Description of services General The framework RM6020 consists of 2 Lots as set out below. As part of the Insurance Services 3 offering, a Dynamic Purchasing System (DPS) RM6138 has been incorporated to offer insurance services. This is intended to support a level of competitiveness within the market and to make available a full range of services to meet a diverse range of customer requirements. A full list of insurance services can be found in Annex A of this document.

For the purposes of clarification, this customer guidance document relates to the use of the Framework Agreement only and a separate customer guidance document has been created to guide customers through the use of the DPS – RM6138.

o Lot 1 is for the provision of insurance brokerage and associated support services which include placing of and advice on a range of insurance policies including but not limited to; property and construction, liability, motor and travel, personal accident, health and life insurance

o Lot 2 is for the provision of compensation claims handling, which includes claims in respect of employer’s liability, third part motor claims, uninsured loss recovery, public liability and property damage/loss.

General guidance

This document, should be considered in conjunction with the supplier pricing and should contain everything you need in order to consider your payment solutions programme, whether from scratch or as a replacement. The document(s) allows you to review the offerings of all suppliers on the RM6020 framework including details of:

Charges Potential additional charges

It is recommended that customers enter into a contract with their chosen supplier. Customers will be responsible for managing their own call-off under the umbrella of the agreement and will have their own account management arrangements with their chosen supplier. Most of the content in the contract is pre-completed material detailing the standardised service and charging model.

The contract consists of the following elements: Core Terms; Order Form Joint Schedules; Call-off Schedules

The order form captures essential details relating to the specific contract, in effect providing a summary, as well as being the document for putting the contract in place:

The parties enter into the contract by signing the order form. The terms and conditions are mainly standard government provisions that will be applicable

to all contracts.

The framework is for an initial four year term (a 12 month extension option is available).

Background

Insurance Services 3 will consist of both a DPS (Dynamic Purchasing System) and a Framework Agreement. A Separate Guidance Document has been created for using the DPS and can be found on the web page here.While running alongside a DPS offering insurance related services, the Framework Agreement will cover both Brokerage and Advisory services and Claims Handling services.

Whilst the Framework Agreement is open for an initial 4 year period, the DPS does not require a maximum length and can be terminated when required, however it makes sense to align with two or more potential 4 year framework agreements for brokerage services and will therefore run for an initial 8 year period. The DPS will allow access to the full insurance market, including niche supply areas.

Public Sector Contract

This Framework Agreement has been awarded using the new Public Sector Contract. This is the new Crown Commercial Service (CCS) standard template for framework contracts for common goods and services. It is a shorter and simpler government contract developed by the Crown Commercial Service, Government Digital Service and Government Legal Department. Frequently Asked Questions

1. How does the new Insurance Services 3 offering work?

Insurance Services 3 (IS3) is split into 2 commercial agreements. RM6020 is a framework agreement with a lot for insurance brokers and a lot for claims handling suppliers. RM6138 is a Dynamic Purchasing System (DPS) for insurers. Insurance Brokers on RM6020 will access RM6138 on behalf of customers to ensure their insurance requirements are met. Previously IS2 was a framework agreement with separate lots for insurance providers, insurance brokers and a claims handling supplier. We have merely split the lots on IS2 into 2 agreements.

2. What is new about IS3?

Apart from the split of the agreement into a DPS and Framework Agreement the following enhancements have been made: New categories of insurance such as health and life assurance have been added. New insurers have been added to the DPS giving customers greater choice. New insurance brokers have been added to the framework, giving customers greater choice. Claims handling has been expanded to cover the whole of the public sector, previously it was for

Central Government only. Claims handling now has 3 suppliers providing competition and allowing customer choice. Up to date Public Sector Contract Regulations used covering GDPR and Social Value

3. What is a Dynamic Purchasing System (DPS)

The Dynamic Purchasing System (DPS) is a procedure available for contracts for works, services and goods commonly available on the market. As a procurement tool, it has some aspects that are similar to an electronic framework agreement, but where new suppliers can join at any time. However, it has its own specific set of requirements. It is to be run as a completely electronic process.

4. Why have you used a DPS for Insurers instead of a lot on the framework agreement?

A DPS offers greater flexibility over a framework where suppliers can join the DPS at any time over the life of the DPS. One weakness on IS2 was that for certain classes of insurance there was little or no cover therefore customers had to go outside of the contract. Where customers demand certain specific classes of insurance, suitable insurers can be recruited onto the DPS to meet those demands.

5. How do I find out which suppliers have been appointed to IS3 and the services they offer?

As on IS2 a supplier matrix will be available to buyers showing the supplier both on the DPS and the framework agreement and their offering. If buyers email [email protected] then this information will be sent out from CCS Customer Service Centre.

6. How do I call off from IS3?

Using the DPS is a fully electronic process and guidance is given on our website. [LINK]. There are a small number of insurers who will deal directly with the buyer so choosing a supplier from the DPS is via further competition only, a direct award to an insurer is not possible. Alternatively your broker will have access to the DPS and will carry out a further competition on your behalf with a large number of insurers, as most insurers will only deal through an insurance broker.

b) From RM6020 Insurance brokerage and Claims Handling Services

You do have the option to direct award an insurance broker on lot 1 if your anticipated fees from the broker is below £12.5K, your requirements are straightforward and not of a complex nature. A direct award pack is available from CCS Customer Service Centre at [email protected]. For all other requirements then a further competition must be carried out.

For lot 2 Claims Handling a further competition must be carried out, direct award is not possible on this lot.

7. If I run a further competition under Lot 1 under R6020 to choose an Insurance Broker, can I ask for insurance prices as well as all associated fees and commissions?

In this further competition you must only ask for the Insurance Brokers fees/commissions to meet your requirements, i.e. place insurance cover or offer advice/other services. We strongly recommend that you ask for a complete breakdown of costs associated with the placement of your insurance cover as Insurance Brokers will receive various commissions from insurance companies, these vary with class of insurance and insurance company. Under FCA rules the Insurance Broker is duty bound to disclose the breakdown of their total remuneration.

8. Do I need to use the Crown Commercial Service eSourcing Suite to run the further competition and is there any guidance provided?

No you can use any eSourcing suite to conduct a further competition. We recommend that you put your organisation name and the framework number in any subject heading when using a 3rd party eSourcing suite to make sure it is easy identifiable to the supplier. The Crown Commercial Service eSourcing Suite (a free service) is available to run your further competition. Further information can be found here [LINK]

9. What areas could I explore in a further competition?

There are a number of areas in which you could explore in a further competition, see the Customer and Supplier Guidance document for further information. If you are utilising the services of a broker they will be able to provide further advice and guidance.

Please remember to ask relevant questions i.e. insurance specific and please note there is a number of standard information on the suppliers contained within the supplier matrix so there is no need to ask for this again.

Please note you will need to tailor the criteria and percentages to meet your specific needs.

All public sector organisations in England, Wales, Northern Ireland and Scotland. A detailed list of customers who can access the framework agreement can be found in the OJEU notice which can be found in the link [LINK]

11. I have a long term agreement with a broker under RM3731, can they still access RM6138 DPS?

Under RM3731 it explicitly states that Insurance Brokers under lot 2 of the agreement must use lot 1 of the same agreement so unfortunately in this occasion you must either re-compete or novate onto RM6020. We would recommend this approach for all long term agreements currently under RM3731 as RM6020 has been let in accordance with the latest public sector contract (PCR) and covers GDPR and social value.

12. You produce a comprehensive range of information such as letter of appointment and call off contract, what can I amend?

The areas that you are able to amend are those in the square brackets and highlighted in yellow. Although we recommend that the call off agreement should be kept as close as possible to the original version, should you wish to amend or add a clause of your own we would recommend you carry out some pre competition dialogue with potential suppliers to ensure that they can sign up to this clause(s) as there may be regulatory issues and ensure it is within the further competition documentation. No clauses should be added after the further competition is completed. Framework schedules and joint schedules cannot be amended.

13. If I utilise a broker can I still receive a quote from a direct dealing insurer/s?

Yes, however you will need to agree with the approach with your selected Insurance Broker and the direct dealing insurer/s. In some circumstances the buyer may need to issue further competition documentation to the direct dealing insurer using the DPS and the insurer response may need to be returned to the buyer. This would need to be agreed between all parties. It is worth confirming this approach when running a further competition for an Insurance Broker.

14. Am I able to collaborate with other public sector departments and will it deliver savings?

Yes, the framework agreement does allow you to collaborate with other public sector bodies and there have been a number of examples through the previous framework. CCS refers to this as “Clustering” and there is a schedule within the call off agreement that addresses this.

It is not possible to give an exact saving percentage as to what the collaboration will deliver. This will depend upon a number of factors for example; claims history, risk profile. Some possible tips for reducing costs could be the same policy wording across organisations, one review meeting with all partners and risk management philosophy.

Should you wish to collaborate you may wish to consider collaborating with similar risk profile organisations and speak with insurance professionals to discuss further.

15. Can I enter into a long term agreement (LTA) with an insurer and / or Insurance Broker?

Yes, you can have an LTA up to 5 years for both an insurer and broker. We would recommend you align the dates of both Insurer and Insurance Broker to avoid any miss match in terms and conditions upon framework end. Should you want to explore any LTA options these will need to be detailed in your further competition documentation.

16. Can I run a further competition for the support services only?

Yes, you will need to make it clear in your further competition document that this is what you wish to do.

17. My incumbent Insurer is not on Lot 1; can a framework Insurance Broker still use them?

In this instance we would recommend your insurer to join RM6138, the process is straightforward and they can be added relatively quickly.

18. Can I run further competition on just 100% price?

No, you must include a quality element within your further competition. Information on the further competition process and percentages for each Lot can be found within the Customer User Guide.

19. How do I know what is the right insurance for me?

Should you be unsure on what classes of insurance and levels you need you may wish to seek insurance advice from an Insurance Broker or other insurance professional. CCS cannot offer this advice as we are not regulated by the FCA to do so.

20. What is a Broker and what is their role?

An insurance broker acts as an insurance intermediary between an insurer and a buyer, advising the policyholder on the most suitable product for their needs, helping to manage and mitigate potential risks and arranging to put cover in place.

21. What happens if a full claims history is not available (e.g. in the case of a newly established organisation)?

In the event of a full claims history being unavailable you will need to discuss the options with your appointed Insurance Broker (if applicable) or insurers.

22. What is funded insurance and how do I get a quote?

Funded insurance means different things to different people. In essence funded insurance is where there could be a number of pots/pools of money to cover accidental damage, third party damage or something similar. The pots/pools of money could be held by the customer, insurer or broker.

The framework agreement does not limit the funded methodology to one specific class of insurance.

23. Can I run an eAuction at the further competition stage?

Yes, you have the ability to run an eAuction across Lots 1 & 2 of RM6020. Before you proceed with an eAuction you may wish to consult the market before you do so to gage their appetite. Please note eAuctions are not generally conducted within the insurance market on lot 1 for Insurance Brokers however for lot 2 Claims Handling suppliers eAuctions have been successfully carried out.
