On May 18, 2016, the Office of Administrative Law (OAL) received your petition asking for adetermination as to whether the "Authorized Personal Property Schedule (APPS}" dated April 1,2014, incorporated by reference into the California Department of Corrections andRehabilitation's D.O.M. Section 54030.1 as Appendu~ A, constitutes an underground regulation.The challenged rule is attached hereto at Exhibit A.

In issuing a determination, OAL renders an opinion only as to whether a .challenged rule is a"regulation" as defined in Government Code section 11342.600,1 which should have been,but was not adopted pursuant to the Administrative Procedure Act (APA).

You indicate that the Authorized Personal Property Schedule (APPS}, dated Apri11, 2014,was incorporated by reference into D.O.M. Section 54030.1 and that "it is commonknowledge that the Departments Operations Manual is laced with underground regulations."You also indicate that "if [the APPS] was approved for publication as regulations in Title —15, then they would not be considered as being ̀ underground regulations."'

The. APPS (version dated 2/1/2007) was originally submitted to OAL on July 23, 2007, aspart of an amendment to section 3190 of Title 15 of the CCR. It was incorporated byreference. into section 3190(b){2). The file was submitted by CDCR as an emergency byoperational necessity pursuant to Penal Code section 5058.3. It was reviewed and approvedby OAL and subsequently filed with the Secretary of State on August 13, 2007, effective thesame day.

A document incorporated by reference into a regulation becomes a duly adopted regulation.Title 1, section 20, states at subdivision (e):

Where a regulation which incorporates a document by reference is approved byOAL and filed with the Secretary of State, the document so incorporated shallbe deemed to be a regulation subject to all provisions of the APA.

The C?ctober 1, 2013 version of the APPS was also adopted in an emergency rulernaking byoperational necessity. It was incorporated by reference into section 3190 (b)(2) of Title 1.5 ofthe CCR in a file submitted on December 24, 2013. The file was reviewed and approved byOAL. The regulations were filed with the Secretary of State on January S, 2014, and becameeffective the same day they were filed with the Secretary of State.

A Certificate of Compliance for the emergency rulemaking filed January 8, 2014, was timelysubmitted by CDCR to OAL on June 16, 2014. The Certificate of Compliance certified thatCDCR complied with Government Code sections 11346.2 to 11347.3, inclusive. TheCertificate of Compliance adopted -the April 1, 2014, version of the APPS. It was likewiseincorporated by reference into section 3190{b)(2). The entire file was reviewed and approvedby O.AL on July 22, 2014, and filed with the Secretary of State that day, effective on filing.Therefore, the amendments to section 3190 of Title 15 of the CCR, including the Appendu~containing the Apri11, 2014, version of the APPS, was duly adopted pursuant to the APA. Aregulation that is duly adopted pursuant to the APA is not an underground regulation.

For the reasons discussed above, we find that the rule challenged by your petition is not anunderground regulation.2

Facilities may submit re9uests to be exempted from the personal property items detailed in these schedules. TheseExemption Requests are to be submitted to the Chief, Standardized Procedures Unit (SPU). All requests mustinclude rationale and supporting data such as incident reports, physical plant limitations, etc. In the case of anemergency, where the safely of inmates, staff, or other persons are at immediate risk,, the requesting institutionmay immediately act to restrict an item but must notify the SPU. An exemption xequest sha11 be submitted to theSPU within five working days of any locally imposed restriction. Exemption requests will be processed through theappropriate Associate Director and then submitted to the Deputy Director, Division of Adult Institutions (DAT) forapprovalidi sapproval .
