Executive Summary.

The objectives of the Second Roads Safety Improvement Project (RSIP2) are an improved

condition and quality of sections the M-03 road and increased safety on roads in Ukraine. The

project is a follow-on for RSIP which was approved by the World Bank in 2009. The RSIP2 is

aimed at reconstruction of road M-03 between Kyiv-Kharkiv-Dovashanskiy, primarily

concentrating on improvements in the Lubny-Poltava section of the existing road for the purpose

of increasing radius at bends, widening the carriage ways, and establishment of safety measures to

reduce accidents and increase mobility to enhance commerce and trade in the eastern part of

Ukraine. The project implemented by Ukravtodor (UAD) – the state governing body of automobile

roads in Ukraine, supervised by the Ministry of Transportation and Communications, under

Government of Ukraine (GoU). The project also aims at improvement of institutional and

technical capacity of some road sector institutions in development of designs and implementation

of road safety measures. The improvements in the Lubny-Poltava section included construction of

three bypasses – one each at Pokrovska Bagachka, Krasnogorovika and Poltava. For construction

of the three bypasses additional land was required and based on the Resettlement Policy

Framework approved the project on March 11, 2012, a Resettlement Action Plan (RAP) was also

developed to protect the interests of the Project Affected Persons (PAPs) due to land acquisition

in the three bypasses, following the Bank Guidelines on Social Safeguards OP4.12. This RAP was

approved and disclosed on March 28, 2012. The estimated land area was to be acquired at the

commencement of the project was 2 houses and 102 ha (mostly agricultural land owned both by

private owners, leased by large companies and or village council lands which has been leased out

for agriculture activities.) The total number of PAPs at this stage was 106 and the estimated total

compensation was about UAH 38 million (US$4.74 million equivalent).1

However, due to delays in land acquisition, design changes, legal proceedings due to dispute in

rate of compensation awarded by the local administration, missing land owners and emergence of

new claimants for some of the land lots during construction, there has been an increase in the

number of PAPs from 106 in the original RAP to 124 owning 128 land parcels proposed for

acquisition. This Addendum is prepared in order to update the RAP with additional information

on PAPs, land lots and due diligence process of land acquisition to ensure compliance with Bank

guidelines and procedures.

The eligibility and entitlement matrix for this RAP Addendum for the additional 18 PAPs is based

on the entitlement matrix and the valuation formula in the original RAP, as prepared by the Project

Implementation Unit (PIU) of UAD, GoU, approved by the Bank, disclosed in Ukraine and WB

info shop in March 2012. The implementation of this RAP Addendum for the additional 18 PAPs

is estimated to increase the total land acquisition (of 113.89 ha) compensation costs to

UAH 70.24 (USD 2.6 million2.) Provisions have also been included to address the risk of any new

claimants of land ownership during the life of the project and legacy issues. In addition, following

the Law of Ukraine, provisions for any claims specially by those PAPs or their legal heritors

thereof – has been included to avoid disputes in the future. Should any such situation arise either

during and or beyond the life of the project, the Government of Ukraine shall ensure the same are

addressed appropriately in accordance with prevailing Laws of Ukraine.

The Project Description & Background

1. The RSIP2 is continuation of the earlier project RSIP, with the same objective of

developing improved condition and quality of sections of the M-03 road, and increased traffic

safety on roads in Ukraine. In addition to upgradation of sections of M-03 road (Kyiv-Kharkiv-

Dovzhanskyi road) under Component 1 of the project, Component-2 included improvement road

safety conditions in M-12 sections between Striy-Znamyanka to Vinnytska Oblast.

2. The overall responsibility of land acquisition for implementation of the project, in

accordance with the loan agreement, rests with the Project Implementation Unit (PIU), established

in Ukrdorinvest, under Ukravtodor, in Ukraine. Through an order of Ukravtodor № 299, dated

10.10.2016, entrusted Poltava Road Service (PRS). the responsibility to execute activities related

to acquisition of land plots as well as the support the process of land acquisition. Accordingly,

Ukravtodor is represented in the project area by the Poltava Road Administration agency called

the Poltava Road Service (PRS), and also has the mandate for construction, operation and

maintenance of the M-03 rests with PRS. Since land management falls under the jurisdiction of

the local administration (Rayon), based on the requests from PRS to the district administration

(Oblasts), the Oblasts directs the respective Rayons to purchase land following the Law of Ukraine.

Wherever, if any, gaps are found, then, the Resettlement Policy Framework (RPF) governed by

the loan agreement between GoU and the World Bank, were followed. and those agreed in the

approved RAP. Wherever disputes arose on land acquisition processes or compensations offered,

they may be settled through negotiations between the PAP and the administration or adoption of

legal options to resolve issues, as a last resort. To support and expedite acquisition processes for

implementation of the project, PRS has been aiding the Oblasts and Rayons in evaluation,

documentation and consultation with land owners, in addition to providing funds for acquisition

to Rayons for onward disbursements to the project affected persons (PAPs).

3. Due to the need for additional land for construction of the three bypasses, identification of

land for acquisition was carried out during project preparation and a Resettlement Action Plan

(RAP) for the three bypasses in M-03 road was developed by the PIU, approved by the Bank and

disclosed on March 2012. Since no land acquisition was anticipated in other sections of the M-03

and M-12 roads, due to the scope of work being limited to upgradation, rehabilitation and widening

within the existing Right of Way (RoW), apart from inclusion of road safety features, no RAP was

prepared for these sections. The loan was restructured to include some design changes in the

components, to increase the project financing to 100% (as Ukraine undergoing a financial crisis

then), to allow usage of loan proceeds for financing land acquisition and relocation of loan

proceeds between components. These changes were regularized and made effective through a loan

amendment signed between the Ukraine and the World Bank on August 21, 2015.

4. Although the RAP for the three bypasses were approved, land data or claims for land

ownership of all the plots within the alignment of each bypass wasn’t forthcoming within the cut-

off date communicated and recorded in the approved original RAP. Data on a significant number

of land plots were not available. Information on land plots (registered property rights,

encumbrances, location, coordinates, etc.) then available were with different state authorities and

local self-government. Filing and consolidation of both quantitative and qualitative data pertaining

to ownership, land characteristics, land use, lease, etc., and other related information with the State

Land Cadaster3 commenced in 2013 and still continues until all land data in Ukraine is captured

in the system. In addition, the process of land ownership registration of land parcels has not yet

been completed.

5. Land plots was transferred to former members of collective agricultural enterprises

(collective farms, state farms, etc.) as a result of privatization of land post the breakup of USSR.

Agriculture land were either collective (Commune) or State farms and State owned. Although land

reforms in Ukraine started on the eve of the collapse of USSR, the first round of reforms rolled out

in 1990 and the second round in 1999, where, privatization of land was done through distribution

of paper shares to rural population. The land received through the conversion of the share

certificates could be used to establish new private farms or to enlarge existing household plot, etc.

Public Lands and private lands were leased by both village councils and individual owners for

commercial agriculture. Most of the documentation for ownership in many cases have still not

been registered in the cadastral maps (during the preparation of the original RAP),4 although some

noting including hand written notes are retained by owners as proof of ownership though not

recognized by law. Many of the lands declared as public lands owned by various state agencies

while planning acquisition during project preparation, later emerged as private lands when road

development works commenced. Most of the ownerships of the plots surfaced either during

individual consultation and or public consultation, though public consultation by acquiring

authorities and the PIU were not expansive and inclusive during preparation and implementation

of the RAP.

6. Delayed and progressive enhancement of social safeguards capacity for PIU staff members

too affected implementation of the original RAP and documentation of activities. In such a back

drop, streamlining of land records at least for the plots to be acquired under the project took time

for verification and processing formal title deeds before initiating the acquisition processes.

Aim of this RAP Addendum

7. The aim of this RAP Addendum is to record and include additional PAPs landowners who

are eligible for compensation on account of the land acquisition which emerged due to minor

changes in the construction designs of the three bypasses, emergence of new title holders of the

land parcels, and delayed in acquisition of the same. Further, the loan was amended in July 21,

2015 to include provisions for drawing loan proceeds to compensate land acquisitions. Since there

is an increase in the number of PAPs due to the aforesaid changes, an Addendum to the existing

RAP for the Project was found necessary to update the documentation in compliance with the

Resettlement Policy Framework, and social safeguards guidelines of the Bank. 5

Original RAP and RPF Reference

8. The RAP Addendum for RSIP2 has been prepared based on the RPF and RAP approved

under the project and disclosed in 2012. The following compensation principles provided under

the RPF and RAP continues to be governed and followed for implementation of this Addendum to

the RAP:

All possible steps will be taken to minimize acquisition of productive, privately owned

land to avoid acquisition of residential areas and businesses, through careful selection of

the needed plots.

Related to the above, the project will use government owned land as much as possible.

In case land acquisition is necessary, the property and inheritance rights of affected people

will be respected, and procedures specified in the RPF document and the existing RAP will

be followed.

The preparation and implementation of the land acquisition and compensation plan will be

done in a transparent manner with the participation of affected persons and relevant

institutions.

For those affected persons losing agricultural land, all efforts will be made to providing

acceptable replacement land of equivalent monetary and production value. If such land is

unavailable, compensation for lost land will be paid in cash.

Valuation of land, businesses, and other assets for which compensation is given will be

based on full replacement cost / market value;

Any infrastructure facilities such as roads, water pipes, and communication networks

disrupted by project activities will be replaced

Compensation, land registration and land transfer issues shall be resolved in mutual

understanding with owners whenever possible. without seeking court intervention.

Affected people will be provided replacement land or compensated in full, without

deduction for depreciation or for any other purpose, before construction begins in the area

of the affected land.

The above policy shall apply to all affected persons regardless of the severity of impact

and, whether or not, they have legal titles to land or assets. Particular attention will be paid

to the needs of vulnerable groups among those affected.

9. Categories of affected persons may include (i) persons who have a legal title over land and

property and those without it, and (ii) people temporarily losing access to land or assets (for

example during the construction works) or those losing access permanently. The land needed for

the project is divided into the following categories:

i). Land not subject to compensation: Village council land, village council reserve land,

public use land;

ii). Land subject to compensation for deforestation: Tree belt area, state forest unit land,

forest fund land;

iii). Land subject to compensation: Land held fully or in part by private persons,

commercial entities or institutions, including farm land, vegetable plots, land for

commercial activities or residential purposes.

iv). Rental and or Leased land

10. The type of land to be allocated for the Project and data provided by Poltava Road

Administration reference in the existing RAP is relevant and applicable to the PAPs referred to

herein the Addendum RAP. The following are the prevalent use of land, and categories of affected

persons, and the compensation measures identified that has been referenced in the RAP:

Small businesses will be provided the. land for their further usage and

proper formalization, i.e. they will be offered alternative land plots for the

business reallocation while the land offered will be legally formalized for

the purposes of the small business. The businesses will be supported in

relocation of their assets.

The use of public land plots acquired for the project will be monitored and

in the unlikely case if some of them were used by the community members

as hayfields, pastures or for recreation alternative opportunities or access

paths will be created by the local authorities with the support of the

borrower.

Scope of the RAP Addendum

11. This RAP Addendum is prepared to document the update:

(a) the total number of PAPs from 106 (in original RAP) to 124 owning 128 land plots as

per the current assessment;

(b) increase of land to be acquired from 102 ha to 113.89 ha;

(c) the PAPs whose land has been/to be acquired and compensation paid till date;

(d) Land parcels that have new claimants whose ownership is still to be determined and

verified;

(e) include provisions for:

i). cases of inheritance where beneficiaries have either relocated;

ii). untraceable and therefore process legal permission from courts for allowing

construction activities while acquisition by local administration for transfer of

title deeds are being processed; and

iii). allow claims if any in the future by any new landowners or by PAPs who have

already been compensated in accordance with Ukrainian laws for land

acquisition.

(f) increase the total costs of Land Acquisition for the project from UAH 38 million (in

the original RAP) to an estimated value of UAH 70.24 million, and budgetary

allocations provided for land acquisition from the loan proceeds after restructuring of

the loan in August 21, 2015.

Legal Policy and Administrative Framework

12. Legal frameworks within the Constitution of Ukraine and its Laws, Codes and Regulations

(as applicable enacted by the Parliament and Cabinet of Ministers of Ukraine, relevant

proclamations, regulations, guidelines both of the World Bank and of Ukraine have been

considered in the approved RPF and RAP (see Appendix 1), continues and are relevant for this

addendum. The RAP Addendum is prepared based on the references made to the WB Operational

Policy on Involuntary Resettlement OP4.12. There are no changes in the legal frameworks,

regulations, and guidelines referred to in the existing RAP and therefore, continues to be applicable

for the activities under this Addendum RAP.

Public Consultations in Preparation of the Addendum

13. Consultations with PAPs was held at different times of project implementation, after the

initial processes during preparation of RPF and RAP, in addition to individual consultations during

site visits and or upon receipt of communications or claims of ownership and or grievances.

However, for finalization of this Addendum, special public consultations were held under the aegis

of the local administration and community members in each bypass separately. Both newly and

previously affected persons and other member from the local communities participated in these

consultations. The participants were provided with project information and other related information

pertaining land acquisition, including the design changes (wherever applicable), implementation and

completion schedules, in addition to project-specific entitlements, the Government Decree on the GRM and

steps for submission of ownership claims, if any, on lands within the RoW of the alignment, to

facilitate land acquisition and disbursement of compensation.

14. The decision to hold this consultation in December 2017 was to primarily allow farmers to

complete their harvest before the onset of winter, which would also reduce admission of any

compensation towards potential losses from standing crops in the lands remaining to be acquired.

No physical resettlement was induced at any stage of the acquisition. However, one PAP in

Krasnogorivka bypass has now approached the local administration for resettlement through

replacement of house in the same village (Bilotserkivka) as the walls of the house developed cracks

due to ongoing road construction works in the RoW about 10 meters away from the house. The

case was reviewed, found deserving, and is being considered eligible for relocation and

resettlement assistance following the norms in the entitlement matrix of the approved original

RAP. Since this PAP was not identified in the approved RAP, the same has been included in the

124 PAPs list through this Addendum.

Eligibility of PAPs under the RAP Addendum

15. The eligibility criterion, application of laws and processes for land acquisitions including

evaluation of values, and compensation thereof, are the same as given in the original RAP prepared

by Ukravtodor, approved by the Bank and disclosed on March 28, 2012. The total costs and

compensations paid/ to be paid to some of the PAPs varies/shall vary on account of the prevalent

market prices and or court orders directing the local administration to revise the compensation

value where owners have approached/may approach courts for re-evaluation of properties, from

time to time. The table below gives a brief overview of the number of PAPs and the compensation

amounts:

16. The additional land plots identified for acquisition are based on the current construction

designs and alignments of the three bypasses linked to M-03 road are given in Annexures 1, 2, and

3 for each bypass, respectively. The table includes detailed information of the ownerships of land,

cadastral reference, size of each plot, the present ownership (public or private), current usage the

intended compensation type, evaluated price of the land, details of the compensation paid to PAPs

for the land acquired and rehabilitation of existing assets in these land parcels.

Entitlements of PAPs under the RAP Addendum

17. The entitlements approved in the original RAP continues to be relevant and will be applied

as appropriate for the additional PAPs identified and recorded in this Addendum. The name of the

PAPs and the total compensation payments evaluated and negotiated (in most of the cases) is

provided in Annexes -1, 2 and 3, herewith.

Implementation Arrangements and Institutions processing the Addendum

18. The institutional arrangements and organizational responsibilities for implementation of

this RAP Addendum will continue to be the existing arrangements as indicated in Appendix 1 of

the original RAP approved and disclosed in 2012. In addition, as cited in para 2 above, Poltava

Road Service Agency and the PIU, shall continue to assist Oblasts, Rayons, Village Councils/local

administration to expedite acquisition processes through identification and verification of land

owners, evaluation of properties and other productive assets, documentation, consultation with

land owners, and, providing funds (received from PIU) to Oblasts/Rayons for onward

disbursements to the PAPs whose lands are being acquired. Based on the reports received from the

Poltava Road Service Agency and those collected by the PIU, a consolidated progress report on

land acquisition will continue to be recorded and reported in the formats as is being done currently.

Grievance Redress Mechanism (GRM)

19. Awareness of GRM under the Ukrainian law by the people, both in the project area and

other rural areas in Ukraine is very low. Establishment of GRM procedures for the project as

agreed in the Loan agreement and approved RAP was not fully executed due to various constraints

including jurisdictional authority to enforce the same. Specially introduction and disclosure of

GRM mechanism at self-government bodies of the project districts and in the website of

Ukravtodor, is still being established. Few community members utilize the opportunity during

public consultations to air their grievances, while others with little knowledge have approached

the administration or judiciary for redressal. Dissemination of prevalent GRM mechanism among

the people in the project area has been very limited by the local administration, although project

consultants do explain the provisions and procedures during public consultations. This has led to

an increase in the number of grievances submitted when road construction works commenced.

20. Currently, all grievances are recorded in Oblasts/Rayons following the Ukrainian laws,

while project specific records of grievances and redressal measures undertaken are recorded with

the contractor at construction sites, supported and monitored by the Construction Supervision

consultants, and, at the PIU, where these are consolidated and reported by the social development

specialist (recruited for the project) to the Project Manager, and thereafter included in the Quarterly

Progress Report submitted to the World Bank, for information. This system is in addition to those

identified and or addressed during field visits by the PIU officials. The aforesaid procedures will

be continued during implementation of this RAP Addendum, be maintained and reported till the

close of the project.

Budget requirements

21. The World Bank on July 16, 2015 approved utilization of loan proceeds for financing Land

acquisition under the project through an amendment to the loan agreement. An estimated cost of

US$6,690,000 was allocated from the loan proceeds to cover the costs of the land acquisitions

needed for the execution of the works under the Project. Although loan proceeds were allocated,

compensations disbursed to PAPs till date has been drawn from State’s own resources. Should a

need arise in the future, and if loan funds are utilized for the purpose, statement of expenditure for

the same will be submitted to World Bank for its review.

Disclosure, Monitoring and Evaluation of the RAP Addendum

22. Disclosure of this RAP Addendum upon approval by the World Bank, will be done by the

PIU in both English and Ukrainian languages in the official website of Ukravtodor and, shall be

made available in the Oblasts, Rayons and Village Council offices in the Project area. The World

Bank may also disclose the approved RAP Addendum in its website as part of the disclosure norms

agreed in the loan agreement, and amendments thereof.

23. Given below is the proposed implementation schedule of this RAP Addendum:

24. The PIU shall continue to monitor the implementation of this RAP Addendum following

the existing procedures as given in the original RAP approved. The progress in implementation

of the RAP addendum shall be reported to the World Bank by the PIU in the quarterly progress

report along with the log of grievances received and addressed during the reporting period. Upon

completion of majority of land acquisitions and disbursement of compensations to PAPs, a sample

audit of the completed land acquisition cases will be included in the terms of reference of the

auditor who shall execute the same as part of their annual audit of the project and provide a short

brief observations/finding in the annual audit report. The terms of reference for expansion in the

scope of work of the auditor will be discussed and agreed with the World Bank before

incorporation of the same. Upon completion of acquisition of remaining land parcels, in

accordance with the guidelines of the World Bank, the PIU shall submit a draft land acquisition

completion report to the World Bank for the latter’s review. The final report upon approval by the

World Bank and Ukravtodor, will be disclosed by the PIU in Ukravtodor’ s website.

Challenges and Risks

25. The implementation of RAP, management of land acquisition and resettlement under the

project continues to be a challenge by Ukravtodor, participating agencies of the State and local

councils for many reasons including those cited in para 4, above. These challenges and risks may

continue till the completion of all land acquisition and other project activities. Therefore, it was

considered appropriate to submit few for information of all concerned of the unforeseen

challenges/risks that the PIU may confront leading to delays in implementation of this RAP

Addendum:

i). Lack of coordination amongst institutions authorized to carryout land acquisitions;

ii). Lack of clarity in roles and responsibilities, and processes for execution land acquisition,

due to poor knowledge and capacity in application and or interpretation of Laws of Ukraine

and WB safeguard guidelines for the project;

iii). Availability of documentation of land ownership is still the largest issue as despite World

Bank assistance and advancements made for mapping land and assets in the cadastral maps,

records of ownership and demarcation of community lands, village council lands, leased

lands, private lands and state-owned lands, are still low and needs extensive effort to

identify owners, as many of them have migrated both within and outside Ukraine for better

opportunities;

iv). Inconsistency in land evaluation processes and methodology adopted by the legally

authorized evaluators led to disagreements in compensation amounts, compelling PAPs to

resort to legal proceedings to avail the envisaged benefits;

v). The Laws of Ukraine for land acquisition which provides rights to citizens to approach the

administration with grievances to claim ownership of the acquired or to be acquired land

and or land titled as village/community land. This provision leads to continued uncertainty

even after completion of all land acquisition and activities under the project activities.

Therefore, the land acquisition completion report may be prepared analyzed, completed and

published after completion of all land acquisition, thereby giving provision for unanticipated

claims under the Ukrainian Law, if any, that may emerge posthumous to disclosure of this RAP

Addendum.
