    (2) ln the case of a Development Officer who has been confirmed in theservices of the Corporation on a date prior to the date of publication of theserules in the.fficial Gazette, the percentage specified in the above Tableshall be increased by the appropriate transitionat concessions, if any, asdefined in clause (t):Provided that the transitional concessions shall not apply to thoseDevelopment fficers who are governed under rule 4.

    Explanation: For the purpose ofihis clause, -(1) "ascertained population'' means the population as ascertained from thelatest Census Report of the Government of lndia;(2) A Development Officer is said to be working in a "rural area" or "remote

    performance of the Development Officer for the appraisal yearimmediately preceding that date is assessed for any purpose under theserules or was assessed hitherto under the staff rules;(o) "service" means the period spent on duty as a Development Officer andleave including extra-ordinary leave which has been condoned under sub-rule (4) of rule 69 of the staff rules;(p) "staff rules" means the Life lnsurance Corporation of lndia (Staff) Rules,1960;(q) "succeeding year" means the period of twelve months commencing fromthe relevant appraisal date;(r) "Table of Disincentives" means the Table as appended in sub-rule (1) ofrule 6;(s) "lncreased Expense Limit" means the Expense Limit as mentioned in rule4.(t) "transitional concession" means the concession as specified in the Tablebelow applicable to a Development Officer who has been confirmed in the

    (u) words and expressions used and not defined herein but defined in thestaff rules shail have the meanings respectively assigned to them in thosestaff rules. '3. Tenure.- Subject to the provisions of these rules, a Development Officershall hold office by the same tenure and in the same manner as any otherclass of employee in the Corporation:Provided that he shall conform to the expense limit applicable to him:Provided further that the services of a confirmed Development Officershall not be terminated on the ground of poor business productionresulting in cost ratio in excess of the expense limit applicable to him,unless he has been given an opportunity to conform to the expense limitas provided in rule 6.

    4. Expense limit applicabte to Deveiopment Officers.- (1) The expenselimit applicable to a Development Officer shall be as specified in the Tableof Expense Limit as provided in clause O of rule 2 and it shall be theexpense limit applicable to his operational area as increased by twopercent, if, at or before such commencement of the relevant appraisalyear, he has completed the age of 55 years;Provided that the increased expense limit specified in the sub-rule (1) shallapply to relevant appraisal date commencing after the date of publication ofthese rules in the Official Gazette in respect of opeiational areas 'A', 'B', 'C'and'D'

    (2) ln respect of a Development Officer who has been confirmed on a dateprior to the date of publication of these rules in the Official Gazette and whohas put in more than ten years of service as a Development Officer at thecommencement of the relevant appraisal year.-

    (2) Where no increment is granted to a Development fficer in any year in' accordance with rule 6 as a disincentive, such increment shall not begranted to him in any subsequgnt year, except in accordance with theprovisions contained in rule 8.6. Opportunity to conform to the expense limit"- (1) Where the annual' remuneration of any Development Officer in the preceding year or years isin excess of the expense limit, his services shall not be terminated merelyon that ground if his case is capable of being dealt with by awardingdisincentives, subject to the provisions of rule 8, from the relevantappraisal date as provided in the Table of Disincentives, so as to affordhim an opportunity to conform to the expense limit:Provided that for the purpose of award of disincentives in accordance withthe Table of Disincentives, his performance shall be appraised withreference to the annual remuneration and the prescribed expense limitapplicable to him.

    (3) Where the basic pay of a Development Officer is reduced or fixed undersub-rule (1) or sub-rule (2) (hereinafter refered to as "the revised basicpay"), he shall be allowed only such allowances and other benefits as areadmissible on that basic pay:Provided that there shall be no protection of the annual remunerationeither by granting a personal allowance or otherwise; and no arrears ofpay or any allowance for the past period consequent on his conforming tothe expense limit later on shall be payable.

    (4) The appointing authority shall be the competent authority for implementingthe provisions of sub-rules (1), (2) and (3) and it shall determine themafters specified in the said sub-rules, as soon as may be, after the expiryof the relevant appraisal year:Provided that the competent authority concerned shall, before deckJingany matter under this rule, give an opportunity to the Development Officerto make a representation.

    (5) Where the representation received under proviso to sub-rule (4) discloses,(a) any factual inaccuracies in the computation of etigible premium orother figures, the competent authority shall revise his decision to theextent it is warranted by the revised figures and pass appropriate

    orders disposing of the representation;(b) any cause beyond the control of the Development Officer, such asaccident or sickness which W'arrants relaxation on the expense limitand he pleads that the award of disincentives should not be effectedon that ground, the competent authority shall forward therepresentation to the Zonal Manager, for decision.(6) lf the Zonal Manager is satisfied that there is any merit in therepresentation, he may consider the facts and circumstances of the caseand pass such orders as he may deem fit.(7) A Development Officer whose representation has been rejected by theZonal Manager may submit a Memorial to the Chairman in respect of thatmatter.(8) Notwithstanding anything contained in sub rules (1) to (7) where theannual remuneration of a Development Officer in any preceding year. (hereafter in this sub-rule referred to as the "relevant yeaf) exceeds 38o/oof the eligible premium of that year and the aggregate of the annual

    (9) ln the case of a Development Officer who has been confirmed in theservices of the Corporation on a date prior to the date of publication ofthese rules in the Official Gazette, the percentage mentioned in sub-rule(8) above shall be increased by the appropriate transitional concessions,and it shall be as under,-(a) The services of a Development Officer shall be liable for termination inaccordance with rule 7, if his annual remuneration in the First appraisalyear commencing after the date of publication sf these rules in theOfficial Gazette (hereinafter referred to as the 1first appraisal )rea/')exceeds 50% of the eligible premium in that year and the aggregate of

    the annual remuneration in the lirst appraisal year and the twoappraisal years immediately preceding the first appraisal year exceeds50o/o of the aggregate of the eligible premium in those three years.(b) The services of a' Development Officer shall be liable for termination inaccordance with rule 7, if his annual remuneration in the Secondappraisal year commencing after the date of publication of these rulesin the Official Gazette (hereinafter referred to as the "second appraisalyear") exceeds 45% of the eligible premium in that year and theaggregate of the annual remuneration in the second appraisal year andthe two appraisal years immediately preceding the second appraisalyear exceeds 50% of the aggregate of the eligible premium in thosethree years.(c) The services of a Development Officer shall be liable for termination inaccordarice with rule 7, if., his annual remuneration in the Thirdappraisal year commencing after the date of publication of these rulesin the Official Gazette (hereinafter referred to as the "third appraisalyear") exceeds 40 o/o of the eligible premium in that year and theaggregate of the annual remuneration in the.third appraisal year andthe two appraisal years irnmediately preceding the third appraisal yearexceeds 47.50o/o of the aggregate of the eligible prernium in thosethree years.(d) The services of a Development Officer shall be.liable for termination inaccordance with rule 7, if his annual remuneration in the Fourthappraisal year commencing after the date of publication of these rulesin the Official Gazette (hereinafter referred to as the 'fourth appraisalyear") exceeds 38% of the eligible premium in that year and theaggregate of the annual remuneration in the fourth appraisal year andthe appraisal year immediately preceding the fourth appraisal yearexceeds 38% of the aggregate of the eligible premium in those twoyears.

Tefmination of service in certain cases.- (1)where a DevelopmentOfficer has failed to conform to the expense limit and where no opportunityto conform to such limit could be given under the provisions of iule O, tfreZonal Manager may terminate his services after giving him three monthsnotice or salary in lieu thereof:Provided that the Development Officer shall be given an opportunity toshsw cause agqinst such proposed termination of his service.

    (2) An appeal against an order passed under sub-rule (1) shall lie to theManaging Director and the provisions of rules 41, 42, 43., 44 and 45 of thestaff rules shall, so far as may be, apply to any such appeal:(3) ln the case of an appeat under sub-rule (2), the Managing Director shallconsider the records of the case and pass orders on merits having regardto the.circumstances of the case.8. Deferment of Disincentives.- (1) The disincentives, other than "noincrement", shall not be awarded from the relevant appraisal date(hereinafter referred to as "the'relevant due date"), but shaif be kept inabeyance until after the expiry of the succeeding year, if, in any precedingyear a Development officer, who has completed at least ten years ofservice, has exceeded the prescribed expense limit attractingdisincentives in accordance with the Table of Disineentives.

    Provided that he has not exceeded the prescribed expense limit for acontinuous period of not lbss than ten years immediately preceding suchrelevant appraisal year.(1) \Alhere the Development Officer conforms to the prescribed expense limitin the succeeding year, referred to in sub-rule (1), no action shall be takento award the disincentives which have been kept in abeyance, and if theincrement,. which would have been otherwise accrued to him on therelevant due date, had been disallowed as a disincentive, such incrementshall be released from the relevant due date.(2) Where the Development Officer exceeds the prescribed expense limit in

    such succeeding year, the disincentives which have been kept inabeyance shall be awarded fr,om the relevant due date and appropriaterecovery of the excess remuneration paid to him in such succeeding yearsha'll be made from his salary for the following year and the disincentive ifany of "no increment" shall become final and he shall also be liable foraction in accordance with the Table of Disincentives for his faiture tocbnform to the prescribed expense limit in such succeeding year.

    THE GAZETTE OF INDIA : EARAORDINARY(3) Where the disincentives are not enforced or the increment is releasedfrom the relevant due date in adcordance with sub-rule (2), the precedingyear under sub-rule (1) shall not be regarded as a year in which he fiasnot exceeded the prescribred expense limit for the purpose of computingthe continuous service of ten years, in which he has not exceeded theprescribed expense limit.9. Reinstatement of reduction in basic pay effected in aGcordance withthe Table of Disincentives as a result of appraisal where the relevantappraisal falls on cir after lst day of April, 1988.-(1) The reduction effected in the basic pay of a Development Officer as aresult of appraisal on the relevant appraisal date falling on or after the 1stday of April, 1988 (hereinafter referred to as "current decrements") maybe reinstated in accordance with the provisions of this rule or rule 10.(2) Where a Development Officer qualifies for reinstatement in accordancewith this t'ule, the reduction in basic pay which was first effected on orafter the 1't day of April, 1988 shall first be reinstated; the reduction inbasic pay which was effected thereafter shall be reinstated next and soon.

    Provided that if a Development Officer fails to quatify for reinstatementwithin five appraisal years following the appraisal date from which hisbasic pay was reduced, there shall be no reinstatement of that reduction,and in that case the next reduction, if any, in basic pay shall be regardedas due for reinstatement if he subsequently qualifies for reinstatement:Provided further that the reinstatement of reduction in basic pay under thisrule and rule 10 shall be limited to only three occasions throughout theservice as a Development Officer. ''

    (3) Subject to the provisions of sub-rule (4), if on any relevant appraisal datefalling on or after the 1tt day of April, 1988, the appraisal discloses that aDevelopment Officer has not eSceeded the expense limit in the precedingyear and that the cost ratio in such preceding year and the next twopreceding years taken together does not exceed the combined expenselimit for: those three years (hereinafter referred to as a "block of threeyears") the eligible current decremenUs may be reinstated with effect fromthe relevant appraisal date:Provided that in any preceding year, a Development Officer does notconform to the expense limit, he may qualify for "reinstatement if therearises a block of three years on any subsequent relevant appraisal date:Provided further that current decremenUs pertaining to not more than oneyear shall be reinstated on one relevant appraisal date, even though the

    that date) bears to the eligible premium of the preceding year and thefuture cost shall be deemed to be within ceiling, if such annualremuneration applicable to a Development Officer is not in excess ofhis expense limit percentage (inclusive of transitional conc,essions, ifany) of such eligible premium.(4) No reinstatement shall be allowed if, on reinstatement, the DevelopmentOfficer shall reach"a stage in the scale of pay which he would not havereached on the ground that he had exceeded the expense limit, and in' such a case the ieinstatement shall be limited to the siage in the scale ofpay which he would have normally reached.l0.Reinstatement of reduction in basic pay effected in accordance withthe Table of Disincentives as a rsult of appraisal where the relevantappraisal falls on or after the lst day of April, 1988 - Alternativemethod.-

    Subject to the provisions of sub-rules (2\ and (4) of rule 9, if aDevelopment Officer does not exceed the expense limit in threesuccessive appraisal years, the current decremenUs pertaining to oneyear may be reinstated with effect from the relevant appraisal date nextfollowing the last such appraisal year.11. Provident Fund.- (1) Notwithstanding anything contained in rule g of tneLife lnsurance Corporation of lndia Development Officers (Revision ofTerms and Conditions of Service) Rules, 1986, where the currentdecrements are reinstated to a'Development Officer frorn the relevantappraisal date in accordance with the provisions contained in rule g or 10,the Corporation shall contribute to the Provident Fund established by it(hereinafter referred to as the "Fund") a maximum amount of 10 per cent

    of the aggregate of the basic pay comprised in such decrements inrelation to the period for which thoseldecrernents have been reinstated:Provided that if during the period or part of the period in vtrhich the saiddecrements were in force,-the rate ai which the employeCs contributionwas higher than 10 per cent, the Corporation may contribute at suchhigher rate on thatpart oJ the basic paypertaining toihe r nt peri".l'Provided further that the Development Officer shall contribute to the Fundan amount equal to the contributions requireO of ne Corfoiation-as 6isadditional contribution in accordance with ttre rules of th'e Ffi; and insuch manner as he may be directed by the corporation.

    (2) The eorporation shall credit its csntributions to the Fund as and when andto the extent the Development Officer makes sucfr additional,contributionsurder the second proviso to sub-rule (1).(3) The contributions made by the Corporation under suFrub (1) shall not beavalfable for any purpose for which the employer's contriUriion.
