Ordinance, I, SIR HAROLD ALFRED MACMICHAEL, G.C.M.G., D.S.O., High Commissioner for Palestine, do hereby proclaim that the lands described in the Schedule hereto are Forest Reserves under the control and management of the Government. 1. . These Regulations may be cited as the Defence (Amend­ment) Regulations (No. 29), 1942, and shall be read as one wi th the Defence Regulations, 1939, hereinafter referred to as the prin­cipal Regulations.

•. 2. Regulation 31 of the principal Regulations shall be amended by the deletion of the marginal note thereto and by the substitution of the following marginal note therefor :—

"Rules as respects certain places and areas".

3. The following regulation shall be inserted in the principal Regulations, immediately after regulation 31 thereof :—

"Controlled areas.

31A. The H i g h Commissioner, if satisfied wi th respect to any area that it is necessary or expe­dient, i n the interests of the public, safety or the defence of Palestine or the efficient prosecution of the war or the maintenance of public order, to empower any military authority to impose from time to time restrictions upon the entry into that area of persons who are not resident or employed therein, may by order declare that area to be a controlled area for the purposes of these Regula­tions ; and while the order is in force any military authority specified in that behalf in the order may, subject to any restrictions imposed by the H i g h Commissioner, give directions prohibiting or regu­lating the entry of such persons as aforesaid into the area, or such parts of the area, and for such periods, as may be specified in the directions, and providing for the removal of persons who are i n the area or such parts of the area in contravention of the directions.

A n y area in relation to which an order made under this Regulation is in force is hereafter i n these Regulations referred to as a "controlled area" ."

1. These Regulations may be cited as the Defence (Bills of Exchange etc.) Regulations (No. 2), 1942.

2. —(1) These Regulations shall apply to bills of exchange and promissory notes which —

(a) at the date of the publication of these Regulations in the Gazette are held as security for a loan granted for agricul­tural purposes by an approved company within the meaning of the Short Term Crop Loans (Security) Ordinance, 1935, and

(b) fell due for payment between the 1st January, 1938, and the 31st December, 1938, •both dates inclusive, and

(c) at the date of the publication of these Regulations in the Gazette are unpaid in whole or i n part.

(2) For the purpose of this Regulation the term "agricultural purposes" includes husbandry of all kinds, purchase of live stock, seed and fertilizer, and improvements (whether temporary or per­manent) to the land designed to conserve the soil, to improve the fertility of the land, or to provide accommodation for live stock or storage for produce.

3. I n the case of actions taken on bills of exchange and promis­sory notes to which these Regulations apply, section 96(1) of the Bi l l s of Exchange Ordinance shall be deemed to be amended by the substitution of the words "s ix years" for the words "five years" appearing therein.

4. Paragraphs of the principal Order shall be amended —

(a) by the substitution of the word "Direc tor" for the words "Dis t r ic t Commissioner" appearing in the marginal note to that paragraph;

(b) by the revocation of paragraph (1) thereof and the substitu­tion of the following paragraph therefor :—

"(1) The Director shall consider any dispute so reported and, if he deems fit, the Director, or any regional in­spector of the Department of Labour required by the Director to do so, shall endeavour to conciliate the parties by all means at his disposal and shall for this purpose make use of any existing machinery for the settlement of disputes as may seem to h im appropriate to this end ." ; and

(c) by the substitution of the words "the Director" for the words "the District Commissioner" wherever they appear in sub-paragraphs (2) and (3) thereof.

5. Paragraph 5 of the principal Order shall be amended by the substitution of the words "the Director or a regional inspector of the Department of Labour" for the words "the District Commis­sioner" appearing in that paragraph.

"6 . ,Where after endeavour has been made by the Director or a regional inspector of the Department, of Labour to con­ciliate the parties under paragraph 4 of this Order, no settle-men t i s reached within twenty-one days after the date upon which the dispute was reported to the Director, the Director shall without delay report the circumstances of the dispute to

1. This Order may be cited as the Gaza (Precautions against Fire) (No. 2) Order, 1 9 4 2 .

2 . t־ This Order shall apply to all premises situated in the Town Planning Area of Gaza.

3 . I n this Order, "Director of Passive Defence" and "Deputy Director of Passive Defence" mean the Director of Passive Defence and the Deputy-Director ׳ of Passive Defence for Gaza District , respectively, appointed under the Defence (Passive Defence Services) Regulations, 1 9 4 1 ; " W a r d e n " means a member of the Corps of A i r Raid Wardens and F i re Watchers established under the Defence (Passive Defence Services) Regulations, 1941.

4 . Every house holder shall keep in his house, or in the open yard adjoining such house, one receptacle containing sand and one or two receptacles containing not less than 36 litres of water.

5. The keeping of any movable inflammable material (excepting wireless masts, flag-poles or washing) on the roof of a flat-roofed house,•or in the space between the roof and the ceiling of the top storey of a house with a pitched roof, is hereby prohibited.

6. The occupier of any premises used for business, commercial or manufacturing purposes which are left unoccupied for any period in the 2 4 hours of each day shall provide fire fighting appliances to the satisfaction of the Director of Passive Defence or the Deputy Director of Passive Defence, and shall affix on the main door of his premises a notice, in two of the official languages, i.e. Engl i sh and Arabic, stating where and how the premises may be entered and the place at which the keys may be obtained during any period in which the premises are left unoccupied. The keys, during such absence, must be kept at some place which is a reasonably short distance from the premises.

7. A n y police constable or any Warden shall have the right to enter any premises to which this Order applies to ensure compli- ׳ ance wi th the provisions of this Order.

8. If ' the' provisions of this Order are not complied wi th i n respect of any premises, the occupier of the premises shall be guilty of an offence and liable upon conviction to a fine not exceeding twenty pounds.

1. This Order may be cited as the Trading with the Enemy (Specified Persons) (Amendment) Order (No. 17), 1942, and shall be read as one with the Trading with the Enemy (Specified Per­sons) (Amendment) Order (No. 14), 1942, hereinafter referred to as the principal Order.

2. The Schedule to the -principal Order shall be varied :—

(a) by inserting therein the names and addresses specified in Part I of the Schedule to the United Kingdom Trading with the Enemy (Specified Persons) (Amendment) Order (No. 17), 1942 (Statutory Eules and Orders 1942 No . 2154), herein­after referred to as the Amending Schedule;

(b) by deleting therefrom the names and addresses'specified in Part I I of the Amending Schedule;

(c) by making therein the amendments specified in Part I I I of the Amending Schedule. •

3. The Amending Schedule shall be deposited at the office of the Custodian of Enemy Property, Jaffa,Road, Jerusalem, and any person may inspect it free of charge on any day, except a Saturday, Sunday or public holiday, between the hours of 9 a.m. and 12 noon. Wri t ten enquiries as to whether the name of a particular person is contained in the Amending Schedule shall be answered free : of charge.

I N E X E R C I S E of the powers vested in them by paragraph 1 4 of the Loca l Councils (Givatayim) Order, 1 9 4 2 , the Loca l Council of Givatayim, with.the approval of the District Commissioner, Lydda Distr ict , have made the following by-laws :—

1. These by-laws may be cited as the Givatayim (Advertise­ments) By-laws, 1 9 4 2 .

2 . I n these by-laws, unless the context otherwise requires :—

"Advertisement" means any notice or illustration, placard, carving, drawing, design, or photograph displayed in any public place, on paper, cardboard, canvas, wood, glass or metal or otherwise, as well as any copy of any advertisement, and includes any advertisement lighted electrically or other­wise, and any cinematograph film displayed in any public place, other than in places of public entertainment duly licensed, and any notice or special issue of any newspaper, but does not include signboards.

"Signboard" means any notification exhibited upon the resi­dential premises, office or place of business of any person, including a signboard, written, fixed or posted on a wall or other place, upon which is inscribed only the name of such person, or the nature of the business or occupation carried on in such premises or a statement of any other purpose for which such premises are used or both the name of such person and any such notification or statement.

"Advert ise" means to post, exhibit or otherwise display any advertisement in any public place.

"Pub l ic place" includes any road, street, avenue, public gar­den, lane, alley, square, and any passage either public or private, open to the public, unoccupied site, as well as a bridge, sidewalk, fence, board, boarding, hoarding, tree, post, gate, any external part of any building or fence and any place of public entertainment.

3. No person shall advertise or provide for the posting of any advertisement in any public place other than those described in the Ei rs t Schedule to these by-laws or such places that may from time to time be added to such schedule.

4 . No person shall exhibit any advertisement within the boun­daries of the Loca l Council area of Givatayim in form or size other than prescribed i n the Second Schedule to these by-laws.-

Charges for 5.—(1) The following charges may be levied by the Council exhibition of upon the exhibition of advertisements : advertisements. •

(a) In respect of any advertisement displayed upon the screen of any cinema—a charge not exceeding one mi l for each 100 square centimetres of the surface of the screen occupied by such advertisement for each period of a week from Saturday evening to Friday inclusive or for any part of such period, such charge to be levied upon the proprietor or manager of the cinema.

(b) I n respect of any advertisement lighted electrically or otherwise—a charge not exceeding one mi l for every five square centimetres of any place occupied by such advertise­ment for a period of a month or any part thereof, provided that, if the Council shall instal special places for the exhibi­tion of lighted advertisements, they may levy a charge not exceeding one mi l for each square centimetre of any such place occupied by such an advertisement for a period of a month or any part thereof. Such charge shall not include any costs or expenses in connection with the wri t ing, designing, carving or any other inscription of such advertisement.

(c) I n respect of any other advertisement—a charge of one mi l per every ten square centimetres of surface of the ad­vertisement for each period of three days or part thereof regardless of the number of copies of such advertisement. One third of that charge shall be levied for the fourth and each subsequent day of advertising. Any charge levied under this paragraph shall be signified by the stamping of each copy of the advertisement with a special seal provided for this purpose by the Council.

(2) N o person shall display any advertisement unless the charge due under the preceding sub-by-law has been first paid to the Council.

advertisement in a special place installed for that purpose by the Council shall apply to the Council for authority to do so within the time prescribed in the Third Schedule to these by-laws.

(2) The order of priority of the exhibition of any such advertise­ment shall be determined by the Council.

7. The Council shall be entitled to receive five copies of any advertisement mentioned in by-law 5(l)(c) of these by-laws without payment.

8. A n y person wishing to advertise, exhibit or fix a signboard to any premises, shop or place of business within the Loca l Coun­ci l area of Givatayim shall first obtain a licence so to do from the Council.

9. A licence in respect of a signboard shall be valid unti l the 31st day of December next following the date of issue thereof.

10. A licence in respect of a signboard may be renewed within the month of January every year. The Council may serve a notice upon the owner of any signboard in respect of which the licence has not been renewed after the expiration of such month requesting him either to remove such signboard or to renew the licence therefor.

11. The fees for a licence in respect of a signboard shall be assessed on the size of the signboard at the rate of 500 mils for every metre length or any part thereof, provided such fee is not less than 250 mils. Should the height of the signboard exceed its length the fee shall be collected according to its height.

12. The Council may grant a reduction on the charges men­tioned in by-laws 5 and 11 of these by-laws in respect of any adver­tisement or signboard exhibited by or for the benefit of any in ­stitution or organisation devoted to charity, philanthropy, religion, culture, art or sport or by or for the benefit of any other institution or organisation which in the opinion of the Council is of a public nature, or serves a public purpose.

13. No person shall remove, tear, deface, spoil or soil any ad­vertisement and/or signboard exhibited in accordance with these by-laws.

14. N o person shall interfere with , deface, destroy, break or soil any board, kiosk or any place specified for the exhibition of advertisements by the Council in accordance with the provisions of these by-laws.

15. —(1) No person shall advertise, post, display or erect any advertisement or signboard lighted intermittently by electricity or any advertisement or notice produced by means of megaphones projecting to the street.

(2) No advertisement or signboard shall be erected or placed in a public place in such a manner as to obstruct traffic or vision.

(3) Only one signboard shall be allowed on each entrance of a shop or place of business.

(4) No signboard shall be erected, exhibited, advertised or posted in perpendicular manner or protruding from the wall .

(5) The height of signboards shall not exceed 50 centimetres but if its length exceeds 2.50 metres the height may reach 75 centimetres.

16. No person shall distribute within the boundaries of the Loca l Council area of Givatayim from hand to hand any adver­tisement other than a newspaper or a special issue of any news­paper licensed under the Press Ordinance, or any amendment thereof.

17. No person shall display any advertisement or signboard in the form of a streamer across the roadway or in the form of a notice carried or distributed on or from any vehicle, animal or man or in the form of a board carried by a man.

18. —(1) Without prejudice to the right of the Council to pro­secute any person contravening the provisions of these by-laws, the President may serve a notice in writ ing on any person who contra­venes any provision of these by-laws and require h im to remove any advertisement or signboard exhibited or to destroy any place used as a place of advertisement in contravention of these by-laws or otherwise to comply with the provisions of these by-lawTs within the time prescribed in such notice.

(2) Should any person upon whom a notice has been so served fail to comply with the request within the time prescribed in the notice, the Council may execute the work at his expense and may recover the cost thereof from him as a civi l debt.

(3) Should the Council be unable to ascertain the name or ,the address of any person contravening these by-laws, the Council or their representative may remove any advertisement or signboard exhibited or destroy any place of advertisement arranged contrary to these bv-laws without anv notice whatsoever.

Exemptions. 19.—(1) The provisions of these by-laws shall not apply to notices, signboards or advertisements exhibited by the Government of Palestine, L a w Courts or the Council.

(2) The names and addresses of the proprietors, written on show windows and doors shall be exempt from the fees prescribed under these by-laws.

(3) Name-plates fixed on private dwelling houses indicating only the name of the occupier, shall be exempt from the fees prescribed by, but shall otherwise be subject to, the provisions of these by­laws.

Penalties. 20.—(1) Any person who contravenes any of the provisions of these by-laws shall be liable to a fine not exceeding d6P.20.—־ for

1. This Order may be cited as the Food Control (Table Eggs) Order (No. 2), 1942.

2. F o r the purposes of this Order, unless the context otherwise requires —

"consumer" in relation to eggs means any person who acquires in any manner whatsoever any egg wi th any object in view regarding its ultimate disposal other than that of sale as defined herein;

"eggs" means eggs in shell of domestic fowls and includes fresh or preserved eggs but does not include cooked eggs;

"licensed egg collector" means a person authorised by the Controller to purchase eggs on behalf of any licensed pur­chasing station;

"licensed purchasing station" means a person authorised by the Controller to purchase eggs for the purpose of distributing them;

"person" includes firm;

"retailer" means a person licensed as such under the Wholesale and Retail Dealing in Controlled Articles (Limitation) Order, 1941;

"sale" means any disposition or offer of or agreement for the disposition of any egg for gain; and " s e l l " shall be con­strued accordingly. .

3. No person other than a licensed egg collector or a licensed purchasing station shall move any egg out of any village, tribal unit, settlement, municipal or local council area.

4. N o person shall move any egg out of any of the zones speci­fied in Column I of the Fi rs t Schedule to this Order, save under the authority and in accordance wi th the terms of a written permit issued by the authority specified opposite such zone in Column I I of the said Schedule.

5. Notwithstanding anything contained in any other law, sale of eggs shall take place only —

(a) by a producer to a licensed purchasing station (either direct or through a licensed egg collector),

. (b) by a licensed purchasing station to any person to whom such station may be directed to sell i n accordance with para­graph 6 or 11 of this Order,

(c) by a retailer to a consumer.

6. No licensed purchasing station shall dispose of any egg otherwise than in accordance with directions that may from time to time be given to such station by the Controller or any person authorised by h im i n writ ing in that regard; such directions may be either special or general.

7. N o person shall sell or purchase any egg at a price exceeding the maximum price applicable in accordance with the Second Schedule to this Order.

8. Any licensed purchasing station or any retailer engaged i n the sale of eggs shall keep or cause to be kept accurate accounts and records of all his dealings in eggs, including particulars identi­fying the persons from whom the eggs were purchased and the persons to whom the eggs were sold.

9. The provisions of this Order shall not apply to eggs sold for the purpose of hatching, provided that1 i n the event of any sale of eggs for hatching purposes being i n respect of more than twenty five eggs —

(i) the purchaser shall have furnished the seller with a declara­tion in writ ing that the purchase is being made for that purpose;

(ii) the seller shall have stamped each egg indelibly and legibly i n red wi th the letter " H " ;

(iii) the seller keeps records specifying the name of each pur­chaser, the quantity of eggs purchased by each purchaser, the price charged for each egg and the date of sale.

10. —(1) The provisions of this Order are subject to any direc­tions, authorisations, permits or licences which may at any time be given or granted by the Controller or by an Assistant Controller.

Amendment of section 10 of the principal Ordinance.

1. These Regulations may be cited as the Defence (Amendment of the Rent Restrictions (Business Premises) Ordinance, 1941) Regulations, 1942, and shall be read as one with the Rent Restric­tions (Business Premises) Ordinance, 1941, hereinafter referred to as the principal Ordinance.

2. Section 2 of the principal Ordinance shall be amended by the insertion at the end thereof of the following :—

" " L o c a l Counci l" means the local council constituted under the Local Councils Ordinance, 1941, for a local council area within which any premises are situated;

" L o c a l Council A r e a " means any village or group of villages or area administered by a local counci l ."

3. Sections 3 and 6 of the principal Ordinance, with the excep­tion of subsection (6) of section 6, shall be amended by the substitu­tion of the words "municipal or local council" for the word "mun i ­c ipa l" wherever the latter word appears therein.

4. Section 10 of the principal Ordinance shall be amended — (a) by the insertion therein, immediately after subsection (1)

thereof, of the following subsection :—

" (1A) Where this Ordinance has been applied to a local council area the local council thereof shall appoint a num­ber of Rent Commissioners not exceeding eighteen at such remuneration as may be approved by the District

Commissioner which shall be paid from the local council fund ." ;

(b) by the substitution of the words " I f any municipal council" for the words " I f any such counci l" appearing at the begin­ning of subsection (2) thereof, and by the substitution of the words " is applied in accordance with subsection (l) of this section" for the words " is so applied" appearing in subsection (2) thereof;

(c) by the insertion, immediately after subsection (2) thereof, of the following subsection :—

"(2A) I f any local council fails to appoint any or sufficient Eent Commissioners within fourteen days of the date when this Ordinance is applied in accordance with sub­section (1A) of this section the District Commissioner may appoint such number of Eent Commissioners as may appear to h im to be necessary but so that the total num­ber appointed does not exceed eighteen. The Rent Com­missioners so appointed shall be paid such remuneration as the District Commissioner may direct from the local council fund."

5. Section 11 of the principal Ordinance shall be amended —

(a) by the substitution of the words "Where this Ordinance has been applied to a municipal area, the Rents Tr ibuna l " for the words "The Rents Tr ibuna l" appearing at the beginning of subsection (1) thereof;

(b) by the insertion therein, immediately after subsection (1) thereof, of the following subsection :—

"( lA) Where this Ordinance has been applied to a local council area, the Rents Tribunal shall consist of three persons appointed by the District Commissioner from a list of not less than six persons nominated by the local council, one of whom shall be appointed by the District Commissioner as chairman :

Provided that if within fourteen days of the date when this Ordinance is applied to a local council area the local council shall not prepare such a list the District Commis­sioner may appoint three fit persons as a Rents T r i b u n a l . " ;

(c) by the substitution of the words "The members of a Rents Tribunal appointed under subsection (1) of this section"" for the words " T h e members of a Rents Tr ibuna l " appearing at the beginning of subsection (2) thereof;

(d) by the insertion, immediately after subsection (2) thereof, of the following subsection :—

I N E X E R C I S E of the powers vested in h im by sections 3 and 6(1) of the Rent Restrictions (Business Premises) Ordinance, 1941 (hereinafter called 'the Ordinance'), the H i g h Commissioner in Council has been pleased to order, and it is hereby ordered as fol­lows :—•

1. This Order may be cited as the Rent Restrictions (Business Premises) (Application to Nablus) Order in Council , 1942.

2. The Ordinance shall apply to the Municipal Area of Nablus.

3. The prescribed date for the purposes of section 6(1) of the Ordinance shall be the last day of Dhilhijje in the Hejira year 1361 (7th January, 1943 A . D . ) .

4. The percentage addition for which provision may be made under the first proviso to section 6(1) of the Ordinance shall, in the Municipal Area of Nablus, be an addition of five per centum.

1. These Regulations may be cited as the Defence (Regulation of Establishments) (Amendment) Regulations (No. 2), 1942, and shall be read as one with the Defence (Regulation of Estab­lishments) Regulations, 1942, hereinafter referred to as the prin­cipal Regulations.

2. W i t h regard to the night of the 31st December, 1942/lst January, 1943, Regulation 25 of the principal Regulations shall be amended, as far as it relates to drinks, by the substitution of the expressions "12.00 midnight" and "12.30 a .m." for the ex­pressions "10.00 p . m . " and "10.30 p . m . " , respectively, wherever the two last mentioned expressions appear i n that regulation.

(a) The fourth period of insurance shall commence on the 1st January, 1943, and end on the 31st March , 1943, both dates inclusive.

(b) The premium payable under any policy of insurance issued under the Scheme shall be payable at the rate of three eighths of one per cent, per month in respect of the abovementioned period.

(c) Save as provided in paragraphs 5(c) and 6(b) of the Scheme, the amount of any one premium payable under a policy issued under the Scheme in respect of the abovementioned period shall not be less than one and one eighth per cent, of the sum insured or of the average amount insured by the policy as the case may be.

(Amendment of Import, Expor t and Customs Powers (De­fence) Ordinance, 1939), Regulations (No. 2'), 1942.

3. Section 2(1) of the principal Ordinance shall be amended by the insertion therein, immediately after paragraph (d) thereof, of the following paragraph :—

' 1 ( e ) "Competent Author i ty" means any person who is a Competent Authority for the purposes of Regulation 46 of the Defence Regulations, 1939."

4. Sections 5, 6, 7 and 8 of the principal Ordinance (as en­acted by the second amending Regulations) shall be amended by the insertion therein immediately after the word "Di rec to r" , wherever that word appears therein, of the words "or any Com­petent Author i ty" .

5. The Interpretation Ordinance shall apply to these Regula­tions as it applies to an Ordinance.

6. These Regulations shall come into force on the first day of January, 1943.
