Dear Members,

This has been a big year of change for NOAA, positive change!

The Education Committee and staff put their heads together to make significant modifications to The Key Awards in judging, award criteria and the ceremony itself. All indications are it was a great success. The banquet had a huge turnout, and everyone appreciated the reduced categories and video-based presentation, both of which lowered the time needed to present the winners’ awards from 140 to 50 minutes.

As most of you know, the show will soon be televised. This is part of our plan to put the industry’s “best foot forward.” The key Awards are , in all actuality, a peer review that has caused change and improvement in local properties every year since their inception. Why not share the winners with the general public,

many of whom are potential residents? Look for the program soon on Time Warner and Cox Cable’s FREE ON DEMAND sections. We also plan to air the program as an infomercial on a local network affiliate. Stay tuned for details.

We had a great Casino Night in October. We packed the room at Hawthorne Valley Country Club and everyone had a great time.

The Advertising and Public Relations staff position has finally (after two years of Shawn “temping”) been filled. Maren Guse has a degree in photojournalism from Syracuse University and is already making a positive impact. Be sure to meet her at the next event you attend!

We made a breakthrough in group purchasing. Our gas program results in huge energy savings for many of our members, but, until now, we never had a meaningful electricity program. I am pleased to announce that we’ve secured a deal with North Shore Energy that includes savings that pick up where most available plans leave off. Please call me for details on this exciting new group purchasing program.

I look forward to seeing all of you at our upcoming trade show at Windows on the River. Attendance has been on the rise, and we hope to continue the trend this year.

The job of municipal housing judge is a difficult one and has become even more difficult in the past eight years with the increasing number of foreclosures. Housing Court dockets include both civil and criminal cases. Renters find themselves unable to pay rent and face eviction. Criminal cases consist of tickets and violation notices issued by the City of Cleveland.

In 1996, Raymond Pianka, a longtime west side councilman, ran and was elected Judge of the Cleveland Municipal Housing Court. In the 13 years since he was first elected, Judge Pianka has worked diligently to improve Cleveland’s neighborhoods, and he is doing so in the typhoon of the housing crisis, a storm in which Cleveland finds itself one of America’s hardest-hit cities.

Judge Pianka is a lifelong Clevelander, having grown up in the ethnically and culturally diverse Detroit- Shoreway neighborhood which includes Italians, Hispanics, Vietnamese, Irish, Romanians, Hungarians and other nationalities. He graduated from West High School – a Cleveland Public

School – and earned both his undergraduate and law degrees at Cleveland State University.

In 1985, Judge Pianka was elected councilman of his neighborhood, Ward 17. He was reelected twice without opposition, and served through 1995. During his tenure on Cleveland City Council, Judge Pianka served as chairman of the Community and Economic Development Committee, and chairman of the Legislative Committee.

After his 1996 election to Housing Court, Judge Pianka

became proactive in heading off some of the court’s more preventable cases. He did so through education and outreach, creating the following initiatives:

The Court’s Landlord Seminar Workshop is conducted in partnership with us here at the Northeast Ohio Apartment Association and is a series of seminars designed to educate

landlords as to their (and their tenants’) rights and responsibilities. The Housing Code Enforcement Advocates Forum is a series of meetings in which housing topics of particular concern to neighborhood organizations are discussed.

“How To” videos and newsletters, designed and published by The Court,

educate the public on topics concerning home maintenance, the law and the navigation of Housing Court. (To view a listing

of initiatives, see page 17.)

These programs and others would help to educate plaintiffs and defendants alike, creating a better understanding of the law, expectations and responsibilities. These were the days when plaintiffs and defendants were individuals – individuals who showed up for court. Little did anyone know at the time that

these would soon be referred to as “the good old days.”In recent years, Cleveland has found itself at the epicenter of the mortgage crisis earthquake. Judge Pianka explains, “Cleveland had a very high concentration of sub-prime lenders, because traditional financial institutions were pulling out of the market. There was a change in how loans were given and who they were given by – from regulated banks to unregulated investment companies.”

The result? Many homeowners who couldn’t pay their escalating mortgages abandoned their homes in anticipation of foreclosure. The new institutions viewed a home as a small part of an aggregate – an asset that could be chalked up as a loss and abandoned, like so many midwestern factories.

The numbers are staggering. There are over 10,000 abandoned homes in the city of Cleveland. In some neighborhoods, one in six houses stand vacant, usually stripped of their scrap-able alloys (especially plumbing and aluminum siding). Many of these homes are unrepairable,

and the institutions that hold their deeds know it.This resulted in the equivalent of a new “penny stock”

market: Cleveland’s foreclosed homes. Speculators from other states have swooped in and purchased the deeds of thousands of foreclosed homes, many between $500 and $1,500 each on eBay, in hopes of selling them when the market recovers. Some more ambitious speculators believed they could easily rent out these homes and ride out the market while collecting a handsome return on their investment.

“These aren’t baseball cards,” says Pianka, “and these homes’ new owners are quickly

realizing that their assets need repairs that they can’t afford.” What’s happening as a result? Decaying neighborhoods, and,

when push comes to shove, another round of abandonment. The difference this time is that owners are being held accountable.The housing crisis has

changed the court’s day-to-day operations. Cases and challenges are up, forcing the court to find new ways to deal with problems. “Through it all, we run a court that knows what’s going on, has a memory of what’s happened in the past, and is accountable,” he explained.

It’s difficult to work through these problems in a city that was on an upswing. “I’ve seen 30 years of value-building community development work wiped out in a few years,” said Pianka. “If the crisis ended

tomorrow, we’d be dealing with the fallout for another five to ten years.”

Judge Pianka wishes the new crop of out of town owners ran their businesses like NOAA members do. “NOAA members treat ownership like a business, not a game. Furthermore, preserving their asset

is extremely important to them, and that helps everyone involved.” He pays NOAA members the highest compliment when he says, “In my 13 years on the bench I’ve had over 60,000 cases on our criminal docket, and I don’t believe a single one of them involved a NOAA member.”

Cleveland typically names the corporation as the defendant rather than corporate officers.

Signs are placed on these homes with city

contact information and no trespassing notices.

Parties seeking equitable relief must not be

guilty of reprehensible conduct.

In addition to the property cited, defendants are

encouraged address all problem properties.

In criminal cases, the defendant is required to pay for grass cutting and boarding of the property, instead of using money

from taxpayers.

Foreclosures and bankruptcy do not relieve

property owners of their responsibility

to keep the property up to

code.

Letters are sent to prop-erty owners reminding

them of their rights and responsibilities in

maintaining a foreclosed property.

New rules to ensure property owners are not

left behind in the process. Seminars are available to

explain the process.

Offenders are required to complete community

service hours spent fixing up vacant properties.

A Bio Healthy Home Solutions, a NOAA member, specializes in odor removal and disinfecting apartment suites and common areas. Their product claims to remove all odors and kills most bacteria.

We decided to put owner Tim Manoa to the test. He was asked to demonstrate their capabilities on a problem suite located at 200 West apartments in Fairview Park. Janene Kubit, owner and manager of 200 West, was skeptical of their solution. “We have tried everything in this suite to remove the heavy cooking and incense odors,” said Kubit.

Previously the maintenance staff at 200 West had sealed the walls with Kilz and cleaned the carpet twice with no success. The next step would have been to replace the relatively new carpet, but that might not have solved the issue either.That is when A Bio Healthy

Solutions was summoned to 200 West by NOAA to prove their product. Manoa and his team wearing a white biohazard suits closed the suite and sprayed their product throughout the suite including the air conditioning ducts, cabinets and the coils on the back of the

refrigerator. The staff was told not to enter the sealed suite for eight hours. The next day Manoa, his team and the 200 West staff opened the door to a normal smelling unit. “It smelled so clean I was amazed,” said Kubit. Their leasing staff is now showing the unit which had been off the market for months.

“The next time we come across something like this or unusual or smoking odors, we will call A Bio Healthy Home Solutions before spending money on anything else,” Kubit said.

The Bed Bug Problem

There is a problem that is nearing epidemic proportions in many parts of the country that has found its way to Southwestern and Central Ohio. Bed bugs, which most of us thought was only a mother’s threat to her children, have become a real problem that many property owners are struggling to control. In the 1950’s an attempt to eradicate the problem in the United States was successful, however it appears that the problem has risen again due to international travelers bringing the pesky insects back with them. The rapid spreading has caused an industry wide concern.

In Dayton, after two years of unsuccessful attempts to curb a growing bed bug problem, all 180 suites of the Biltmore Apartments had to be emptied to allow for a total building fumigation. Terminix was brought in to fumigate the 18 story building with Vikane gas. The owner of the property, AIMCO, had spent the two previous years attempting

to locate the source of the infestation and treat it suite by suite and floor by floor to no avail. Only a full building fumigation was determined to be able to curb the problem at a cost that included not only the exterminator’s expense but the cost to temporarily relocate the residents of the 180 units.

Tom Hut, of the Public Health Department for Dayton and Montgomery County, reported that tenants of apartments were calling over a dozen times each day about bed bugs. This number is up from a dozen calls per average week in 2008.

The Central Ohio Bed Bug Task Force has an website which lists the myths about bed bugs. On it, they dispel the myth that bed bugs are only a problem in low income housing, that bed bugs carry diseases, that simple pesticides or flying insect bug bombs will help kill bed

bugs. Bed bugs can be found anywhere and can be carried home after sleeping in a hotel, flying on a plane, sitting in a movie theater or through many other points of contact. While they are aggravating, they do not carry disease, they simply bite and create itching that is distracting and ultimately painful. There are no simple methods to kill bed bugs that are successful in eradicating their nests. Awareness of the problem and decisive action is the only way to stop the continued growth of the problem.

The Columbus Dispatch reported last Fall that Bill Willis, a local lawyer representing many property owners, is being contacted three to five times a day regarding bed bug problems. Wills said the Columbus Apartment Association is encouraging tenants to sign papers acknowledging that their home was pest free at move-in and that the residence they had moved from was pest free as well. He estimated that members of the association are spending a combined

$1,500,000.00 on bed bugs annually.The Dispatch article also stated that every fire station in Cincinnati has been found to be infested and Ken Sharkey, of the Cincinnati Health Department, was quoted as saying that one assisted living unit was found to have 30,000 bed bugs in one room.

One thing that exacerbates the problem is that often those who have bed bug problems are embarrassed and attempt to solve it themselves. Only when the problem is overwhelming turn to their landlord for professional extermination.

Stopping the Bed Bugs

The bed bugs usually feed at night as people are sleeping. They, like mosquitoes, feed on human blood. Since they are roughly the size and shape of an apple seed, they are easily seen. The problem is that the rust colored bugs often hide when there is light and can easily fit in cracks and in furniture. Again, like mosquitoes, they gorge themselves and become fat and their color changes as they feed. Unfortunately part of the problem in eradicating them is that they can go for long periods, even several months,

without feeding again.It is important to understand that the only successful way to treat a bed bug infestation is to thoroughly disinfect and eliminate the areas where they nest and hide. It is best to vacate the rooms being treated and to be extremely careful with the treatment so that it is complete. Missing one or two bugs will allow them to reproduce again, and all earlier efforts will be wasted. It is recommended to only treat the seams of furniture; do not simply treat all the areas where they have been, and do not spray pesticides all over mattresses and other furniture.

The New York Department of Health and Mental Hygiene put out a brochure that helps explain the problem and how to deal with it. A portion is reprinted below:

How To Get Rid of Bed Bugs:

1. Find out where bed bugs are hiding in your home.

Use a bright flashlight to look for bed bugs or their dark droppings on bedroom furniture.

Or use a hot hair dryer, a thin knife, or a playing card to force them out of hiding spaces and cracks.

Check: • Behind your headboard.• In the seams and tufts of your mattress and inside the box spring.• Along bedroom baseboard cracks.• In and around nightstands.• Other bedroom items, including window and door casings, pictures, moldings, nearby furniture, loose wallpaper, cracks in plaster and partitions, and clutter.

2. Clean areas where bed bugs are likely to hide.

• Clean bedding, linens, curtains, rugs, carpets, and clothes. To kill bed bugs, wash items in hot water and dry them on the highest dryer setting.

Soak delicate clothes in warm water with lots of laundry soap for several hours before rinsing. Wool items, plush toys, shoes, and many other items can be placed into a hot dryer for 30 minutes.

• Scrub mattress seams with a stiff brush to dislodge bed bugs and their eggs.• Vacuum mattresses, bed frames, nearby furniture, floors and carpets. Pay special attention to cracks and open spaces. Immediately after vacuuming, put the vacuum cleaner bag in asealed plastic bag, and dispose of it in an outdoor container.• If you find bed bugs on a mattress, cover it with a waterproof, zippered mattress cover labeled “allergen rated,” or “for dust mites.” Keep the cover on for at least one year.• If your box spring is infested, seal it inside a vinyl box spring cover for at least one year. Ifno cover is available, throw the box spring away.• Dispose of infested items that cannot be cleaned and get rid of clutter. Seal tightly in a plastic garbage bag and discard in an outside container.• Repair cracks in plaster and repair or remove loose wallpaper.

3. Be very cautious about using pesticides yourself.

Pesticides can be hazardous to people and pets. If you choose to use a pesticide, or a licensed pest control professional suggests you use one, follow these precautions:

• Only use pesticides clearly labeled for bed bug extermination. Never use a cockroach spray,ant spray, or any other pesticide that does not list bed bugs on the label.• Follow label instructions exactly.• Never spray pesticides on top of mattresses or sofas, or in areas where children or pets arepresent.• Never purchase or use a product without a manufacturer’s label and never buy pesticidesfrom street vendors.• Avoid using “insecticide bombs” and “foggers” in your home. These products can spreadhazardous chemicals throughout your home, and are not likely to be effective against bed bugs.

How To Keep Bed Bugs Out of Your Home:

• Wash clothing and inspect luggage immediately after returning from a trip.• Inspect used furniture for bed bugs before bringing it into your home.• Never bring discarded bed frames, mattresses, box springs, or upholstered furniture into your home.

How To Keep From Infesting a Guest’s Home:

Ohio’s Plan of Action:

State Senator Eric H. Kearney of the 9th District, representing Hamilton County, after review of Senate Bill 45, has decided that further study and consideration is necessary. It is assumed, but not certain, that a 13 member task force will be appointed to study the bed bug problem and make recommendations on how to proceed. The Ohio Apartment Association hopes to be able to have one of their members appointed by the Governor

to the task force so that input of a practical nature is given and those who have to bear a substantial expense are adequately represented.

The task force would: have one year to analyze the impact of bed bug infestations, describe the best way to eradicate the problem, and make recommendations on how to effectively monitor infestations, how to safely and effectively treat the problem with chemicals, how government agencies can assist with the

problem, whether additional legislation is needed, and which agencies shall be charged with the enforcement of laws and ordinances enacted pertaining to controlling bed bug infestations.

It is anticipated that a decision regarding the task force will be made still this year and before the Senate recesses for the winter holidays.
