KATE CAGLE Daily Press Staff Writer Following the defeat of Measure LV in November, the City Council is continuing to look into ways to abate large development projects in Santa Monica, either by requir- ing voter approval or a City Council super-majority vote for projects that exceed the general plan or zoning code. “I’ve been at this a long time and development has always been a contentious issue in Santa Monica,” Councilmember Kevin McKeown said, who introduced a motion Tuesday for staff to look into the two options. “Some people think that they won the battle but I want to end the war.” Measure LV would have required voter approval for devel- opment projects taller than 32 feet with an exception for affordable housing. Supporters of the meas- ure promised to “stop the transfor- mation of our beach town into a high-rise, high-rent concrete urban jungle.” The anti-growth measure gained support of six of the seven neighborhood groups in Santa Monica. However, when it came to the actual voters, Santa Monicans struck down the measure by 11 percent while reelecting four city councilmembers. No councilmem- bers supported Measure LV. Santa Monica’s largest residen-tial property owner has filed a law-suit against a Boston-based hedgefund, alleging AEW attempted a“hostile takeover” of seven of theirproperties in the city and two oth-ers in Los Angeles County.

The suit is the latest battle in alegal war that has waged betweenNMS Properties and AEW over ajoint venture to finance 9 proper-ties in Southern California.

NMS owns and manages 23buildings in Santa Monica and is

Patients undergoing cancer treatmentoften experience significant “symptomburden”, with pain, fatigue, nausea, con-stipation/diarrhea, dry mouth, and emo-tional symptoms. While cancer may bewell controlled, these symptoms canalter one’s ability to engage in enjoyingday-to-day life. What is the best way to

treat these symptoms? Although it canbe difficult to separate symptoms causedby the disease being treated from theside effects of treatments, effectiverelief is often available. There have beensignificant advances in knowledge aboutoptimal approaches to managing symp-toms. Often patients, their families, andtheir oncology professionals are soengaged with the logistics of complextreatments for cancer that there is littletime or energy for optimal attention tothe management of burdensome symp-toms. But effective symptom manage-ment can have major benefits in terms ofday-to-day functioning, well-being, andquality of life. This presentation intro-duces the concept of symptom manage-ment at all phases of illness, as well as anevidence-based review of the state of theart treatments for many common symp-toms. The goal of this lecture is to helppatients and families expand their knowl-edge of symptom management to workeffectively with their treatment teamstowards the goal of optimal well-beingduring treatment.

Christopher Pietras, MD is anAssistant Professor of Medicine in theDavid Geffen School of Medicine. He isboard certified in internal medicine withspecialty in hospitalist medicine and pal-liative care. He is part of the palliativecare team at UCLA.

Nocturnal Animals is a dark psychologicalthriller – extremely dark in fact. On the sur-face the story is about an upscale art gallerycurator, “Susan” (Amy Adams) and her ex-husband “Tony”, a struggling writer (JakeGyllenhaal). The story is told in the form of anovel embedded within the action. AmyAdams, Michael Shannon and ArmieHammer shine, as does Aaron Taylor-Johnson. The scenes of a novel that Tony haswritten as a gift to Susan play out within thestory as she reads it. This book is a tale ofrevenge, fast-paced, emotional and violent.In the film it becomes a counterpoint to thescenes of the “real lives” of the central charac-ters, which seem static and starved of passion.The low-key scenes of “reality” interrupt thefervent fast pace of the chapters of the novel.The rhythm keeps suddenly changing – aninteresting interplay of styles formulated bythe director, designer Tom Ford. It was how-ever somewhat jarring to me.

The sound track is classic ‘40’s or 50’s filmnoir style in genre. The production design –the lavish yet cold as ice interiors and shotchoices are rich and delicious. Director Ford,a fashion icon, lends his genius to the medi-um of film in the design of the sets and loca-tion choices. The camera work, especially theclose-ups of the faces, is striking. The moviebegins with some very off-the-wall film clipsof zaftig women parading and dancing,almost completely nude, as part of an art

opening exhibition. These opening scenes seta style. However, their startling quality is notrevisited in the story of the main characterplayed by Adams, who has curated this exhi-bition. It seems thrown in for effect ratherthan having a pivotal meaning for the story.It should have been more obvious that thiswas a hidden aspect of her personality.

I found the most fascinating character tobe “Ray Marcus” – a dangerous West Texasoutlaw played beautifully by British actorTaylor-Johnson. He is able to communicatethe genuine humanity behind the eyes ofthis killer. This character is not simply adead-eyed purveyor of evil. Taylor-Johnsonrelated to the audience in a Q&A after thescreening that he had done extensiveresearch on serial killers such as JeffreyDahmer and Ted Bundy to gain insight forhis performance. He found these serialkillers to have a disconnect between theirown humanity and their deeds. This discon-nect allows them to seem genuinely decentas they lure innocents to their lair. The “dis-connect” is what confuses and deflects theirvictims’ instincts. This is one of the bestportrayals of a killer I’ve seen. You mayactually catch yourself growing to like thisquintessentially heinous character.

I wish the story had been more intricatelywoven to show more depth in the main char-acters. That said, Nocturnal Animals is worthseeing for its color and the depth of the visu-als, and for Taylor-Johnson’s performance.

Complaints against

Councilwoman Pam O’Connor

filed by a local activist organization

have been forwarded to the Los

Angeles County District Attorney’s

office for review.

The Santa Monica Coalition for

a Livable City filed a complaint last

month against O’Connor alleging

violations of the City Charter in

connection with the firing of

Elizabeth Riel and at least one part

of that complaint has been sent to

the county.

Riel was offered a position with

the City of Santa Monica in 2014,

only to have the offer rescinded

before her first day of work. Riel

sued the city and the case was set-

Prices are going up for the Big Blue

Bus and officials are holding a public

meeting on Sept. 10 to preview changes

and hear public feedback.

BBB will host a meeting from 6-7:30

p.m. at the Main Library (601 Santa

Monica Blvd.) to update customers on its

proposed fare updates and service

changes.According to staff, BBB will be adding

11 percent more service over the next 12

months as part of the Evolution of Blue

campaign to provide connections to the

upcoming Expo Light Rail Line.

To offset costs and bring some if its

products inline with regional averages, the

base fare will increase by $0.25 to $1.25

per ride. Express fares increase to $2.50

(50 cent increase), seniors/disabled fares

will be unchanged, tokens will increase to

$1.25 (25 cent increase), day passes are

unchanged, the 13-ride ticket increases to

$14 ($2 increase), a 30-day pass goes to

$50 ($10 decrease), a youth 30-day pass

drops to $38 ($2 decrease), an express 30-

day increases to $89 ($9 increase). A new

rolling 7-day pass will be available for $14.

According to the staff report, the goal is to

incentivize prepaid media and limit the

amount of cash transactions as a means of

increasing efficiency. Currently, cash cus-

tomers take an average of 23 seconds to

board while prepaid customers take less than

4 seconds.“Currently, 2 percent of customers use

30-day passes, 2 percent use 13-ride pass-

es, 3 percent use day passes, and 1 percent

use tokens,” said the staff report. “These

Opponents who helped defeat MeasureLV in the fall urged the council to focus ontactics to curb traffic congestion and increasethe stock of affordable housing, instead ofrevisiting the failed ballot measure.

“It was a very contentious election. Itfailed. It failed handily. I think 11 points is adefinitive victory,” said Jason Islas, leader ofthe “No on Measure LV campaign. “Peopledo like the direction the city is going in.”

Other councilmembers supportedMcKeown’s motion but also expressed doubtwhether the ballot box is the right way todecide on future development.Councilmember Terry O’Day called theprocess “unwise” and “inherently argumen-tative.” He hopes city staff will recommendinnovative ways to involve the public in cityplanning, without bringing projects to acitywide vote.

Both Councilmember Sue Himmelrichand Mayor Pro Tempore Ted Winterer hint-ed they may support requiring a super-

majority of council votes for large develop-ment projects. Right now, those projectsrequire just a 4-3 majority of the seven votes.Councilmember Glenn Davis, who intro-duced the motion with McKeown, took anopen-ended position on requiring eithervoter approval or a super-majority of thecouncil. She says she looks forward to learn-ing more about the options.

“I think if we are intent on trying toreestablish trust with this community aboutdevelopment issues, now is the time to havethe conversation and not in 2018 whenthere’s probably going to be another ballotmeasure,” Davis said.

Councilmember Pam O’Connerabstained from voting on the motion andexpressed doubt any further restrictions onprojects would appease anti-developmentgroups.

“Ballot box measures tie the hands offuture generations,” O’Conner said. “Wewould be making it more difficult for futuregenerations when times are different andneeds are different.”

Early next year, city staff will unveil thefinal draft of the “Downtown CommunityPlan” which will create guidelines for devel-oping the downtown core and maintain the“our town” character of Santa Monica.

ON DECEMBER 1, AT APPROXIMATELY 2:30 A.M.Officers patrolling the area near Ocean Avenue and Pico Boulevard noticed a beigeVolkswagen Passat in the 00 block of Arcadia Terrace in a no parking zone. The vehiclewas occupied by five males, including one juvenile who was in the driver seat, andsmelled of burnt marijuana. During their investigation, the officers noted that all fouroccupants appeared to be under the influence and none had a valid driver license. Whilesearching the vehicle, the officers found a loaded pistol. The gun was registered to a res-ident of San Bernardino not related to any of the occupants of the vehicle. One of thesubjects was found to be a documented Florencia 13 gang member. Michael SamuelMedina, 18, of Lennox, had bail set at $35,000. Jose Roberto Arbizu, 18, of Los Angeles,had bail set at $35,000. Christopher Ariel Murillo, 19, of Santa Monica, had bail set at$35,000. Victor Alfonso Rodriguez, 19, of Los Angeles, had bail set at $35,000. A juve-nile was also arrested.

ordered them to pay AEW’s attorneys’ feesand costs in excess of $6 million.

Attorneys for NMS have already filed anappeal to the Superior Court’s ruling. In themeantime, NMS will continue to manage allof the properties.

The dispute between NMS and AEW overthe joint venture will continue to work itsway through the courts over the comingyears. In the latest lawsuit, NMS filed a com-plaint alleging AEW attempted a “hostiletakeover” of the nine properties to oust themas managers in November, weeks before thejudge’s order.

On November 21st, a team of locksmiths,private security guards, and computer techni-cians suddenly stormed all the nine proper-ties at once and announced there was a newmanagement company in charge, accordingto the complaint. As employees scrambled tocall their bosses, Shekhter’s son, Alan, went tosee what was happening in the apartments at1502 Broadway. A guard prevented him fromentering and claimed to have a court ordergiving management company USRG the rightto take over the building.

Over the next five hours, Shekhterremained locked out as similar scenesunfolded at the other properties. Duringthat time, Shekhter claims the intrudersrummaged through files, changed locks andtook keys and garage openers and keptemployees from leaving. The Santa MonicaPolice Department finally ended the ordealwhen they ordered the intruders to leave,according to the complaint.

Since that day, NMS Properties has post-ed guards outside the buildings in question.They remain there today.

The lawsuits do not involve the city ofSanta Monica but press coverage of the rul-ing caused some leaders to lose trust withthe developer who has 18 additional proper-ties up for future development. At lastTuesday’s City Council meeting, leadersasked for additional scrutiny of all city con-tracts dealing with NMS.

“We don’t know what aspects of our busi-

ness with various people in the city could beimpacted,” said Councilmember SueHimmelrich, who directed city staff to lookinto the matter.

Councilmember Kevin McKeown says hehas already heard from the tenants of theseven local buildings involved in the lawsuitwho are worried about what a managementshake-up means for them.

At the meeting, a spokesman for NMSpromised to hand over any documentsregarding current or pending contracts withthe city.

“We would like to reassure the council,the mayor that we will cooperate fully withanything that the council would like to lookat,” Eric Rose said. “We’re confident that anyreview will show NMS has always acted withthe highest integrity.”

The lawsuit could hit NMS’s pocketbooksmuch harder than the $6 million dollars infees and suit costs owed to AEW. Shekhterestimates the value of the properties cededto AEW at $500 million, according to a com-plaint filed by his attorneys with theSuperior Court on Dec. 1st.

When pressed, Rose would not commit toproviding documents about the company’sfinancial viability to the City Council. Roserestated the company’s confidence they willwin on appeal.

“This is simply a business dispute,” Rosesaid.

The judge’s Dec. 2nd ruling came after aforensic examination of documents handedover as part of the lawsuit filed by NMSagainst AEW over the joint venture. InSeptember of 2015, the judge ordered NMSfreeze all electronic documents and submitcomputers and devices to the court.Evidentiary hearings took place over eightdays in October of this year.

Shekhter’s attorney, Skip Miller of MillerBarondness, LLP in Los Angeles, defendedhis client last week in a statement to theDaily Press:

“Neil Shekhter didn’t forge anything. Theorder is wrong. All he did was discard hispersonal home computer to protect his andhis family’s privacy,” Miller said.
