STATE OF TENNESSEE COUNTY OF TENNESSEE GREENE COUNTY LEGISLATIVE BODY SEPTEMBER 16, 2019 6:00 P.M. The Greene County Legislative Body was in regular session on September 16, 2019 at 6:00 P.M. in the Greene County Courthouse. Mayor Morrison called the meeting to order to transact business that has lawfiflly come before the Honorable Body. Mayor Morrison asked that you stand for a moment of silence in memory of the former County Mayor Alan D Broyles. Commissioner Brad Peters gave the invocation. Conm~issioner Lyle Parton led the Pledge to the Flag. Mayor Morrison called the Commissioners to sign in on their keypads and the following Commissioners were present. Commissioners Bible, Bowers, Bryant, Burkey, Carpenter, Clemmer, Cobble, Crawford, Dabbs, Kesterson, Lawing, Parton, Patterson, Peters, Quillen, Shelton, Tucker, Waddle, and White were present. Commissioners Arrowood and Powell were absent. There were 19 Connnissioners present and 2 Commissioners absent.

PUBLIC HEARING

MayorMorrisonaskedif therewere anyonewho wantedto speakin regardsto therezoningcertainterritory ownedby RussellWard from A~1,GeneralAgriculture Districtto B-2, GeneralBusinessDistrict within theunincorporatedterritory of GreeneCounty,Tennessee.

RussellWard,propertyowner,spokein favor of rezoningofhis property. Heexplainedthathis automotivebusinesswould be for repairingautomobiles.

MayorMorrisonaskedif therewereanyonewhowantedto speakagainsttherezoningrequest.

JimmyNapoleonexpressedhis concernsby statingthatif thisbusinessfails andis resoldto anotherbusiness,you do not know whatkind ofbusinesscouldgo in thatlocation.He saidhe would rathernot seethepropertybeingrezonedandthatit would causehis propertyvalueto go down.

Billy Masseyspokedagainsttherezoningof theproperty,statingthis would causemoretraffic atthis locationandwould causehis propertyvalueto go down.

Molly Cooley,NortheastRegionalDirectorofTennesseeSuicidePreventionNetwork,wasunableto attendtheCommissionmeeting. JackStewartspoketo theCommission,insteadof Molly Cooley,explainingtheprogramoftheTennesseeSuicidePreventionNetwork.

Cathy Osborne,newly namedDirectorofGreeneCountyHealthDepartment,thankedeveryonefor theirsupport. Shesaidis very excitedaboutthis newopportunityastheGreeneCountyHealthDepartmentDirector.

JuneGriffin, TennesseeCommitteefor Bill ofRights,gaveacommendationtoCommissioners,by standingby andsupportingthe2’~”Amendment.

CommissionerCobblecalledon Don Burchnellto speakin regardsto theCommissiondonatingtheElectionCommissionbuilding to the WalterStateCommunityCollege. He saidthattheCommissionis not in thepositionto donatethis property.

CommissionerWaddlespoketo the Commissionersin regardsto theFiring Range,statingthis is avery nice location. Hesaidweneedto advertisethis rifle range.

PROCLAMATION FORSUICIDE PREVENTION AWARENESS MONTH

WI-IEREAS, suicideis oneofthemostdisruptiveandtragiceventsa family andcommunitycanexperience,with

more than 1000 lives lost in Tennesseeeachyear andan estimated8-25attemptedsuicides for each suicidedeath;

and

WHEREAS, suicide is the9~leadingcause of all deaths in Tennessee and the second leading cause ofdeath amongyouthages10 to 24, andthefirs leadingcausefor children 10-17;and

WHEREAS,three livesadayarelost to suicidein Tennessee,whichmeanswe lose22 Tennesseanseachweekand97 peopleper month;and

WI-IEREAS, Tennesseeveterans,active-dutymilitary personnel,andNationalGuardsmenfaceadisproportionaterisk ascomparedto thegeneralpopulationof Tennessee,with moredyingfrom suicidethancombat;and

‘WHEREAS,public awarenessofthis teirit~’ingproblemis thekeyto preventingfurthersufferingandlossof life;andtherisk for humanself-destructioncanbereducedthroughawareness,educationandtreatment;andasthehighestrisk for suicide is amongthesurvivorsof thosewho died by suicideor thosewho haveattemptedsuicide;and

WHEREAS,suicidepreventionhasbeendeclaredastatepriority by theGovernor;andtheTennesseeLegislaturehasdeclaredteensuicidepreventionasastatepriority in partnershipwith theTennesseeSuicidePreventionNetworkto implementtheTennesseeStrategyfor SuicidePrevention;and

WHEREAS,Tennesseeis anationalleaderin theeffortto preventsuicide,beingoneof thefirst statesto developasuicidepreventionandevaluationplancoveringthelifespan;and

WHEREAS,the GovernorofTennesseehasappointeda SuicidePreventionNetworkAdvisoryCouncil tocoordinatetheimplementationoftheTennesseeStrategyfor SuicidePrevention;and

WHEREAS,TSPN is agrassrootscollaborationof Tennesseansandorganizationsworkingto eliminatethestigmaof suicide,educatethecommunityaboutthewarningsignsof suicide,andultimately reducetherateof suicideinour state;and

WHEREAS,everymemberof ourcommunityshouldunderstandthat throughoutlike’s struggleswe all needoccasionalreminderthat we areall silently fightingout own battles;and

WHEREAS,weencourageall residentsto takethetime to inquireasto thewellbeingof their family, friends,andneighborsoverthenext few daysandto genuinelyconveytheirappreciationfor their existenceby anygesturetheydeemappropriate.A simplephonecall, message,handshake,orhug can goa longwaytowardshelpingsomeonerealizethat suicideis not theanswer;and

NOWTHEREFORE,I, KevinMorrison, byvirtueofthe authority vestedin meas MayorofGreeneCounty,Tennesseedo herebyproclaimthemonthofSeptember,2019 as

WHEREAS,Disastersandemergenciescomein manyforms,developin amoment’snotice,andcanhappenanytime, andgreatlyaffectourcitizens,businesses,andcountyin anextremeadverseway; and

WHEREAS,Oneof ourgreatestresponsibilitiesis educating,preparing,andprotectingthepeopleof GreeneCountyfrom disastersandemergencies;andthevigilanceandurgencyof thisresponsibilityis apriority for this Commissionandeverydepartment; and

WHEREAS,Successfulemergencypreparednessis acooperativeandcollaborativeeffort acrosscivil, governmental,andgeographicalboundaries,andthatsuccesscomesby working tobgether,aligningtrainingandpreparedness,equipment,andresourcesof emergencyanddisasterresponseacrossall local,State,andFederaljurisdictions;and

WHEREAS,Experiencehastaughtusthat GreeneCountiansmayhaveto rely on themselves,their family, their friends,andtheirneighborsin largedisastersuntil first respondersarrive;and

WHEREAS, It is imperativethatwe encouragethecritical importanceof individual andfamilypreparednessfor potentialdisastersandemergencies.To createanaturalinstinct in ourcitizenryto haveaplan,knowwhereto go, whatto do, andhowto respondandsurviveadisasterandprotectthemselvesandtheir families; and

WHEREAS,TheGreeneCountyOffice of EmergencyManagementandall of GreeneCounty’sEmergencyFirst Respondersarededicatedto providingthe best,mostimmediateandtimelywarningsandresponseto emergenciesanddisastersfor theprotectionof life, limb, andpropertyof all GreeneCountycitizens;and

Call to Order:Mayor Morrison called meeting to order at 8:31 am in the conference room at the Greene County Annex.Quorum was present.Minutes:Motion was made by Sheriff Holt to approve minutes from the June 26, 2019 meeting and was seconded byCommissioner Dabbs. Motion was then approved with no opposition.Reports:Danny Lowery presented the June 2019 financials for Funds 121 and 264. Motion to approve the reports wasmade by Roger Woolsey and was seconded by Commissioner Peters. Motion was then approved with noopposition.Discussion:Clinic had 159 visits in June. There has been an increase in July visits some Biometrics are being done. Clinic isstill on 32 hours and may extend those hours during flu season if needed. Motion was made by Roger Woolseyand was seconded by Danny Lowery to allow Erin to coordinate with Calvin at EMS to have TB skin testingdone through the clinic for EMS personnel. Bridget will be getting the cost on those.Krystal will be getting with Trinity on drug cost to compare with clinic cost.Motion was made by Commissioner Peters and was seconded by Commissioner Dabbs to continue with thepolicy in place on retirees on health insurance.State has denied allowing another retirement supplement plan, if the committee chooses to go with the stateon the 457B plan. Motion was made by Commissioner Peters and was seconded by Commissioner Dabbs toterminate Nationwide. Motion was approved with no opposition. Danny will get an outline for the RFP to getquotes to include fee structure, availability, be local, assume fiduciary responsibility and education of theplans. Most counties are on the state plan, county schools have a 403B plan.Meeting broke to go into Closed Session.Reconvened for claims.Claims:Claims were discussed in closed session with not action to be taken in open session.

Mayor Morrison called the meeting to order at 3:05 P.M. in the conference room at the GreeneCounty Annex.

MINUTES:

A motion to approve the minutes from May 30, 2019 was made by Commissioner Clifford “Doc”Bryant, seconded by Commissioner Teddy Lawing. No discussion. Vote taken to approve. KalebPowell abstained. All in favor. Minutes approved.

DISCUSSION:

Mayor Morrison began the meeting by turning it over to Erin Elmore. Erin then turned it over toDavid Beverly who had some questions regarding items in the draft of the policy book.

Items that were brought up by David Beverly:

• Sick Leave — on the household part for sick leave. Asked about using sick leave forparent that doesn’t live in household. Mayor Morrison suggested striking “residing inhousehold”. Roger suggested leaving it alone. Erin Elmore asked about adding “step” tothe policy. Commissioner Teddy Lawing made motion to strike language “residing within

• EMLA — David asked if it could be explained a little better. Erin said that in order to getFMLA, she needs paperwork on file. Sick time protects the wallet, but FMLA protects thejob. After more discussion on how to get paperwork filed, Mayor Morrison suggested amotion that if an employee is absent due to illness more than 3 consecutive days, theemployee shall contact H.R. within 5 working days of consecutive absence to requestFMLA. Commission Clifford “Doc” Bryant made motion with Commissioner Robin Quillensecond. With no further discussion, vote taken. All approved. Motion passed.

• Special Holiday Provision — David stated that the Sheriff’s Department has to work onholidays. Asked if it was possible to say “with the exception of”. Commissioner Clifford“Doc” Bryant commented that it should say with the exception of departments that sayotherwise. Roger Woolsey stated that this section seems fine to him since they get time

and a half if they work it anyway. Doc Bryant said nobody gets time and a half unlessthey work over 40 hours. Roger suggested clarifying this section. After more discussionon wording of the section, Mayor Morrison suggested a motion saying that thisprovision excludes departments/employees that compensate or receive compensationas a part of their required departmental duties or special job description i.e. SheriffDepartment and EMS. Roger stated this should be on section 3.12 and 3.13. Rogerthen stated that he thinks it needs to say that the Sheriff’s Department compensates104 hours for holidays. Commissioner Clifford “Doc” Bryant made motion with RobinQuillen second to add this language and to specify normal years and election year hours.No further discussion. Vote taken and all in favor.

• Drug Testing — David then asked why Sheriffs Department, EMS, Highway, and SolidWaste are the only departments subject to random drug testing. Roger Woolsey statedthis is an actual Federal law that you can’t random test everyone. Mayor Morrisonsuggested adding language for clarity. Roger said to add a footnote that it is asmandated by Federal law. Roger also said policy needs to specify the panel of drugstested and that this is a confidential random drug test. Commissioner Pam Carpentermade motion to add this language. Commissioner Kaleb Powell second. With no furtherdiscussion, vote was taken. All in favor. Motion passed.

Mayor Morrison then recognized payroll clerk, Shelley Fillers. Erin Elmore stated that bottomline is hour for hour system we tried to get won’t work. Doc Bryant asked why. Erin said theLocal Government system now in place will not work that way. Mayor Morrison asked Shelleyhow the time was accrued now. She said it is day for day. If you work 8 hours per day, you getShours per month. Doc Bryant said this isn’t fair and it needs to be the new system to make itfair. Erin Elmore stated the system just cannot do it, unless you want to pay a lot of money toget a new system. Robin Quillen asked Shelley what she thinks of the other system.

Shelley stated that she has no opinion on it because she’s not familiar with it. Erin said what wewould be buying is a time keeping system, not a payroll system for $30,000 per year. Robinasked if it would make things easier for Shelley. Erin replied yes. Robin said she would agree tothat system. Doc agreed saying he thinks this needs to be pursued.

Robin Quillen then asked Shelley what she thinks. Shelley worries that it will take longer for 7.5hour employees to earn the day off.

Lots of various discussions around the table before discussion moved back to 37.5 vs 40 hour

per week employees.

Doc Bryant stated we need to pursue a new system. Robin agreed stating we need to look forbetter. Erin said that for the system the City uses there is a one-time set up fee of $5000 then$40,000 per year subscription. Robin stated that we need to look into this more.

Erin asked if the handbook is now on hold. Roger stated that we need to get everything done

except this.

Erin then asked about the new hands free law that goes into effect on July 1~.Doc Bryant askedif it really needs to be and how is it now if you break the law while driving a County vehicle.Calvin Hawkins, EMS Director, stated they pay their ticket. Discussion then centered arounddiscipline of employees. Nathan Holt stated that he decides discipline in his department. Erin

stated that discipline is up to the department. Roger stated it should be left up to thedepartment head and that if it’s something that puts the County at risk, then a push can bemade to the department head to do something. It was agreed not to put anything in the policybook about the new hands free law.

Mayor Morrison stated there is no rush to get the new policy book out. Just need to get it right.

Erin Elmore is to get 3 quotes on software for next meeting.

With no other business and no further discussion, Commissioner Robin Quillen made motion toadjourn. Commissioner PamCarpenter second. All in favor.

COURTHOUSEANNEX

The Greene County Commission Ethics Committee met on August 14, 2017 at the Courthouse Annex.Committee members present were: Chairman Jason Cobble, Joy Rader, Register of Deeds, and

Commissioners Tim White, George Clemmer, Gerald Miller, John Waddle, Josh Arrowood and SecretaryPaul Burkey.

Seven other County Commissioners were in attendance as well as Mayor Crum and County AttorneyRoger Woolsey, among others.

The meeting was called to order at 4:30 p.m. The Committee reviewed and unanimously approved the

Minutes from the most recent Ethics Committee meeting in December 2015.

The purpose of this meeting was to respond to two separate complaints from Commissioner Eddie

Jennings:

1) That Road Superintendent David Weems used a County Road Department vehicle to promote

his political campaign by placing campaign signs on the vehicle during the4

th of July parade.

2) That Commissioner Robin Quillen threatened him with bodily harm during the June CountyCommission meeting.

Discussion:

Complaint 1: Chairman Cobble asked Commissioner Jennings to provide any additional information hehad about the incident. He did so, including a photograph of the County vehicle with the campaign signs.

Mr. Weems responded that the sign was supposed to have the campaign-related phrase taped over sothat the sign just identified him as the official in the parade. He indicated the tape must have come off

and apologized again as he has done publicly several times. The Committee then had a wider discussionabout the applicability of this incident to the Ethics Committee. County Attorney Woolsey briefed the

Committee on Ethics Committee duties as interpreted by the CountyTechnical Assistance Service(CTAS).

After discussion John Waddle made the motion that the Ethics Committee recommend to Mr. Weems

that he meet with the County Budget Director and determine a fair reimbursement for the use of thevehicle during the

4th of July parade. Gerald Miller seconded the motion. After some additional

discussion about alternative ways this could have been resolved, the motion passed unanimously by

show of hands.

Complaint 2: Chairman Cobble offered the floor to Mr. Jennings for any further information. Heindicated that, during the June Commission meeting, he was addressing Commissioner Butch Patterson

and said words to the effect of “Butch, you may want to shoot me”, to which Commissioner Quillenquipped words to the effect of “Eddie, sometimes I’d like to shoot you.” She acknowledged that she

said it and several in attendance indicated they had heard it. However, the general consensus was that,in the context of the debate, she made the remark in jest and frustration toward the end of a very long

meeting and had no actual intent to harm Commissioner Jennings.

Commissioner White made the motion to dismiss the complaint without action. Commissioner Waddle

seconded the motion. The motion carried unanimously by show of hands.

Mayor Kevin Morrison called the Budget & Finance committee meeting to order on Wednesday,August 7th 2019 at 1:00 P.M. in the Greene County Conference room at the Annex. A quorum waspresent.

Motion to approve the Budget & Finance minutes June 27th, 2019 was made by CommissionerTucker, seconded by Commissioner Waddle. Minutes carried.

BUDGET AMENDMENTS:

For their review, the Committee received budget requests that had already been previouslyapproved by Mayor Morrison.

BUDGET AMENDMENTS NEEDING APPROVAL BY THE BUDGET & FINANCE COMMI1TEEGreene County Register of Deeds Joy Rader Nunnally requested that $2,244 be transferred within theRegister of Deeds Department budget to add Part-Time Personnel. $1,000 be transferred fromRentals (351), $1,065 from the Premiums on Corporate Surety Bonds line (508) and $179 from PostalCharges line (348). $2,065 be transferred into Part-Time Personnel line (169), $128 transferred intoSocial Security line (201) $21 into Unemployment Compensation and the remaining $30 intoEmployer Medicare line (212). Motion to approve the budget request was made by CommissionerWaddle and seconded by Commissioner Quillen. Motion passed.

Greene County Sheriff Wesley Holt requested that $8,205 from the Sheriffs Department budget betransferred from Gasoline (425), $7,156 into the Mechanics (142) $444 into Social Security (201) $501into Pension (204) and the remaining $104 into Employer Medicare line (212). Request is to increasetwo mechanics where they can be more competitive with the current market. Motion to approve thebudget request was made by Commissioner Quillen and seconded by Commissioner Tucker. Motionpassed. The need for a survey to establish across the board pay scale was discussed.

Resolutions:

A. A Resolution to budget for $7,701 revenue received from various sources tothe Sheriff’s Office for the fiscal year ending June 30,2020. Motion to approveResolution A was made by Commissioner Waddle and seconded byCommissioner Tucker. Motion carried.

B. A Resolution authorizing the Greene County Court Clerk to establish a SatelliteOffice with a drive through for vehicle tag renewal on West Summer Street inGreeneville, Tennessee. Commissioner Tucker made a motion to postponeResolution B until the September 4th meeting. Commissioner Quillen secondedto pull Resolution B until next month’s meeting. All agreed.

C. A Resolution authorizing the Greeneville-Greene County 911 Emergencycommunications District to issue negotiable Bonds, notes and Debtobligations. Commissioner Waddle explained that 911 had to update theirsystem and it was approved to get it from Motorola. It has been installed andup and running. There is a grant from USDA that will pay $35,000. And they aregoing to finance at least 1% less than Motorola. It has to be approved by theCounty Commission for the grant and loan. Commissioner Waddle made amotion to have the Budget & Finance sponsor Resolution C. It was secondedby Commissioners Quillen. Approved with no opposition.

Discussions:

Greene County Clerk Lori Bryant informed the Committee that an upgrade from Windows ito 10has to been implemented by end of year. The cost will be $24,654. It will come from the CountyClerk’s automation reserve account. This can be done by Budget Amendment.The Election Commission Office Building on North Main Street is in need of a roof replacementwhich comes at a cost of $65,000. To be ADAcode complaint it will take $10,000 to $15,000.Rewiring up to code is another issue. Repairs in Electrical is $2,344, $21,500 for upgradedrestrooms, alcove 6,855, roof $43,000, totaling $74,000. The Old Consumer Credit Union Buildingon the 11-E is a prospect which is 13.24 acres which could be used for other Government officesin the future. The building has heating and cooling gas. Four units on roof that are fifteen yearsold, two in wall systems, thirteen offices inside, conference room, lobby which is 40x30, teller31x15, two 8x12, two 8x11, two lOxil and one lOxlO, two bathrooms and roof in good shape, withthree lane drive-thru for satellite office and plenty parking. In an effort to save money and provideconvenience, the County could consolidate Election Office and Emergency Management Officeand the satellite office. The County is exploring possibility of purchasing building. Storage at theElection Commission has been an issue. A grant is in place to buy new machines and equipmentthat are self-contained unit. There is ninety of them and twenty- five readers. Space at the CCUbuilding would be adequate. The lobby would be an excellent place for early voting. ChairmanMorrison said the list price of Consumer Credit Union Building on the 11-E bypass is $600,900, Hehas been in contact with the Realtor and the secured price is $425,000 which is $57.00 square footnegotiated cost Money would have to come out of the General Fund. Motion was made byCommissioner Waddle to send in a form of resolution to County Commission on purchasingConsumer Credit Union Building. It was second by Commissioner Quillen. Approved with noopposition.

Mayor Kevin Morrison called the Budget & Finance committee meeting to order on Thursday, June27th 2019 at 4:00 P.M. in the Greene County Conference room at the Annex. A quorum waspresent.

Motion to approve the Budget & Finance minutes June 5th, 2019 was made by CommissionerQuillen, seconded by Commissioner Waddle. Minutes carried.

BUDGET AMENDMENTS:

For their review, the Committee received budget requests that had already been previouslyapproved by Mayor Morrison.

BUDGET AMENDMENTS NEEDING APPROVAL BY THE BUDGET & FINANCE COMMITTEE

Greene County Attorney Roger Woolsey requested that $1200 from the Greene County Attorney’sDepartment budget be transferred from Legal Services (331), into the Overtime Pay (187). ChairmanMorrison said that it should be noted that County Attorney Roger Woolsey and Sandy Fowler areconsistently busy and they do a great job for the County.

Greene County Commissioner John Waddle requested that $22 from the Greene County SoilConservation Departmentbudget be transferred from Unemployment Compensation (210), into theOvertime Pay (187).

Greene County Sessions Judge Ken Bailey requested that a total of $2,307 be transferred from the

Social Security (102). $1.00 into the Judges (102) $1,956 into Probation Officer (111) $25 into MedicalInsurance (207) and the remaining $325 into Communication line (307).

Greene County Health Department Shaun Street requested that $65,000 from the Greene County

Local Health Center Department budget be transferred from Medical Insurance (131), into OtherEquipment (790).

Greene County Health Director Shaun Street requested that $3,000 from the Greene County Other

Local Health Services Department budget be transferred from Medical Insurance (131), into the

Clerical Personnel (162). $1,000 from the Social Security (201), $800 into Pension (204) and $100 intothe Life Insurance line item (206) the remaining $100 into Other Fringe Benefits line (299).Note; The Health Department was able to use funds originally allocated to Health Insurance becausethat is where the department head allocated any excess grant funding that will be used in other line

items during the year and reimbursed from the State.

Greene County Sheriff Wesley Holt requested that $6,100 from the Greene County SheriffDepartment budget be transferred from Part-Time Personnel (169), $1.00 into the CountyOfficial/Admin Officer (101) $4,099 into Detectives (107) and the remaining $2,000 into Overtime line(187).

Greene County Sessions Judge Ken Bailey requested that a total Of $472 be transferred from theGreene County Juvenile Department’s Other Contracted Services (399). $11.00 into the Youth Service

Officers (112) $12.00 into Secretary (161) $23.00 into Ufe Insurance (206), $25.00 in the MedicalInsurance (207) $141 into Communications line (307) and the remaining $260 into Dues andMembership line (320).

Greene County EMSDirector Calvin Hawkins requested that $31 from the Greene County EMS’sDepartment budget be transferred from Clerical Personnel (162) into the Supervisor/Director (105).

Greene County Inspection and Regulation Amy Tweed and Tim Tweed requested that $8,124 betransferred from the Assistants Line (103) into Medical Insurance (207). $1,000 from Gasoline be

transferred into Data Processing Services (317) and $2,100 transferred from Periodicals (437) into the

Law Enforcement Equipment (716).

Greene County Election Commissioner Donna Burgner requested that $1,001 be transferred from theGreene County Election Worker line item (193). $1.00 into the County Official/Admin Office and theremaining $1,000 into Pension line (204).

Greene County Attorney Roger Woolsey requested that $600 from the Greene County Attorney’sDepartment budget be transferred from Part-Time Personnel (169), $526 into the Overtime Pay (187)$433 into Social Security (201) $33 into Pension (204) and the remaining $8 into Employer Medicareline (212). Motion to approve the budget request was made by Commissioner Quillen and secondedby Commissioner Tucker. Motion passed.

Greene County Parks and Fair Board Director Terry Cannon requested that $372 from the GreeneCounty Parks and Fair Board’s Department budget be transferred from Part-Time Personnel (169),

into the Overtime Pay (187). $1,069 transferred from Other Supplies and Materials (499-650) intoBuildings Improvements line (707-650).

Greene County Maintenance Director Mel Seaton requested that $3,176 from the Greene County

Maintenance’s Department budget be transferred from Electricity (415). $2,500 into the Maintenance

Personnel (167) and the remaining $676 into Medical line (207).

Greene County Clerk Lori Bryant requested that $1,550 from the Greene County Clerk’s Departmentbudget be transferred from Clerical Personnel (162), $1,500 into the Part time (169) and theremaining $50 into the Over-Time line (187).

Greene County EMADirector Bill Brown requested that $578 from the Greene County EMA’sDepartment budget be transferred from Other Charges (599). $163 into Medical Insurance and theremaining $415 into Communications (307).

In order for all budget amendments to be approved as a group, question was asked if there was

anyone present whomwould like to pull any of the budget amendment requests. A motion was thenmade by Commissioner Waddle to approve the budget requests as a group and it was seconded by

Commission Tucker. All were in favor. Commissioner Quillen made a motion to approve the fourteenbudget amendments needing approval by the Budget committee. Commissioner Tucker second themotion. Motion passed.

Discussions:

In addition, the committee had a copy of the Debt Management policy. A motion to approve theDebt Management in accordance with the Three Star program was made by Commissioner Waddleand seconded by Commissioner Tucker. Motion carried. The CT-0253 form was presented.Chairman Morrison explained that this is the notice of the Debt obligation that we are goingforward with the Radio Project and there is no appropriation to be made at present for thisprogram but coming fourth in the future there will be a monetary obligation by the County as wetake on this Capital Project. There was a motion by Commissioner Waddle and seconded byCommissioner Quillen. All were in favor.

John Waddle wanted to give the Budget Committee an update on the 911 status. An upgrade tothe 911 needs to be before December

31st• They have agreed to buy from Motorola. Motorola has

agreed to finance. We need to look into the USDA. USDA Rural Development brought papers overthis morning. We will be getting a $30,000 grant We were open for $100,000 but they cut funds.Weapplied for $400,000. Interest rate will be 3.5% instead of 4.5 %if it comes through. Notificationshould be around September or October.

Mayor Morrison stated that we would Closing out 2018-2019 New Year beginning new 2019-2010Budget on Monday July Vt~which is a first.County Attorney Kevin Morrison stated that a lot of progress had been made. He praised BudgetSecretary Regina Nuckols and Budget Director Danny Lowery for a job well done.Mayor thanked all the departments. He said that this should be the goal to do thingsprofessionally and do them on time. This makes it a lot easier on all departments.

ThePlanningCommissionwas informedthat apolicydevelopedby theTennesseeOffice ofLocal PlanningAssistance(whooversawGreeneCounty’splanningprocessuntil 2016)requiredproposedexpansionsof non-commercialcemeteriesto be

handledasasubdivisionofland. This meantthatexistingcemeterieswithoutpublic roadfrontagecouldnot expandunlessfrontagewasprovided,whichwasnot apracticalsolutionin thissituation.Uponreviewofthe request,staffdetermined:

1. Statelaw exemptednon-commercialcemeteries,suchasfamily orchurchburial grounds,from stateregulationunderthe provisionsofthe“CemeteryAct of2006”.

2. Statelaw did not expresslyprovidefor local governmentregulationoffamily cemeteries.3. GreeneCountyregulationsdid not requirethesubmissionand/orreviewof siteplansfor

cemeteries.4. Neithertheexistingcemeterynortheproposedexpansionwasa subdivisionasdefinedin

T.C.A. §13-3-401(B)(i), i.e, the expansiondid not requirestreetor utility construction,andthecemeterypropertywould notbe sold orusedfor building.

5. If theproposaldid not meetthedefinitionofsubdivision,thenasubdivisionplat couldnot

be requiredto besubmitted.

A RESOLUTION TO REZONE CERTAIN TERRITORYOWNED BY RUSSELL WARD PROM A-i, GENERAL AGRICULTURE DISTRICT

TO B-2, GENERAL BUSINESS DISTRICT WITHINTHEUNINCORPORATED TERRITORY OF GREENE COUNTY, TENNESSEE

WHEREAS, the Greene County Commission has adopted a zoning resolution establishing zone districtswithin the unincorporated territory of Greene County, Tennessee and regulations for the use of propertytherein; and

WHEREAS, the Greene County Commission realizes that any zoning plan must be changed from time totime to provide for the continued efficient and economic development of the county; and

WHEREAS, Russell Ward has requested that this property be rezoned from A-i, General AgricultureDistrict to B-2, General Business District; and

WHEREAS, the Greene County Regional Planning Commission did review a request on August 13, 2019that the Russell Ward property be rezoned and recommended that the Greene County Commission deny therequest to rezone the property.

NOW, THEREFORE BE IT RESOLVED that the Greene County Legislative Body meeting in regular sessionon the

16th day of September, 2019 a quorum being present and a majority voting in the affirmative to amend

the Greene County Zoning Map to show the following property to be zoned 8-2, General Business District.

Being the same property identified as Greene County tax map 067, as parcel 025.20, as shown on theattached survey and tax map.

This change shall take effect after its passage, the welfare of the County requiring it.

RESOLUTIONAPPROVING THE TRUSTEE’SOFFICIAL BOND

WHEREAS,the official bond for the County Trustee must be approved by the

Greene County Legislative Body; and

WHEREAS.the minimum amount of the official bond for the Trustee shall be

determined from the amount of revenues handled by the Trustee during the last fiscal year

audited by the comptroller of the treasury as mandated by T.C.A. 8-1 1-103 (a); and

WHEREAS.the comptroller has recommended that the Trustee’s official bond be

increased by $6,182.00 to meet the statutory minimum amount required; and

WHEREAS,after consideration of the statutory requirements for the official bond

for the Trustee and the recommendation by the comptroller, it appears that the surety bond

of the office of Trustee should be increased as specified above to protect the state, county

and citizens in the event the county official fails to perform his duties properly.

WHEREAS, the Greene County Mayor’s Office received the aforementioned grant, fromthe Tennessee Department of Health;

WHEREAS, the Health Department and Greene County Government will provideoversight and manage the construction of a Walking Trail at the NolachuckeyElementary School, allocating the total amount of $20,000 for the project, for thepurpose of creating and safe and healthy space for Community residents.

yes,they couldgive adiscount. Mrs. Elmoresaidthatthis alsoincludes15 timeclocks,which

thereis amonthly charge. CommissionerPetersaskedif theCourthouseAnnex hadtheIT

capabilitywith serversand internetsupportto equipthetimekeepingsystem. Erin Elmoresaid

shedid not forseethatbeingan issue. David Herdonstatedthatthetimekeepingsystemis a

cloudbasedsolution andwill not needa serverotherthanfor thetime clocks. Hestatedthat

therewould not bea lot of IT maintenanceneeded. CommissionerPetersaskedErin Elmoreif

all or themajorityofthedepartmentheadswasin agreementwith this timekeepingsystem. Erin

Elmorestatedthat themajority ofthemhaveaskedfor atimekeepingsystem. Commissioner

Peterssaidhe would like to seeaMOU documentfrom all theelectedofficials.

RogerWoolseystatedthattheBudgetandFinanceDirector,DannyLowery couldcall theshots

on howhe wantsthepayroll done. CommissionerTuckersaidthat thebestway to do this,

would be to postponetheResolutionuntil you get theMOU documentsfrom thedepartment

heads. CommissionerWhite saidthatif it is on paperI believeit, but if it is in thecloud, I don’t

A RESOLUTION TO DONATE CERTAIN REAL PROPERTY TO WALTERS

STATE COMMUNITY COLLEGE - NISWONGER CAMPUS

WHEREAS, Greene County has a rich heritage in the field of education; and

WHEREAS, Greene County is home to the newly constructed Walter StateCommunity College — Niswonger Campus; and

WHEREAS, the Walters State Community College — Niswonger Campuscurrently enrolls approximately eleven hundred students, mostof whom are Greene County residents; and

WHEREAS, the Greene County Commission recently acquired the formerConsumer Credit Union building on Elk Street to house theGreene County Election Commission office and the GreeneCounty EMA office, respectively; and

during the debate regarding the purchase of the CCU BuildingMayor Kevin Morrison and numerous commissioners expressedmaintenance and infrastructure concerns about the currentElection Commission building, including a leaking roof, faultysewer pipes, a non-ADA-accessible public restroom; and

WHEREAS, because of said maintenance concerns, the cost of repairsneeded to bring the building up to code appear to be greaterthan the property is worth; and

WHEREAS, the most beneficial use of the property to the community wouldbe as an addition to the Walters State Community College —

Niswonger Campus;

NOW, THEREFORE, BE IT RESOLVED that the Greene CountyCommission, meeting in session on the 16th day of September 2019, a quorumbeing present and a majority voting in the affirmative hereby donates the currentGreene County Commission property to the Walters State Community College —

Niswonger Campus to use as Walters State and the Tennessee Board of Regentssee fit.

This request shall take effect upon passage, the public welfare requiring it.

Lori Bryantsaid, “I just wantedto take the $4.00and give it backto thecitizenswith a

service. Shesaid,“Whateveryou decide,I amokaywith it. I just wantedto do something

thatI feel would be for thegoodof thecitizens.” Thedrive-thruwould benefittheelderly,

thosewith mobility issuesor peoplewho maybe on oxygenwho havedifficulties in entering

theclerk’s office attheAnnex,and alsohelpparkingissuesat theAnnex.

WHEREAS, the Greene County Clerk desires to rent a 1200 square foot office on West

SummerStreetat the intersection with the 70 Truck Route in Greeneville, Tennessee to establish a

satellitedrive-throughvehicle tag renewal location for the benefit andconvenienceof the citizensof

GreeneCounty; and

WHEREAS, it appears that it would be in the bestinterestsof andgreatlybenefitthe

citizens of Greene County; to establish a satellite office facility to facilitate speedy and efficient tag

renewals by allowing the citizens of Greene County to have a drive- through location which in turn

would reduce congestion and parking issues at the Greene County Annex; and

WHEREAS,the proposedleasefor the satelliteoffice would be for a three-yearperiodwith

an option to extendas needed at a cost of One ThousandTwo Hundred Dollars ($1,200.00) per

month; and

WHEREAS,the County Court Clerk utilizing existing staff andfunding in her budgetwill

GreeneCountyAttorney be ableto staffand furnish the satelliteoffice with personnel,furniture, andequipmentbut will needRogerA. Woolsey204 N. County Trustee NathanHolt explainedthatthetax is ConstitutionalandtheTennessee

Constitutionsaysthat all propertyrealandpersonalis subjectto taxation. Commissioner

Peterssaidhe hasreceivedseveralcommentsand questionsfrom constituentsabout

CommissionerBryant’sunpaidpersonalpropertytaxes. NathanHolt explainedthat theState

ConstitutionandTennesseeCodeAnnotatedbothmandatethatpersonalpropertytaxesbe

leviedon equipmentbusinessusein operations.

Billy Nunnally,who servesasthecounty’stax attorney,explainedthattheInternal

RevenueServicehasplacealien ofabout$15,000againstCommissionerBryant’sproperty

andtherearealso leinsrelatedto the studentloans. Mr. NunnallysaidunpaidGreeneCounty

personalpropertytaxestotal $5,000andthoseownedto theTownof Greenevilleare$6,000

for thatperiod. Mrs. Nunnally saidthat hewasdirectedby anearliertrustee,DanWalker, to

file a lawsuitagainstBryantthatresultedin an $11,000judgementagainsthim to pay the

personalpropertytaxes.He saidthecountyhasnotpursuedany aggressiveactionto collect

thejudgementthroughseizuresof CommissionerBryant’sassetsbecausetheywould be

battlingthefederalliens in any litigation and thosewould takeprecedenceoverthe local

ones,whichwould notbe apracticalmove. Heexplainedthat statelaw doesprovidethe

trusteeauthorityto seizethebusinessequipmentfor unpaidtaxes,but he did not know

RE: Request to Take Clifford Bryant inFront of the Greene County Ethics Committee

We are formally filing this request for Clifford Bryant,3

rd District Greene County Commissioner, to

appear before the Greene County Ethics Committee. We are making this request based on thefollowing issues:

His failure to pay his Greene County Personal Taxes beginning in 2002 is the first reason. He says

that he doesn’t owe anything. He doesn’t think that the government can tell him what to doaccording to him.

Number two is because since 1996 he has owed for student loans that he has refusedto pay. It tooka federal judge threatening to put him in jail for 10 days, before he came up with 15,000 to pay onthat large loan. Also, his unwillingness to comply with a mediated agreement to make payments en

that student loan also comes into play.

Thirdly, the IRS also has a huge bill that he owes on not paying his billed taxes to them. It seems that

an each of these issues, he ignores bills, court papers and any kind of reminders sent to him from allof the above entities.

Wedo not think that he should be in the position to make decisions for every tax payers’ money thatlives in Green! County. This is not conduct expected or accepted from any member of the public,

especially an elected off cial.

We are asking for review and possible repercussions from the Ethics Committee on these issues.

Ic) ResidentialProperty, to he assessed at twenty-five (25%)percentof its value, pros-ided thati csidentialproperty containingtwo (2) or more rental units is herebydefinedas industrial andcommercialproperly; and

Id) Farm Property,to be assessed at twenty.five (25%)percent of its s’alue.House trailers, mobile homes, and all other similar movable structures used for commercial,

The Legislature shall provide, in such a manner as it deems appropriate, tax relief to elderly,ito-income taxpayers through payments by the state to reimburse all or part of the taxes paid bysuch persons on owner-occupied residential properms~but such reimbursement shall not be antthligation imposed, dtrectly or indirectly, upon counties, cities or towns.

By general law, the legislature may authorize the following program of tax relief:

a) The legislative body ofany county or municipality may pros-ide by resolution or ordinance

.Any taxpayer who is sixty’five (65) years of age or older and who owns residential propertyis the taxpayer’s principal place of residence shall pay taxes on such property in an amount notre weed the maximum amount of tax on such property imposed at the time the ordinance orresolution is adopted;

(2) Ans’ taxpayer who reaches the age of sixty-five (65) after the time the ordinance or resolu-ri,,tt~s adopted, who owns residential property as the taxpayer’s principal place of residence, shalltitc,eafter pay taxes on such property in an amount not to exceed the maximum amount of tax‘‘Ft such property imposed in the tax year in which such taxpayer reaches age sixty’five (65); and

The following Principles of Ethical Conduct are an excerpt from Executive Order 12674 of April 12, 1989, as

modified by Executive Order 12731 These Principles apply to all employees of the Federal Government.

Part I-Principles of Ethical Conduct

Section 101. Principles of Ethical Conduct. To ensure that every citizen can have complete confidence in theintegrity of the Federal Government, each Federal employee shalt respect and adhere to the fundamental principlesof ethical service as implemented in regulations promulgated under sections 201 and 301 of thIs order:

a- Public service is a public trust, requiring employees to place loyalty to the Constitution, the laws. and ethicalprinciples above private gain

b- Employees shalt not hold financial interests that conflict with the conscientious performance of duty.c. Employees shalt not engage in financial transactions using nonpublic Government information or allow the

improper use of such information to further any private interest,d. An employee shall not, except pursuant to such reasonable exceptions as are provided by regulation, solicit

This matter is before the United States Magistrate Judge with respectto the

Motion to Quash[Doc. 68] filed by DeborahBryant, the wife of the defendant. Oral

argumentwasheldon January11,2017.

TheUnited StateshasajudgmentagainstClifford E. Bryant, which wasenteredin

this caseon April 17, 1996. The judgmentwas in the original amountof $54,048.33.

However, in the interveningtwenty years, the amount owed has increasedto nearly

$400,000. After finally obtaining some records from the defendantafter numerous

motions for discovery and for sanctions,the United States subpoenaedrecords from

various bankswith which the defendanthad had financial dealings. In September,the

United Statesserveda subpoenaonAmericanPatriotBankwhich soughtthe following:

For the time period of July 1, 2007, through the date of your response,any and allrecordsof mortgageaccounts;chargeaccounts;loan accounts;IRS accounts;financial

statements;wire transfers;credit apptications;credit reports; accountstatements;depositrecords, including copies of depositeditems which exceed$250.00; certificates; loanapplications; signature cards; authorizations; resolutions; account, loan, or otheragreements;copiesof the front andback of all checks(including cancelledcheeks);andall otherinformation as may be includedin saidrecordsand files regarding, relating to, orincluding but not limited to any and all accountsheld in the name(s) of the following, orfor which any of the following havesignatory authority: Clifford E. The subpoena did not request records relating to Ms. Bryant. However, American

Patriot Bank respondedwith records which included documents relating to loans on

which Ms. Bryant was a co-signer along with the defendant. No documents were

produced which related to Ms. Bryant’s personal bank accounts. When the United States

discovered that it had received documents which related, at least in part, to Ms. Bryant, it

immediately sent her notice under the Right to Financial Privacy Act, 12 U.S.C. §~340 1-

3422. The notice included information regarding how she could file the present Motion

to Quash. The United States has not yet inspected the documents which relate in part to

Ms. Bryant.

At the hearing, the undersignedexplained to Ms. Bryant that the information

sought by the subpoenawas in aid of executionof the judgment againstMr. Bryant.

Counselfor the United Statesalso explainedthat Mr. Bryant hasassertedthat his health

limits his ability to work as a chiropractor,and that for this reasonhe maintainsthat he

cannot make payments. Ms. Bryant acknowledgedat the hearing that under the

circumstancesthe United Stateswasentitledto thediscoverysought,andto therecordsat

issue here from American Patriot Bank. Ms. Bryant also advisedthat Mr. Bryant has

handledall of the businessdealingswith American Patriot Bank and otherbanksfrom

which recordswerealsosubpoenaed.

The Court finds that the subpoena seeks inforn~ationthat is relevant and

proportionalto the needsof the caseunderF.R.Civ. P. 26(b)(1)and F.R.Civ.P.69(a)(2),

and that the loan documentsproducedon which Ms. Bryant is a co-signatorymay be

inspected and utilized by the United States in aid of execution on the judgment.

REPORTAND RECOMMENDATION

The United States has filed a motion for sanctions and for contempt [Doc. 82] requesting

the Court hold Defendant Clifford Bryant (Bryant) in contempt for his failure to comply with a

prior Court order entered on March 24, 2017, in which the Court ordered, based on the parties’

agreement, to make installment payments on a judgment the United States obtained against Bryant

years ago for failure to pay back his student loans. This matter is before the United States

Magistrate Judge under the standing orders of the Court and 28 U.S.C. § 636 for a report and

recommendation and certification of facts. The undersigned finds Bryant to be in civil contempt

of courtandRECOMMENDStheDistrict Court takeappropriateactionas it deemsnecessaryto

compel Bryant to comply with the previous orders of the Court to include potential incarceration.

I. FINDINGS OF FACT

The Court makes the following findings of fact. On July 11,2018, the United States filed

its motion for contempt and servedit on Bryantby both U.S. Mail andemail [Doe. 82]. On July

12, 2018, the Court entered an order directing Bryant to appear before the undersigned on

September 13, 2018, to show cause why he shouldnot be held in contemptof court basedon the

allegations contained in the motion filed by the United States [Doe. 84]. To assure Bryant had

notice of both the motion and the date of the hearing, the Court directed the U.S. Marshal to serve

Bryant personally with the relevant pleadings and the order to appear. On July 30, 2018, the U.S.

Marshal personally served Bryant with the Order setting the case for a hearing along with the

pleadings filed by the United States [Doe. 85]. Since that time, Bryant has not filed any responsive

pleadings challenging the allegations in the motion to hold him in contempt. Not only did Bryant

not challenge the allegations, on September 13, 2018, the date of the Court had set the case for a

hearing, Bryant did not appear as ordered by the Court.

A summary of the procedural history of this case is in order to appreciate the undersigned’s

recommendation. On April 17, 1996, the United States filed a certification of judgment recording

the judgment against Bryant it had obtained in the Circuit Court for Greene County, Tennessee in

the amount of $54,048.33 for Bryant’s failure to pay back a Sallie Mae student loan [Doc. 1]. On

September 25, 2000, the United States filed a motion to compel, requesting the Court order Bryant

to respond to post-judgment discovery served on him on May3, 2000 [Doe. 7]. On September 25,

2000, the District Court ordered Bryant to comply with his discovery obligations within 10 days

of the entry of the order [Doe. 8]. On August 15, 2001, the United States filed a motion for

contempt, indicating that Bryant had not complied with the Court’s order of September 25, 2000

[Doe. 9]. The District Court set the matter for a hearing on October 15, 2001 for Bryant to show

cause why he should not be held in contempt [Doe. 10]. On October 5, 2001, Bryant then

complied, and the motion was withdrawn [Doe. Il, 12].

No further action was taken in the court’s file until October 16, 2012 when the United

Statesissueda subpoenato producedocuments[Doe. 20]. On August8, 2014, the UnitedStates

filed a motion to compelpost-judgmentdiscovery,requestingtheCourt compelBryantto respond

to discoveryrequestsfiled on him on April 21, 2014 [Doe. 21]. On May 27, 2015,theHonorable

R. Leon Jordan referred the matter to the undersigned[Doe. 26]. On August 5, 2015, the

undersigned ordered Bryant to fully respond to the discovery requests by September 1, 2015 [Doe.

28]. On September 28, 2015, the United States filed a motion for contempt and for sanctions for

Bryant’s failure to comply with the Court order entered on August 5, 2018 [Doe. 30]. On

September30, 2015,theCourtenteredanOrderto ShowCauserequiring Bryantto appearto show

causewhy he shouldnotbe held in contemptof courtandset the matterfor a hearingon December

9, 2015 [Doe. 33]. On that date, thematterwas rescheduledto January27, 2016, to permit the

partiesto resolvethe pendingissues[Doe. 36]. BecauseBryantsubmittedsomeresponsesto the

discoveryrequests,the United Statesrequestedthe hearingbe rescheduledto permit it to review

his responses.The Court resetthe matter to February24, 2016 [Doe. 37]. On that date,Bryant

advisedtheCourtthathe would complywith thediscoveryrequestsby March 25, 2016. The Court

continuedthehearinguntil April 12, 2016 [Doe.40]. On April 6,2016, the United States withdrew

its motionto hold Bryant in contempt[Doe. 43].

OnMay4,2016, the United States filed another motion to compel post-judgment discovery

for not respondingto discoveryrequestsservedon Bryanton March4, 2016 [Doe. 45]. Thematter

was referredto theundersigned[Doe. 48]. On June8, 2016, the undersignedgrantedthe motion,

orderingBryantto respondto thediscoveryrequestsby July 11, 2016 [Doe. 49]. On July 15,2016,

the United Statesfiled a motion for sanctionsand contempt[Doe. 50]. The undersignedentered

an orderrequiringBryant to appearon August 11, 2016 to showcausewhy he shouldnot be held

in contempt[Doe. 53]. The hearingwas resetto September15, 2016. On September15, 2016,

the Court orderedBryant to producetherequesteddocumentsby September26, 2016andresetthe

hearinguntil October27, 2016 [Doe. 58]. Bryantcompliedwith thediscoveryrequests,and the

UnitedStateswithdrew its motion [Doe. 59].

On March 6, 2017, the United States filed a motion for an agreed installment payment order

[Doe. 75]. In this motion, the parties announcedthat Bryant had agreedto make monthly

installment paymentsbeginning April 1, 2017 in the amountof $1,000.00andcontinuing for 48

months[Doe. 75, pg. 1]. The Courthelda hearingon themotion on March 24,2017,during which

Bryant appearedandconfirmedon the recordhis agreementto the termsstatedin the motion for

installmentpayments. On that date,this Court enteredan AgreedOrdergrantingthe motion for

an installmentpaymentorderestablishedby both partiesandorderedBryantto

make forty-eight (48)paymentsof $1,000 eachconsecutivemonth...,followedbythirty—six (36) paymentsof $900 eachconsecutivemonth thereafter,followed bymonthly paymentsof $800eachconsecutivemonththereafterfor the remainderoftime until thejudgmentis fully andcompletelypaid off andsatisfied,including anyand all interest,surcharges,or otherfeesassociatedwith thejudgement.

[Doe. 80, ‘~2]. The Courtfoundthat “[a] failure to timely andcompletelymakea monthlypayment

in accordancewith this orderwill be deemeda violationofthis orderunlessthe failure isjustified.”

[Doe. 80, pg. 1-2].

On July 11,2018, the United States filed a motion for sanctions and for contempt indicating

Bryant hadnot compliedwith the Agreed Orderenteredon March 24, 2017 [Doe. 82]. On July

12, 2018, the undersignedset a hearingon the motion for September12, 2018 and directedthe

U.S. Marshalto serveBryantpersonallywith theordersettingthehearingalongwith thepleadings

the UnitedStateshad filed [Doe. 84]. On July 30, 2018, theU.S. MarshalservedBryantwith the

order andthepleadings[Doe. 85].

On the date of the hearing, Bryant did not appear. The Court then proceeded to conduct

thehearingthat hadbeenset. TheretheCourt finds that theUnitedStatesestablishedby clearand

convincing evidencethat Bryantmadepaymentsin accordancewith the order from April 2017

through January2018 [Doe. 82-1, Declaration,p. 1, ¶ 3], However,the checkBryantsubmitted

for his February2018monthlypaymentwasreturnedin March 2018 for insufficient funds [Doe.

82-1, Declaration,p. 1, 115]. Bryant then successfullymadehis March 2018 payment,and that

paymentwas then applied to the missedFebruarypayment[Doe. 82-1, Declaration,p. 2,116].On

March 27, 2018, theUnitedStatessentBryanta lettervia regularmail andvia email to inform him

thathis Februarycheekhadbouncedand thathis nextpaymentshouldbefor $2,000to coverboth

March and April [Doe. 82-1, Declaration,p. 2, ¶ 7; Hearing on Motion for Sanctionsand

Contempt,Exhibits 1 and2]. On April 18, 2018, Bryant tenderedtwo cheeksfor $1,000 eachto

coverhis paymentsfor March andApril [Doe. 82-1,Declaration,p. 2, ~]8]. Then,Bryant’s check

for the monthofMay wasreturnedfor insufficient funds, andthe UnitedStatesagainsenta letter

via regularmail andemail advisinghim of this and that he would have to make it up with the

June’s payment [Doe. 82-1, Declaration,p. 2, ¶ 9-11; Hearing on Motion for Sanctionsand

Contempt,Exhibits 3 and4]. In Bryant’s attempt to makepaymentsfor May andJune,both his

cheekswerereturnedfor insufficient funds [Doe. 82-1, Declaration, p. 2-3,1! 12-13]. As ofthe

dateof thehearing(September13, 2018), theUnited StatesinformedtheCourt that Bryanthasnot

tenderedpaymentfor the monthsof May, June,July, andAugust.

BryanthasnotcontactedtheUnitedStatesregardinghis missedpayments.Bryanthasnot

providedtheUnitedStatesnor theCourt with any evidencethat his financial circumstanceshave

changedsince he agreedthat he could make the payments outlined in the Court’s March 2017

order. Indeed,at the hearing,the United Statesintroducedno evidencethat Bryant’s financial

statushad changedat all, and that they believed it had not. At the time the Court enteredthe

installment order, Bryant understoodthat failure to comply with monthly paymentscould

constitutea violation of theCourt order,unlessjustified [Doe. 80, ¶ 1].

In settinga hearingon themotion andprovidingBryantnotice,theCourt providedBryant

with an opportunity to addresstheallegationsabouthis failure to comply with theCourt’s order.

Ratherthan filing any pleadingsor appearingat the hearingashe haddonein thepast,he simply

ignoredtheCourt. He hasmadeno argumentandpresentedno evidencethathis financialsituation

hasworsenedor that he is unableto fulfill his paymentobligationsto the United States. In short,

Bryant has not provided any explanationfor his failure to comply with the Court’s order.

Therefore,theCourt is left with uncontradietedtestimonythat Bryanthasthepresentability to pay

ashe did whenthecourtenteredthe initial orderbut hassimply refusedto do so.

The Court finds by clearand convincing evidencethat Bryantwas awareof this hearing,

thathe hadbeenpersonallyservedby theU.S. Marshalwith theorderdirectinghim to appearand

that he wasservedwith thepleadingsfiled by the United Statesseekingto hold him in contempt,

and that he has introducedno evidenceto addressthe allegationsthat he haswillfully failed to

comply with theCourt’s order directing him to pay in installments. Instead,Bryant hassimply

ignoredthe Court’s ordersand failed to comply with his prior agreementto pay a long-standing

obligationhe owesto theUnitedStates.

H. ANALYSIS

Choosing to disobey a lawful court order may be punishableas contempt. Glover v.

Johnson,138 F.3d229, 245 (6th Cir. 1998). But contemptis a “serious” powerto be usedonly as

a “last resort.” Gaschov Global FitnessHoldings, LLC, 875 F.3d 795, 799 (6th Cir. 2017).

“Contemptcomesin two varieties,civil andcriminal. ‘The distinctionbetweencivil andcriminal

contemptlies in the purposeof the court’s mandate.Civil contemptsanctionsare designedto

Clapper v. Clark Dcv., Inc., No. 17-4056, 2018 WL 4030850, at 1(3 (6th Cir. Aug. 23,

2018)(quotingDowneyv. Clauder,30 F.3d 681, 685 (6th Cir. 1994)). In contrast,“[c]riminal

contemptsanctions... areimposedto vindicatetheauthorityofthe courtby punishingpastactsof

disobedience.”Id. “With respectto civil contemptproceedings,‘[j]udicial sanctions... may, in a

proper case, be employed for either or both of two purposes;to coerce the defendantinto

compliancewith thecourt’sorder,andto compensatethecomplainantfor lossessustained.”Elec.

WorkersPensionTn FundofLocal Union #58, IBEWv.Gary~sElec.Sen.’. Co., 340F.3d373,379

(6th Cir. 2003)(quotingUnitedStatesv. UnitedMine WorkersofAm., 330 U.S. 258, 303—04, 67

S.Ct. 677, 91 LEd. 884 (1947)).

In this case,theUnitedStatesseeksto hold Bryantin civil contempt. The initial burdenis

on the UnitedStatesto demonstrateby clearand convincingevidencethat Bryanthasviolatedthe

Court’s order. SeeHarrison v. Metro. Govt of Nashvilleand Davidson County, Tenn.,80 F.3d

1107, 1112 (6th Cir. 1996). The Court finds that theUnitedStateshascarriedits burdento show

by clearandconvincing evidencethat Bryanthasviolateda specificcourtorderrequiringhim to

pay accordingto its terms. Once the United Statesestablishedits prima facie case,the burden

shifts to Bryant who could defendtheallegationofcontempt“by coming forward with evidence

showingthat he is presentlyunableto comply with the court’s order.” Elec. WorkersPensionTn

Fund, 340F.3dat 379. For Bryant to meet this burden,hemust “show categoricallyandin detail

why he ... is unableto comply with the court’s order.” Id. quoting Rolex Watch U.S.A., Inc. v.

Crowley,74 F.3d 716, 720 (6thCir.1996).

In this case,Bryant receivedadequatenoticeof thehearingandchoseto ignoretheCourt’s

order that he appearin personto addressthe motion filed by the United States. He offered no

Fund, 340 F.3dat379. Instead,he hasthumbedhis noseat the legal process.Bryant’sfailure to

comply with the Court’s order without any justification constitutes civil contempt. Under these

circumstances,the undersignedfinds that Bryant is in civil contemptandsanctions,including

monetarysanctionsor incarceration,areappropriate.

The next issue is what are the appropriatesanctionsin this case. Bryant hasconsistently

refusedto comply with his discoveryobligationsin this case,requiring the United Statesto file

motions to compel repeatedly. Rather than complying promptly, he drags out the process,

requiringthe United Statesto file thesemotions againandagain, andthe Court to addressthem

time andtime again. He hasdemonstrateda seriouscallousnessto his discoveryobligationsand

to the orders of the court. This attitude is reflected in his pattern of conduct over the years but also

mostrecently in his ignoring the Court’s orderfor him to appearandaddressthe allegations.

In this case, the Court RECOMMENDS that the District Court take whateveraction it

deemsappropriateto forceBryant to comply with the Court’s order. That actioncould include

incarceratinghim until he complies with the Court orderor otherwiseshowsthathe is presently

unableto comply. In this case,Bryant’sunwillingnessto attendthe hearingin violation of the

Court’s orderor to offer any evidenceto addressthe allegationscontainedin the motion leavesthe

Court with no otheroption but to include the mostseriousof sanctionswhen the District Court

decideswhat actionto take to compelcompliance.Among the availableactionthe District Court

shouldconsideris the incarcerationof Bryant for his continuedcivil contemptuntil he purgesit.

Thejudicial processcannotfunction wherelitigantsareableto openlymockthe process.Ignoring

court ordersrequiring him to appearis mockingthe process.Agreeingto a Court orderandthen

ignoring is mocking the process.Biyant cannotignore court orders withoutjustification, andup

Accordingly, the undersignedRECOMMENDSthat the motion [Doe. 82] of the United

Statesbe GRANTED and that Bryant be found in civil contemptof Court. Given the history of

this caseandBryant’s caviler approachto his obligationsto comply with the Court’s ordersand

giventhat he hadnoticeof the hearing,ignoredthe hearing,andpresentedno evidencethat he is

unable to comply presently with the Court’s order which obligated him to make payments

according to its terms, and that he has failed to pay according to the terms of the order, the

undersignedRECOMMENDS that the District Court setan appropriateorder requiring him to

comply with the ordersof the Court and thatsuch ordercould include anARRESTWARRANT

beingissuedfor Bryant andthathe be ARRESTEDAND INCARCERATEDandbroughtbefore

theDistrict Court to explain his lack of complianceandthathe remainincarcerateduntil he either

purgeshimselfof the contemptor otherwiseshowsto thesatisfactionof the District Court that he

is unableto complywith the Court’s orders.

The Court directs the U.S. Marshal to serve a copy of this Report and

Recommendationon Bryant at his last known addressat 297 Fairfield Dr. Greeneville,

reached any agreement from their meeting.

After hearing the parties on this matter, and considering Judge Corker’s

well-reasonedR&R, theCourtwill ADOPT theR&R. TheCourtadoptstheR&R’s factual

findings, and the Court finds that the governmenthas shown by clear and convincing

evidence that Mr. Bryant has violated specific court orders, namely, the agreedorder

requiringhim to pay $1,000per month to the governmentandthe order requiring him to

appearbefore the Court in Greeneville. SeeHarrison v. Metro. Gov’t of Nashville and

DavidsonCnty., Tenn.,80 F.3d 1107, 1112 (6th Cir. 1996) (holding that the initial burden

is on themovantto demonstrateby clearandconvincingevidencethat thenon-movanthas

violatedthe Court’s order).

Moreover, the Court finds that Mr. Bryanthasnot met his burdenof showingthat

he is presentlyunableto complywith the Court’s orders, SeeElec. WorkersPensionTr.

Fundv. Gary’s Elec. Serv. Co., 340 F.3d373, 379 (6th Cir. 2003) (holding that, oncethe

movant hasmadea showing by clear andconvincingevidence,the burdenshifts to the

non-movant to show that he is presently unable to comply with the Court’s order).

Accordingly, the Court finds Mr. Bryant in contemptfor failure to pay the agreed$1,000

monthlyamountto thegovernment,’andfailure to appearbeforeJudgeCorker,or file any

noticeor motion with the Court regardingthathearing.

The Court notesthat Mr. Bryantassertsthathe canno longerpaythisamount. However,the Court finds that Mr. Bryant has no excusefor his failure to discusshis allegedchangeinfinancial circumstanceswith the government,or file a motion in this Court,regardingthepaymentamount,ratherthan writing badchecksfor the $1,000monthlyamount.

TheCourthasconsideredtheappropriatesanctionsin this case,andhasdetermined

thata brief termof incarcerationis theonly appropriatesanction. Mr. Bryantalreadyowes

thegovernmentasubstantialsum of money, which he hasrepeatedlyrefusedto pay, and

thus, any attempt to order Mr. Bryant to pay a fine in this matter would be

counter-productive. Moreover, in light of Mr. Bryant’s egregiousbehavior, the Court

deemsincarcerationappropriate.Mr. Bryant maynot ignore ordersof the Court. As Judge

Corkernotedin his R&R: “The judicial processcannotfunction wherelitigants areableto

openly mock the process. Ignoring court ordersrequiring him to appearis mocking the

process.Agreeingto a Court order and then ignoring is mocking the process.” [Doc. 89

at 8]. Mr. Bryant neverprovided any remotely adequateexplanationfor his failure to

comply with Judge Corker’s order, nor his failure to work with the government if his

financial situationhadchanged,ratherthanwriting badchecksfor the owedamount.Thus,

theCourt finds that a shortperiodof incarcerationis an appropriatesanction

Accordingly, the Court OVERRULES Mr. Bryant’s objections [doc. 91],

ADOPTS JudgeCorker’sR&R [doe. 89], and GRANTS the United States’motion for

sanctionsand for contempt[doe. 82]. Mr. Bryant is foundto be in contemptof courtand

shall be imprisoned for a term of 10 days. Mr. Bryant shall surrender to the United States

Marshalat the JamesH. Quillen United StatesCourthousein Greenevilleno later than

12:00p.m. on Monday.July 22, 2019. Mr. Bryantis warnedthathis failure to self-report

at this time will resultin additional sanctions.
