Aquaculture Lease Board Meeting July 30, 2018

Lease Program Authority as per NYS ECL, Art. 13, Title 3 §13-0302

Suffolk County

• Authorizes access to underwater lands for cultivation of shellfish in Peconic and Gardiners Bays (excluding private oyster grant owners that cultivate oysters only).

• Controls the location of shellfish farms, size of lease and number of leases.

NYS Dept. of Environmental Conservation

• Regulates all aspects of shellfish cultivation that occur on Suffolk County leases.

• Issues required on/off-bottom culture permits & bed permits.

Aquaculture Lease Board

• Established by Chapter 475, Article II of the Suffolk

County Code.

• Consists of three members:

– Commissioner, SC Dept. of Economic Development &

Planning (or designee)

– Director, SC Division of Planning & Environment (or

designee)

– Commissioner, SC Dept. of Health Services (or designee)

Aquaculture Lease Board

• Function

– Conducts meetings to review proposed lease sites and

receive oral testimony regarding those sites.

– Evaluates all information, commentary and analysis

received on such sites.

– Determines which proposed sites are available for leasing

by resolution adopted by majority vote.

• Makes its determination based upon County Lease Program criteria

and regional/environmental factors.

Lease Program Requirements and

Procedure for New 10-acre Leases

• Cap of 60 acres of “new” leases per year.

• Unallocated acreage or terminated acreage will carry

over from year to year.

• Available Acreage 2018 = 90 acres

• Applicants may apply for: • Sites within the

Cultivation Zone.

• Option of either 5- or 10- acre leases.

• 1-3 Lease site locations. • Applicants will only be

issued a lease for one location.
