Internal Resettlement Monitoring Report for the Quarter October - December 2015

1. LAND ACQUISITION AND RESETTLEMENT PLAN (LARP)

The project is category B for i volu tary resettle e t a d category C for i dige ous people. Draft Land Acquisition and Resettlement Plan (LARP) for New Khanki Barrage was prepared and

submitted to ADB for approval. ADB cleared the draft LARP on July 07, 2012. LARP was revised/

updated and cleared by ADB in Feb 2014. Land Acquisition is in progress according to requirement

of Land Acquisition Act 1894. A total of 8.6 acres of land was required for construction of Head

Regulator and Head Reach of the new LCC. Section 4 and section 5 of Land Acquisition Act for 8.6

acres of land were notified and published in the Punjab Gazette on August 07, 2012 and January 21,

2013 respectively. Land price was assessed, and the EA released the total amount Rs. 9.925 million

to the Revenue Department, Government of the Punjab.

However, due to change in engineering design it was found that only 4.58 acres out of 8.6 acres of

land was required along with a new piece of land 1 acre, 6 kanal, 3 marlas, and 4.5 Sarsai. Due to

this change, process of land acquisition was re-initiated. The section 4 & 5 of land Acquisition Act

1894 for additional land was notified and published in the Punjab Gazette on July 11, 2014 and July

29, 2015 respectively.

Again due to change in engineering design of LCC Lead Channel, the procedure for acquiring 5 kanal,

10 Marla of private land from one landowner (Mr. Farooq Akbar Cheema) is still in process.

Compensation rates have been re-calculated to reflect current values and procedures. The

landowner has received full payment for crop losses trees and structures.

The five affected families which are residing at the Dera of land owner, now they are shifted in their

new accommodation built by the landowner on his remaining land. Their livelihoods remain

unaffected. These households have received their relocation allowance (Pak Rupees

5,000/household) and cash assistance for vulnerable households (Pak Rupees72, 000/-household).

Alternative accommodation for the 15 no. of the affected families of Irrigation staff is also being

constructed and out of 15 AFs, 8 are shifted in new buildings. Funds for the remaining compensation

activities are available. All compensation payment of 6.625 acres land and relocation of the 07

affected households will be completed by Feb 2016.

LARP implementation activities for Tranche-2 relates to LCC Lead Channel (component) of New

Khanki Barrage Project. Internal Resettlement Monitoring of all relevant activities is the

responsibility of PMO (Environment and Social Unit (ESU). Internal Monitoring Reports in the shape

of QPR are being regularly submitted to the Bank. The PMO is in the process of engaging an

independent resettlement monitor (IM) to cover all tranches of the MFF. The IM will be mobilized

by Feb 2016 and is expected to submit its first external resettlement monitoring report by end of

Feb 2016.

Total amount under LARP is Rs. 18.05 Million. Out of which, Rs. 9.925 Million has already been paid

to the Revenue Department for land Acquisition. Rupees 3.987 million have been paid to the 19 no.

of affected families as compensation amount for their structures, vulnerability allowance & shifting

allowance. The detail is given in Annex-A.

2. ADJUSTMENT MADE IN THE COMPENSATION RATE DURING UPDATING OF LARP

The LARP of New Khanki Barrage was approved in 2012. Again, it was updated and approved in 2014. The

adjustment was made in compensation rates of the land after certification by the Revenue Department,

Government of Punjab.

The rates are still applicable up till now. The adjustment made in the compensation is given

in Annex-B.

3. EMPLOYMENT FOR THE AFFECTED HOUSEHOLDS IN PROJECT RELATED JOBS

Two types of affected families are residing at LCC Lead Channel. First are Irrigation Department Employees

and they are already serving in Irrigation Department. Second are the land owner and his agriculture

laborers, those are cultivating crops. They remained busy in construction and shifting in newly built houses.

The Contractor is ready to accommodate the affected families for jobs as and when they demand. ESU, PMO

Punjab Barrages requested to the Consultants to ask the Contractor to provide jobs under the project. As per

recommendation of the Engineer, the Contractor trace each of the person included in the list, the list of the

potential persons of affected families requiring jobs under the project. The Contractor offered them an

appropriate employment. Out of 16 affected persons, only 3 residents of Irrigation Colony were willing for

jobs with the Contractor and the Contractor hired their services. The status of employment of affected

families is given in Annex-C. The Contractor also offered jobs to the family members of employees of

Irrigation Department of Khanki Division. Out of 26 applications, 20 family members of Irrigation staff were

offered jobs and the Contractor hired their services under the Project. The detail is given in Annex-D

Regarding employment to the unskilled labor of the local area, the status of skilled and un-skilled labor

employment for the month of October, November and December, 2015 is given in Annex-E, which is

59%, 59% and 61 % respectively for the unskilled labor for the project area.

4. RELOCATION OF AFFECTED HOUSEHOLDS AND THEIR CURRENT LIVING

CONDITION

Total Twenty One (21) affected families (AFs) are to be dislocated from LCC Lead Channel component of New

Khanki Barrage Project. In first phase, land owner and his five (05) Agri-laborers are relocated and an amount

of Pak Rupees 3.927 million has been paid to the six (06) no. of affected families as the compensation amount

for their structure and other assets. During the above mention quarter the shifting allowance amounting to

PKR 60,000/- has been paid to 12 No of irrigation staff. Crop compensation for 2.125 acre (remaining land)

and private trees (100%) paid to Mr. Farooq Akbar Cheema vide cheque No. 44598144 dated 07-12-2015. Out

of Fifteen (15) No. of affected families of Irrigation Department Employees 08 no. of families have shifted to

the newly constructed residences. The remaining 07 no. of families shall be shifted in the month of February

2016.

The owner of the land has built the new dera along with the residences for the labourers 05

No. of Agri. Labourers have been shifted in their new residences. Before and after

comparison of residences shall be presented in next quarterly report.

Case No.1

Mr. Farooq Akbar Cheema is the only land owner fall in category of affected household. His land,

trees and residential structures were affected due to NKBP. A compensation payment of amounting

Pak Rs. 1,570,362 was given for crops, tube well, hand pump and structures. Current status of land

and structure can be viewed as under:

for structure, 1 no. hand pump, poverty allowance and relocation allowance.

5. GRIEVENCE REDRESSAL MECHANISM

Tranche-2 also has an operational Grievance Redressal Mechanism that covers all types of

grievances of NKBP, including resettlement. Complaint register is also being maintained by the

Consultants to record community concerns and their solutions. Out of 27 complaints, 17 complaints

have been resolved while 12 complaints are yet to be resolved. The detail of complaints is given in

Annex-F.
