ThisprojectaimstoassisttheMisrata/TawerghaJointCommitteeinimplementingtheagreedroadmapincludingsupportingtransitionaljusticeprocessesandfacilitatingthereturnoftheTawerghans,andpeoplefromal-Kararim,TominaandKarzaz,insafetyanddignity.Thisincludesaddressingsomeofthefundamentalcausesoftheconflictbetween the communities, dealing with allegations of past human rights violations, and promoting dialoguebetweenthetwocommunities.Italsoaimstosupportcommunitysecuritysothatthedisplacedpeopleareableto exercise their right to return as recognized in the roadmap. I. Situationanalysis
Libya iswitnessing significantpolitical conflict, insecurityandeconomic challengesafter the17February2011revolution.Libya'spoliticalcrisishasbeenfurtherexacerbatedbytheoutbreakofconflictinTripolionJuly2014whichhasledtothedivisionofthecountrybetweentwoparliaments,theirgovernmentsandalliedmilitias.Unless the fighting is stopped through a negotiated settlement, the state institutionsmay sooncollapseandLibya’sfinancialreserveswillsoonbedepletedleadingtoahumanitariandisasterandincreasedsufferingof Libyan citizens. The stabilizationof Libya requiresboth agreementbetween variouspoliticalfactionsaswellasestablishmentofpeacebetweenwarringcommunities.
InaccordancewithitsmandatemostrecentlyrenewedbyUnitedNationsSecurityCouncilresolution2213(2015),UNSMILhasbeenleadinginternationaleffortstomediateapeacefulresolutiontoLibya'spoliticalandinstitutionalcrisisandbringanendtothearmedconflict.TheUNSMIL-facilitateddialoguehasincludeda number of distinct tracks including the main 'political' track; security; tribal leaders; political parties;municipalities; women; and civil society. The political track has resulted in an agreement for theestablishmentofaGovernmentofNationalAccord:on8October2015,UNSMILproposedalistofnomineesfor aGovernmentofNationalAccord (GNA); on17December2015apolitical agreementwas signed toestablishtheGNAandendorsedbytheSecurityCouncil.
Aspartofthemunicipalitiestrack,theUNSMILHumanRights,TransitionalJusticeandRuleofLawDivision(HRD)alsohelpedfacilitateadialoguebetweenMisrataandTawerghawhichhasledtoanagreementtoenter into negotiations on implementing the right of return of Tawerghans to their town. The citywasdestroyedbytheMisratabrigadesinretaliationforwhattheyperceivedasTawerghanscollectivelysidingwith Qadhafi in 2011 and allegedly committing massive human rights abuses. A year-long negotiationresultedinaJointCommittee,consistingofrepresentativesfrombothcommunities,agreeingonaRoadMapon18December2015(seeannex).TheRoadMapoutlinesprinciplesandmeasuresdealingwithreparationsfor victims of human rights abuses; accountability for perpetrators; reconstruction of Tawergha anddamagedareasofMisrata;andthesafeandvoluntaryreturnofTawerghanstotheirareas.TheadoptionoftheRoadMappaves theway formoving forwardonresolvingkey issuesbetweenthe twocommunitiesleadingtothereturnsoftheTawerghans.
The dialogue process between Misrata and the Tawergha demonstrates that it is possible to facilitatedialogue between warring communities in Libya even while the general environment remains deeplypolarized and insecure. These dialogues can contribute to overall stability and confirms the need for asystematicapproachtotransitionaljustice.
ThisprojectaimstoassisttheMisrata/TawerghaJointCommitteeinimplementingareparationprogrammeandfacilitatethereturnoftheTawerghans,andpeoplefromal-Kararim,TominaandKarzaz(areasontheoutskirtsofMisratadamagedbythe2011war),insafetyanddignity.Thisincludesaddressingsomeofthefundamentalcausesoftheconflictbetweenthecommunities,dealingwithallegationsofpasthumanrightsviolations,andpromotingreconciliationbetweenthetwocommunities.ItalsoaimstosupportcommunitysecuritysothatthedisplacedpeopleofTawerghaareabletoexercisetheirrighttoreturntotheircommunityasrecognizedintheroadmap.
Inaddition,theprojectwillbuildthenationalcapacitiesindialoguemanagementandshareexperienceandbest practices with other communities, such as Mashashya and the Gwalish to resolve their conflict.UNSMIL’sHRDenvisagesfacilitatingsimilardialogueprocesseswiththeseandpossiblyothercommunitiesFinally, the project will support institutionalizing transitional justice as a national priority for Libya. Acomprehensivetransitionaljusticeprocesswillenhancethepoliticalandsocialstabilityofthecountry.

II. Strategy
ProjectJustification
FollowingthesigningoftheLibyanPoliticalAgreement,localizedfightinginLibyahascontinuedwhilsttheGovernment ofNational Accord has been establishing itself as the only legitimate government in Libya.Opportunities foraddressingsomeof the localizedconflictsbetweenspecificdisputingparties,however,have recently led to local ceasefire agreements and willingness to resolve disputes through dialogueprocesses. Some communities, especially thosewho have been displaced from their communities, havecometogether,afterseveralroundsoftalksandconfidencebuildingefforts,toexplorehowtotakeforwardreconciliationandpeacebuildinginitiatives.
InDecember2015, forexample, the JointCommittee for theMisrataandTawerghadialoguesreachedacomprehensiveagreement,a roadmapoutlininggeneralprinciplesonmoving forward to“overcomethelegacyofthepastinafairwayandcontributetothebuildingofaLibyabasedontheruleoflaw,justiceandhuman rights.” The roadmap is based on past agreementswhich recognized “the right of the people ofTawerghatoreturntotheirland”(January2015)andnotedtheexpectation“tothereturnofallinternallydisplaced people by 31 December 2015” (March 2015). Upon this basis, the Joint Committee called foraddressingkeyissuessuchasa)reparationofvictims,b)accountabilityofdetaineesandmissingpersons,c)safereturns,d)reconciliation.
Inordertobuildonthismomentumandsupporttheselocalreconciliationefforts,UNSMILandUNDParewellplacedtosupporttheMisrataandTawerghadialogueprocessincludingfacilitatingthedevelopmentofthe operationalization plan for the roadmap, elaborating the processes andmechanisms throughwhichcommunitiescanbebetterequippedtodealwiththepast,andforinternallydisplacedpeopletofeelsafetoreturntotheirhomeswithoutfearfortheirsecurity.
Similarprocesscanalsobesupportedinothercommunities.TheMashashyaandtheGwalish,forexampleareothercommunitieswhicharepreparedtoenterintodiscussiontoreducetensionsbetweencommunitiesandfacilitatethereturnofIDPs.EldersfromZintanandMashashya,forexample,agreedon15January2016toestablishacommitteetooverseethereturnofdisplacedpeopleandareseekingassistanceinfacilitatingthedialoguebetweenthecommunities.TheGwalishlocalcouncilhasalsoestablishedaJointCommitteewiththeKiklamunicipalitytoaddressissuesoflandownershipandreconciliationandsomeIDPshavealreadybeguntoreturntotheirhomes.
InordertofurthersupporttheMisrataandTawerghaprocess,andtheinitiativesintheMashashyaandtheGwalish,thisprojectsupportsathree-prongedapproach:1)facilitatethedialogueprocessandinitiativesforconfidence building and conflict resolution; 2) support transitional justice mechanisms, including fact-finding,documentationandreparationsand3)strengthensafetyandsecurityatthecommunitylevel.
The project also aims to contribute to the overall achievement of the 2030 Agenda for SustainableDevelopment,specificallyGoal16relatedtopromotingpeaceful,justandinclusivesocieties,andparticularlypromotingtheruleoflawandaccesstojusticeforall.
ProjectSummary
TheSupporttoTransitionalJusticeandReconciliationattheLocalandNationalLevels inLibya isa2-yearprojectthataimstofacilitatedialoguebetweendifferentpartiesinlocalizeddisputesandtoworkwiththepartiestoidentifyawaytodevelopcapacitiesforconflictresolution,establishtransitionalprocessestodealwithpastviolationsanddevelopplanstoenhancecommunitysecurity.Theprojectwillsupportkeyactorsatthelocalandnationallevelstoa)continuedialogueprocessesontransitionaljusticeandreturnofIDPs;b)develop strategiesandplans to support transitional justicemeasures; c) support inclusive community

safetyandsecurityplanning.TheprojectwillbeginwiththeMisrataandTawerghadialogueandwillaimtoreplicatetheapproachinothercommunitiesthroughthecourseof2016-2017.
TheoryofChange
Thefigurebelowillustratesthetheoryofchangefortheproject.Theprojectfocusesonthedisputesbetweenspecificcommunitiesandaimstofacilitatedialogueontheimmediateandunderlyingcausesofthedisputes,buildcapacityonconflictresolutionandtransitionaljusticeandsupportplanningforsomelevelofsecurityat thecommunity level to facilitatereturnof IDPstotheirhomes.WhilebeginningwiththeMisrataandTawerghadialogues,itisexpectedthatbasedonthelessonslearnedfromthedialogues,similarinitiativescanbereplicatedinotherpartsofLibya.
The underlying theory of change for the project is that facilitating dialogue between communities,establishingameansofaddressingallegationsofpastviolations,andestablishingamodicumofsecurityatthelocallevelwillreducetensionsbetweencommunitiesinconflictandbegintheprocessofstabilizationandrecoveryforthecommunities.Theoverallaimwouldbetoavoidthecurrentstateofongoingretaliatoryandretributiveviolencebetweencommunitiesandtobuildconfidence/trustforpeopletofeelsafetoreturntotheirhomes.
ProjectContent
Transitional justice processes among communities in conflict in Libya can be sustained and potentiallyexpandedevenasLibyaremainsafflictedbypoliticalpolarizationandsecurityinstability.Infact,theprogressoftheseprocessescancontributetoreducingpoliticalandviolentconflict.Theenvisagedstrategywouldconsistof:
• FacilitatingtheimplementationprocessoftheRoadMapDocumentagreedbyMisrataandTawergha,leadingtothereturnsoftheTawerghans.ThiswillbedonebyorganizingandfacilitatingmeetingsoftheJointCommitteeandprovidingspecializedexpertisetoaddresstheissuesidentifiedintheRoadMapDocument.
• FacilitatingdialogueamongwarringlocalcommunitiesbyusingtheexperienceandknowledgegainedthroughfacilitatingdialoguebetweentheMisratansandtheTawerghans.

• FacilitatingthedesignandimplementationoffurtherstepsinvolvedintransitionaljusticeprocessesinLibyasuchastruthseeking,justice,reparationsandinstitutionalreformaspartoftheeffortstoresolveconflictsbetweencommunitiesinLibya.
• StrengtheningLibyannationalinstitutionalandtechnicalcapacitiesforsettingupoftransitionaljusticeprocessinLibya.
• Assistingintheprocessofreturnofinternallydisplacedinsafetyanddignityaspartoftheprocessofresolvinglocalconflicts.

This output area will focus on enabling the key parties to the disputes from displaced communities tocontinue the dialogue process on transitional justice and return of IDPs. For the case of Misrata andTawergha,thiswillmeanensuringthatanoperationalplanisdevisedbasedontheroadmapofDecember2015.UNDPandUNSMILwillalsoprovidetechnicalsupporttoestablishbaselinesthroughcommunitylevelassessmentsonperceptionsofsafetyandsecurityincludingconfidenceintheconditionsofreturn.
SpecificlessonswillbedrawnfromtheexperiencesofMisrataandTawerghatohelpinformothersimilardialogueprocesses.ForthecaseofMashashyaandtheGwalish,whoareinterestedinundertakingasimilarprocess,theprojectcansupporttheprocesstodevelopagreementstofacilitateareductioninviolenceandareturnoftheIDPstotheircommunities.

UNDPandUNSMILwillprovidetechnicalsupporttodevelopingatransitional justicestrategyatthe locallevelforthedisplacedcommunities.Asoutlinedintheroadmap,thetransitionaljusticestrategywillneedtoconsidermechanismsfordocumentationandfactfindingofpasthumanrightsviolations,reparationsforvictims,andestablishingaccountabilitymechanisms.Asameansoffurtherconfidencebuilding,thesituationofdetaineesandmissingpersonswillalsobeaddressedthroughcapacitybuildingofjusticesectoractorsaswell as supporting systems toexpediteprocessingof cases. Technical expertson transitional justiceandreparationswillbedeployedtoadviseintheprocessandtobringininternationalexperiencesofhowsimilarprocesseshaveworkedinotherplacesandsituations.Theexperiencesofestablishingthesemechanismsatthelocallevelcanalsohelpinformnationalmechanismsfortransitionaljustice.
UNDPandUNSMILwillalsoidentifymeansthroughwhichtosupportconflict-affectedpopulationswithlegalandpsychosocialsupport,includingthroughcivilsocietyandotherthirdpartymechanisms.

The Transitional Justice project teamwill need towork closely to coordinatewith other ongoingUNDPprogrammestobuildsynergiesacrossthedifferenteffortstosupportLibya in itsrecoveryandtransitionprocess.Theseprojectsincludethefollowing:
• StrengtheningLocalCapacitiesforResilienceandRecoveryprogramme,whichfocusesonsupportingthe work of localmunicipalities including to support basic service delivery, address communitysecurityandconflictresolutionandpromotelivelihooddevelopment.
• StabilizationFacilityforLibya,whichprovidessupporttoenhancethelegitimacyoftheGNAthroughrehabilitationofcriticalinfrastructureandbusinessesdestroyedbytheconflict,boosttomunicipalcapacityandshorttermconflictresolutionsupport.
• ImmediateAssistancetotheLibyanPoliticalDialogueandGovernmentofNationalAccord,whichcontinuestoprovidesupporttotheUNSMIL-ledpoliticaldialogueprocess.
• Capacity Strengthening Initiative project,which focuses on institutional strengthening of Libya’spublicadministrationtodelivercoregovernmentfunctions.
• Assistance to Building a Constitution project, which supports the development of Libya’s newconstitution.
• SupporttoCivicEngagementProjectwhichaimstopromotesocialcohesionanddialogueespeciallybybuilding capacityofwomenandyouth toengage in thedialogueprocessesandbyprovidinggrantstoCSOs.
UNDPExperienceinLibyaandinTransitionalJustice
UNDPhasbeenworkinginLibyasince1970sandsince2011wasengagedwiththegovernmenttosupportingthetransitionfromauthoritarianrulethroughgovernanceanddevelopmental interventions, includingonstrengthening the rule of law and policing and facilitating political and administrative reform. UNDPcontinuestohavepresenceonthegroundinTripoliandanofficeinTunissupportingprogrammingonthegrounddespitetheoutbreakofviolenceinmid-2014.

Globally,UNDPdrawsonoveradecadeofexperienceinsupportingtransitionaljusticeinitiativesworldwide.In Guatemala, UNDP focuses on providing support to victim-centered approaches to transitional justiceincludingsupportingNGOsinbringingprivatecomplaintsinhumanrightscases,enablingpublicaccesstoarchives,identificationandreturnofvictims’remainstotheirfamilies,andreparationstoSGBVvictims.InEasternDRCaloneandspecificallyinrelationtoSGBV,justice-sectorsupportrunsthegamutofaccesstojusticethroughlegalrepresentation,communitypolicing,mobilecourts,and(underthepovertyalleviationpillar)reintegrationofsurvivorsthrougheconomicregenerationefforts.InBosniaandHerzegovina,UNDPhasworkedwithnationalauthoritiestodevelopbroad-basedstandardsforwitnessandvictimsupportafterconductingamajorneedsassessmentandbroad-basedparticipatorypublicconsultationthatinformedthedevelopmentofacomprehensivetransitionaljusticestrategy.Aspartofits2014-2017StrategicPlan,UNDPprioritizes support to transitional justice and assists societies to address legacies of gross human rightsabusesinpost-conflictandpost-authoritariancontexts.
ExitStrategyandSustainability
TheSupporttoTransitionalJusticeattheLocalandNationalLevelsinLibyaaimstoprovideimmediate,short-term support to respond to priorities that have emerged out of sub-national dialogue processes and tocontinuefacilitatingdialoguebetweenpartiesinvolvedinspecificdisputes.Italsoaimstocollectlessonsandbegin the discussions on national transitional justice processes to contribute to more long termstrengthening of national mechanisms to address impunity and promote access to justice. Once aGovernmentofNationalAccordisformed,UNDPwillbeabletofurtherdevelopsustainableandlongerterminterventionsindiscussionwithnationalpartnerstosupportcapacitiesonruleof law,ensuringaccesstojusticeandpromotingtransitionaljusticeprocessesthroughoutLibya.

II. ManagementArrangements
4.1.Programmeoversightandmanagementstructure:TheTransitionalJusticeProgrammewillfollowaDirectImplementationModality(DIM)wherebyUNDPtakesentire responsibility for the implementationofprogrammeactivitiesbut remains guidedby theprinciplesofnationalownership.ProgrammeimplementationwillfollowUNDP’srulesandregulations.TheoverallaccountabilityforprogrammemanagementwillalsorestwithUNDPLibyaCountryDirectorwhileday-to-daymanagementoftheactivitieswillbewiththeUNDPProgrammeManagerreportingtotheCountryDirector.All financial resourcesmobilizedwill be channeled through theUNDPContributionBankAccount andfundswillbemanagedbyUNDP.UNDPwillutilizethefast-trackcrisisresponsecontractandprocurementmanagementprocedurestoexpediteeffectiveandtimelyservicesrequiredforthesuccessofthesupportprovidedtotheTransitionalJusticeinitiativeduringthelifespanoftheproject.Technically,theprojectwillbeimplementedinaccordancewiththerecommendationscontainedwithintheSpecialReportoftheSecretary-GeneralontheStrategicAssessmentoftheUnitedNationsPresenceinLibya,February2015.Undertheserecommendations,UNSMILoperatesatthestrategiclevel,andtheprogrammaticandoperationaltasksshouldbedeliveredchieflybyUnitedNationsagencies,fundsandprogrammes,workinginpartnershipwiththeMission.ProjectBoardAProjectBoardwillbeestablishedtoensurestrategicdirectionandoverseetheimplementationoftheproject.TheprojectboardwillconsistofUNDPseniormanagement(UNDPResidentRepresentativeorCountry Director), representatives fromUNSMIL and partneringUN agencies, a representative of theGovernment when it is established, and key donors to the project (including Germany, Italy andSwitzerland).TheProjectBoardwillmeeteveryfourmonthstoreviewtheprojectprogress,challengesanddirectionandtoreviseactivitiesforthefollowingfourmonthperiodasrequired.The Project Board is the group responsible formaking, by consensus,management decisions for theprojectwhenguidance isrequiredbytheprojectmanager includingrecommendationsforapprovalofprojectannualworkplansandrevisions.InordertoensureUNDP'sultimateaccountability,ProjectBoarddecisionsaremadeinaccordancewithstandardsthatensuremanagementfordevelopmentresults,bestvalueformoney,fairness, integrity,transparencyandeffective internationalcompetitionprocesses. Intheeventaconsensuscannotbereachedwithin theBoard, the finaldecisionwill restwith theUNDPResidentRepresentative/CountryDirectorasperUNDPpolicy.TheProjectBoardhasthefollowingresponsibilities:

IV. LegalContext
ThisprogrammedocumentshallbetheinstrumentreferredtoassuchinArticle1oftheSBAAbetweentheGovernmentofLibyaandUNDP,signedon20May1976.
ConsistentwiththeArticleIIIoftheStandardBasicAssistanceAgreement,theresponsibilityforthesafetyand security of the executing agency and its personnel and property, and of UNDP’s property in theexecutingagency’scustody,restswiththeexecutingagency.
Theexecutingagencyshall:a) putinplaceanappropriatesecurityplanandmaintainthesecurityplan,takingintoaccountthe
securitysituationinthecountrywheretheprojectisbeingcarried;b) Assume all risks and liabilities related to the executing agency’s security, and the full
implementationofthesecurityplan.UNDPreservestherighttoverifywhethersuchaplanisinplace,andtosuggestmodificationstotheplanwhennecessary.Failuretomaintainandimplementanappropriatesecurityplanasrequiredhereundershallbedeemedabreachofthisagreement.
TheexecutingagencyagreestoundertakeallreasonableeffortstoensurethatnoneoftheUNDPfundsreceived pursuant to the Project Document are used to provide support to individuals or entitiesassociatedwithterrorismandthattherecipientsofanyamountsprovidedbyUNDPhereunderdonotappearonthelistmaintainedbytheSecurityCouncilCommitteeestablishedpursuanttoresolution1267(1999).Thelistcanbeaccessedviahttp://www.un.org/Docs/sc/committees/1267/1267ListEng.htm.Thisprovision must be included in all sub-contracts or sub-agreements entered into under this ProjectDocument.

RoadMapDocument
18.12.2015Introduction1. TheMunicipalCouncilofMisrataandtheLocalCouncilofTawerghaproposedaJointCommitteeto
dealwith thedossierof the twocommunities, inaccordancewith theoutcomeof themeetingofLibyanMunicipalitiesheldon28-29January2015inGenevaundertheauspicesoftheUnitedNationsSupportMissioninLibya(UNSMIL).
2. FollowingdiscussionsofanumberofconcernsaffectingLibyaincludingtheissueofthereturnofthosedisplaced, the meeting affirmed in its final statement on 29 January “the right of the people ofTawerghatoreturntotheirlandthroughtheestablishmentofaCommitteetodiscussthemechanismtoachievethatonthegroundandtoremoveallobstaclesandpreparealltheappropriateconditions”.
3. Themeeting also agreed thatUNSMILwould “follow up this process in cooperationwith the two
sides”. Accordingly,UNSMIL’sHumanRights,TransitionalJusticeandRuleofLawDivisionassistedthedialoguebetweenthetwocommunities,includingbyprovidingtechnicalassistance,organizingand facilitating meetings and training workshops for both sides outside Libya in order to shareknowledgeandbenefitfromcomparativeinternationalexperiences.
4. TheLibyanMunicipalitiesmeetingheldunderUNSMIL’sauspiceson23-24March2015inBrussels
alsocommitted“tothereturnofall internallydisplacedpeopleby31December2015”. TheJointCommitteenotesthattheneedtoaddresstheissueofthereturnofallinternallydisplacedwithinthisdeadlinewasnotpossibleduetotheprevailingsituationinLibya,buthopesthattheestablishmentoftheLibyanGovernmentwouldcontributetoaccomplishingitasspeedilyaspossible.
5. The establishment of the Joint Committee for the two communitieswas confirmed at ameeting
betweenMisrataandTawergharepresentativesinTunison27-28May2015.Thetermsofreferenceof the Joint Committee were defined on the basis of the meeting of Misrata and TawergharepresentativesinTunison27July2015.Thetermsofreferenceincluded:
• toreachanunderstandingoftherequirementsofjusticeforbothsides;• toagreeproposals toaddresstheneedsofvictimsofbothsides, includingreparationsforthe
harmtheysuffered;• toworkonidentifyingthephysicalconditionsnecessarytosupportvoluntaryandsafereturnsto
Tawergha,al-Kararim,TominaandKarzaz;• tomakeproposalsforthemaintenanceofpeaceandthepromotionofreconciliationbetween
MisrataandTawerghaandforthegoodofLibya;• toagreeacomprehensiveoperationalplantoaddresstheseobjectives.
6. ThemembersoftheJointCommitteewereselectedinAugust2015.TheJointCommitteemetseveraltimesbetweenAugustandDecember2015inTripoli,TunisandGeneva.Inaddition,asub-committeeoftheJointCommitteemetseveraltimestodiscussspecificandimportantissues.ThegovernmentsofGermanyandSwitzerlandsupportedthemeetingsinTunisandGenevafacilitatedbyUNSMIL.

7. TheJointCommitteetookseveralinitiativesduringthisperiodtobuildconfidence
between the two communities, including by encouraging the release of a number of prisoners;assisting in the transfer of civil status and student files to those concerned; distributing schoolmaterialsandorganizingmeetingsoffamiliesfrombothsides.
8. TheJointCommitteeagreesonthefollowingaspartofitseffortstoarriveatasettlementonissuesthathaverisenbetweenthetwocommunitiesduringtheconflictin2011.
I.Generalprinciples9. The JointCommitteeseeks tosatisfy the legitimateaspirationsofboth theMisrataandTawergha
communitiesinanefforttoovercomethelegacyofthepastinafairwayandcontributetothebuildingofaLibyabasedontheruleoflaw,justiceandhumanrights.
10. In carrying out its specific tasks, the Joint Committee is ready to cooperate with the LibyanGovernment through the local administrations in both areas which would help accelerate thevoluntaryandsafereturnofthosedisplacedassoonaspossible.
11. The Joint Committee calls on the Libyan Government to give priority to the setting up of a
comprehensive transitional justice program that includes the intrinsically linked pillars of truth-seeking, reparation, justice and reform. The Joint Committee asks the Libyan Government toacceleratetheestablishmentoffact-findingandtruthseekingcommittee,whichwouldhaveamongitsprioritiestheexaminationoftheeventswhichtookplaceduringperiodbetween17Feband11Augast2011inTawergha,al-Kararim,TominaandKarzaztoguaranteenon-repetitionoftheabuses.The JointCommittee is ready toworkwith theLibyanGovernment toachieve thesegoals for thebenefitofLibyaasawhole.
12. TheJointCommitteeemphasizesthenecessityofaddressingthecurrenthumanitariansituationof
thedisplaced.II.Reparationsforvictims13. TheJointCommitteeaffirmstheimportanceofaddressingtheneedsofallvictimsofhumanrights
violations.
14. TheJointCommitteeacknowledgesthatareparationprogrammeneedstoincludemultipleprocessessuchasclassifyingandprioritizingviolations;identifyingandprioritizingbeneficiaries;andagreeingon the type of reparations –material andmoral, individual and collective – and criteria for theirdeterminationtakingintoaccountthegravityoftheviolationsandtheharmsuffered.
15. Intheabsenceofacomprehensivenationalreparationinitiative,theJointCommitteewilldesignwith
theassistanceofinternationalexpertsareparationsprogrammethatiscredible,transparent,basedonappropriatedocumentationandinlinewiththeprinciplesoffairnessandnon-discrimination.Thisiswithoutprejudicetotherightofvictimstosubmitindividualrequestsforreparationsinrelationto

period after the agreed date, through the transitional justice mechanisms which the Libyangovernmentwillimplementorthroughbringingcasesbeforethenationalcourts.
Timeframeandphasedapproach16. TheJointCommitteehasagreedthatthereparationprogrammewillinprincipleaddresstheneedsof
victimsfrombothsidesfortheperiodbetween17February2011and11August2011.Theneedsofthevictimsfortheperiodfollowing12August2011willbeaddressedsubsequentlyintheframeworkofanationalprogrammetobeapprovedbytheLibyanGovernment.
Typeofreparations17. Reparations will include both material and moral reparations as wel as providing medical and
psychologicalsupport.Reparationswerecategorizedasfollows:MaterialReparations: They includeefinancialcompensationforassets,capture,torture,unlawfuldetention,deathunder tortureandsummaryexecution.Under thiscategory, thenumberswillbeidentifiedandthenecessaryestimationforthereparationwillbepreparedwiththeagreementofallsideswithoutexclusionofanyvictim.Thiswillbedoneinfulltransparency.Inordertoregulatethereparationsprocedure, itwillbenecessarytodefinethetimeframeandtopresentthedocumentsprovingtheharmsufferedandexplainingthetypeofharm.Health and Psychological Reparations: It includes identifying the type of harm from themedicalreports,whileprovingthattheharmwassufferedinrelationtothespecifiedeventsandduringtheagreedperiods.Thematerialvaluewillbedefinedandeffortswillbeaccomplishedtoallowthevictimtoreceivetreatmentinaneasyandcontinuousmanner,untiltheendoftheharmsuffered,whetherthetreatmentisinsideorabroad.Itincludestheirassistanceinreceivingadministrativefacilitationregardingentryvisas,residenceandcoveringtheexpensesofthetreatment.Psychologicalreparationswillbeprovidedintheformofpsychologicalsupportthroughestablishingpsychologicalsupportunitsinsideoroutsidethecountry,accordingtothecase,andtheirsupportinreceivingadministrativefacilitationregardingentryvisas,residenceandcoveringtheexpensesofthetreatment.TheJointCommitteealsoconsidersthereturnofthedisplacedasfulfillingtheirrighttorestitution,includingrestorationofhousing,landsandpropertiesaspartofthereparations.
Funding18. Theimplementationofareparationprogrammewillrequirehumanandfinancialresources.TheJoint
CommitteeregretsthatsuccessiveLibyanGovernmentsdidnotaddresscomprehensivelytheneedsof victimsandasserts that the Libyan statebearsultimate responsibility for covering the costsofreparations.
19. AtrustfundsupportedbytheLibyangovernmentshallbeestablishedtofundtheproject.DonationsfromlocalandinternationalentitiesthatwishtosupporttheLibyanpeoplesolvingtheircrisiswillbecollectedthroughthetrustfund.ThetrustfundwillonlyconcerntheMisrata/Tawarghafile.ItcanbeexpandedtocollectfundsforthereconstructionofTawargha,al-Kararim,TomminaandKerzaz.

III.Accountability,detaineesandmissingpersonsJudicialscreeningofdetainees20. TheJointCommitteecallsontheLibyanGovernmenttoensurethepromptscreeningofthedetainees
todeterminewhoshouldbereleasedandwhoshouldbechargedandbroughttotrialonthebasisofLibyanlegislationandinternationalstandards.�TheJointCommitteeunderlinestheneedforreferralstotrialtobebasedonsolidevidenceandoninvestigationsconductedbyindependent,impartialandprofessionalpublicprosecutors.
21. TheJointCommittee isreadytoreferanyrelevantdocuments itreceivesthrough itswork,andto
facilitatethesubmissionofinformationonpossiblecrimes,totherelevantjudicialauthorities.22. TheJointCommitteeaffirmsthatconfessionsandotherinformationacquiredundertortureorother
formofcoercionmustnotbeusedinthisprocess.23. TrialsshouldbeunderLibyanlaw.Theconvictedhavetherighttoanappeal.Thosereleasedfrom
detentionshouldbeprovidedwithdocumentationindicatingtheperiodoftheirdetention,withoutprejudicetotheirrighttogocourt,iftheywerenotprovenguilty.
Holdingdetaineesandprisoners24. TheJointCommitteecallsontheLibyanGovernmenttoensurethattheauthoritytoarrestandhold
detainees and prisoners is exercised exclusively by the competent judicial authorities, and thatdetaineesandprisonersareheldinofficiallyrecognisedfacilitiesundertheeffectiveoversightoftherelevantLibyanauthoritiessuchastheJudicialPolice.
Judicialpursuitofsuspectsnotindetention25. TheJointCommitteecallsontheLibyanGovernmentandtheinternationalcommunitytocooperate
inidentifyingandpursuingsuspectedperpetratorsofcrimeswherevertheymaybe, internallyandabroad,inlinewithfairtrialproceduresandinternationalagreementsonjudicialcooperation.
Missingpersons26. TheJointCommitteeiscommittedtocooperatewiththeLibyanGovernmentandrelevantbodiesand
internationalorganizationsinthecollectionofinformationonmissingpersonsinordertoestablishtheirfate.
IV.Safereturns27. TheJointCommitteeacknowledgestheimportanceofensuringthephysicalsafetyofthereturnees
andcalls for theconductassoonaspossibleofanassessmentof the levelofcontaminationfromminesandexplosiveremnantsofwar (ERWs) inTawergha,al-Kararim,TominaandKarzazandthedevelopmentandimplementationofadecontaminationplan.

28. TheJointCommitteewillcoordinatewithlocalandinternationalbodiestolaunchassoonaspossible
aprogrammetosensitizethereturnpopulationsofthedangersofminesandERWs.
Protectionfromactsofviolence29. The Joint Committee acknowledges that the function of protecting returnees and in general of
securinglawandordereverywhereinLibyabelongstotherelevantStateinstitutions,specificallythepolice,judiciaryandprisonservice.
30. TheJointCommitteesuggeststheadoptionofacomprehensivenationalprogrammeunderfullstateauthorityofthepolice,thearmyandthejudiciarytosecuretheareaagainstanyactsandtoensurethe rule of law. Pending the rebuilding of the security,military and judicial institutions, the JointCommitteemaysuggesttothelocalauthoritiestheformationofaforceundertheMinistryofInteriorordefense,assignedwithpreservingthesecurityoftheroadsandthestateinstitutionsinthearea,securingcitizensandnotallowinganybreachesofthelaw.
V.Otherconditionsforreturns31. The JointCommitteecommits itself to respecting the rights,needsand legitimate interestsof the
internallydisplacedandwillfacilitatetheirvoluntaryreturninsafety.TheJointCommitteewillworkwithnationalauthoritiesandrelevantinternationalactorstoensurethatreturnsareundertaken.
Voluntarinessandparticipation32. The Joint Committee stresses that the returns ought to be based on the informed and voluntary
choices of the displaced. The Joint Committeewill respect the choice of those deciding to settleelsewhereandwillnotregarditasarenunciationoftheirrighttoreturntotheirplacesoforiginatalater time or on an occasional basis. The Joint Committee will facilitate the full participation ofinternallydisplacedpersons,includingwomen,intheplanningandmanagementoftheirreturn.
Reconstructionandeconomicactivities33. TheJointCommitteeseeksnationalandinternationalsupportforthereconstructionofTawergha,al-
Kararim,TominaandKarzaz–includinghousing,schools,healthcentres,lawenforcementandotherfacilities.Suchreconstructionmayneedtobephasedand involvetherestorationofbasicservicessuch as water, electricity,medical facilities and schools. National and international actors shouldsupporttheresumptionofeconomicactivities.Thereturnshouldnotbelinkedtothecompletionofthereconstructionprocess.
VI.Maintainingpeaceandpromotingreconciliation
34. TheJointCommitteeaffirmsthattheultimateobjectiveofitsworkistherestorationofpeaceandthe
promotionoftrustandreconciliationbetweenbothcommunitiesandatthenationallevel.

35. The agreement betweenMisrata and Tawergha leaders, the discussion amongmembers of both
communities and the establishment of the Joint Committee to conduct a systematic dialoguedemonstratethewillingnessandthecommitmenttoamicablyresolveissuesofcontentionandpavethewayforreconciliation.
36. TheJointCommitteewillstrivetoensurethatthereturnsandallotheraspectsofitsworkfacilitate
theactiveparticipationofwomenandtakeintoaccounttheirconcernsandspecificneeds.
37. TheJointCommitteewillalsostrivetoensurethatthebestinterestsofchildrenaretakenintoaccountinthereturnsandallaspectsofitswork.
Communityengagement
38. TheJointCommitteerecognizestheimportanceforthetwocommunitiesofre-buildrelationshipsin
theyearsahead.IturgeslocalleadersofMisrataandTawerghatopromotejointandwidediscussionforumsandotherinitiativesaimedatencouraginggoodcommunicationsandfriendlyrelations,andadvisingonthemaintenanceofpeaceatcommunitylevels.
39. The Libyan Government, local authorities and councils of elders are invited to encouragereconciliationbetweenthetwoparties.Itmayseektheassistanceofanysuitableactortofacilitatemeetingsbetweenthetwosides.
40. The Joint Committee calls on all segments of society to engage in reconciliation, particularly the
victimsduetotheirprominentroleinestablishingpeaceandreconciliation.41. The Joint Committee specifically calls on all media to promote in their discourse reconciliation
betweenthetwocommunitiesandinLibyaasawhole.VII.Stepstobeundertakenduringthefirstquarterof2016
• Continuethereparationprocessincludingtheidentificationofthefirstsetofbeneficiariesandthenatureofcompensation;andinitiatereparationsprogrammesforphysicalandpsychologicalrehabilitationinLibyaandabroad.
