In addition to the issues raised in the State’s application, the Court is particularly interested in
briefing and oral argument of the following questions:
1. Whether the corpus delicti rule should be abrogated in light of modern criminal procedure
protections. See, e.g. State v. Mauchley, 67 P.3d 477, 485-87 (Utah 2003) (discussing
modern criminal procedure protections and the necessity of the rule).
2. Assuming the corpus delicti rule is retained, should the sufficiency of the corroborating
evidence be evaluated by 1) the trustworthiness standard, requiring corroboration of the
confession, see Mauchley, 67 P.3d at 488; 2) the traditional standard, requiring slight
evidence, independent of the confession, of the corpus delicti; or 3) both? See Thomas A.
Mullen, Rule Without Reason: Requiring Independent Proof of the Corpus Delicti as a
Condition of Admitting an Extrajudicial Confession, 27 U.S.F. L. Rev. 385, 413 & n. 131
(1993) (collecting cases).
3. Assuming the corpus delicti rule is retained, does it apply to in-court statements, or is it
limited to extrajudicial statements? See Mullen, Rule Without Reason, 27 U.S.F. L. Rev. at
408 (noting that the corpus delicti rule does not apply to infrajudicial statements).
