Intestacy Rules

The Intestacy Rules maydetermine who inherits yourassets, depending on your

personal circumstances, if you donot have a Will. If you fall into anyof the following categories youneed a Will.

No close living relativesIf you die without leaving a Will,and you have no close livingrelatives, your whole estate will goto the Crown. We help you createa Will that ensures you leave yourassets to chosen beneficiaries.

Co-habiting couplesUnmarried partners who leave noWill do not automatically inheritfrom each other except forproperty owned as beneficial jointtenants. It is therefore importantfor co-habiting couples to makeWills. We can help you protectyour partner.

Married/Civil Partnershipwith no childrenWithout a Will, the law limits theamount a spouse or civil partnerinherits to sums specified byintestacy rules. The remainder ofyour assets will go to othermembers of your family. It isalways best to write a Will.

Married/Civil Partnershipwith childrenWithout a Will, intestacy rules

dictate how your assets will beshared between your spouse orcivil partner, and your children.The rules may not match yourintentions, and the chance toutilise inheritance tax allowancesefficiently will be lost.

Single with childrenIf you leave no Will, your childrenwill inherit all your assets but youwill have missed the opportunity toappoint a guardian, and a trusteefor the management of theirfinances. We can help you protectyour children.

Single with no childrenWithout a Will, your parents willinherit from you or, if they havedied, your closest living relatives.We can help you create a Willthat leaves your assets to thoserelatives, friends or charitiesselected by you.
