    9 veryusefulmeetingwiththeDefenceyesterday,wherebywetried

    10 toputforwardacommonpositiontowardsthisCourtthismorning

    11 sothattheCourt,ifitismindedtoagree,maypassordersby

    12 consent. Now,thefirstissueweaddressedwasnumberone,of

    13 course,whichisthelengthoffinaltrialbriefandallparties

    14 wanttofileafinaltrialbrief. Andintermsofthelengthof

    15 thefinaltrialbrief,wesoughtguidancefromtheCDFcase,and

    16 inthatcasetherewerefewerDefencewitnesses,bymorethan

    17 half. Ithinknorebuttalandcertainlylessemphasisonthe

    18 complexitiesoftheJCE,andinthatcasetheProsecutionhad

    19 beenallowedamaximumof400pagesincludingheaders,footnotes

    20 etcetera,andeachoftheDefencecounsel200pages. Sothe

    21 partiescametotheagreementthatfortheProsecution400pages,

    22 amaximumthereof,wouldalsobesufficient,andforeachDefence

    23 counsel,amaximumof200pages,andthiswaswhatweproposed

    24 jointlytoputforward.

    25 PRESIDINGJUDGE: Now,doItakethattomean,MrAgha,

    26 thattheProsecutionwillbesubmittingajointfinaltrialbrief

    27 initiallyallowedthreeweeksfromtheclosingoftheevidence.

    29 theentireevidence,shouldrebuttalbeallowed.

    11 guidancefromtheCDFcase,andweweresuggestingamaximumof

    12 threehoursfortheProsecution,andamaximumoftwohourseach

    13 fortheDefence,subjectofcoursetotheTrialChamber'sability

    14 tolimitthattimeperiod,orthosetimeperiods,ifitfelt

    15 mindedtodoso.

    16 PRESIDINGJUDGE: Sowewouldbelookingatamaximumof

    17 ninehours. Thatwouldtake,fully,twohearingdays.

    7 belimited. So,thatisadecisionwhichisobviouslystillwith

    9 TheonlyotherissuewhichI'dliketoraiseistheissue

    10 whichlearnedcounsel,MrKnoops,raisedyesterdayandthatisin

    11 respectofwitnessTF1511. Now,thisisquiteaproblematic

    12 positioninthesensethatthereisanorderof24thNovember

    13 2003wherebythiswitnesswasgivenglobalprotectivemeasures

    14 andat"K"ofthatdecision,essentiallythestartingpointis

    15 fortheDefencetoapproachtheCourtforamodification,ifyou

    16 like,ofthoseprotectivemeasuresandthen,iftheCourtwasso

    17 minded,fortheProsecutiontoassistinfindingthatwitness

    18 well,notfindingbutputtingtheDefenceincontactwiththat

    19 witness. Now,thepositionoftheProsecutionis,anditmaybe

    20 thattheCourtcouldvarytheseorderstoday,shouldtheDefence

    21 applytodoso,iswehavenodifficultyindisclosingthename

    22 ofthatwitnesstotheDefence. However,we'venotbeenin

    23 contactwiththatwitnessuntil2003. Aswe'veinformedthe

    24 Defencewedon'thavehiscontactdetails. SoiftheDefence

    25 weremindedtomakeanapplicationtoday,tovarythatprotective

    26 measuresorder,andallowit,theProsecutionwouldsuggestthat

    27 wecancertainlyprovidethenametotheDefence,and,inthose

    28 circumstances,theywouldbeatfulllibertytomakecontactwith

    29 thatperson,interviewhim,and,ifneedbe,iftheyfelthewas
