6. The burial of ashes caskets will be permittedonly with the written approval of the Council.The scattering of cremated remains is notpermitted anywhere on any cemetery ownedby Stirling Council.

7. No tomb, monument, inscription, rail, fence, chain orother structure shall be permitted to be erected orplaced on the burial space without the writtenapproval of the Council.

All works relating to the erection of a memorial mustbe carried out by a registered member of StirlingCouncil Memorial Mason Registration Scheme.All memorial foundations are installed by StirlingCouncil Monumental Technicians.

8. Monuments: Maximum Dimensions

Adult Lair: Height: 5ft (1524mm)Width: 3ft (914mm)Depth: 1ft (305mm)

No memorial structure or item should protrude more than 6 inches in front of where a memorial base should be positioned and must not encroach on the lair space. A request for removal will be made for all items encroaching onto the burial space.

9. The owner must keep tombs, monuments and othererections in good order and repair. Failure to do sowithin a period specified by the Council in writingmay result in the Council ordering repairs or removingdamaged objects at the owner’s expense. The Councilmay refuse interments in these lairs until the expenseshave been paid. Please be advised that any remedialworks must be carried out by a registered memorialmason and only with the permisson of the CemeteriesService.

Stirling Council has a responsibility and duty of careon Health and Safety matters regarding monumentsand memorials and therefore operates a program ofstability testing.

Conditions of Use

10. Please be advised that the Cemeteries Servicecannot guarantee that rabbits or other pestswill not eat floral tributes. Mourners shouldmake an informed decision on the placementof floral tributes.

11. The Council will not be responsible for anyclaims or damages or injury in connection withany tomb, monument or other erection.

12. The digging and filling of graves and the restoration and maintenance of the surface will be carried out on the instructions of the Cemeteries Officer by Stirling Council Operatives.We do not allow any shrubs, plants or trees at the lair and may remove any found at the grave.

13. Hewing or dressing of stones is not permittedin the cemeteries, except for renovation work oradding inscriptions to existing memorials. Afterthe work has been carried out, the site must beleft clean and tidy.

14. Cemeteries will be open to the public duringdaylight hours subject to the Council’s rulesand regulations. The Cemeteries Officer has thepower to remove anyone behaving improperlyand to prevent people from entering out ofhours.

15. Visitors to the cemeteries should keep to thepaths where appropriate and not walk on thegrass, or damage flowers, shrubs or trees.Children must be accompanied by an adult.

16. Any difference or dispute arising, regardingthe meaning or interpretation of these rulesand regulations, will be decided by the ChiefExecutive or other duly authorised officer of theCouncil.

1. The purchaser and his/her successors in ownershipwill have the exclusive right of burial, subject tothe management rules and regulations madeby Stirling Council, in accordance with the Burialand Cremation (Scotland) Act 2016. The purchaserwill be given a lair certificate describing thelair. Stirling Council (“the Council”) will fix theprice charged for the exclusive right, for issuingand transferring lair certificates and for all burialground charges. The Law: Under Part 1 of theBurial and Cremation (Scotland) Act 2016 theCouncil has the authority to sell the exclusive Rightof Burial in burial ground in which it manages andretains ownership.

2. Only one person can be recorded as having theexclusive right of burial in a lair and cannot sell ortransfer the right without written approval fromthe Council.

Should the above person change address theCemeteries Service should be notified in writing.

3. The owner has the right of burial for him or herself,wife, husband or children, or anyone in his/herimmediate family. Others may be buried in the laironly at the request of the owner, and with writtenconsent from the Council.

4. The application form for burial (form CEM1) mustbe completed and returned to the cemeteriesoffice no later than 48 hours before any full coffininterment, or the burial of caskets.

5. A lair shall be sold for up to four standard sizecoffin interments (providing ground conditionsallow) and no coffin shall be removed to makeroom for a new interment.

Lair capacity is not guaranteed as each cemetery has different ground conditions.

Headstones which fail this test will be made safe until procedures are carried out to reinstate the stone safely.
