Akula Gopayya College of Education, Sri Gowthama Buddha Minorities Educational Society, Prathipadu, Tadepalligudem, West Godavari-534101, Andhra Pradesh. has submitted application on 30.12.2002. The institution was granted recognition for offering B.Ed course with an intake of 100 students vide order dated 10.09.2003.

The institution was granted recognition with a condition that the institution shall shift to its own premises/building within three years from the date of recognition. (In case the course started in rented premises.

The institution submitted proposal for shifting of premises on 28.12.2007 along with Rs.40,000/- vide Receipt No. 13794 dated 07.02.2008 towards inspection fee for shifting of premises.

Now, visit is being organized to verify the infrastructural and instructional facilities available at the new premises.

The management is also running B.Ed and D.Ed in the same building.

The shifting inspection of the institution was done on 31.03.2011.

The Committee considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice to all the courses under Section 17 of NCTE Act. Accordingly, show cause notice was issued to the institution on 07.07.2011. The institution had submitted its written representation along with relevant document son 08.08.2011.

The Committee considered the written reply of the institution dt. 07.07.2011 on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

As seen from VCD, the roof of the building is covered with Asbestos sheets and the building is incomplete.

The details of the other programmes run by the management in the same building/campus along with the existing course is not submitted.

In the building plan submitted, the built up area is not clearly mentioned. And the building plan is not legible and is not approved by competent Government authority.

Based on the above points the committee decides to withdraw the recognition of the B.Ed (APS00706) course run by the Akula gopayya College of Education, Sri Gowthama Buddha Minorities Educational Society, Prathipadu, Tadepalligudem, West Godavari-534101, Andhra Pradesh from the academic year 2012-13, in order to enable the ongoing batch of students in B.Ed course, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.

Accordingly, withdrawal order was issued to the institution Vide No. F.No.APS00706/B.Ed/AP/2011-12/32287 dt. 15/11/2011.

Aggried by the withdrawal order of SRC, the institutin preferred an appeal to NCTE Hqrts. and the appellate authority in its order dt. 20/03/2012 with a direction to the SRC for restoration of recognition to the institution for B.Ed course. Accordingly, the appeal is accepted and the Order of SRC dt. 15.11.2011 is reserved.

The committee considered the appellate authority order Dt. 20.03.2012 and decided to restore recognition of the institution.

The Committee in its 208th meeting held on 13th -14th July 2011 considered the reply of the institution and again it was decided to serve the Show Cause Notice for the following:

The request of the institution for consideration of grant of recognition to HPT course cannot be acceded to as it was not online. As per NCTE Regulations 2009 it is mandatory for Teacher Education Institution to apply online for recognition of a Teacher Education course. NCTE Hqrs has directed not to consider the applications received offline for TPT/HPT/UPT courses.

As per direction of SRC Show Cause Notice was issued to the applicant institution on 19.07.2011. The institution has submitted written representation on 25.07.2011.

SRC in its 209th Meeting held on 31st July 2011 considered the reply of the institution and it was observed that, as per VT report, the name of the course in the visiting report is given as HPT/D.E.C.Ed. Whereas the institution had applied online for D.E.C.Ed course and not for HPT course. NCTE Hqrts has directed not to consider the course if it was not specified in the online application. As per NCTE regulations 2009, it is mandatory for Teacher Education Institution to apply online for recognition of a specific teacher education course.

In view of the above, the committee in its 209th meeting held on 31st July, 2011 after going through the reply of institution, come to the conclusion that the reply is not satisfactory and not convincing and hence, the recognition is refused.

Accordingly, refusal order was issued to the institution vide no. F.No. SRCAPP244/D.E.C.Ed/AP/2011-12/30827 dated 13.10.2011 as per direction of Regional Committee.

Aggrieved by the withdrawal order of SRC the institution preferred appeal to NCTE-Hqrs and the appellate authority in its order no. F.No.89-433/2011 Appeal/1st Meeting-2012 A47694 dated 15/02/2012 the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the SRCs order dated 13/10/2011 with a direction to the SRC for further processing of the case for HPT course as per regulation, accordingly, the appeal is accepted and the order of SRC dated 13/10/2011 is reversed.

Note: the institution given in NCTE-Hqrs letter dt.23/12/2010 (copy enclosed) mentioning that as per NCTE Regulations, 2009, it is mandatory for the TEIs to apply on-line for recognition of a teacher education course. SRC was silent on receiving applications offline till 20th September, 2010 for the above courses. You are, therefore, directed not to consider the applications received offline for TPT/HPT/UPT courses was following in this case.

The matter was pleased before SRC in its 219th Meeting held on 15th-16th March, 2012. The committee decided to process the application for HPT course as per Regulation.

Accordingly, the application is processed for HPT course.

The Committee considered the appellate authority order dated 15/02/2012 remanding back the case to the SRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of the NCTE regulation, the Regional Committee decided to issue Letter of Intent for grant of recognition to H.P.T. course of one year duration with an annual intake of 50(Fifty only)(one unit) for the academic year 2012-13 subject to the appointment of qualified staff through duly constituted selection committee as per the Norms of NCTE/State Government/Affiliating University and be given effect before the commencement of the academic session.

St. Peter Training College, Kolencherry P.O, Ernakulam District, Kerala made an application for B.Ed course to SRC, NCTE, Bangalore on 30.12.2002

The application was processed and after considering the report of the visiting Team as well as other relevant materials granted recognition to the institution for offering B.Ed course with an intake of 100 students vide order dated 23.02.2005.

The institution was granted recognition with a condition that the institution shall shift to its own premises/building within three years from the date of recognition. (In case the course started in rented premises).

The institution vide its letter dated 28.12.2008 submitted proposal for shifting the B.Ed course to the new location. Consent letter was issued to the institution on 19.01.2011. Accordingly, inspection of the institution was carried on 07.02.2011.

The Committee in its 206th meeting held on 9-10th June, 2011, considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly, a show cause notice was issued to the institution on 12.07.2011. The institution has submitted written representation on 01.08.2011.

The Committee considered the written reply of the institution dt. 01.08.2011 on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The management is also running a Higher Secondary School in the Ground floor of the same building. This is against the NCTE norms.

Land documents are in individuals Name and not in the Name of the Society/Trust/Institution as per NCTE Norms. In the sale submitted by the institution, land is in individual name of Mr. Geevarghese Kathanar; in Sy.no.600/9 for the extent of 2 Acres & 31 cents. Land has to be in the name of the college/trust on the date of application as per regulations.

As per VCD observation, the building is roofed with AC sheets.

Building completion certificate from competent Govt. authorized Engineer is to be submitted.

Land usage certificate from competent Govt. authority is not submitted.

Multipurpose hall size is 988 sq.ft. which is less than the requirement of Regulation 2009.

Byelaws of the Society are to be submitted by the management.

An Affidavit on Rs. 100/- stamp paper in the prescribed format with notary attestation is to be submitted.

In the building plan submitted Sy.no., Plot no, total land area and built up area not mentioned.

Non- Encumbrance Certificate from the competent Government Authorised person / Authority in English version is not submitted.

Salary is not paid as per State Govt/UGC norms. The institution has not given the facility of CPF/PPF to the staff members.

Based on the above points the committee decides to withdraw the recognition of the B.Ed (APS00680) course run by St. Peters Training College, Ernakulam District, Kerala from the academic year 2012-13, in order to enable the ongoing batch of students in B.Ed(APS00680) course, if any, to complete their course.

Accordingly, withdrawal order was issued to the institution for offering B.Ed. course vide No.APS00680-B.Ed./2011-12/32517 dated 15.11.2011.

Aggrieved by the refusal order the institution preferred an appeal before the appellate authority on 06.12.2011.

The Appellate authority on 18-01-2012 & 29-02-2012 noted that the institution had contested that they never proposed shifting of the premises as mentioned in the order of withdrawal of recognition. The Council also noted that the appellant was claiming that all the documents, a reference to which has been made in the withdrawal order, had already been submitted. The appellant admitting occupation of three rooms by the school undertook to vacate them. The English version of the Societys constitution mentioned only schools and had not envisage establishment of the other educational institutions like Teacher Training Institutions. The appellant had submitted a copy of the Universitys affiliation order dated 23.03.2005, which inter-alia mentioned that the minimum consolidated monthly emoluments of a teacher should be Rs.8,000/- and that of the Principal should be Rs.12,000/-. The position regarding present emolument was not clear. The Council taking into account the number of grounds mentioned in the withdrawal order, admission of the appellant about presence of the school in the B.Ed. college premises, submission of documents some of which were still in Malayalam (like non-encumbrance certificate) and conditions; if any, laid down by the University in their latest affiliating order (copy of which has not been furnished) in regard to payment of salaries and provision of other benefits to the staff came to the conclusion that the matter deserves to be remanded to the SRC to conduct a fresh inspection of the institution on payment of the fee and taking further action thereafter.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and remand the matter to SRC vide Appellate authority order F.No.89-457/2011 Appeal/2nd Meeting-2012 A49007 dated 20.03.2012 with a direction to conduct a fresh inspection of the institution on payment of the fee and to take further action thereafter.

The committee considered the Council order dt. 20/03/2012 and other relevant documents and decided to cause inspection on payment of Rs. 50000 inspection fee, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, under Section 17 of NCTE Act.

D.Ed

Goutham Teacher Training Institute, Chamarajanagar District, Karnataka.

Goutham Teacher Training Institute, Gundlupet-571111, Chamarajanagar District, Karnataka

Goutham Teacher Training Institute, Gundlupet-571111, Chamarajanagar District, Karnataka submitted an application for grant of recognition on 30.09.2003 and was granted recognition for offering D.Ed course with an intake of 50 students vide order dated 29.11.2004 with the condition to shift to its own premises within 3 years from the date of recognition.

NCTE, Hqrs. vide letter dated 25.04.2011 had forwarded a copy of the inspection report dated 24.06.2010 conducted under Section 13 of NCTE Act. As there were deficiencies pointed out in the inspection report, NCTE-Hqrs. had requested SRC to look into the matter in order to ascertain the compliance/ adherence of the NCTE Norms and Standards by the institution and also to take appropriate action.

The SRC in its 205th meeting held on 18th-19th May 2011 considered written representation of the institution and decided to issue Showcause Notice. Accordingly, Showcause Notice was issued to the institution on 27.06.2011. The institution submitted written representation on 15.07.2011.

The Committee in its 210th meeting of SRC held on 22-23 August, 2011 considered the written reply of the institution dated 15.07.2011 on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

As per VT report, the institution is functioning in an old temporary building, which was originally, meant for Hostel. The construction of new building is yet to start; the management has shown to the VT members the proposed land where the new building is proposed to be constructed; only fencing is put around the boundary of the land where work is yet to start. This is gross negligence on the part of the management that even after a lapse of 3 years (and after more than of 6 years and 9 months) that shifting has not been effected. The construction of new building has not started. (The management has also admitted the same). This is against the NCTE norms.

Based on the above points the Committee decided to withdraw the recognition of the D.Ed course run by the Goutham Teacher Training Institute, Gundlupet-571111, Chamarajanagar District, Karnataka, from the academic year 2013-14, in order to enable the ongoing batch of students in D.Ed, course, if any, to complete their course.

Accordingly, withdrawal order was issued to the institution vide No. APS01410-D.Ed./KA/2011/30804 dated 12.10.2011.

Aggrieved by the withdrawal order, the institution preferred an appeal on 05.12.2011.

The appellant appeared before the Council on 28-02-2012. The Council noted that the institution was granted recognition for conducting D.Ed. course vide order dated 29.11.2004. NCTE caused an inspection of the institution on 24.06.2010 under Section 13 of the NCTE Act. On the basis of this report, SRC issued Show cause Notice on 27.06.2011 and subsequently withdrew recognition of the institution. The Council noted that the society Goutham Social, cultural and Educational Society was in possession of 3.33 acre of land at Sy.Nos.174/2 and 177/1 by way of gift deed dated 25.04.2006. After taking necessary approval from office of Municipal Council, Gundlupet, it constructed a building with a built up area of 17030.91 sq.ft. and to this effect a building completion certificate was issued on 01.12.2011 by the Office of Town Municipal Council, Gundlupet.

In view of the above, the Council came to the conclusion that there was adequate justification in remanding the case to SRC for causing inspection of new premises of the institution for ascertaining availability of infrastructure and other facilities as per norms, after obtaining a payment of Rs.40,000/- from the institution.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate justification in remanding the case to SRC for causing inspection of new premises of the institution for ascertaining the availability of infrastructure and other facilities as per Norms, after obtaining a payment of Rs.40,000/- from the institution and for taking further decision thereafter.

The Appellate authority vide order F.No.89-448/2011 Appeal/2nd Meeting-2012 A48947 dated 20.03.2012 remands back the case of Goutham Teacher Training Institute, Chamarajanagar, Karnataka to SRC, NCTE for necessary action as indicated above.

The committee considered the Council order dt. 20/03/2012 and other relevant documents and decided to cause inspection on payment of Rs. 50000 inspection fee, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, under Section 17 of NCTE Act.

CMR College of Education, CMR Janardhana Trust, CA No. 2,3 Cross, 6th A Main, HRBR Layout, Kalyan Nagar, Bangalore-560043, Karnataka was granted recognition for offering B.Ed course with an intake of 100 students vide order dated 25.11.2007.

The institution in its letter dated 16.10.2007 has submitted a proposal for shifting of premises along with Rs.40,000/- towards shifting fee. The inspection was carried out on 24th November 2010. The inspection report has been received along with VCD. The inspection was carried out on 24.11.2010.

The SRC in its 199th meeting held on 22-23 December 2010 considered the VT Report, VCD and all the relevant documentary evidences and decided to issue Show Cause Notice. Accordingly, Show Cause Notice was issued to the institution on 28.01.2010. The institution submitted its written representation on 03.03.2011.

The SRC in its 203rd meeting held on 31st March,2011 & 1st April, 2011 considered the written representation and decided to issue Final Show Cause Notice. Accordingly, Final Show Cause Notice was issued to the on 06.05.2011. The institution submitted its written representation on 06.06.2011.

The Committee in its 206th meeting held on 09-10th April, 2011 considered the VT Report, reply of the institution vide letter dt.06.06.2011 and all the relevant documentary evidences and decided to serve another Final Show cause Notice under Section 17 of NCTE Act. Accordingly, a Final Show Cause Notice was issued to the institution on 07.07.2011. The institution submitted its reply on 18.08.2011.

The Committee in its 211th meeting held on 23 considered the written reply of the institution dt. 02.08.2011 on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The management is sharing the building used for running D.Ed & B.Ed programmes along with other courses namely. Pharmacy, Law, M.B.A & Nursing courses which is not permissible as per NCTE norms. No exclusive earmarked campus are available for the courses being run.

As per NCTE norms, earmarked land area and built up area is required. B.Ed and D.Ed courses are not in exclusive building, meant for the Teacher Education Programme only.

Based on the above points the committee decides to withdraw the recognition of the B.Ed (APS01493) course run by CMR College of Education, CMR Janardhana Trust, CA No.2, 3 cross, Bhuvanagiri OMBR Layout, Banasawadi, Bangalore-560043, Karnataka, from the academic year 2012-13, in order to enable the ongoing batch of students in B.Ed(APS01493) course, if any, to complete their course.

Accordingly, withdrawal order was issued to the institution vide No. APS01493-B.Ed./KA/2011-12/32976 dated 02.12.2011.

Aggrieved by the withdrawal order, the institution preferred an appeal on 27.01.2012.

The appellant appeared before the Council on 01-03-2012. The Council noted that a) the institution submitted a proposal for shifting of the institution to own premises on 16.10.2007. SRC caused an inspection of the institution at the new premises on 24.11.2010. the visiting team reported that the new premises has an education complex with B.Ed. and D.Ed. in one building of one block and in the opposite two blocks, courses such as Pharmacy, law measuring and management were running. A built-up area of 2750 sq.mtrs. was meant for B.Ed. course and 2655 sq.mtr. was for D.Ed. course. It however recorded that labs., centralized library, a hall and auditorium were in separate block opposite to B.Ed. and D.Ed. block. So, there was certain amount of ambiguity with regard to existence of exclusive building with all the requisite facilities.

The Council after taking into consideration the submission made by the appellant and reply of the institution to the Show Cause Notice as well as VT observations, came to the conclusion that there was adequate justification in remanding the case to SRC for causing re-inspection of the institution for ascertaining availability of exclusive infrastructure for B.Ed. and D.Ed. courses, after obtaining a payment of Rs.40,000/- from the institution and for taking further decision thereafter.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council concluded that there was adequate justification in remanding the case to SRC to cause re-inspection of the institution to ascertain the availability of exclusive infrastructure for B.Ed. and D.Ed. course, after obtaining a payment of Rs.40,000/- from the institution and for taking further decision thereafter.

The Appellate authority vide order F.No.89-29/2012 Appeal/2nd Meeting/2012 A49023 dated 20.03.2012 remandS back the case of CMR College of Education, Bangalore, Karnataka to SRC, NCTE for necessary action as indicated above.

The committee considered the Council order dt. 20/03/2012 and other relevant documents and decided to cause inspection on payment of Rs. 50000 inspection fee, to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, under Section 17 of NCTE Act.

Kittoor Rani Chennamma PG College, Belgaum, Karnataka

Kittoor Rani Chennamma PG College, Belgaum, Karnataka had submitted an application for starting of M.Ed. course on 11.9.2007.

After submission of essential documents, inspection was conducted on 31.07.2008. The VT report and all other related documents were placed before 162nd meeting of SRC held on 20-21 August, 2008 and it was decided to issue Letter of Intent/Conditional recognition. The letter of intent was sent to the institution on 18.09.2008.

Even after the lapse of stipulated time, the institution has not submitted any reply and the matter was placed before 171st meeting of SRC held during 16-17 March 2009 and a Notice was served to the institution on 24.3.2009 to submit the documents before 10th April, 2009. The institution submitted reply on 28.4.2009.

The matter was placed before 174th meeting of SRC held during 1.5. 2009 wherein it was decided to send Notice. Again, a letter was sent on 9.6.2009 to submit the documents within 19.6.2009 and a reminder letter was sent on 2.7.2009 to submit the documents within 10th July, 2009. A letter was submitted on 22.7.2009 stating that the Vice-Chancellor of Karnatak University, Dharwad is making appointment of teaching staff as per norms.

The matter was placed before 179th meeting of SRC held on 23rd July, 2009 and it was decided to serve Notice and Notice was served on 24.7.2009. Since the institution did not submit any reply, the matter was once again placed before 180th meeting held on 29th July, 2009 wherein it was decided to permit the institution to submit the repy by 17.8.2009 and a final reminder was sent on 31.7.2009.

The institution submitted its representation on 30th July, 2009 and 11.8.2009. The reply was considered by SRC in its 181st meeting held during 20-21 August, 2009 and it was decided to serve Notice to submit reply by 28th August, 2009 and notice was issued to the institution on 24.8.2009.

The institution did not submit any reply even after expiry of stipulated period and hence the matter was placed before SRC in its 182nd meeting held on 31st August, 2009 which came to the conclusion to refuse the recognition/withdraw the Letter of Intent OR Conditional Recognition accorded to the institution for the proposed course as per Section 14(3)(b) of NCTE Act for the following reasons:-

The institution has not appointed requisite faculty/staff and also not submitted the staff list and affidavits as per regulations 7(9) of NCTE.

Accordingly, refusal order was issued to the institution vide Order No. F.SRO/NCTE/2008-2009/15844 dated 24.09.2009.

Aggrieved by the refusal order the institution preferred an appeal before the appellate authority on 13.09.2011.

The Appellate authority on 8-12-2011 noted that a) Karnataka University submitted an application to the SRC for grant of recognition of Kittur Rani Channamma P.G. Centre, Belgaum, Karnataka for M.Ed. course. SRC vide letter dated 18-09-2008 issued a letter of intent prior to grant of recognition under Clause 7(9) of NCTE Regulations. Thereafter it issued a notice, for which the administrator of Karnataka University submitted a reply on 28-07-2009 stating that the University is in the process of appointing qualified staff to teach M.Ed. students. Meanwhile, some qualified and permanent teaching staff has been transferred from Dharwad to Belgaum. Despite this reply, SRC decided to refuse recognition on the grounds as stated in Para 1 above. (b) The Council further noted Kittur Rani Channamma P.G. Centre, Belgaum was upgraded to the status of an independent University under the name Rani Channamma University, Belgaum from 2010 onwards. The Rani Channamma University, being the successor institute of the earlier P.G. Centre, pursued the matter of M.Ed. recognition and filed an appeal. The delay caused in filing the appeal was due to upgradation of PG centre into university, which was a valid reason for condoning the delay caused in preferring the appeal. (c) The university had taken steps to appoint full complement of the faculty for teaching M.Ed. students.

The Appellate authority therefore came to the conclusion that there was adequate justification in accepting the appeal with a direction to the SRC for considering the faculty profile of the institution and for taking further decision thereafter. The institution is advised to forward a complete set of faculty profile as required under NCTE Norms, for consideration of SRC.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the SRCs order dated 24-09-2009 vide appellate authority order No.89-361/2011 Appeal/8th Meeting/2011/A46189 dated 04/01/2012 with a direction to the SRC for considering the faculty profile of the institution and for taking further decision thereafter. The institution is advised to forward a complete set of faculty profile as required under NCTE Norms, for consideration of SRC.

The institution has not submitted Faculty profile to this office so far(as advised in the appeal order). The appeal committee advised the University to forward reply to the show cause notice of SRC for consideration vide its order dt. 04.01.2012.

The SRC in its 217th meeting held on 8-9 February, 2012 considered the Appellate authority order dt. 04.01.2012 and decided to await for the reply from the institution till 45 days and then process the reply of the institution to the show cause notice for further action.

But, so far, faculty profile is not received and no reply in this regard is received from the institution.

Hence, as per the decision of 217th meeting of SRC and since 45 days is over and faculty profile is not received from the institution, the matter is once again placed before SRC for its consideration and decision.

The committee considered the matter and decided to close the file of M.Ed (APS08997) course applied by Kittoor Rani Chennamma PG College, Belgaum District, Karnataka for the time being, as the institution is yet to submit the faculty profile.

Pragathi D.Ed College, H.M.Nagar, Mudhol, Bagalkot District-587313, Karnataka has been granted recognition for offering D.Ed course with an intake of 50 students vide order dated 01.11.2007.

A letter dt. 18.06.2009 has been received from the Principal Secretary, Primary and Higher Education, Education Department, Government of Karnataka and has recommended SRC to withdraw the recognition granted to D.Ed college, as the institution is not maintaining Norms and Standards as prescribed by NCTE.

SRC in its 178th meeting held on 13-14 July 2009 considered the recommendation of the State Government of Karnataka regarding withdrawal of recognition to D.Ed college and decided to issue show cause notice. Accordingly, show cause notice was issued to the institution on 12.08.2009. The institution submitted its written representation on 31.08.2009.

SRC in its 183rd meeting held on 22.09.2009 considered the written representation and decided to issue notice under section 17 of NCTE Act after submission of filled in Questionnaire along with documents. Accordingly, notice was issued to the institution on 11.11.2009. The institution has submitted its written representation on 03.12.2009.

SRC in its 188th meeting held on 28-29 January 2010 considered the written representation along with original file and other documents available and decided to withdraw the recognition for D.Ed course. Accordingly, withdrawal order was issued to the institution on 05.03.2010.

The Institution preferred appeal and the Appellate Authority has remanded back the case to SRC vide order dated 19.07.2010 and has stated that the institution may be allowed to shift to own premises by November 2010 and the appellant shall apply to the SRC for inspection of permanent premises well in advance along with the inspection fee and its requisite documents, so that shifting of the institution shall take place within stipulated period of 3 years.

The SRC in its 195th meeting held on 17- 18 August, 2010 considered the appellate authority order dated 19.7.2010 remanding the case to SRC for causing inspection of permanent premises and it was decided to cause inspection of the institution for B.Ed. Course, under Section 17 of NCTE Act, on payment of Rs.40,000/- inspection fee and on submission of filled in Questionnaire, along with relevant supporting documents relating to building, land, including Building Completion Certificate from the competent Government Engineer and Land Use Certificate. Accordingly, a letter was issued to the institution on 27.09.2010.

The institution has submitted written representation on 26.10.2010. Further, the institution has also not submitted Rs.40,000/- towards inspection fee and has requested SRC to provide 3 months time for inspection.

The SRC in its 198th meeting held on 24-26 November 2010 considered the matter and decided to cause inspection of the institution for shifting to new premises after submission of Rs. 40000/- towards inspection fee. The inspection was carried out on 24.03.2011. The inspection report has been received along with VCD.

The SRC in its 203rd meeting held on 31st March & 1st April 2011considered the VT report, VCD and all the relevant documentary evidences and decided to issue show cause notice. Accordingly, Show cause notice was issued to the institution on 09.05.2011. The institution has submitted its written representation on 09.06.2011.

The reply of the institution is not convincing and not satisfactory. On careful perusal of the original file of the institution and other related documents, Act of NCTE, 1993, regulations and guidelines from time to time laid on the table, written representation from the institution dt. 09.06.2011. The Regional Committee decided to withdraw the recognition of the institution for D.Ed (APS05203) course on the following grounds.

The management is requesting three more months time to complete the building. The photographs submitted clearly indicate/shows that the building is in initial state of construction, and the management has not honoured the commitment given to appellate authority that the building will be completed by Nov, 2010.

The management is running D.Ed programme. The total built up area as per VT report for D.Ed programme is 3289 Sq.ft. which is inadequate. As per the NCTE norms, 16,000 Sq.ft. built up area is required for D.Ed.

The Building Completion Certificate from a Competent Govt. Engineer in a prescribed format is not submitted.

Language learning lab is not available separately.

Science lab and Psychology lab needs to be strengthened.

Salaries are paid by cash and not through Bank.

The institution has not paid shifting inspection fee of Rs. 40000/-

Based on the above the committee decides to withdraw the recognition of the D.Ed (APS05203) course run by the Pragathi D.Ed College, H.M. Nagar, Mudhol, Baglkot District-587313, Karnataka, from the academic year 20112-13, so as to enable the ongoing batch of students to complete their final year course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was no ground to accept the appeal, accordingly, the appeal is rejected and SRCs order dt. 22.07.2011 is confirmed.

The committee considered the matter and noted the council order dt. 20/03/2012 and further decided to inform the affiliating body/examining body for necessary enforcement.

As per the directions given in SRC in its 175th meeting held on 13-14 May, 2009 the office of SRC has reviewed the files of the institution who have been granted recognition either in a rented premises pending construction of own building or in lease premises pertaining to the B.Ed course in the State of Karnataka.

A list of such institution has been prepared and placed before SRC in its 176th meeting held on 27-28 May, 2009 it was decided that the institution which have not shifted to the permanent premises even after the expiry of three years time limit be issued notice.

As per the decision of SRC Notice was issued to the institution on 01.09.2009.

As the institution did not care to respond to the notice issued on the institution, for their failure to shift to permanent premises, even after the lapse of three years stipulated period permitted in their conditional orders of recognition and the matter was placed before SRC. The SRC in its 196th meeting held on 15-16 September 2010 considered the matter and decided to issue Showcause notice. Accordingly, Showcause notice was issued to the institution on 27.10.2010.

Again the institution did not care to respond to the showcause notice issued on the institution even after lapse of four months.

The Committee considered the non-reply to the Notice, VT Report, VCD and all the relevant documentary evidences and it was decided to serve Final Showcause Notice Under Section 17 of NCTE Act for the following :

1. Demand Draft of Rs. 40,000/- towards inspection fee in favour of The Member Secretary NCTEPayable at Bangalore should be submitted.

2. Land documents of the new building/location for having own land in the name of the institution/Society/Trust.

3. Building Plan of the new building duly approved by th Government authority.

4. Building Completion Certificate from the Government authorities in the prescribed format(Format enclosed).

5. Land Usage Certificates from the concerned Government authorities stating that the land is exclusively permitted/ sanctioned for Educational Purposes only should be submitted.

6. Encumbrance certificate from the competent Government authority should submitted.

7. Fix Deposit Receipt of Rs. 5 lakhs kept in JOINT ACCOUNT with SRC in Nationalised Bank for a period of 5 years towards Endowment Fund in ORIGINAL should be submitted

8. Fixed Deposit Receipt of Rs. 3 lakhs kept in JOINT ACCOUNT with SRC in Nationalised Bank for a period of 5 years towards Endowment Fund in ORIGINAL should be submitted.

9. Certificates of Resgistration/ Bye-law of the Society/Trust should be submitted.

10. The Affidavit in Rs. 100/- stamp paper in the prescribed format with Notary attestation.

The committee considered the non-reply to Showcause Notice by the institution and decided to withdraw recognition for B.Ed course (APS03935) with effect from 2011-12, in order to enable the ongoing batch of students in B.Ed course, if any, to complete their course.

The institution was granted recognition on 22.11.2005 with an intake of 50 students. Further, the institution has submitted application for D.T.Ed-AI on 29.12.2005. The institution was grated recognition on 13.11.2006 with an intake of 50 students, thus making an annual intake of 100 students, which includes the existing intake of 50 and additional intake of 50 students, with the condition to shift to own premises within 3 years.

The institution has submitted its written representation on 20.10.2010 for shifting of premises along with D.D of Rs.40,000/-.

The SRC in its 198th Meeting held on 24th-26th November 2010 considered the written request and other documents submitted by the institution and decided to cause composite inspection at the new premises Under Section 17 of NCTE Act. The institution was directed to submit within 30 days of the receipt of the notice, Duly filled in Questionnaire along with all the necessary documents for land, building approval and completion certificate from a competent Govt. Engineer, FDRs for Rs. 5 lakhs and 3 lakhs and other relevant documents.

Accordingly, a letter was issued to the institution to submit the documents on 06.01.2011.

Accordingly the inspection of the institution was fixed between 1th-6th March 2011. The same was intimated to the institution on 11.02.2011. Accordingly shifting inspection of the institution was conducted on 21.04.2011.

The institution is also running B.Ed., Course (APSO3621).

The SRC in its 205th meeting held on 18-.19 May 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly, a Show cause notice was issued to institution on 27.06.2011. The institution has submitted its reply on. 27.07.2011.

1)The Committee considered the reply of the institution dt. 27.07.2011, VT report of the institution and all other related documents along with the original file of the institution and decided that shifting to new/permanent premises be permitted for B.Ed (APS03621) course only.

2) The Committee further considered the written reply of the institution dt. 27.07.2011 whih is unsatisfactory/unconvincing on the above matter and also the relevant documents of the institution and decided to withdraw recognition for the following reasons:-

The total Built up area earmarked for the D.T.Ed, D.T.Ed-Al & B.Ed programme is only 18500 Sq. ft. which is grossly inadequate for three courses as per NCTE norms. The same is also corroborated by the management by affixing signature of the management representative in the essential data.

The latest Building Completion Certificate from the competent Government Engineer is not submitted

FDRs for Rs. 5 lacs and 3 lacs towards Endowment and Reserve fund respectively from a Nationalised Bank in joint account to each of the course being run is to be submitted.

Notarised affidavit on Rs. 100/- stamp paper in the prescribed format is to be submitted for D.T.Ed course

The Sy.no. given in Building plan & BCC are not matching with land documents. This discrepancy may be explained.

Salary is paid by cash and not through Bank, Proof for salary paid through Bank by Cheque is to be produced

Land documents dt. 16.08.1989 & 24.07.1996 are not in the Name of Society/institution.

Based on the above points the committee decides to withdraw the recognition of the D.T.Ed (APS03620) & D.T.Ed-Al (APS05171) course run by the Wisdom Teacher Training Institute, Cheyyattraivendran, Cheyyar Taluk, Thiruvannamaalai District-604 401, Tamilnadu, from the academic year 2013-14, in order to enable the ongoing batch of students in D.T.Ed (APS03620) & D.T.Ed-Al (APS05171) courses, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The institution was grated recognition on 30.08.2006 with an intake of 50 students, thus making an annual intake of 100 students, which includes the existing intake of 50 and additional intake of 50 students, with the condition to shift to own premises within 3 years.

Al-Hidhaya Womens Teacher Training Institute, Tirunelveli District, Tamilnadu submitted application were granted recognition to D.T.Ed & D.T.Ed-AI course vide Orders dated 30.03.2005 & 30.08.2006 at 872, Aykudi Road, Vahini Building, Tenkasi, Tirunelveli-627811, Tamilnadu with the condition to shift to own premises within 3 years.

The institution vide its letter dated 28.09.2007 & 12.01.2009 submitted Rs.40000/- for shifting of premises at 2.8-77/2, College Road, (Via) Tenkasi-Elathur, Tirunelveli District-627803, Tamilnadu

Accordingly the shifting inspection of the institution was fixed between 7th-11th March 2011. The same was intimated to the institution on 04.03.2011. Accordingly inspection of the institution was conducted on 11.03.2011.

The SRC in its 203rd meeting held on 31st March & 1st April 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly, a Show cause notice was issued to the institution on

The management is running Two Teachers Training courses in the same building, and no earmarked built up area for each of the course/programme. The total built up area is 11241 sq.ft. which is inadequate for both D.T.Ed and D.T.Ed-Al Teacher Education Programmes as per NCTE norms. A total built up area of 21,000 Sq.ft is required for both D.T.Ed and D.T.Ed-Al.

Based on the above points the committee decides to withdraw the recognition of the D.T.Ed-Al (APS4422) course run by the Al-Hidhaya Womens Teacher Training Institute, No. 872, Aykudi Road, Vahini Building, Tenkasi, Tirunelveli-627811, Tamilnadu, from the academic year 2013-14, in order to enable the ongoing batch of students in D.T.Ed- Al (APS04422) course, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.

T.E. Thiyagaraja Pillai I.A.S (Rtd) Teacher Training Institute, KAP Visvanatham HR. SEC.School Campus, Thillainagar, Tiruchirapalli 620 018, Tamilnadu has submitted an application for D.T.Ed Course on 10.08.2005. The institution was granted recognition on 02.09.2006 with an annual intake of 50 students, with the condition to shift to own premises within 3 years.

The Ministry of Human Resource Development (MHRD), Government of India, based on the enquiry report submitted by Sri.Sathyam, IAS (Retd) has directed NCTE for taking action. In this regard, it has been envisaged that all the cases cleared by SRC in its 116th meeting held on 22-23 August 2006 should be re-inspected and the maintenance of Norms and Standards should be verified.

The above institution was one amongst 71 institutions which was granted recognition in the 116th meeting. Based on the directions of MHRD, inspection under section 17 of the above institution was carried out on 17.12.2008. The VT report, VCD, original application file along with other documents were placed before SRC in its 170th meeting held on 16-17 February 2009. SRC decided to issue notice under section 17 of NCTE Act. Accordingly, a final show cause notice was issued to the institution on 02.04.2009.

The institution has submitted its reply on 12.05.2009, the matter was considered by SRC in its 180th meeting held on 29th July 2010 and the Committee considered the above matter and decided to conduct inspection for shifting of premises to permanent building after submission of the requisite documents. Accordingly a letter was issued to the institution on 02.09.2010. The institution submitted its reply alongwith Rs.40000/- on 09.10.2009.

Meanwhile the institution vide its letter dated 20.12.2010 requested to give permanent approval for the existing place. The SRC considered the matter in its 200th meeting held on 20th-21st January 2011 and all relevant documents and decided to cause inspection to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme.

The shifting inspection of the institution was fixed between 14th-18th March 2011. The same was intimated to the institution on 03.03.2011. Accordingly inspection of the institution was conducted on 16.03.2011.

The SRC in its 203rd meeting held on 31st March & 1st April 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly show cause notice was issued to the institution on 05.05.2011. The institution submitted its reply on 02.06.2011.

The SRC in its 206th meeting held on 9-10 June 2011 considered the VT Report, reply of the institution vide letter dt.02.06.2011 and all the relevant documentary evidences and it was decided to serve Final Show cause Notice under Section 17 of NCTE Act. Accordingly, a Final Show cause notice was issued to the institution on 04.07.2011. The institution has submitted in its reply on 22.08.2011 and 13.10.2011.

The Committee considered the reply of the institution dt. 22.08.2011 & 13.10.2011, the following deficiencies are still persists and the reply is not satisfactory/not convincing, and it was decided to withdraw recognition for the following reasons:

The land is not registered in the name of the institution/trust. The lease deed is in favour of individual by name K.A.P. Vishwanathan correspondent of a H.R. Secondary School running in the same building/campus. Which is against the NCTE norms of 2009.

The management has not submitted the building plan approved by the Competent Government Authority. The survey nos are not mentioned in the building plan.

Non-encumbrance certificate from competent Govt. authority is not submitted.

The Committee considered the reply of the institution and decided as the case abounds in infirmities. Land is not belonging to the Society. There is no proof of the building plan being approved by the corporation. Non-encumbrance certificate is not certified by the competent Govt. authority. The institution is not serious enough to reply to the many show cause notices issued.

Taking all these pointes into account the recognition given is withdrawn with immediate effect.

Based on the above grounds. the committee decides to withdraw the recognition of the D.T..Ed course (APS04408) run by T.E. Thiyagaraj Pillai I.A.S (Rtd) Teacher Training Institute, K.A.P.Visvanatham, H.R. SEC. School Campus, Thillainagar, Tiruchirapalli620 018, Tamilnadu from the academic year 2012-13, in order to enable the ongoing batch of students in D.T.Ed course, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order for B.Ed courses.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore if any, when all the admitted students complete their course.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was no ground to accept the appeal, accordingly, the appeal is rejected and SRCs order dt. 22.12.2011 is confirmed.

The committee considered the matter and noted the council order dt. 20/03/2012 and further decided to inform the affiliating body/examining body for necessary enforcement.

BTK B.Ed College of Education, Ramanathapuram, Palaghad Road, Mannur Post, Pollachi Taluk, Coimbatore District, Pin-642005, Tamilnadu had submitted an application for B.Ed Course on 08.08.2005. The institution was granted recognition on 12.09.2006 with an annual intake of 100 students, with the condition to shift to own premises within 3 years.

Honble high Court of Madras in W.P.24370 to 24374 of 2005 have directed NCTE to cause inspection within a period of 3 months. Accordingly, inspection of the institution was carried out on 22.11.2005.

SRC in its 105th Meeting held on 2-3 December, 2005 considered the report and decided to issue notice to the institution. Accordingly, a notice was issued on 13.12.2005. The institution submitted its reply on 22.12.2005.

The reply was considered by SRC in its 107th Meeting held on 27th December 2005 and it was decided to reject the proposal. Accordingly, Refusal order was issued to the institution on 20.01.2006.

Further, the institution reply to the Notice on 23.01.2006 and requested to reconsider the earlier decision of the committee to reject the proposal and pass fresh orders.

The matter was again placed before SRC in its 109th meeting held on 2nd February, 2006 and advised the institution to prefer appeal under section 18 of NCTE Act.

Accordingly, the applicant institution preferred an appeal under Section 18 of NCTE Act, before Appellate Authority, NCTE, New Delhi. The Appellate Authority considering the appeal passed an order vide.F.No.89-36/2006 dated. 24.05.2006 remanded back to SRC to cause inspection.

As per the decision the re-inspection was conducted on 14th and 16th August, 2006. SRC in its 116th meeting held on 22-23 August, 2006 and it was decided to grant recognition from the academic year 2006-2007.

Accordingly, a recognition order was issued to the institution on 12.09.2006.

In the 181st Meeting of SRC held on 20-21 August, 2009 it was decided that the institution which have not shifted to the permanent premises even after the expiry of 3 years time limit be issued notice under section 17 of NCTE Act for further action.

As per the decision of SRC, a notice under section 17 was issued to the institution on 11.09.2009.

The reply in response to notice dated 11.09.2009 was not received instead the institution vide its letter 22.2.2010 had requested to grant another 3 years time from 2010-11 upto 2012-13 to conduct the course in temporary rented building. The institution has stated that it has purchased own land for the college and it needs time to construct new building.

Meantime, NCTE-Hqrs in its letter dated 05.04.2010 has forwarded written representations of various institutions from the State of Tamilnadu requesting for extension of period for shifting to the old premises after expiry of 3 years.

NCTE-Hqrs had requested to furnish the details of these colleges and action taken by SRC against these representations.

The matter was considered by the SRC in its 193rd meeting held on 21-22 June 2010 and decided to withdraw recognition to the institution for the following:-

The institution was given recognition on 12.9.2006 in a temporary premises with a specific condition that the institution should move to a permanent premise within a period of three years i.e., on or before 11.9.2009. Notice was served on 11.9.2009 for which the College has not replied inspite of several reminders.

The institution, after the lapse of three years stipulated period, now gives a representation that it has purchased the land only now, and the plan for actual construction is yet to commence. As per the approved norms and regulations, the institution should have possessed the land at the time of original application itself; purchase of land only now, after a lapse of three years is a serious violation of norms, involving suppression of facts.

The institutions request for extension of time by another three years which only means that it is not serious in its efforts to move to a permanent premise, extension of time in this regard cannot be granted as per the regulations of NCTE.

The institution was given notice under Section 17 on a complaint made by the State Government regarding infrastructural deficiencies and violation of norms and standards, for which the institution did not care to respond.

As the institution itself had admitted in writing that it has purchased the land only now and that it needs three more years time for construction, there was no need for any further notice / explanation from the institution.

Under the above grounds, the Committee decides to withdraw the recognition for B.Ed. course, with immediate effect. But, it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order. The State Government and the affiliating University be informed accordingly for necessary enforcement.

Accordingly, withdrawal order was issued to the institution on 09.09.2010.

The institution preferred appeal to NCTE, Hqrs and the Appellate Authority vide order dt. 20.03.2012 has stated as follows:-

the reasons adduced by the appellant for condonation of 9 months and 3 days delay was not justifiable and hence it decided not to condone the delay and admit the appeal.

The Council hereby decided to accept the reasons for condonation of delay, and admit the appeal.

After perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council concluded that the reasons adduced by the appellant for condonation of 9 months and 3 days delay was not justifiable and hence it dcecided not to condone the delay and admit the appeal.

The committee considered the matter and noted the council order dt. 20/03/2012 and further decided to inform the affiliating body/examining body for necessary enforcement.

Mother Teresa College of Education, Warangal District, Andhra Pradesh.

An application was submitted by Mother Teresa College of Education Yellanndu Road, Mahabubabad, Warangal-506101, Andhra Pradesh, for grant of recognition to D.Ed course in the office of SRC-NCTE, Bangalore vide dated 30.01.2004 under NCTE notification dated 05.01.2004 dispensed with the requirement of NOC of the State Government from the institutions running B.Ed college and invite applications for D.Ed course from different institutions for grand of recognition to Elementary Teacher Education courses under Sarva Shikshana Abiyan (SSA).

Your application was under process and in the meanwhile, the Government of Andhra Pradesh of Hyderabad filed a Writ Petition No.22866 of 2005 in the Honble High Court of Andhra Pradesh of Hyderabad challenging the Notification of NCTE with regard to the dispensing with the requirement of NOC from the State Government. The writ petition was allowed by the learned single judge with the directions that the rule excluding the State Government is bad. Against said judgment a Writ Appeal No.692 of 2006 was filed in the Division Bench of Honble High Court of Hyderabad. Many discussions took placed between the State Government of Andhra Pradesh and SRC-NCTE. However, neither State Government withdrew the case filed by them nor the stay has been vacated.

Some institution went to the Court and filed writ petitions individually, seeking directions for processing of their applications, in one of such Writ Petition No.8278 of 2008. The Honble High Court decided that the application of the institutions shall be processed as per the NCTE rules and regulations norms and standards existing as on date.

As per the direction of Honble High Court and decision of SRC for processing of pending D.Ed application as per new regulation of NCTE in its 164th meeting held on 20th September 2008, the SRC started to process the applications.

In view of the above decision, a deficiency letter was issued to the institution vide dated 01.10.2008 followed by a reminder dated 04.12.2008 directing to submit following documents within a period of 90 days as per Section 7(1) of the NCTE Regulations 2007:

Land document on ownership basis having minimum 2500 Sq.Mts area with its English Translation attested to be true copy.

Building plan in original duly approved by the competent authority mentioning Sy.No/Plot no on the land mentioned in point No.1 above.

Building Completion Certificate approved by competent authority stating the location of building, Sy.No, total build-up area.

Land Use Certificate from the Government Authority along with encumbrance certificate.

Original Affidavit relating to details of land possessed on Rs.100 stamp paper attested by Notary Public in the enclosed format.

Fixed deposit receipt (FDR) for Five Lakhs from Nationalized Bank submitted should be for current year.

As per para 9(1) of Regulations there shall be a Endowment fund of 5.00 Lakhs per course per unit in the form of a Fixed Deposit of a duration of and above 5 years of a nationalized bank

Fixed deposit receipt (FDR) for Three Lakhs from Nationalized Bank submitted should be for current year.

As per para 9(1) of Regulations there shall be reserve fund of Rs.3.00 Lakhs per course per unit in the form of a Fixed Deposit of a duration of and above 5 years of a Nationalized bank.

SRC in its 135th meeting held on 7th-8th June 2007 decided to treat the application which have not submitted compliances as closed after the expiry of 90 days of time as per the regulations of NCTE, 2005. A letter dated 31.10.2008 has been issued but no reply has been received from the concerned institution within 90 days may also be closed, in terms of section 7(1) of the NCTE Regulations.

The institution has failed to submit the reply within 90 days. After consideration of facts and also non-submission of reply to the deficiency letter within the stipulated time, it is decided to close the application. Accordingly the application submitted by Mother Teresa college of Education, Yellandu Raod, Mahabubabad, Warangal- 506 101 , Andhra Pradesh was closed vide order dtd.04.03.2009.

In the Meantime the institution has filed a Court case in the High Court of Andhra Pradesh at Hyderabad vide Writ Petition No. 7409 of 2011 against the order dtd.04.03.2009 issued by NCTE-SRC closing the application.

The Honble High Court of Andhra Pradesh at Hyderabad has passed an order dt. 13.07.2011 pertaining to Writ Petition No. 7409 of 2011 filed by Mother Teresa Educational Society. The details of order is mentioned below:

The short prayer made by the petitioners in this Wirt Petition is that may permitted to file applications before the respondent seeking relaxation of the cut-of date for compliance of the deficiencies as prescribed under Regulation 7 of the NCTE Regulations, 2009.

After hearing the learned counsel for the petitioners, I am of the considered opinion that no prejudice would be caused to either of the partners in case of petitioners are permitted to file applications seeking more time to do away with the deficiencies.

In view of the above, the petitioners are permitted to move the applications as prayed for under Regulation 11 of the NCTE Regulations , 2009. In case the applications are filed , the same shall be considered within a period of four (4) weeks thereafter.

The Writ Petition is, accordingly, disposed of. There shall be no orders as to costs.

The institution vide letter dtd.30th July 2011 has submitted the copy of the Court order and other documents. Reply to the deficiencies pointed in the closure order dtd. 04.03.2009.

The committee considered the reply of the institution and also Judgment dated 31.01.2011 of the Honble Supreme Court of India in the matter of Bhanwar Kanwar Singh Shiksha Mahavidyalaya and others Vs NCTE, which is relevant in this regard as it insists on ensuring adherence to NCTE Act & Regulations before the cut off dates.

It was decided to reiterate that as per the NCTE Regulations of 8(7) (1) the institution/society sponsoring the institution shall be in possession of required land on the date of application.

The committee considered the reply of institution dt. 30.07.2011 and decided to refuse the recognition of the institution on the ground that the sale deed of the land documents dt. 16.07.2004 & 8.12.2004, both are after the date of application i.e,30.01.2004.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was no ground to accept the appeal, accordingly, the appeal is rejected and SRCs order dt. 17.11.2011 is confirmed.

The committee considered the matter and noted the council order dt. 20/03/2012 and further decided to inform the affiliating body/examining body for necessary enforcement.

Hindi Shikshak Prashikshan Mahavidhyalay, Karimnagar District, Andhra Pradesh was granted recognition for offering H.P.T Course with an intake of 60 students vide order dated 17.09.2001.

An application was submitted by Hindi Shikshak Prashikshan Mahavidyaalay, Karimnagar District, Andhra Prades for grant of recognition to H.P.T ,course in the office of SRC-NCTE, Bangalore on 09.04.1999.

The application was processed as per the provisions contained in Rules and Regulation, Norms and Standards vogue at that point of time and the recognition was granted to the institution vide order dt 17.09.2001 with stipulated conditions.

The institution in its letter dated 28.12.2008 has submitted proposal for shifting the H.P.T course to the new location. With D.D of Rs 40,000/- vide no-630787 dated 24.06.2009. Inspection of the institution was conducted on 08.02.2011.

The Committee considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly Show Cause Notice was issued to the institution on 07.07.2011. The institution has submitted its written representation along with relevant documents on 30.07.2011 received on 04.08.2011.

The Committee considered the written reply of the institution dt. 30.07.2011 on the above matter and also the relevant documents of the institution and decided to withdraw recognition as the reply is unsatisfactory & unconvincing for the following reasons:-

As per BCC report, 713.33 sq.mts of the building is roofed with AC sheets

As per the records submitted by the management, the land is on a private lease deed for 30 years in individual name executed on 19.03.2008, and private lease in the individual name is not acceptable, and against the norms of NCTE.

The Affidavit on Rs. 100/- stamp paper in the prescribed format with notary attestation is to be submitted.

The institute has not submitted the Land usage certificate from a competent Govt. authority.

FDRs for Rs. 5 lacs and 3 lacs towards endowment and reserve fund respectively in joint account from a Nationalised Bank is to be submitted

Salaries are paid in cash instead of through Bank.

Based on the above points the committee decides to withdraw the recognition of the B.Ed (AOS00266) course run by the Hindi Shikshak Prashikshan Mahavidhyalay, Karimnagar District, Andhra Pradesh from the academic year 2012-13, in order to enable the ongoing batch of students in B.Ed, course, if any, to complete their course.

But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body be informed accordingly.

Further decided to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore, if any.

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was no ground to accept the appeal, accordingly, the appeal is rejected and SRCs order dt. 15.11.2011 is confirmed.

The committee considered the matter and noted the council order dt. 20/03/2012 and further decided to inform the affiliating body/examining body for necessary enforcement.

Application was processed and recognition to the institution was granted on 20.01.2006 at No.113/53, Angappa Naicken Street, Chennai-600001, Tamilnadu.

Meanwhile the institution vide letter dated 16.09.2009 intimated the office about shifting of Measi College of Education to the newly constructed building at No.2, Demellows Road, Chennai-112. The institution vide letter dated 24.02.2010 submitted application for shifting of B.Ed and D.T.Ed course to new building along with Rs. 40000/- for each course.

The inspection of the institution for shifting of premises was conducted on 16.09.2010. The Committee in its 197th meeting held on 13th-14th October 2010 considered the VT Report and all the relevant documentary evidences and it was decided to serve Showcause Notice Under Section 17 of NCTE Act for the following -

The earmarked area as provided in Essential data and countersigned by the management for B.Ed course is 13004 Sq.ft. which is inadequate as per NCTE Norms.

The total Built up area available for both D.Ed. and B.Ed is 18554 Sq.Ft. which is far less than the requirement of 27,000 Sq. Ft. as per NCTE Norms.

To produce the latest Building Completion Certificate from the competent Government Engineer,

Accordingly, show cause notice was issued to the institution on 10.12.2010 to submit reply within 30 days.

The reply from the institution has not been received even after a lapse of time period of more than 30 days.

The SRC in its 200th meeting held on 20-21 January 2011 considered the VT Report and other relevant documents, and non-reply of the institution to the Show Cause Notice and decided to withdraw the recognition for the following reasons:-

The institution has not cared to reply to the show cause notice issued vide letter dt. 10.12.2010 under section 17 of NCTE Act, for the deficiencies pointed in the notice.

The earmarked area as provided in Essential data and countersigned by the management for B.Ed course is 13004 Sq.ft. which is inadequate as per NCTE Norms.

The institution has submitted Building Plan which is not approved for the location and Sy.No not mentioned.

The management has not submitted the building plan approved by the Competent Government Authority.

The management has not produced the latest Building Completion Certificate from the competent Authorised Government Engineer.

The total Built up area available for both D.Ed. and B.Ed is 18554 Sq.Ft. which is far less than the requirement of 27,000 Sq. Ft. as per NCTE Norms.

Accordingly, order withdrawing recognition has been issued to the institution on 03.03.2011.

The institution preferred appeal and the appellate authority vide order dated 06.07.2011 has confirmed the withdrawal orders of SRC.

Aggrieved by the order of the appellate authority, the institution filed W.P.17997 and 17998 of 2011 and the court has passed judgment dt.12.08.2011 which reads as under:

. The matter remitted back to the second respondent (SRC,NCTE) to consider the request of the petitioner in all relevant facts and pass fresh orders within a period of three weeks from the date of receipt of copy of this order.

Accordingly, the matter was placed before 210th meeting held on 22-23 August 2011 and the matter was deferred.

As per the directions of the Honble High Court the institution has submitted its written representation on 05.09.2011 and has stated that copies of the Building plan of the new premises is duly approved by the corporation of Chennai. The Building plan clearly shows the total constructed area, which is more than sufficient for running both B.Ed and D.T.Ed courses.

The institution has submitted vide letter dt. 05.09.2011 the Building plan approved by The Commissioner, Corporation of Chennai for the proposed Measi College of Education at Door no.2, Demellows Road, Choolai, Chennai-600112, in R.S. No. 1290,1294,1296/2,1297,1298,1299,1295 (New No. 1289/17, Old R.S. No. Patta: 1289/13), Vepery Division, Block No.34, Chennai Fort-Tondiarpet Taluk with total plot area of 23354 sq.ft and 2170 sq.mts, as per patta is 22913.01 sq.ft and 2129 sq.mts. Total built up area is 28211.48sq.ft and 2621.88 sq.mts.

The SRC in its 211th meeting held on 21-23 September 2011 considered the matter and decided to comply with the court order on receipt of any fresh submission from the institution and the reply of the institution be processed.

Since the court has ordered to dispose the case by considering the request of the petitioner in all relevant facts and pass fresh orders within a period of 3 weeks and in obedience with the court the institution has already submitted the reply and the same was also placed before 211th meeting.

The Committee considered the request of the institution, Court order and decided as the case abounds in infirmities. There is no proof of the building plan being approved by the corporation. There is also no proof that the building has been constructed as per the plan. The building has not been approved for the location in reference. In the (so-called) approval, Survey nos have not been mentioned. The building completion certificate issued by a Chartered Engineer and not a Govt. Engineer as required in the Guidelines.

Taking all these pointes into account the recognition given is withdrawn with immediate effect.

The Committee in it 212th metting hled on 24th Oct 2011 iconsidered the reply of the institution dt. 02.09.2011, direction of Honble High court of Tamilnadu and processed the reply of the institutin and the following deficiencies are still persists and it was decided to withdraw recognition from the academic year 2011-12 om prder tp eab;e the pmgpmg batch of students in B.Ed course, if any, to complete their course for the following reasons:

The earmarked area as provided in Essential data and countersigned by the management for B.Ed course is 13004 Sq.ft. which is inadequate as per NCTE Norms.

The institution has submitted Building Plan which is not approved for the location and Sy.No not mentioned.

The management has not submitted the building plan approved by the Competent Government Authority.

The total Built up area available for both D.Ed. and B.Ed is 18554 Sq.Ft. which is far less than the requirement of 27,000 Sq. Ft. as per NCTE Norms.

Accordingly, withdrawal order was issued to the institution on 02.12.2011.

The institution vide its letter dt. 11.11.2011 had submitted DD No. 193096 dt. 05.11.2011 for Rs. 40000/- and DD No. 193095 dt. 05.11.2011 for Rs. 40000/- for B.Ed and D.T.Ed course.

The institution preferred an appeal to NCTE, Hqrts and the Appellate Authority vide order dt. 20.03.2012 .

After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate justification in remanding the case to the SRC for causing re-inspection of the institution for both B.Ed and D.T.Ed courses and for taking further decision thereafter.

The committee considered the Council order dt. 20/03/2012 and other relevant documents and decided to cause composite re-inspection (for B.Ed & D.T.Ed) to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, under Section 17 of NCTE Act.

3 The SRC considered the matter in its 202nd meeting held on 14th-15th March 2011 and on careful perusal of the original file of the institution and other related documents, NCTE Act 1993, Regulation and guidelines issued from time to time laid on the table, written representation from the institution, the Southern Regional Committee decided to reject the application on the following grounds:-

The instruction has not submitted the Minority Certificate issued by competent authority.

As per Building Completion Certificate it is having asbestos sheet on 3rd floor.

4 Therefore the application of Christ Dogga Surinaidu D.Ed College, Plot No. 388/348 & 35, Village- George Town, Post- Kottavalasa, Taluka- Kottavalasa, Dist- Vizianagaram, Andhra Pradesh for permission to D.El.Ed Course has been rejected order was issued on 11.04.2011. The original FDR No. 0037436 dated 29.03.08 of 5 lakhs issued by State Bank of India and FDR No.0040787 dated 25.09.10 of 3 lakhs issued by State Bank of India are returned harewith.

The Institution preferred an appeal at NCTE Hqrs. Wherein NCTE Hqrs has directed in the order F.No.89-312/2011/ Appeal/6th Meeting/2011 dt. 28.10.2011 as under:

After perusal of documents, memorandum of appeal, and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the SRCs order dated 11/04/2011 with a direction to SRC to verify the minority status of the institution from the Competent Authority in the State under the National Commission for Minority Educational Institutions Act, 2004 and thereafter process further as per Regulations. Accordingly, the appeal is accepted and the order of SRC dated 11/04/2011 is reversed.

As per the Appeal order SRC has to verify minority status from competent authority and thereafter process further. As such a letter has been addressed to the Minority Welfare Department. The reply of the same may be awaited.

The Committee considered the matter and decided to process the application on the direction of Appellate order dt. 28/10/2011, on submission of Minority status of the institution from the competent authority in the State under the National Commission for Minority Education Institutions Act, 2004, original application and related supporting documents within four weeks from the date of confirmation of the Minutes.

Accordingly, a letter was issued to the institution on 03.02.2012.

The institution has submitted its written reply on 13.02.2012.

The Committee considered the reply of the institution dt. 13.02.2102 and all the relevant documentary evidences and it was decided to serve Final Show cause Notice under Section 14(1) of NCTE Act, for the following:

The institution has not submitted the original application and related documents as sought.

In the building completion certificate submitted, type of roof not mentioned for the 2535.11 sq.mtrs of built up area shown & for the 599.37 sq.mtrs of built up area is covered with asbestos sheet, which is not permissible as per NCTE regulations 2009.

The institution has not submitted valid minority certificate issued by the competent authority from the State Govt. as B.Ed is banned in the State of Andhra Pradesh.

In view of the above and with reference to the totality of information collected & based on a collective application of mind, the Committee decided to issue a Final Show cause Notice to the institution as to why the recognition be not refused and thereby providing an opportunity to the institution to make a written representation within 21 days from the date of issue of the Notice along with necessary certificates/documents in order to take a final decision in the matter; failing which action will be taken including the refusal & rejection of application for recognition, based on the records available, with no further notice

Golkonda Educational Society Plot No.12-5-92/1 Ganesh Nagar, Siddipet village and Post Office, Medak- 502 103, Andhra Pradesh has submitted an application for grant of recognition to Siddipet College of Education, Plot No. 1381, Prasanth Nagar, Siddipet, Medak-502103, Andhra Pradesh for B.Ed Course online on 28.9.2010 and hard copy received on 30.9.2010.

The Application was scrutinized and a copy of application was sent to State Government for recommendation on 30.10.2010/02.02.2011. A deficiency letter was issued to the institution on 09.12.2010.The inspection of the institution was conducted on 01.04.2011.

The Southern Regional Committee in its 204th meeting held on 27th and 28th April, 2011 considered the VT report, VCD and all the relevant documentary evidences and it was decided to serve show cause notice for the following:

Building Completion Certificate from Competent Government Engineer is to be submitted.

From VCD observation, it is observed that the building is incomplete and still under construction at the time of application/inspection/visit.
