To adopt a systematic, comprehensive and ecological solid waste management program which shall:1. ensure the protection of public health and environment;2. ensure the proper segregation, collection, transport, storage, treatment and disposal of solid waste;3. encourage greater private sector participation in solid waste management.

Role of the Municipality in Solid Waste Management as per RA 9003

-Primarily responsible for the implementation and enforcement of the provisions of Republic Act No. 9003 otherwise known as the “Ecological Solid Waste Management Act of 2000”

-Segregation and collection of solid waste shall be conducted at the Barangay level specifically for biodegradable, compostable and reusable wastes

-Provided, That the collection of non-recyclable materials and special wastes shall be the responsibility of the municipality

Recovery c. Collection and Transportation d. Disposal of Solid Wastese. Facilities and Equipment

A.Waste Segregation and Storage

All must segregate their generated solid wastes into four categories:

 1. Biodegradable/compostable2. Non-biodegradable recyclable 3. Non-biodegradable non-

recyclable4. Special and hazardous wastes

• Head of institutions must choose proper receptacle such as cans, sacks, bags, binds, etc. that will facilitate sanitary, efficient handling, storage, collection, transport or disposal at less cost. Food wastes must be placed in hard plastic containers/pails or pit.

•The use of non-biodegradable (non-recyclable) disposable materials (e.g. plastic-based, styro-based) must be minimized, if not eliminated.

•The use of biodegradable food liners, wrappers and containers must be maximized.

•Public thoroughfares and grounds in front of or within the vicinity of residential houses must be kept clean and tidy by the owner/occupant of the house, dwelling or building at all times.

•Trees, shrubs or other vegetation within the vicinity or residences must be regularly cared for and maintained to minimize generated wastes and unpleasant sight.

•The use of biodegrable wrappers or bags (e.g. for dry goods/products, paper based wrappers) must be maximized.

•The use of plastic, plastic-based and other non-biodegrable food receptacles (e.g. styrofoam) must be minimized, if not eliminated, subject to the regulations set forth by the Board.

•The use of plastics, styrofoams, and the like that are being used as food and product packages is prohibited except when the use of said non-biodegrable materials is necessary and appropriate as may be determined by the Board.

•All food chains, restaurants, eateries, supermarkets, markets, department stores, hardwares, wholesale/retail stores and other commercial and business establishments are given six (6) months to dispose all of their stocks of plastics, styrofoam, and the like that are being used as food and products packages and shall be replaced by environmental friendly materials such as paper plates, paper bags, paper cups, paper food packs and other similar biodegrable materials.

B. Waste Processing and Resource Recovery

Institutional establishments shall adopt appropriate resource recovery and recycling strategies.

Food and kitchen refuse may be utilized as animal feeds. Reuse of non-biodegradable recyclable wastes must be maximized.

C. Collection and Transportation• The owner/operator must be responsible

for the timely positioning of stored segregated solid wastes during collection period.

•Specific date and hour of waste collection shall be prescribed by the Board.

•Unsegregated wastes shall be treated as “DISPOSED OF” and in violation of antilittering provision of this Code and must be penalized accordingly.

D. Disposal of Solid Wastes

There shall be a system of proper disposal of solid wastes for residential areas in the following manner:

•Where space is available, all discarded biodegradable must be properly

processed/composted for use as fertilizer or soil enhancer. Residuals of solid waste after resource recovery, recycling and composting shall be disposed of in accordance with the provisions of this Code;

•Hospital, laboratory, pharmaceutical, funeral wastes, and the like must be stored, collected, transported, and disposed of in accordance with the guidelines, rules and regulations of the Department of Health (DOH). Refer to the Manual on Hospital Waste Management, PD 856, otherwise known as the Sanitation Code of the Philippines;

Material Recovery Facility (MRF). This shall serve as the facility for the storage, processing and trading recyclables from institutions and commercial establishments. Discarded materials (Residual/Non-recyclable) shall be regularly collected and disposed of at the sanitary landfill.

E. Facilities and Equipment

ENFORCEMENT COMPONENT

AND PENALTY PROVISION

Solid Waste Management Enforcers

•Regular Enforcers – SWM Board, Sanitary Inspector, Municipal Agriculture personnel, Municipal Health Office personnel

•Auxiliary Enforcers – Punong Barangay, Sangguniang Barangay, Sangguniang Kabataan, Barangay Tanods, Barangay Solid Waste Management Committee, and Barangay Health Workers

•Deputized Ecological-Aides and Traffic Aides – There shall be a Deputized Ecological-Aides and Traffic Aides to be appointed by the Mayor upon the recommendation of the Solid Waste Management Board

Prohibited Acts

•Bringing out of waste outside the scheduled day/time of collection.

•Littering, throwing, dumping of waste in the streets, highways, roads, and any other public areas and immediate surroundings, including vacant lots, water ways or any place not otherwise designated as dump site or disposal area. Hanging garbage on trees fences and gates.

•The open burning of solid waste.

•Open dumping, burying of biodegradable or non-biodegradable materials in flood-prone areas.

•Causing or permitting the collection of non-segregated or unsorted waste.

•Undertaking activities or operating, collecting or transporting equipment in violation of the Waste Collection Truck Standards as set forth in or established pursuant to the Code .

•Squatting in controlled dumpsite or sanitary landfill .

•Unauthorized removal of recyclable material intended for collection by authorized persons.

•The mixing of source-separated recyclable material with other solid waste in any vehicle, box, container or receptacle used in solid waste collection or disposal

•Non-compliance or in violation of any provision of this Code not specifically provided above shall be penalized by a fine in the amount of not less than P1,000.00 but not more than P2,000.00 or by imprisonment not less than 3 months but not exceeding 5 months, or both.

•Violation and non-compliance to Rules and Regulations issued by the Board in the enforcement and implementation of this Code shall be penalized by a fine of not less than P500.00 but not more than P2,000.00 or imprisonment of not less than 5 days but not more than 1 month, or both, depending upon the gravity of the infraction committed.

COLLECTION AND DISPOSITION OF FINES

•Violator shall be issued with a Citation Ticket by the Solid Waste Management Enforcers.

•The payment of fines for violation of this Code shall be made at the Municipal Treasurer’s Office.

The fines collected in violation of this Code shall be disposed as follows:

•50% to the Municipality of San Nicolas as special fund to be called as Environment Trust Fund to be expended for the implementation of this Code and related Ecological and Environment Ordinances;

•15% to be given as incentive to the group of SWM Enforcers who apprehend the violator;

•35% to the respective barangay where the violation was committed to be expended for the implementation of this Code and related ecological and environmental ordinances.
