1. INTRODUCTION

There are many reasons why Burke Management Services Pty Ltd is successful in the transport industry; the main undoubtedly, is our genuine commitment to superior customer service. Our customers are our number one priority. 2. OBJECTIVES

This level of quality service delivery requires teamwork and co-operation among our employees, suppliers and subcontractors. This manual has been prepared as a guide to the expectations and performance standards required of our subcontractors. Burke Management Services Pty Ltd will only use approved contractors and subcontractors. Management is firmly committed to our Workplace Health & Safety (WHS) policy enabling all work activities to be carried out safely and with all possible measures taken to remove (or significantly reduce) risks to the health, safety and the welfare of our employees, sub-contractors, authorised visitors and anyone else who may be affected by our operations. This Induction Handout is designed to provide sub-contractors with an overview of our Codes of Practice to ensure compliance with the Workplace Health and Safety Act and standards of our accredited schemes. This manual always remains the property of Burke Management Services Pty Ltd. The manual is copyright and does contain sensitive company information. For these reasons copying of this manual is not allowed and the manual is not to be distributed outside of this organisation. 3. COMPANY EXPECTATIONS

Sub-contractors are expected to always act in the best interests of the Company. This requires performing their duties professionally, honestly, ethically and within the law. All sub-contractors are representatives of the Company and must not indulge in any activity that could damage the Company’s reputation. There is a principal Workplace Health and Safety Act in each State that gives wide-ranging responsibilities to workplace individuals. The key principle in each Act is the ‘duty of care’ which imposes obligations on employers to ensure the workplace health and safety of employees at work. This obligation extends to sub-contractors and visitors in ensuring their own workplace health and safety and that of others. Sub-contractors must be committed to co-operate with Burke Management Services Pty Ltd on workplace health and safety matters. Sub-contractors are required to take reasonable care of company property utilised in their jobs or entrusted to them. Company property includes but is not limited to, vehicles, trailers, computer hardware, networks and software. CONFIDENTIAL INFORMATION - Employees must not disclose to any person or organisation confidential information or information which may be regarded as sensitive to

the Company’s interests, without prior authorisation of their manager or supervisor. Intellectual Property remains an asset within the company at all times. Burke Management Services Pty Ltd sub-contractors are required under the Code of Conduct, to behave at all times in a way that upholds Burke Management Services Pty Ltd values.

4. CODE OF CONDUCT

The Code of Conduct requires that a sub-contractor must: Behave honestly and with integrity;

Act with care and diligence;

When acting as a representative of Burke Management Services Pty Ltd, treat everyone with respect and courtesy, and without harassment;

When acting as a representative of Burke Management Services Pty Ltd, comply with National Employment Standards and Fair Work Australia legislation (Fair Work Act 2009);

Comply with any lawful and reasonable direction given by the management team and those who have authority to give the direction;

Maintain appropriate confidentiality and respect with regards to dealings that the sub-contractor has with any customer, employee or other subcontractor of Burke Management Services Pty Ltd;

Disclose, and take reasonable steps to avoid, any conflict of interest (real or apparent) in connection with sub-contracting to Burke Management Services Pty Ltd;

Use Burke Management Services Pty Ltd resources, materials and equipment in a proper manner;

Not provide false or misleading information in response to a request for information that is made for financial purposes in connection with the sub-contractor’s consignments;

Not make improper use of:

a) inside information; or

b) the sub-contractor's duties, status, power or authority, in order to gain, or seek to gain, a benefit or advantage for the sub-contractor or for any other person.

At all times behave in a way that upholds Burke Management Services Pty Ltd values and the integrity and good reputation of Burke Management Services Pty Ltd;

Whilst on duty off-site, at all times behave in a way that upholds the good reputation of Burke Management Services Pty Ltd; and

Comply with any other conduct requirement that is prescribed by the regulations asked of you from time to time.

5. DISCRIMINATION & HARASSMENT POLICY

Purpose Burke Management Services Pty Ltd is committed to the principles of equity and diversity in order to create an equitable work environment. This is supported by our commitment to the application of statutory requirements and related policies. Burke Management Services Pty Ltd is committed to fostering a culture that values and responds to the cultural diversity of our employees and sub-contractors, together with the identification and implementation of strategies for the elimination of discriminatory or harassing practices. The law (the Queensland Anti-Discrimination Act 1991) is about fairness and promotes entitlement to be treated fairly no matter what sex, race or age you are, if you have an impairment or what political beliefs you have. The Anti-Discrimination Commission administers the law which protects everyone from unfair discrimination, sexual harassment and vilification in many parts of their lives. The Act says it is against the law to treat you unfairly because of your:

age Harassment is any behaviour that: Offends, upsets, intimidates or humiliates another person; and/or

Makes the workplace uncomfortable or unsafe; and

May be verbal, written or physical. Responsibilities Burke Management Services Pty Ltd will take all reasonable steps to prevent harassment from occurring. The Manager and supervisors (management team) are responsible for ensuring compliance with all statutory responsibilities and the adoption and implementation of equity and diversity and equal employment opportunity policies and practices. The management team are responsible for ensuring that sub-contractors are aware of the equal employment opportunity policies and programs and in the identification and elimination of discriminating or harassing practices. All sub-contractors have a responsibility to help Burke Management Services Pty Ltd provide a workplace free from harassment and discrimination.

6. DRUG AND ALCOHOL POLICY

Purpose The purpose of this policy is to: Ensure a safe workplace free from the effects of alcohol and prohibited/controlled substances;

Minimise disruption to work flow;

Maintain a satisfactory level of employee and sub-contractor health, safety and work performance. Consistent with the purpose Burke Management Services Pty Ltd prohibits sub-contractors in: Undertaking their duties whilst under the influence of prohibited/controlled substances or alcohol;

Using alcohol or prohibited or controlled substances in the workplace during working hours; and

Bringing and using prohibited or controlled substances into the workplace without the prior approval of the Manager. This policy applies to all employees, any volunteers and sub-contractors and their employees. The focus of this policy is on prohibited and controlled substances or alcohol use or dependence, which affects the work performance of the individual and endangers the safety of others. All sub-contractors have a responsibility to present for work and remain unimpaired by alcohol. This means that the responsible consumption of alcohol must be adhered to prior to work, during lunch breaks and at any functions likely to occur. There will be “zero tolerance” on prohibited or controlled substances, unless authorised by a doctor or pharmacist and reported to your Supervisor/Manager. If you are driving, or in charge of an articulated motor vehicle, B-double, road train, vehicle carrying a placard load of dangerous goods, tow truck, pilot or escort vehicle escorting an oversize vehicle, or a vehicle being used by you as a driver trainer to give driver training, you must have a blood alcohol level of 0.00 (zero). 7. SMOKE FREE WORKPLACE POLICY Burke Management Services Pty Ltd is committed to providing for the health, safety and welfare of its employees and sub-contractors whilst at work. Consistent with this commitment Burke Management Services Pty Ltd provides a workplace atmosphere free of environmental tobacco smoke. This policy applies to all employees and sub-contractors of Burke Management Services Pty Ltd. Where is Smoking Permitted? Smoking is permitted in designated areas during breaks and out of work hours however smoking must not take place within 4 metres of doorways leading into premises. Burke Management Services Pty Ltd management team encourages non-smokers to avoid passive inhalation of environmental tobacco smoke. The management team supports and encourages, employees and sub-contractors choosing to participate in “stop smoking” programmes.

7. OCCUPATIONAL HEALTH AND SAFETY POLICY & OBJECTIVES

This policy explains Burke Management Services Pty Ltd commitment and responsibility of management, employees and sub-contractors to: Work with our stakeholders and suppliers to provide services that meet our customer’s specific needs;

Develop long-term relationships to ensure the best outcomes for our company;

Deliver our jobs to customers on time, meeting their requirements and maintaining allocated costs;

Provide evidence throughout all jobs that they have been delivered in accordance with the customers and any known authority requirements;

Identify and manage the risks associated with our work;

Provide a safe, healthy and environmentally friendly workplace, including all work areas within our control;

Strive for continued improvement of service delivery through measurement of customer satisfaction;

Comply with relevant authorities, regulatory and statutory requirements;

Provide the necessary resources and commitment to ensure our policies and objectives are met; and

Commit to setting & reviewing our objectives and targets on an annual basis. Our objectives are to:

Satisfy our customer’s requirements;

Increase our customer base and repeat work from existing customers;

Have zero workplace accidents or incidents;

Ensure immediate and ongoing attention to quality of performance, safety of all concerned and consideration of the environment;

Ensure our sub-contractors operate with the same objectives in mind; and

Communicate with the people involved in our jobs to enable the above. 8. PERSONAL PROTECTIVE EQUIPMENT (PPE) Whilst on site at Burke Management Services Pty Ltd the following minimum PPE must be worn:

Steel capped shoes/boots; and

High visibility vest. Sub-contractors must also have the following PPE to be utilised on sites where required:

Long Pants and long-sleeved visibility shirt

Hand Protection (gloves for manual handling eg load restraint)

Hard hat

Eye protection

Hearing Protection

Wet weather attire Site Signage All personnel must report to reception on arrival and site signage must be observed at all times.

9. CHAIN OF RESPONSIBILITY

With recent and further planned legislative changes, all parties in the transport chain have a clear responsibility to ensure road safety and legislation requirements are not compromised. This is referred to as the chain of responsibility. Parties included in the chain of responsibility include any person or party who influences the transport assignment, such as:

Consignors - those who commission the carriage of a load by road;

Packers - those who place goods in packages, containers or on pallets transported by road;

Loaders - those who place or restrain the load on a heavy vehicle ;

Drivers - those who physically drive a heavy vehicle;

Drivers - those who physically drive a heavy vehicle;

operators and schedulers - those who operate the business that controls the use of a heavy vehicle;

receivers - those who pay for the goods or take possession of the load; and

employer’s or managers of a business may also be personally liable for breaches by an employee.

As a sub-contractor, you can be held legally accountable if your actions, inactions or demands cause or contribute to road safety breaches. Chain of responsibility is similar to the legal concept of “duty of care” that underpins occupational health and safety law. Penalties and sanctions under the road law for liability in negligence and damages claim’s, can range from formal warnings to court-imposed fines and penalties. It is required by law for you to take all reasonable steps to prevent your actions or conduct from causing or contributing to a breach. Commercial arrangements We ensure our commercial relationships do not cause our business to breach chain of responsibility laws by: including best work practices in our commercial arrangements with our sub-contractors;

requesting information about what systems and controls are in place to ensure compliance (eg, policies on drugs or fatigue management); and

avoiding arrangements which encourage or reward non-compliance. How Do You Work Within The Chain Of Responsibility? Understand your specific role and responsibility as it relates to the chain of responsibility; Accept that you will be held accountable for your acts and omissions; and

Identify your potential exposure to enforcement action or other penalties from Queensland Transport, state transport authorities, insurance companies, police services and Workplace Health and Safety authorities. What are the Driver’s Responsibilities? Drivers of heavy vehicles on the road have a responsibility to ensure legal requirements are

met. Chain of responsibility provisions DO NOT remove these responsibilities.

Sub-Contractor Responsibilities: Whilst undertaking duties on behalf of Burke Management Services Pty Ltd, sub-contractors will ensure that: Prior to commencing a new driving activity drivers notify management if they are unable to complete an assigned task in accordance with any part of the Company Manual.

Completion of a relevant Safe Driving Plan will be taken as acknowledgment of adherence to Company Policy in particular Fatigue Management and Scheduling and Rostering;

Upon commencing a driving activity, drivers are responsible for managing their time in order to safely and legally complete the requested task/s. In particular, driver activities must be accurately recorded and comply with national driving hour requirements, including: Complying with ALL legislative requirements for work and rest periods under national and state regulations. NOTE: Current information on National and State regulated driving hours is available from management. Sub contractors will receive where possible, 24 hours advance notice of a requirement to attend work. Once a driving task has been allocated to a sub-contractor: Where required, the driver reports in at agreed times; and

Where a driver informs of a deviation, Burke Management Services Pty Ltd will notify the customer.

Upon completion of a driver’s activities: All documentation is returned to Burke Management Services Pty Ltd (ie Proof of Delivery and Safe Driving Plans). 10. SCHEDULING AND ROSTERING

Burke Management Services is committed to ensuring that all driver/sub-contractor rosters and schedules are prepared having due regard to the following factors:

Previous trip times and reported incidents;

Adequate time in order to safely and legally complete the task;

Compliance with national and State driving hour requirements;

Providing flexibility to enable short and discretionary rest breaks;

Avoiding changes to a drivers sleeping pattern;

Accounting for loading, unloading and queuing time; and

Providing sufficient notice of work in line with the company fitness for work policy. 11. TRAINING

Sub-contractors will receive instruction and training in the systems, policies and procedures

required whilst contracted by Burke Management Services Pty Ltd. Sub-contractors may be

asked to complete a refresher training course every 12 months as a minimum or as deemed

necessary by the Manager. Reasons for refresher training may include but are not limited to:

Non Compliance, Changes to the Quality Management System.

All Sub-contractors must demonstrate that only trained and experienced personnel will be provided to Burke Management Services Pty Ltd. 12. PAYMENT OF INVOICES

Burke Management Services Pty Ltd will pay invoices after 30 days from date of invoice and upon receipt of appropriate paperwork eg proof of delivery. 13. LOAD CONFIGURATION

It is condition of your contract that you are responsible for the checking of and the legal compliance of all loads in respect to weight, height and length. Burke Management Services Pty Ltd does not encourage or accept loads that exceed statutory mass limits without appropriate permits/documentation. Please refer any problems associated with compliance with mass limits to management who will issue instructions as to where to weigh or how to adjust loads to comply. All fines and costs regarding overweight matters, which occur from not following these instructions, are the responsibility of the sub-contractor. 14. THEFT, ATTEMPTED THEFT OR REMOVAL OF PROPERTY

Any act of theft from Burke Management Services Pty Ltd or any customer will be reported to the appropriate law enforcement authority for action. This is considered an act of wilful misconduct and will lead to a cancellation of the contract after an appropriate investigation and may result in criminal charges. Burke Management Services Pty Ltd believes that the abandonment of a company vehicle, the removal of fuel cards or any equipment provided in the vehicle constitutes theft and may be reported to the appropriate law enforcement authority for action. All allegations of theft, attempted theft or removal of property will be put in writing and the accused person will be given sufficient time to respond to any allegations. 15. PERSONAL PROPERTY POLICY

Personal property brought onto the premises of Burke Management Services Pty Ltd including, but not limited to, vehicles, clothing, personal accessories, office furnishings, supplies and equipment, will be left on the premises at the sub-contractors own risk. Burke Management Services Pty Ltd accepts no liability for theft, damage, or destruction of

personal effects of sub-contractors left on the premises.

17.1 APPENDIX A: SITE SAFETY RULES

INTRODUCTION / DUTY OF CARE Burke Management Services Pty Ltd is committed to ensuring a safe and healthy working environment for all Employees, Visitors, Contractors and Subcontractors in its offices, workshops and workplaces. Although the prime responsibility for health and safety rests with management, it is the responsibility of all Employees, Visitors, Contractors and Subcontractors and persons performing work for the organisation to ensure their own and others’ health and safety by observing safe systems of work, following all rules, policies, procedures and guidelines and reporting potential hazards. SCOPE These rules apply to all employees, visitors, contractors or subcontractors. DEFINITIONS Employee - Any person employed by Burke Management Services Pty Ltd Visitor - Any person visiting Amoco Queensland’s site Contractor - Any person who provides a service for Amoco Queensland Pty Ltd (eg) Mechanics, Fuel Delivery, Builders, Cleaners, Consultants. Sub-contractor - Any person or company who is contracted to perform transport related tasks on behalf of Burke Management Services Pty Ltd and that Burke Management Services Pty Ltd has some level of control over the performance of these tasks. (eg) Pickup and delivery of freight, scheduling delivery times etc. EMERGENCY PROCEDURES AND EVACUATION 1. In the event of an evacuation, all employees, visitors, contractors and subcontractors are to proceed to the assembly point that has been directed for each site. Visitors and Contractors will be confirmed against the sign in register.

2. All employees are to assist with the evacuation of visitors, contractors or subcontractors.

3. Do not leave the assembly point until authorised to do so by the WH&S Officer or senior management. This ensures that we can ascertain if there are persons still to be rescued on site. Assembly Area The Emergency Assembly Area is located as directed for each site.

SITE ACCESS 1. All visitors and contractors must report to the Office to sign the visitors / Contractors register and must sign out when leaving.

2. All subcontractors must be inducted which will allow them to enter and exit the site without signing in and out each time.

3. Access / entry to the site will be monitored by company management. PERSONAL PROTECTIVE EQUIPMENT 1. Personal Protective Equipment MUST be worn as indicated by the signs across site.

2. Steel capped boots, high visibility safety vests or shirts must be worn. SMOKING 1. Smoking is not permitted within 4 metres of any non-residential building ie office and workshop.

2. Smoking is allowed in the designated area. Please take care with butts etc and place them in the bins provided. PARKING 1. All vehicles shall be parked in designated parking bays.

2. Contractor’s vehicles (eg) mechanics etc will be permitted on site to allow them to perform the services they are contracted to perform. DRIVERS FACILITIES 1. As part of our commitment to Fatigue Management, Burke Management Services Pty Ltd has provided drivers facilities for the use of company drivers and subcontractors.

2. Please ensure that the facilities remain clean and tidy.

3. If there are any problems with the driver’s facilities, please advise management on site ASAP. HARRASSMENT 1. Bullying or harassment of any kind will not be tolerated by Burke Management Services Pty Ltd. FIRST AID 1. A first aid kit is provided in the Operations Office. WH&S OFFICER

1. The Workplace Health and Safety Officer can be located in the Office.

FIRE EXTINGUISHERS 1. Fire extinguishers are provided throughout the site and employees and subcontractors should familiarise themselves with their location and request training if they are in any doubt about how to use them correctly.

Only those drivers, loaders or subcontractors that hold the necessary qualifications and have been assessed as competent, are to use Burke Management Services Pty Ltd equipment or to perform any work on Burke Management Services Pty Ltd site. SITE RULES 1. If a visitor or contractor needs to visit other parts of site they are to be inducted and must wear a visitor’s or contractors tag that is to be displayed at all times and returned to the office when leaving the site

2. Visitors and contractors who have NOT undergone a workplace induction are NOT to be on site unless they are escorted by a designated Burke Management Services Pty Ltd representative.

3. Visitors or contractors are not permitted within the Yellow zones (Workshop & Loading Area) without specific management approval.

4. All vehicles on site must adhere to the 10 km/h speed limit.

5. Trucks and forklifts have right of way on site.

6. Pedestrians and vehicles (other than the one being loaded) must remain at least 10 metres from moving trucks and forklifts or from vehicles being loaded / unloaded.

7. In the event that a vehicle is being loaded/ unloaded by someone other than the truck driver, the truck driver is to stay at least 10 metres from the vehicle or within sight of the forklift operator until the loading/ unloading process is completed. They can then conduct their load restraint checks etc.

8. Unless experienced or qualified, Employees, Visitors, contractors, Subcontractors must NOT: a. Climb on ladders, scaffolding, trestles and planks etc

b. Use any power, air or explosive operated tools

c. Enter any designated hazardous area.

Enter or cross over any barricaded and/or signed area without being instructed to do so by an authorised Burke Management Services Pty Ltd representative.

e. Enter any area or carry out any activity that has the potential to put themselves or others at risk of injury.

f. Carry out any work in any trade whatsoever without management permission.

g. Use any hazardous substances. 9. Visitors, contractors and Subcontractors must comply with all reasonable instructions given by the designated Burke Management Services Pty Ltd representative.

10. All visitors are to keep clear of machinery and chemical storage and must refrain from touching levers and switches or equipment.

11. All accidents or incidents must be reported immediately to Management or a member of staff.

12. Firearms, drugs and alcohol are prohibited on or in any Burke Management Services Pty Ltd site or vehicle unless they are part of a manifest or load or they have been approved by Management. MINORS AND CHILDREN ON SITE 1. All minors are to remain in the company of a parent or guardian while on Burke Management Services Pty ltd site. PASSENGERS 1. Passengers are not permitted in any Burke Management Services Pty Ltd vehicles or in any Subcontractor’s vehicle while performing work on behalf of Burke Management Services Pty Ltd unless authorised by Management. WORKING ALONE 1. Any person working alone or outside normal operating hours is to exercise caution and advise Management of working timeframe. MECHANICS AND TRADESPEOPLE 1. Tradespeople that are working on equipment must place signs on the equipment to ensure that no one inadvertently tries to start or use the machine whilst they are working on it.

2. When repairs or the work is completed, the tradesperson or contractor is to remove the signs. NOTE: The only person who is permitted to remove the sign is the person who placed it there originally.

VEHICLE AND EQUIPMENT INSPECTIONS 1. All forklifts must have a pre-start check completed at least once daily BEFORE it is used. Each forklift has weekly pre-start checklist provided.

2. Before using the forklift check that the pre-start has been done for the day.

3. Evidence that a daily vehicle inspection has been completed for each subcontractor vehicle must be provided to Burke Management Services Pty Ltd management. LOAD RESTRAINT 1. All persons responsible for restraining loads, freight or containers etc, must strictly adhere to the load restraint guide. If anyone does not have a copy of the load restraint guide, a copy is available from management. STANDARD OPERATING PROCEDURES 1. Management of Burke Management Services Pty Ltd has provided Standard Operating Procedures to assist with performing your duties safely. Please refer to these documents for guidance and if you have any concerns, please discuss these with Burke Management Services Pty Ltd management ASAP. 2. Specific SOP’s that would be of assistance to you will include:

- Accelerating and gear changing

- Changing Tyres

- Driving Hours (Basic Fatigue Management)

- Driving Hours (Standard)

- Emergency Procedures & Guidelines for Vehicles

- Enter and Exit a Vehicle safely

- Manual Handling

- Night Driving

- Preventing Slips, Trips and Falls

- Reporting Hazards

- Reporting Injuries

- Wet Weather Driving HOURS OF BUSINESS 7.00am till 5.00pm. Please Note: Only those contractors or subcontractors who have permission and have been assessed as competent will be allowed to access the site outside of the designated hours. Particular care must be taken when working alone or outside of the above hours.

17.2 APPENDIX B: SUBCONTRACTOR REPORTING AND OBLIGATIONS SUMMARY Sub-contractors report directly to the Operations Manager.

Sub-contractors are required to possess the following prior to commencement of a job;

o Valid Driver‟ s Licence;

o Valid Work Diary and fatigue-related authorisations;

o Permits (where applicable);

o Appropriate equipment and/or loading materials to secure and safeguard the load;

o Appropriate signage when required;

o Appropriate directories, maps and written instructions
