. The premises shall operate the Challenge 25 proof of age scheme, whereby the only forms of acceptable identification shall be:

- a) Photographic driving licence;

- b) Valid passport;

- c) Military/ UK Services Photo ID;

- d) PASS Hologram ID

21. The premises will be fitted with a burglar alarm system.

22. The premises licence holder shall ensure that the appropriate fire safety, and health and safety regulations are applied at the premises.

23. A complaints procedure will be maintained, details of which will be made available in store and upon request.
