Wider objective: To achieve the effective functioning of acquis communautaire in the field of free movement of goods in the harmonised area through a smooth transition from existing regulatory certification system in Poland to conformity assessment system of the EU (New Approach) and realisation of provisions on the designation of bodies included in the Protocol on European Conformity Assessment Agreement. The project embraces implementation of subsequent priority directives contained in Annex 2 PECAA, with focus on upgrading capacities of the Polish laboratories and certification bodies, and on supplementing technical support to this end, including special equipment (point 3 (a) in PECAA). To increase Poland’s ability to adopt the standardisation system in line with the EU requirements and support its effective functioning in order to ensure the free movement of goods. To harmonise technical regulations in order to allow Poland for the elimination of trade barriers. 2.2. Immediate objectives: Adaptation of the Polish institutions and infrastructure in testing and certification areas to the Union requirements on the basis of the Act on conformity assessment system and New Approach Directives implemented to the Polish law: 89/336/EEC (Electromagnetic compatibility), 99/5/EC (Radio and telecommunication terminals), 88/378/EEC (Toys), 89/106/EEC (Construction products), 93/42/EEC (Medical devices), 90/385/EEC (Active implantable medical devices), 98/79/EC (In vitro diagnostic medical devices); Adaptation of the Polish Centre for Accreditation (PCA) to act as an accreditation body in accordance with the EU requirements; Adaptation of the Polish Centre for Testing and Certification (PCBC), National Regulatory Authority for Telecommunications (URT) and National Institute of Telecommunications (NIT) to meet requirements of the notified or competent bodies (modernisation, complementation of equipment of their laboratories and training); Incorporation of university laboratories in a network of accredited units. Implementation of quality system in the chosen laboratory of Wroclaw University of Technology (WUT) to obtain accreditation allowing for carrying tests under the following New Approach Directives: 98/37/EC (Machinery), 97/23 EC (Pressure equipment) as well as the project of standard pr EN ISO 11439 (High pressure cylinders for the on-board storage of natural gas and fuel for automotive vehicles.) Alignment of institutions involved in the Polish standardisation system with the requirements of European standards bodies by: elaboration of a relevant strategic plan for the Polish Standardisation Committee’s (PKN’ s) development, upgrading of institutions involved in standardisation, IT in standardisation work implemented, European standards databases and their transposition into the Polish standards file created, Competencies of the standardisation personnel upgraded through adequate training, Technical infrastructure supporting standardisation activities in Poland strengthened. 2.3. Accession Partnership and National Programme for the Adoption of the Acquis: The above-cited objectives are in compliance with priority 1.1. of NPAA „Harmonisation of the Polish law in the scope of New Approach Directives”. In the chapter „Internal market” of the „Accession Partnership” the adjustment of standardisation and conformity assessment structure as well as harmonisation of horizontal technical legislation for industrial products were defined as a short-term priority. This project conforms with rules laid down in the „Standardisation, Conformity Assessment and Technical Regulations - Initial National Strategy Towards Harmonisation” (Draft Strategy) and also with the accepted negotiation position. The Strategy reinforces provisions of the Act on testing and certification amended by means of the Act of 22 July 1999, and expressly: recognition of the producers’ declaration of conformity as means of claiming by a manufacturer, upon his sole responsibility, that a product is safe and complies with provisions of the New Approach Directives, shift of competencies in management of lists of products which are subject to obligatory third party certification, simplified procedure for products subject to obligatory third party certification, defining conditions of imposing sanctions against producers who put on the market products non-compliant with requirements of the Law, mutual recognition of test reports, certificates of conformity and declarations of conformity. The draft of Strategy, considered by Committee for European Integration at 22 December 1999, met its basic role. The task to develop a

strategy of the European acquis implementation was passed to relevant institutions and Phare experts,taken into account that NPAA is the basic document describing the complex schedule of actions also inthe field of Free Movements of Goods. Since September 2000 the elements of the Strategy which arestrictly connected with Phare'99 - project PL 99/IB/EC/01 are verified and developed by the PAA in co-operation with the Ministry of Economy and other ministries and institutions. Annex 8 to the fiche "TheImplementation of the Acquis Communautaire in the field of Free Movement of Goods" describes thelatest developments. The conclusions of the analysis will be also taken into consideration while theReports of Realisation of NPAA and NPAA modification are being worked out. The choice of NewApproach Directives for implementation under this PHARE project was made on the basis of thesequencing of implementation of NA Directives contained in the NPAA and strategy. Further on, theagreement between Poland and the European Union concluded within the Protocol on EuropeanConformity Assessment Agreement provides specialised support of the European Union for Polishlaboratories and certification bodies in form of technical assistance, especially specialised equipment.According to its text, funds for these purposes are to come from the PHARE scheme. The PECAAprotocol also lists New Approach Directives to be implemented by competent Polish bodies as well asrelated priority actions, such as training of certification personnel in the requirements of the NewApproach Directives and their practical observance. The list converges with priorities of the project. TheNPAA priorities include foremost legislative actions in the wide areas such as the technical equipmentsector, New Approach Directives, and strengthening (training, re-equipment) of institutions responsiblefor the standardisation system, as well as support for activities of institutions co-operating with thenational standards body. In priority 1.9 NPAA „Adaptation in the field of standardisation” it is stated thatin the field of standardisation the process of transposition of European Standards (and in particularharmonised standards) into Polish standards file is conducted. Special attention will be dedicated toinstitutional building of bodies responsible for standardisation. To quote, the NPPM provisions”participation of the PKN in the national system of notification of standards and technical provisionsaccording to Directive 98/34/EC (and complementary 98/48/EC)”. Also a need is expressed for thecreation of conditions for effective functioning of the New Approach Directives, with emphasis on the factthat “in the community procedures most often a declaration of the manufacturer is required in regard toEuropean harmonised standards”. According to the Accession Partnership Poland adopted Law onNational Conformity Assessment System; legislation implementing the general product safety andproduct liability directives and modified the 1993 Act on Standardisation; to start with transposition ofNew Approach Directives; to establish an independent administrative infrastructure in line with theacquis; to adopt chemicals framework legislation; to pursue alignment of traditional technical legislation.Also the following activities are needed to achieve the free movement of goods “...complete alignmentincluding conformity assessment and market surveillance systems; complete adoption of EN standards;complete alignment of sectorial legislation; ensure implementing structures for all sectors.” In medium-term perspective and according to White Book recommendations it is required that a new act onstandardisation is adopted. The process of changing of the Act on Standardisation consists of twostages. The first stage includes an amendment to the Act of 3rd April 1993 on Standardisation. Thefundamental principles of the current standardisation system in Poland are approaching those of thesystem applied in the European Union. It was found necessary to make only some amendments in orderto facilitate the process of accession of affiliates to CEN and CENELEC national member status. TheAmendment to the Act of 3rd April 1993 on Standardisation was accepted by Parliament on 13rd October2000. The law foresees: the possibility of implementing European Standards into Polish Standards inone of the official languages of the European standards organisations (it is essential for us to implement80% of ENs into PNs s by the end of 2002 – this means the fulfilment of one of the conditions to becomeCEN and CENELEC full member); the establishment of special means to be assigned for financing ofstandardisation activity; the establishment of the Enquiry Point of WTO/TBT (and the Contact Point ofDirective 98/34/EC in the future); the exclusive right of PKN to publish and distribute the Polish,international and European Standards and their drafts. The second stage, the realisation of which isplanned in 2001, foresees the introduction of a new act on standardisation. In accordance with the newact the current status of PKN - a budget institution subordinated to the Prime Minister - will be changedto the independent body (a legal body). According to the provisions of the draft proposal of the new Acton Standardisation all the Polish standards will be voluntary. The draft of new act on standardisation hasbeen already sent to the interministerial consultations for further legislative proceeding.2.4 Contribution to National Development Plan: n.a.2.5 Cross Border Impact: n.a.

3. Description3.1 Background and justification:3.1.1. Conformity Assessment.The Protocol on European Conformity Assessment Agreement (PECAA) signed in 1998 by Poland andthe European Union provides a step-by-step transformation of existing certification system in Poland toconformity assessment system of the European Union. This process proceeds on two parallel levels:transposition of specific New Approach Directives into the Polish law and preparation of technicalinfrastructure of the competent conformity assessment bodies. During the course of review of laws withinthe negotiating groups on the Free Movement of Goods, Poland accepted the obligation of implementingNew Approach Directives into domestic legislation before the end of the year 2002. Activities specified inthis project are in accordance with the accepted in NPAA time-schedule of implementation of particulardirectives into the Polish law. In connection with it, during the realisation of the project proper technicalconditions should be created to achieve effective functioning of the law within the shortest time after itsimplementation. The above-mentioned “Standardisation, Conformity Assessment and TechnicalRegulations - Initial National Strategy Towards Harmonisation” (Draft Strategy) was a multi-annualventure and the text of it became an annex to the PHARE 2000 project. The strategy is continuallyverified in the Ministry of Economy and subsidiary institutions. Tasks included in NPAA and the strategyare being implemented within a framework of a comprehensive programme which has been divided intoa couple of stages converging with subsequent national PHAREs: PHARE 1999 focused on creation ofan institutional base and a legislative framework for the conformity assessment system andstandardisation in Poland. It has been being carried into practice in the form of twinning concentrating onIB, legislation and procedure matters; PHARE 2000 in its part provides for the continuation of twinningactivities related to institutional building and legal framework in order to broaden the scope of taskscovered by PHARE 1999, and in the remaining part – it is of investment character, as it concentrates onthe preparation of technical infrastructure necessary to effectively implement New Approach Directives;PHARE 2001 is a continuation of activities undertaken under PHARE 2000 in regard to technicalinfrastructure and up-grading of human resources directives in competent bodies and notificationrequirements in line with requirements of particular directives. It complements PHARE 1999 with a fewmore New Approach Directives. It has an investment character. There will be a closely-supervised co-ordination of thematic scopes under PHARE 2000 and PHARE 2001 to avoid the convergence andrepetition of subjects covered by the two programmes, and to achieve the optimal economic result.Supervision is an integral part of each segment of the programme. Funds from the EuropeanCommission are limited, so the master programme of implementing New Approach Directives throughPHARE 1999, PHARE 2000 and PHARE 2001 refers to selected directives, the remaining directives arebeing implemented with support from own financial sources of the Polish party only. Due to high costs ofinvestment the project has been restricted only to basic measurement testing equipment, especially inregard to EMC and telecommunications equipment. In regard to more refined and complicated testing,the Polish party intends to continue using support of specialised laboratories located abroad, aspresented in the annex to this fiche. While constructing all the three subsequent programmes, theprospective beneficiaries took into consideration results of PHARE Multi-country and other foreignassistance schemes, including PRAQ III. The last report on implementing the conformity assessmentstrategy was contained in the “Reply to the Replaced EU Common Position in the Area of FreeMovement of Goods” dated 21 July 2000. Information was given there on the state of implementing NewApproach Directives, planned changes in institutional infrastructure and sectorial legislation referring tochemicals, textiles, toys, shoes, nutrients, medical appliances, packed food, pressure containers. Thedocument addressed also the non-harmonised area, standardisation and public procurement issues. Thestarting point for implementing New Approach Directives was the introduction and implementation of thehorizontal Acts on conformity assessment, whose provisions are presented as follows. The horizontalActs on conformity assessment, passed in 1999 and 2000, created the basis for legal transposition ofspecific New Approach Directives and also enabled starting institutional adjustment. Basing on the Acton conformity assessment system, accreditation and amendments of some acts, the creation of thePolish Centre for Accreditation (PCA) was initiated in the end of year 2000. The PCA operates from1 January 2001, following separation of accreditation activities from the structure of the Polish Centre forTesting and Certification (PCBC). The PCA is to perform as the national body accrediting certificationbodies, inspection bodies and laboratories within the national conformity assessment system accordingto the rules accepted by the EA (European co-operation for Accreditation). According to the Act,accreditation by PCA will be the necessary condition to obtain notification by a given conformity

assessment body. The reports from audits conducted so far by foreign accreditation bodies indicatemany materials and training needs whose supply will enable meeting EU requirements within the scopeof conformity assessment. These needs include approximation of accreditation practices to the EUstandards considering the specificity of assessments performed for notification purposes, developmentof a unified programme for assessor training and delivery of software ensuring efficient accreditationprocess, creation of databases and, also, realisation of inter-laboratory comparison tests. The projectprovides assistance for PCA in respect of the significant role that accreditation plays in increasing qualityand confidence for services of conformity assessment on the competitive EU market, both in voluntaryand regulatory areas. The PCBC will keep its existing name and will act in the voluntary area as acertifying body, and in the regulatory area as a designated/notified or competent body for specific NewApproach Directives. This will be a considerable change in the functioning of the PCBC. By the end of2002 its status of the body which co-ordinates national mandatory certification system in Poland will bechanged and it will become one of many bodies acting within the new conformity assessment system.PHARE assistance will be needed in the scope of adaptation of particular organisational units of thePCBC to the competence criteria included in the New Approach Directives:⇒ The Electrotechnical Laboratory of PCBC performs part of scope of electromagnetic compatibility

tests of household equipment. It plans to widen the range of tests to cover fully the EMC scope forelectronics and IT equipment and act as a competent body within 89/336/EEC Directive. To this end,additional equipment and training on testing procedures are needed. Applying for PHARE assistanceis not in conflict with other projects implemented by the Ministry of Posts and Telecommunicationsunder PHARE and concerning electromagnetic compatibility, because it includes a scope ofcompetence not considered in the PHARE projects conducted so far, i.e. EMC testing of electronicsand IT equipment and toys.

⇒ The Mechanical and Chemical Laboratories of PCBC has a good experience in performing toys testsfor safety certificate in Poland. According to the document „Standardisation, Conformity Assessmentand Technical Regulations, Initial National Strategy Towards Harmonisation”(draft), the PCBC will actas designated/notified body for this directive at the national level. All European standardsharmonised with the „toys” directive have been already implemented into the Polish standards set.Directive 88/378/EEC concerning the safety of toys will be implemented to the Polish law as one ofthe executive regulations to the act on general safety of products already passed. A draft regulationhas already been prepared and will become effective in the II quarter of 2001. The expected outcomeis to prepare the above-mentioned laboratories, both in terms of organisation and personnel, to beable to report to the European Commission on their readiness to conduct conformity assessmentprocedures (conformity with harmonised standards and EC type examination as defined in modulesA and B of the 88/378/EEC Directive).

⇒ The Building Materials Laboratory of PCBC reached an agreement with the Ministry of RegionalDevelopment and Construction on the possibility to be notified in the future, following implementationof suitable adaptation activities in the scope of equipment and training. The EEC directive onapproximation of laws and executive regulations of member states concerning construction materials(89/106/EEC), which defines conformity attestation system with technical regulations in Annex III, isbeing introduced in the Republic of Poland by provisions of the " Construction Law" of 7 July 1994and executive acts (Decrees of Minister of the Interior and Administration of 5 August 1998 and of 31July 1998). The system of conformity assessment of construction products, according to thedirective, provides in each case (except of third module of conformity declaration) the participation of"third party" (accredited laboratory, accredited certification or inspection body).

⇒ As the national quality system certifying body, the Quality System Certification Office of PCBC is amember of international network of certification bodies IQNet since 1997. It has recognisedexperience achieved over many years practice in performing assessment of quality systems ofenterprises according to EN ISO 9000 standards. The 93/42/EEC, 90/385/EEC and 98/79/ECmedical directives provide, within D, E, H and Hbis modules, the assessment of quality system ofmanufacturers according to ISO 9000 and EN 46000 standards. The PCBC has an arrangement withthe Ministry of Health, responsible for implementation of these directives, on using competencies ofPCBC for the realisation of the above mentioned modules. This project in its part related to medicaldevices directives is complementary to the PHARE 2001 project proposed by the Ministry of Healthconcerning, among others, preparation of certification bodies to perform type examination (directivesprovide involvement of two types of certifying bodies: bodies which perform type examination andbodies which examine quality systems).

According to the „Telecommunication Law” of 2000, in telecommunication field the URT (NRA - NationalRegulatory Authority for telecommunications), acting as a notified body for directives 89/336/EEC and99/5/EC, is a supervisory body responsible for their implementation. The URT is being built on the basisof a few initial institutions from the Polish telecommunications sector: National Radio-communicationsAgency, National Inspection for Telecommunications and Posts, and – partly – Ministry of Posts andTelecommunications. According to the Telecommunication Law the President of URT is a regulatorybody in regard to telecommunications activities, frequency spectrum management, and acts to assurecompliance with EC directive requirements referring to EMC and type approval of telecommunicationsequipment. NRA’s structure includes regional units for internal market surveillance and inspection

in

compliance with Directives 89/336/EEC and 99/5/EC. Thus, as a successor of the Ministry of Posts andTelecommunications, URT will continue the long-year strategy for implementing EC directives related toradio-telecommunications equipment and electromagnetic compatibility. Fundamental premises of thestrategy were worked out in the mid- nineties (1990s) with the essential support from the EuropeanCommission which, as early as in 1994, committed itself to back up the construction of at least onecomplete laboratory for measurement testing according to EU standards. Provisions on this werecontained in the Financial Memorandum for the PHARE 9313 programme. Creation of laboratory for fullscope of electromagnetic compatibility and conformity assessment testing is expensive so the major goalof this strategy is to have at least one adequately equipped laboratory that would match basic both EUdirective requirements necessary for the implementation of Directives 89/336/EC on electromagneticcompatibility and 99/5/EC on radio and telecommunications terminal equipment. Presently and in thefuture more complicated measurement testing related to the newest digital technologies like GSM andUMTS, have to be conducted in co-operation with specialised laboratories in the European Unioncountries. On the basis of consultations with EU experts, the scope of the project has been designedonly to provide minimal security for implementing New Approach Directives and establishing relatedtechnical infrastructure, while in a longer perspective it is assumed that the market for laboratoryservices will develop naturally. It is important that in conformity with EU requirements, the NRA fortelecommunications will not mix certification activities with market surveillance. The above-describedlaboratory exists by the NRA and has been set as part of the so-called “subsidiary household” in order toensure a firewall between pre-market and post-market testing of products. Its development will beparallel to the laboratory of the National Institute of Telecommunications presented below. The twolaboratories should operate as mutually complementary but separate entities independently obtainingmeasurement results. Within the broader programme of implementing New Approach Directives,implementation of selected directives is supported by the National Institute of Telecommunications (NIT),which conducts complementary work regarding Directives 89/336/EC and 99/5/EC. In the future theInstitute will become an important element in creation of a competitive market for laboratory services inthe telecommunications field. The National Institute of Telecommunications is in possession of TypeApproval Laboratory, which has a certificate of PCBC (accreditation) and develops EMC Laboratory. Inorder to meet EU requirements these are necessary for NIT: adaptation of its organisational structure inorder to conduct certification activities, modernisation of test equipment in the laboratory andimprovement of testing and conformity assessment facilities (Directives 99/5/EC, 89/336/EEC). PHARE2000 funds were planned to purchase basic equipment items, PHARE 2001 funds will be used tocomplete the equipment set in view of strategy requirements for implementing Directives 89/336/EC and99/5/EC. Polish technical universities have qualified personnel and often, diverse technical equipment attheir disposal. These can be used in the adaptation process of hitherto existing system of certification inPoland to requirements of the European Community. The Constructional Materials Testing Laboratory(subsequently named as CMTL), existing at Institute of Materials Science and Applied Mechanics ofWroclaw University of Technology (WUT) has been chosen to incorporate the university laboratory into anetwork of accredited units. CMTL has several-years experience in elaborating expert reports forindustry, local administration and judiciary. Laboratory CMTL has certificate of Office of TechnicalInspection (UDT), valid for many test procedures and this laboratory as the first university laboratory willcontest for accreditation of its quality system due to EN 45001 standard of test procedurescorresponding to New Approach Directives 98/37/EC, 97/23/EC and project of standard pr EN ISO11439. Wroclaw University of Technology is the first technical tertiary school which aims to involve itshuman as well premises resources into changes of accreditation in Poland and into adaptationprocesses in this area compliant with EU requirements. Directive 98/37/EC will be applied by theLaboratory especially in the range of harmonised standards EN 1032, EN 1152, EN 1299, EN ISO 13753and in all cases when machine tests require detailed strength and structural examinations of the

materials used in manufacturing parts or sets of machines. Directive 97/23/EC will be applied in staticand fatigue pressure tests as well as other cases when strength and structural examinations of thematerials used in manufacturing pressure elements are required. The harmonised standards: EN 10222-1, EN 10222-3, EN 10222-4, EN 10268, EN 12482-1 will be used there. Standard EN ISO 11439(actually: pr EN ISO 11439; FDIS in preparation) will be applied in testing of new generation of tanks forcompressed natural gas (CNG) designed to be installed in cars. Laboratory is equipped with variouslevels of wear and applicability in conducted tests, therefore complementation of equipment isnecessary. The investment is necessary to supply the laboratory with equipment enabling it to obtainaccreditation and to carry out tests under Directives 98/37/EC, 97/23 EC and pr EN ISO 11439.Constructional Material Test Laboratory intends to obtain accreditation allowing for carrying tests underthe following New Approach Directives: 98/37/EC (Machinery), 97/23 EC (Pressure equipment) as wellas the project of standard pr EN ISO 11439 (High pressure cylinders for the on-board storage of naturalgas and fuel for automotive vehicles.). In the case of directives which were included into earlier Polishapplications (New Approach Directives 98/37/EC, 97/23/EC), this time aims are quite different whenlaboratory may carry research in two areas, namely: Wide spectrum of materials strength tests andcomplete set structural as well as micro-structural research. Therefore the new range of competence isproposed in Polish market. In turn the project of standard pr EN ISO 11439 is an attempt of obtainingaccreditation in the area which no Polish laboratory has. As regards the strategy for co-operationbetween notified bodies acting in respect to selected New Approach Directives, as described above,networking is primarily important. Within the co-operation framework, exchange of experiences willfacilitate unification of application procedures and common understanding of technical aspects infunctioning of the directives. This will have a great impact on credibility of the system of notified bodiesin Poland. On the home-country level co-operation will resemble that in the EU. In addition to this,sectorial groups of Polish notified bodies will work with their counterparts on the Community level.Groups of bodies notified in regard to selected New Approach Directives are already beginning tofunction, e.g. in the scope of LVD and EMC. To create the target notification system it is necessary tobuild a multilevel structure able to: define notification authorities and notification procedures, rights andobligations of notified bodies and notifying authorities (in conformity with standards laid out in theDeontological Codex prepared by the European Commission), set up a home-country forum for co-ordination between notified bodies and link it with European structures supervised by the Commission,involve PCA in the process of assessing technical competencies of notified bodies. The project focuseson enhancing capacities of competent bodies involved in certification processes for the practicalapplication of the New Approach. Market surveillance is covered comprehensively in the project, withspecial attention to the telecommunications sector and functions of the NRA for telecommunications,which acts for market supervision in regard to New Approach Directives 89/336/EC and 99/5/EC throughits central headquarters and local units. As for the remaining NA Directives, market surveillance activitiescovered by them will be introduced with regulations of the Council of Ministers on implementingindividual directives. Market surveillance activities are co-ordinated by the Office for Competition andConsumers Protection, which is the main market surveillance organ in Poland. The President of theOffice for Competition and Consumers Protection is the general authority responsible for implementationof the provisions related to New Approach Directives, also through the office’s regional units for localmarkets (i.e. “delegations”). Other specific regulations on market surveillance, matching those in theEuropean Union, have been made for: sectors with independent regulatory bodies: telecommunications,energy, and prospectively – posts and transport; sectors with other supervisory organs which are subjectto Ministries, e.g. construction, medical equipment, technical installations (including pressure containers,lifting devices, reservoirs for hazardous materials). Thus, implementation of all New Approach Directivesselected for this project should be effectively linked to a market-surveillance system. Intensified supportfor the market-surveillance system in Poland might be considered as subject of a separate,comprehensive and complex PHARE project. It would take into account the broad array of Specialattention would be paid to product safety. As the appropriate system is under preparation now anda global conception of market surveillance in the scope of New Approach Directives will be prepared inthe I quarter of 2001, this project aims to support the system which will be created with expert advicefrom a Twinning light partner. Market-surveillance organs operate now on the basis of specificprovisions expressed in separate legal Acts. By virtue of the Law on General Safety of Products of22 January 2000 market-surveillance organs can, in justified circumstances, oblige a producer to presenta product for testing in a proper accredited laboratory, defining the scope of analysis and the date. Incase when product safety is deemed unsatisfactory, testing costs are born by the producer and the

product may be withdrawn from the market. Therefore, proper preparation of the laboratories’ technicalinfrastructure conditions performance of duties related to market-surveillance. Competencies in market-surveillance are shared between the Office for Competition and Consumers Protection as the horizontalco-ordinator, and other inspection organs supervised by Ministries responsible for sectorial policies.Office for Competition and Consumers protection has a right to intervene in cases when there are nospecific provisions regulating product safety for a given product category. Through the CommercialInspection, it conducts central and regional analytical laboratories (in voivodships), surveys theInspection’s activities and controlling plans. The Inspection executes market control in stationarycommercial entities like shops and supermarkets, as well as in door-to-door selling companies, in ruralareas, open air fairs, by tourist tracks and highways, fuel stations, at cross-border points, railwaystations, coach stations. Particularly, it concentrates on: proper marking of in-sale products; safety andquality marks; use of additives in foods and nutrients; reliability of content information placed on productson product description labels; conformity with regulations concerning product safety; conformity withregulations concerning product storage; compliance with regulations to hold a valid certificate an testingresults for a sold product by the producer or distributor. The main effort of the Polish authorities is toimprove the organisational, administrative and legislative framework of market surveillance in Poland.3.1.2 StandardisationThe standardisation issues have so far been in part the subject of the co-operation with the EuropeanCommission. The successive programmes: Phare 1999 and 2000 which have terms “certification“ and“standardisation” in their titles are exclusively concerned with the sphere of application of standards inthe production and provision of services. In this area standards are used as a tool necessary to regulateespecially technical production and provision of services. The present programme covers also the verysphere of development (creation) of standards.White Book in the chapter describing preparations of the associated Central and Eastern Europeancountries to integration with the EU Internal Market states: „standardisation is a link connectingregulative bodies, manufacturer and European market and is characteristic for the EU technical andeconomic environment”.PKN as a national standards body (NSB) acts in accord with act on standardisation of 3 April 1993.Present PKN’s priority actions are oriented on accomplishment of 9 conditions determined by CEN andCENELEC to obtain full membership of these organisations. Beginning from 1997 an evident decreasingtrend of number of mandatory PNs can be noticed; out of total number 2600 mandatory PNs werereduced to 990. According to the recent ministries’ declarations the number of mandatory standards willgradually be decreasing as the acquis communautaire, (in particular the EC directives) is implementedinto Polish law (technical regulations). By the end of 2001 it is planned to reduce the number ofmandatory standards by 50% and by the end of 2002 it is foreseen that all the mandatory standards willbe withdrawn. According to the new standardisation law PKN will be acting at full conformity with EUprinciples in particular such as voluntary standards, independence from government administration, legalpersonality for PKN, intellectual property rights for ENs, etc. PKN is aiming at thorough change of itsorganisation to act in a way as leading European standards bodies such as DIN, AFNOR, BSI do. Themost intensive work on implementing ENs into PNs will take place in 2002, but so far significant progresshas been done. with EU requirements and to effect a clear division of standardisation competencies between the Polishstandards body and co-operating institutions.In the area of telecommunications, where one of the main priorities is standardisation, the NationalInstitute of Telecommunications (NIT) is the national research and scientific centre. It is anindependent institution whose activities cover the whole field of telecommunications: radio-communications, radio, television, digital transmission, data transmission, switching systems, terminals,fibre optics, metrology, and elimination of radio frequency interference. The National Institute ofTelecommunications is a member of ETSI and is the National Standardisation Organisation (NSO) forETSI in Poland. Technical Committee (No 11) acting in the National Institute of Telecommunicationsdevelops and approves standards related to the measurement and testing of telecommunicationsequipment and networks, introduces European standards into the Polish Standards file, especiallystandards connected with Directives 99/5/EC, 89/336/EEC and 73/23/EEC (harmonised standards). TheInstitute co-operates with other international organisations such as: UIT, CISPR and IEC.The Training Centre of the Institute provides a wide range of seminars and professional trainingworkshops. NIT’ s activities in telecommunications standardisation are supported by other bodies: theURT (NRA-National Regulatory Authority for telecommunications) and the Ministry of Posts andTelecommunications (MPT).URT (NRA - National Regulatory Authority for telecommunications) is responsible for: monitoring ofquality of telecommunication services in line with standards of European standards bodies and definitionof requirements for telecommunications infrastructure, compliant with standards of European standardsbodies.Ministry of Posts and Telecommunications (MPT). After the institutional reform of 1 January 2001 theMinistry will function with a new scope of tasks. According to the “Telecommunications Law” (Art. 34, 88,89, 108), the Minister responsible for telecommunications will define and issue: indicators of quality fortelecommunication services in line with standards of European standards bodies, and detailed technicaland exploitation provisions for end-contacts universally applied in public telecommunications networks(referred to as “basic requirements”), in line with standards of European standards bodies.In order to achieve the effective functioning of the URT and the Ministry in the standardisation field,further division of standardisation competencies between the two institutions will be worked out underthis project, especially competencies related to harmonised standards in line with New ApproachDirectives 73/23/EEC, 89/336/EEC and 99/5/EC. The studies will link standardisation activities of theURT and the Ministry to those of the NIT and the PKN.As for historical background, co-operation of the involved institutions has been continuing for severalyears and was originally made to create a long-term strategy in the standardisation area. In 1994 anagreement was signed between President of PKN and Minister of Posts and Telecommunications oncommon activities related to standardisation in the telecommunication field. By virtue of that agreementthe secretariat of PKN’s Technical Committee for telecommunications was located in the NIT, asprovisioned in Article 14 of the Standardisation Act. In the same year PKN, NIT and ETSI concluded amoratorium on the participation of these institutions in ETSI in the role of an NSO. On the basis of thatdocument responsibilities for European telecommunication standards were transferred from PKN to NIT(national consensus, national implementation). Since 1.10.1994 a representative of the Minister of Postsand Telecommunications is a member of the PKN. To ensure that the standardisation strategy iseffective, after the institutional reform of 2000 URT (national regulator for telecommunications) will alsobecome an ETSI member.3.2. Linked activities:3.2.1 Conformity AssessmentDirect co-operation between agencies supervised by the Ministry of Economy and the Ministry of Postsand Telecommunications and PHARE in the scope of adaptation of Polish type approval system,certification standards and procedures to the European requirements, started under the system ofnational sector PHARE programmes operative until 1997. For example, PCBC was involved in:· PHARE PL-9303 Quality Promotion: supply of equipment for low voltage and chemical testing,

training on quality management systems, training on general problems concerning New Approach,aid in creating certification system of auditors of quality systems according to EOQ HarmonisedScheme;

· ZZ-9113 PRAQ 91: quality infrastructure, participation in the European quality events;

· ZZ-9525 PRAQ III: assessment and diagnosis of the national accreditation system, training onchosen New Approach Directives, under the PRAQ III FAST a report was made in regard to the toysdirective.

In relation to the national sectorial PHARE program PL9313 the Ministry of Posts andTelecommunications has obtained assistance for the National Radio-communications Agency inconstruction of an anechoic chamber for the EMC Laboratory. The grant of 735000 EUR was assignedfor purchase of absorbers for the up-to-10m. anechoic chamber. Costs of constructing the of thechamber (2 mln. EUR) are covered by National Radio-communications Agency (PAR). Thanks to thisassistance the Central Laboratory of PAR is finishing realisation of the project and right now is settingabout initiating activities of the laboratory. Technical tests of the chamber made by an independentAustrian laboratory confirmed its high operational parameters. To achieve full operability, an additionalmeasuring apparatus is necessary, according to the requirements of the 89/336 ECC and 99/5 ECDirectives and other European standards. This task is assumed to be partly carried out under thePHARE 2000 program. Purchase of the remaining necessary laboratory equipment is to be financed byPAR and under this PHARE 2001 project. The laboratory together with the activities led under thePHARE 2000 programme related to institutional issues (establishment of the NRA fortelecommunications for which the laboratory is to act) will be able to meet the requirements ofaccreditation and notification in relation to the directives mentioned above. As the similar programcarried out parallelly (under PHARE 2000 and planned PHARE 2001) refers to telecommunicationsequipment in the accredited laboratory in the Telecommunications Institute, NRA (i.e. URT) will have atits disposal a necessary technical and laboratory base, which will enable it to fulfil its duties, provisionedby the Telecommunications Law, in the scope of control of compliance with the two New ApproachDirectives related to the telecommunications field: 89/336/EC and 99/5/EC.It must be stressed that all projects managed or supervised by the Ministry of Economy have a clearlydefined scope in regard to electromagnetic compatibility, so there is no redundancy.Conformity assessment activities in the scope of certification and type approval which were initiallycarried out separately (from 1998 under the new rules of assistance of PHARE), are presently led in theintegrated way. Two programmes are carried out presently in this field: PHARE 1999: Structures andSystem of Certification and Standardisation Conforming with the EU Single Market, and PHARE 2000:Certification Phase II. The objective of both these projects is a progressive adaptation of selected Polishcertifying bodies to act as notified bodies for selected New Approach Directives. The realisation of theseprojects is a bit delayed due to the change of date of signing proper realisation agreements for PHARE1999 and the financial memorandum for PHARE 2000. The proposed PHARE 2001 project is not arepetition of the above projects but it widens and supplements them with further New ApproachDirectives or their elements. It also includes assistance for newly-created institutions – PCA and URT(NRA for telecommunications). PHARE 2001 is based on long-term experiences drawn in the area ofcertification within the previous programmes. Significantly, PHARE 1999 will come to an end before theproper implementation of PHARE 2001, so there will be fresh and new results to draw upon. Moreover,PHARE 2001 will use the latest achievements of the first phase of PHARE 2000.Apart from the co-operation within PHARE, the two sectors received assistance under bilateralprogrammes related to the similar scope of activities as described above. The project part related to standardisation will be a logical continuation of the previous and currentlyrunning projects in this area, which helped identify beneficiaries’ key areas for further support.PKN as a PHARE beneficiary has participated in the following programmes: PHARE PRAQ91, PRAQIII,PL 9303. The results of the support received from PHARE programmes:- development of Standards Enquiry Points (PIN s) and Standards Sales Points (PSN s)- development of editorial services within PKN Office- membership of PERINORM consortium- new catalogue of Polish Standards - CD-ROM version- increasing awareness of economic operators on the benefits of participation in standardisation

process- growing participation in technical work of European standards bodies- better preparation to application for CEN/CENELEC membership.Thank to the previous PHARE projects starting of the NORMA system was possible. The NORMAsystem was elaborated In 1999/2000. Received funds made it possible of creation of local area networks(LAN) and purchase an IBM server. The server is the central part of the network where the Normasystem is installed. The NORMA system is based on ORACLE 8.1i platform and is essential part of thefuture integrated information system in the PKN. To make the system (including hardware) operationalabout 900,000 EUR of budget money have been spent.Within the framework of 1999 PRAQ III assessment of Standardisation in Poland it was recommended tocontinue support to the Polish standardisation body (PKN) in bringing it to fully effective membership ofEuropean Standards Organisations. Three detailed proposals for future assistance were made. The firstwas about support to install a fully operational internal info network (budget estimate 0.1MEUR). Thesecond was about assistance in training staff civil servants of responsible ministries to become familiarwith standardisation and notification procedures (budget estimate 0.1MEUR) and the last one oncontinued training on implementation of European directives (budget estimate 0.2MEUR).The above mentioned projects have had positive impacts on some particular PKN services and activities.This program as a logical continuation of the projects, will be an initial stage of fundamental andcomprehensive changes of the PKN aimed at full conformity with leading European standards bodies.In the past the Polish Ministry of Posts and Telecommunications benefited from the following PHAREprogrammes: PHARE PL9313.03 – “Technical Assistance to the Ministry of Posts and Telecommunications”PHARE 1999 – “Creation of technical structures and surveillance system for implementation ofcertification and standardisation in the telecommunications sector conforming with the EU Single Marketdirectives”PHARE 2000 – “Enhancement of the technical competence of institutions engaged in the alignment ofthe national conformity assessment system to EU membership requirements”The proposed PHARE 2001 project results from experiences of the PKN, NIT and MPT instandardisation work. The PHARE 9313 project allowed for preparation of legislative framework for thePolish Telecommunications Law regulating standardisation issues. PHARE 1999 is oriented towardsinstitutional building of market control organs, especially the NRA for telecommunications – URT. In turnPHARE 2000 ends with the choice of a twinning partner for the development of certification proceduresbased on ENs (Certification and Standardisation Phase II). Certification, accreditation and conformityassessment which are subject of linked projects, including past activities under PRAQIII and parallelactivities under PHARE 2001, cannot meet EU requirements without regulations in the field ofstandardisation.It is significant that in the previous programmes certification and standardisation were dealt with “en bloc”while under PHARE 2001 they appear under separate subprojects. This is a result of a consciousdecision. At this stage of progress in conformity assessment and standardisation there is no point incombining them into one. The division will ensure a better institutional management of the projects.3.3. Results:The realisation of the project will strengthen the technical and institutional infrastructure of Polishnational conformity assessment system, necessary for effective use of New and Global Approach rules,and will also contribute to elimination of trade barriers in the free movement of goods. The project,accordingly with its objectives, should result in:

• Accreditation practice of PCA in conformity with EU standards, development of accreditation in newareas of activity, readiness of PCA to act within the scope of assessment and surveillance of notifiedbodies, better efficiency of accreditation procedures;

• Subsequent Polish conformity assessment bodies meeting competence criteria for relevant NewApproach Directives:

- National Regulatory Authority for telecommunications (URT) – ready to control fulfilment ofrequirements related to 89/336/EEC and 99/5/EC Directives including market surveillanceobligation;

- Central laboratory of the NRA for telecommunications and the National TelecommunicationsInstitute equipped to carry out research in the scope of type approval and EMC according to89/336/EEC and 99/5/EC Directives;

- regional units of the NRA for telecommunications fully adapted for surveillance of thetelecommunications equipment market in conformity with the EU standards;

- Electrotechnical Laboratory of PCBC competent to perform testing according to harmonisedstandards as a competent body in regard to 89/336/EEC Directive within the scope of electronicand IT equipment and toys;

- Mechanical and Chemical Laboratories of PCBC competent to perform testing in line withharmonised standards, and conformity assessment of toys according to B module of 88/378/EECDirective;

- Building Materials Laboratory of PCBC competent to perform testing according to harmonisedstandards and to use conformity assessment procedures according to Annex III, and meetingcompetence criteria provided in Annex IV of the 89/106/EEC Directive;

- Quality System Certification Office of PCBC competent to use D/E and H modules within medicaldirectives (93/42/EEC, 90/385/EEC, 98/79/EC);

• Modernisation of technical equipment of the chosen bodies to carry out testing procedures accordingto relevant directives;

• Proficiency of selected bodies (PCBC, URT, NIT) in the scope of methods of performing testingprocedures according to the European standards and relevant documents;

• Readiness of market surveillance authorities to survey internal market within the programme of NewApproach Directives (89/336/EEC and 99/5/EC);

• Incorporation of the Constructional Materials Testing Laboratory (CMTL) of Wroclaw University ofTechnology (WUT) into accredited units will be the first case of taking advantage of staff andequipment potential in adaptation of Polish regulations to requirements of the European Community.Implementation of quality system according to EN 45001 allows to carry tests in the area covered bytest procedures of directives of the New Approach 98/37/EC, 97/23/EC and of project of standard prEN ISO 11439, which soon will become valid in the countries of the European Union.

• Draft strategic plan for the PKN concerning enhancement of its institutional structure according to therequirements of European standards bodies prepared.

4. Institutional framework:4.1. Target Institutions involved in the project are the Ministry of Economy, Polish Centre for Testing andCertification (PCBC), Polish Centre for Accreditation (PCA), Ministry of Posts and Telecommunications(MPT), Polish Committee for Standardisation (PKN), Telecommunications National Regulatory Authority(URT), National Institute of Telecommunications (NIT), Wroclaw University of Technology. The Ministryof Economy is the leading institution in the Project.4.2. Basically, this is a twinning and investment project, parallel with the activities carried out under thetwo preceding IB projects - PHARE 1999 and 2000, and related to the institutional changes mentioned inthe Background 3.1. At the final stage, it will concentrate on the technical strengthening of the involvedinstitutions with expertise, training and equipment.Twinning experts will work directly with the identified beneficiary institutions which are involved in theproject implementation.4.3. The beneficiaries will obtain ownership of the equipment. All twinning and purchase contracts willbe executed by CFCU. In order to support CFCU, the Steering Committee will be established toefficiently carry out implementation works and co-ordinate them. The first stage – Phare 1999 was aimed at institutional solutions and was a typicaltwinning project directed to set up an institutional basis and formal framework in relation to certificationand standardisation in Poland. The second stage – Phare 2000 is envisaged as a continuation oftwinning activities in institution building and setting up legal framework on a complementary basis inrelation to a number of New Approach Directives. Phare 2001 (third stage) continues the twinningactivities but also is aimed at investment necessary to strengthen institutional basis. Within theframework of this stage twinning activities are concentrated on preparation of some existing and newly-created institutions for effective implementation and surveillance of New Approach Directives that havebeen included into this programme. One of the most important tasks is preparing institutions to meet the

requirements contained in the Annex to the Directives (that concern competent bodies, notified bodiesand market surveillance). Nevertheless, all the beneficiaries are fully aware of the necessity forconsultations and a continuous verification of development plans for the institutions involved in theproject. Especially, beneficiaries from the telecommunications sector maintain contacts with twininstitutions in the EU – e.g. OFTEL, RA, NRA's for telecommunications in Denmark, Holland andGermany. All these activities will be realised in the way of classical Twinning and Twinning light.An important advantage of experts will be seen the international experience. It would be stronglypreferred if the experts would exhibit a working knowledge of the Polish language or in other case shouldbe supported by the assistant for the effective co-ordination of the project; a good knowledge of theEnglish language is also required. It is absolutely required that the experts possess legal expertise andprove their competency within the scope of implementing legislation regarding conformity assessment,accreditation, standardisation and market surveillance respectively. It is expected that the PAAwill verify the Action Plan and prepare the recommendations of the project implementation. Apart fromthis role, the PAA will be involved on an on-going basis in providing ad hoc advisory and training supportto the bodies involved in the field of conformity assessment, accreditation and standardisation;supporting the relevant institutions in adjusting Polish practises to EU requirements. The PAA willreceive support from the short-term experts and will co-operate closely with all of the Polish counter-partinstitutions. It is envisaged that the PAA will work in-country for a 20-month period of programmeimplementation. Under this assignment the advisor will be required to specialise in and possessexperience in: legislative and institutional solutions in the area of certification, standardisation,accreditation and conformity assessment in the EU; administration of institutions or complexprogrammes in this area; developing programmes or projects introducing new solutions in conformityassessment, accreditation and standardisation; co-operating with public administration and business.6.2.2. Twinning Light.Twinning light expert/experts during the missions will be located at the Ministry of Economy. Experts willbe to analyse disparities between market surveillance systems in Poland and the EU, assess needs forfuture institutional support for Polish market surveillance organs, as well as define the most efficient wayto align their activities with EU requirements. Ekspert/s should be available for consultation onproblematic issues on request of the interested beneficiaries and can expect working support from them.Report/recommendation including policy guidelines and budget is expected in result of twinning light.The expert/s will work in Poland for 6 months. Under this assignment the advisor will be required tospecialise in and share experience in: legislative and institutional solutions in the area of marketsurveillance in the EU (horizontal and vertical); competencies of market surveillance organs and theirpractical applications; administration of institutions and networking between them; developingprogrammes or projects introducing new solutions in market surveillance; co-operating with publicadministration and business on the central and regional levels.Creation of bases for the EU-compliant system of market surveillance presupposes a wide range oftasks. Because of the large scope of this twinning, a detailed description of the experts' work appears inSub-project 4 (Annex 5) to the fiche.6.3 Non-standard aspects:The project activities will be contracted in line with PHARE DIS and twinning contract procedures.6.4 Contracts:One twinning procedure and contract is planned for Sub-project 1 (IB) of value 1.565M€, and onetwinning light procedure and contract for sub-project 4 (Market Surveillance) of 0.15M€. The obligation in Chapter 1 entitled “Free movement of goods”, reads as follows:“As a definition of the time-frame for the process of harmonisation and implementation of the Communitylaw, the Government of Poland has adopted 31 December 2002 as the date on which Poland will beprepared for accession to the European Union.Poland accepts and will implement in full the acquis communautaire in the area of ‘Free movement ofgoods’ and will not request derogations or transition periods concerning the acquis under this chapter,subject to a reservation in section 4 below (pharmaceuticals), relating to the implementation schedule ofinternal procedures with regard to marketing authorisations of proprietary medicinal products and thetime-frame required for lifting price controls on domestically manufactures medicinal products.Poland will undertake the necessary measures aimed at the implementation and application of theacquis in the area of ‘Free movement of goods’ as declared above by 31 December 2002. Whereverpossible Poland will harmonise its legislation with the acquis and fully implement it as soon as possiblebefore the accession date.” (p.19)Taking into account the limited financial support of the European Commission, this project is restricted toa few selected and most viable New Approach Directives. The remaining directives are beingimplemented from the Polish party’s own financial resources (national budget), with respect to the time-frame expressed in the Negotiation Position. The two directives are being implemented on the basis of the new Telecommunications Law, as of 21July 2000, and the horizontal Act on conformity assessment of 2000 in line with their provisions.Presently secondary legislation is prepared, according to which implementation of the directivesshould take place within 2 years from the Telecommunications Law entering into force, that is until 1January 2003.• 88/378/EEC Directive (toys directive),Implementation of Directive 88/378/EEC is prepared in the form of secondary legislation act(regulation) to the Law on General Safety of Products. Legislative work is in its final phase. Issuanceof the regulation by the Council of Ministers has been planned for the IV quarter of the year 2000,and in the I quarter of the year 2001 at the latest.• 89/106/EEC Directive (construction products),Directive 89/106/EEC was partly introduced into the Polish domestic legislation by the means of:Minister of the Interior and Administration’s Decree of 5 August 1998 on technical approvals andcriteria and single application of construction products,Minister of the Interior and Administration’s Decree of 31 July 1998 on the systems of attestation ofconformity, model of conformity declaration and marking of construction products allowed to beplaced on the market for general use in construction. The quality system is in a state of maturity.Establishing the PCA on 1 January 2001 will eliminate also existing problem ofindependence connected with the functioning of accreditation and certification within oneorganisation – the PCBC. In this way the most important organisational and legal problemshave been solved and other less important incorrectness will be eliminated yet beforestarting PHARE 2001 project in 2002. Activities defined below concern more practicalaspects connected with technical side of accreditation processes conduction, which had notbeen covered with assistance within PRAQ III so far.Activity in point 1.1 is aimed at familiarisation of PCA specialists with methods of planningand conducting surveillance of the accreditation processes, among other with ways ofautomation of these processes with information system, which is connected with purchasedescribed in Task 4, Investment.The aim of activities in points 1.2 and 1.3 is to create a staff of qualified assessors foraccreditation purposes. As a consequence of separation of the PCA from the PCBC, thenecessity of creation in PCA its own assessor training system, which at present is incompetence of the PCBC, arises. To obtain the practical experience in performing audits aparticipation of the PCA auditors as observers in accreditation audits of EA members isnecessary. The aim is to compare and harmonise mutual practices and to clarify manydetailed questions connected with assessment process, e.g. in which scope the adviceduring the audit is permitted.The activity in point 1.4 is not repetition of seminars already conducted within PRAQ III. Itconcerns the organisation of training for assessors in new areas of the accreditation, forinstance inspection bodies and medical laboratories accreditation. The creation ofpossibilities for inspection bodies accreditation was one of recommendations of PRAQ III.Training in point 1.5 concerns new topics. At present the role of accreditation in thenotification process is the subject of works conducted by the Commission and EA. Somecountries give the accreditation bodies the technical tasks connected with this process.Placing this training in PHARE 2001 anticipates further needs which can arise in this scope.In fact, the Law on system of conformity assessment foresees that the notification will begiven to body or laboratory accredited by the PCA in the scope defined in application fornotification, it gives also a possibility of authorisation of the other organs to conduct control ofactivities covered by notification.A purchase of information technology equipment for the PCA purposes is aimed atintroduction of automatised administration process which will enable the efficient performingworks connected with surveillance and planning the accreditation processes, maintenance ofdata basis, organisation of works of the technical committees etc. In future, in the PCA 47persons will be employed, and only a dozen or so will supply services for several hundred ofaccredited bodies. This is the justification for purchase of it equipment and software.purchase of equipment for organisation of comparison testing is in accordance with therecommendation of PRAQ III.

Many electric and electronic products covered by a directive, for instance LVD,are also subordinated to the EMC directive, for instance:- household equipment electrically powered,- electric tools hand operated and similar devices,- radio and TV receivers,- IT devices.The PCBC has a modern, very well equipped electrical laboratory, where above mentionedproducts are tested according to the scope of accreditation, however only in the scope ofstandards of usage safety covered by LVD. Lack of EMC laboratory does not enableperforming comprehensive tests, which would meet expectations of many Polish producers,traditional clients of the PCBC.According to the Law on testing and certification, the PCBC is designated to organise andsupervise national testing and certification system. The PCBC envisage to obtain notificationin the European Commission in the scope of EMC and LVD directives.An engagement of the PCBC on the European scene in testing and certification area is moreand more greater and positively assessed by the partner organisations. Lately, the PCBChas been an co-organiser of the autumn conference CENELEC Certification Week, inWarsaw from 9 to 13 October 2000.Electric and electronic products covered by EMC directive can be introduced on EU countriesmarkets only when they meet requirements of the directive and are properly marked. This isnot the only condition: a producer has to meet requirements of other applicable directives,especially LVD. The PCBC is in a position to help Polish producers in meeting requirementsand placing products on EU countries' markets in the nearest future, among others byperforming comprehensive testing and issuing conformity certificates on request.The Electrotechnical Laboratory of the PCBC has performed for many years part of the radio-frequency interferences (RFI) tests in Faraday cage equipped with the RHODE-SCHWARZfirm devices. The implementation of the EU directive will cause greater demand for EMCtests because hitherto existing regulations on EMC in Poland cover only voltage and powerof interferences. Anticipating new needs, PCBC started to build an anechoic chamber.Investment sources from the Phare programme could enable a purchase of the part forequipment of this chamber for about EUR 110 000 while the total investment part of PCBC inthe field of EMC will be about EUR 380 000.The PCBC has specialised for many years in the low voltage testing in the scope ofinformation technology and electronic equipment, so it could be expected that the extensionof the offer for EMC testing of this equipment will meet expectations of clients who want touse complex service of the laboratory in the scope of both LV and EMC directives.

Moreover, electromagnetic compatibility tests of toys will be performed in the EMClaboratory, because an other PCBC' s laboratory is specialised in toys' testing and itprepares itself to be a notified body in the scope of toys' directive. With regards toorganisation, the assistance in the area of detailed development of methodology ofperforming CE-type testing (B module), development of new internal procedures, training inthe scope of uncertainty of measurement, phthalates testing, organisation of comparisontests, meeting of formal notification criteria on the basis of EA Guidances is needed.The following activities are to be taken within Task 1.3:1.3.1. Performance of final trial audit – 7.000 EURTask 1.5Preparing of Quality System Certification Office of PCBC to act within D, E and Hmodules for medical directives (93/42/EEC, 90/385/EEC, 98/79/EC)- approximate cost :70.000 EURThe PCBC has made initial arrangements with Ministry of Health concerning the participationof PCBC in the quality system assessment process of medical devices supplier’s. The draftLaw on medical devices, elaborated by the Ministry of Health, implementing Directives93/42/EEC, 90/385/EEC and 98/79/EC, defines criteria for quality system assessment ofmedical devices supplier’s in accordance with modules D, E , H and Hbis. The presentelement of the project is complementary to PHARE 2001 project prepared by the Ministry ofHealth titled “Plan of implementation of quality and safety standards in the field of medicaldevices on the basis of EU legislation”. The project of the Ministry is focused on the creationof legal framework for medical devices, preparing of the institution , which have possibility tobecome a Polish certification body for medical devices, of the polish surveillance institution,implementation of the certification and surveillance on medical devices market, training of thestaff of health care institutions in the scope of Law on Medical Devices. Then, activitiespresented below focus on the aspect different from medical product certification, i.e. onapplication of modules D,E and H foreseen for related directives. The competencies requiredin this case are different then for product certification. Such competencies possess the PCBCas a member of IQNet (International Certification Network) which has run certification to ISO9000, ISO 14 000 for many years. Recently, also certification according to EN 46 000 wasimplemented ( one certificate issued, one certification process is in progress). The PCBCelaborated the “Criteria for qualification of auditors and experts for certification of qualitysystems in enterprises manufacturing medical devices”. The PCBC has already reported itsreadiness to use of modules D,E and H which has been reflected, among others, in the“Standardisation, Conformity Assessment and Technical Regulations. Initial StrategyTowards Harmonisation”. It is necessary to prepare the PCBC to meet criteria of notificationwhich requires additional consultation and training within PHARE 2001. The auditors used inthe quality system assessment process of medical devices supplier’s will be originated frommedical sector and selected among specialists possessing necessary knowledge in the fieldof medical devices. The scope of training will include specific assessment technique andmethods of quality system implementation in medical sector (standards EN 46000 andelements of quality systems provided in directives). The detailed content of those trainingcourses will be defined within action 1.5.1., which will result, among the others, in co-ordination of training plans with the project realised by the Ministry of Health.The following activities are to be taken within Task 1.5:1.5.1.Analysis of the current state of the beneficiary and validation of action plan -10.000EUR1.5.2. The role played by high school does not limit itself to didactic and scientific activity solely

but is should stimulate economic changes in a country through participation in localsystem of accredited laboratories.

2. University has traditions lasting several dozen years in carrying research and makingexpert appraisements for industry, judicature, government, local authorities and it canundertake new tasks in this area.

3. Activity of accredited laboratory will entail positive changes in organisation andadministration of high school institute and will stimulate future program of engineers’education.

4. Activity of accredited laboratory enables making contacts with other Europeanlaboratories.

5. Activity of accredited laboratory will make broader basis of financial sources in preparingexpert appraisements.

Help of a Twinning light expert/experts is required to achieve the followinggoals:- improve the organisational and administrative framework for market surveillance in

Poland,- secure compliance with New Approach Directives in the shortest possible time after their

implementation,- uniform application of New Approach Directives with EU practices.This Twinning light will last 6 months. The Twinning Light expert/experts will be establishedduring the missions in the Ministry of Econom. The expert/s will prepare a comprehensivereport on market surveillance in Poland for the benefit of all the beneficiary institutionsinvolved in the project, with guidelines on ensuring practical observance of New ApproachDirectives on horizontal and vertical markets. This requires versatile knowledge of principlesof the New Approach and the degree by which market surveillance is regulated by particularDirectives. The Twinning Light partner should specialise in New Approach Directives as wellas possess experience of national EU markets. Generally, market surveillance is executedon national levels, but Polish twinners will need become familiar with co-operationmechanisms cross-Union. The expert/s will so take part in seminars, conferences andpresentations concerning selected aspects of market surveillance in the EU.Specifically, the task of the Twinning Light expert/s will entail:1. Identification of Poland’s needs and problems with:

a. Market surveillance: (control of products placed on the market)b. Related actions:

3. Preparation of a list with specific national tasks which could arise from any provision inthe Directives and which could be allocated to market surveillance authorities.

4. Development of guidelines for institutional organisation of market surveillance system inPoland.

5. Development of structures for co-operation between surveillance authorities.6. Assessment of perspectives for developing one-stop shopping electronic notification in

• Two types of market surveillance are distinguished in Poland: one related to productsand the other to behaviour of economic subjects active on the market (unfaircompetition). Once established in the Ministry of Economy, the expert will advise onco-ordination between these responsibilities. Complaints of unfair competition may beindicative of deteriorated product quality or put in doubt the product’s conformancewith relevant standards. To reach the maximum quality of advice, co-operation withthe Office for Competition and Consumers Protection will be needed.

19. Dissemination of information on Good Manufacturing Practices.No specific plans for IT purchase (databases) will be planned to handle the exspert’s work,as the already existing systems can manage the expert/s work.Remark on the telecommunications sector: Recognising the need for alignment of MSenforcement and to the EU requirements, the telecommunications beneficiary would like togain from experiences of the EU ADHG Market Surveillance established in Brussels on 9July 1998. Proper functioning of Directives 99/5/EC and 89/336/EC is necessary tosafeguard the Polish/EU Single Market from flooding by low-quality, dangerous electronicproducts, so knowledge of work on RT&TE and EMC in the Group (direct or indirect) will beconsidered an asset in choice of the expert.Expenditures: 150 000 EUR
