The completed, signed and dated booking form and Term and Conditions (including any incorporated terms), forms the Agreement, between the company or person named on the form (Client) and the Western Sydney Wanderers Pty Ltd ABN 26 156 634 016 (‘Western Sydney Wanderers’). MATCH DAY HOSPITALITY PACKAGE In this Agreement the Match Day Hospitality Package supplied by the Western Sydney Wanderers to the Client on each match day at ANZ Stadium and Spotless Stadium includes admission to a hospitality event, the supply of ticketing, food and beverages and benefits as offered by the Western Sydney Wanderers. PAYMENT Upon booking the Match Day Hospitality Package (unless otherwise specified) the Client will be issued with a Tax Invoice which is payable within seven (7) days of the date on the Tax Invoice. Match Day Hospitality Package will not be issued until full payment is received. CANCELLATION Should the Client wish to cancel the Agreement, the Client must do so in writing. If the Agreement is cancelled by the Client within forty-eight (48) hours of match day: Western Sydney Wanderers will refund 100% of the payment should the Match Day Hospitality Package be on-sold; Western Sydney Wanderers will provide no refund should the Match Day Hospitality Package not be on-sold. The Western Sydney Wanderers may cancel the Agreement without notice if you are in breach of any provision of the Agreement and/or Ticketmaster Terms and Conditions. The Western Sydney Wanderers will not be liable for the loss or damage directly arising out of the Match Day Hospitality Package. INDEMNITY The Client will indemnify the Western Sydney Wanderers against and loss or property damage at ANZ Stadium and Spotless Stadium arising out of or as a consequence of the Client’s use of ANZ Stadium and Spotless Stadium, or services except to the extent that such loss, damage, injury or death arises directly from the negligent act or the omission of Western Sydney Wanderers or its servants or agents. GENERAL CONDITIONS The Client must ensure that each of their guests and ticket holders: Do not erect, fix or display any goods, materials, advertisements or promotional material in, on or around ANZ Stadium and Spotless Stadium, without the prior written consent of the Western Sydney Wanderers; Comply with all reasonable directions given by the Western Sydney Wanderers and Pirtek Stadium from time to time (and the obligations referred to in the Privacy section below); Comply with all Ticketmaster and Ticketek conditions specified on the tickets issued as part of the Match Day Hospitality Package; and not use the Match Day Hospitality for any purpose other than for which is was acquired. Without limiting the generality of the foregoing, it is a condition of sale that any Match Day Hospitality Package or part thereof will not be re-sold, on-sold, sublet or rehired nor used for advertising, promotion or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods or services, without the prior written consent of the Western Sydney Wanderers. Any breach of this clause will result in the cancellation of the existing Agreement without refund. Match Day Hospitality in all suites and boxes will cease thirty (30) minutes after the completion of the game and last drinks will be fifteen (15) prior to full time. PRIVACY Privacy is important to Western Sydney Wanderers and we have procedures in place to ensure that your information remains confidential. Western Sydney Wanderers are mindful that your personal details are private and as such will only disclose information in accordance with the Privacy Act 1988. You may access your private information held on our database by contacting the Western Sydney Wanderers (02) 8602 6400. You have the right to refuse marketing materials.
