REGULAR MEETING MARCH 21, 2017 STATE OF MISSISSIPPI COUNTY OF PEARL RIVER CITY OF PICAYUNE Be It Remembered that the Mayor and City Council of the City of Picayune, Pearl River County, Mississippi, met at City Hall, 203 Goodyear Blvd., in said City, Tuesday, March 21, 2017, at 5:00 p.m. in regular session with the following officials present: Mayor Pro Temp Wayne Gouguet, Council Members Tammy Valente, Lynn Bumpers, and Larry Breland, City Manager Jim Luke and Deputy City Clerk Leann Smith. Mayor Ed Pinero and Council Member Jan Stevens were absent.

It Being Determined a quorum was present, the following proceedings were held.

Opening prayer was given by Bro. Barry Lee, followed by the Pledge of Allegiance led by Mayor Pro Temp Wayne Gouguet.

ORDER TO APPROVE MINUTES Motion was made by Council Member Breland, seconded by Council Member Valente to approve the Minutes for the City of Picayune dated March 7, 2017 The following roll call was made:

AN ORDINANCE TO REZONE THE FOLLOWING DESCRIBED PROPERTY FROM R-1, SINGLE FAMILY RESIDENTIAL TO C-2 HIGHWAY COMMERCIAL.

Be it Ordained by the City Council of the City of Picayune, Pearl River County, Mississippi, in meeting duly assembled: Section 1: The following described property shall be rezoned from R-1 Single Family

Residential to C-2 Highway Commercial: The following parcels: 6176140030304000, 6176140030304202, & 6176140030304203 located on corner of South Haugh Avenue & Mitchell Street. For Mark Gibson, which legal description is as follows:

DESCRIPTION: Commencing at the SE corner of Lot 6 of the E. F. Tate’s First Addition the City of Picayune, said point being a 1 ½ iron rod on the West margin of Tate Street; thence South 12 degrees 30 minutes 00 seconds West along said West margin of Tate Street for a distance of 110.19 feet; thence leaving said margin North 77 degrees 30 minutes 00 seconds West 100.00 feet to a set iron pipe, and the Point of Beginning; thence South 12 degrees 30 minutes 00 seconds West 151.19 feet to the North Margin of Mitchell Street; thence North 74 degrees 39 minutes 00 seconds West along the said North margin for a distance of 204.20 feet to the East margin of South Haugh Avenue, said point being a found nail in the concrete gutter; thence North 12 degrees 30 minutes 00 seconds East along the said East margin of South Haugh Avenue for a distance of 154.73 feet to a found iron pipe; thence leaving said margin South 77 degrees 30 minutes 00 seconds East 150.00 feet to a found iron pipe; thence South 12 degrees 30 minutes 00 seconds West 13.70 feet to set iron pipe; thence South 77 degrees 30 minutes 00 seconds East 53.95 feet to the Point of Beginning, containing 0.73 acres, more or less, and being part of the Northwest Quarter of the Southwest Quarter of Section 14, Township 6 South, Range 17 West in Pearl River County, Mississippi.

Section 2. Severability, Conflict and Effective Date. Should any section, clause, paragraph, provision, or part of this ordinance for any reason be held invalid or unconstitutional by any Court of competent jurisdiction, this act shall not affect the validity of any other section, clause, paragraph, provision, or part of this ordinance. All provisions of this ordinance shall be considered separate provisions, and completely severable from all other portions.

Conflict in any case where a provision of this ordinance is found to be in conflict with the provision of other ordinance or code of the City of Picayune, Mississippi, existing on the effective date of this ordinance, the provisions shall take precedence.

This ordinance shall take effect and be in force thirty (30) days after its publication. The foregoing ordinance, having first been reduced to writing, was moved upon
