The primary concern of the Shari’ah can be summed up,

generally as :

“(towards ensuring a better life by)

providing “maslahat ” (benefits)

and the removal of “mafsadah ” (harm) for mankind.”


Thus the Shari’ah laws are there to firstly preserve the

basic rights :

Dharuriyyah: “the essential rights of mankind.”

This can be said to be Islam’s stipulations of basic human

rights - which the purpose of any legislative philosophy

should uphold. Yet, because Shari’ah is based on Divinely

revealed principles , clearly established and documented,

it cannot be repealed anymore, like the man made

legislative system.


The five important essentials (human rights) which it The five important essentials (human rights) which it

1.1. right of religion, right of religion,

2.2. right to life, right to life,

3.3. right to proper use of the intellect, right to proper use of the intellect,

4.4. right to ownership of property, right to ownership of property,

5.5. right of progeny (including preservation of honour right of progeny (including preservation of honour

DharuriyyahDharuriyyah: the essential rights of mankind.: the essential rights of mankind.


Not only does the Shari’ah laws are there to preserve

these basic rights, it goes even beyond mere essentials

but includes catering to related human needs (Haa-jiat) :

Haa-jiat : “the needs of mankind.”

The needs are those requirements attached to the

essential rights as mentioned above. Thus, it provides a

wide and dynamic scope for jurists to extend and include

considerations for changing circumstances of human life.

Not merely the essential and needs, the Shari’ah even

strive towards the ultimate betterment, termed:

Tahsiniyyat : the perfection of mankind’s well-being.

TaTahhsiniyyatsiniyyat: the perfection in well-being.: the perfection in well-being.

The perfection of man’s life are those which society is

enjoined by Islam to aspire to, which can be summed up

into two broad categories:

MAKARIM AL-AKHLAQ

MAHAASIN AL-’AADAH


As the aim in legislation is to ensure well-being of

society, Islam’s fundamental focus is also towards the

actualizing the goodness in man through, ‘reform’ or

‘rehabilitation’ of its citizen towards noble ethical

virtues, without which the ‘goodness’ of any law would

be worthless - as otherwise, it can never be manifested

in society.

MAKARIM AL-AKHLAQMAKARIM AL-AKHLAQ: : ““the nobility of character of citizens”the nobility of character of citizens”


Thus, the educative (element) of the Prophet’s

implementation of Shari’ah upon the citizens must

never be overlooked, lest it become dry legalism -

enforcement lacking compassion and autocratic –

which is opposed to how the Prophet Muhammad

s.a.a.w. had taught and had successfully established

(SUNNAH) to the first generation amongst our pious

predecessors . Allah SWT recorded praises regarding his

exemplary approach:




““It is part of the Mercy of Allah that thou dost deal It is part of the Mercy of Allah that thou dost deal

gently with them. Wert thou severe or harsh-hearted gently with them. Wert thou severe or harsh-hearted

they would have broken away from about thee; so pass they would have broken away from about thee; so pass

over (their faults), and ask for (Allah's) forgiveness for over (their faults), and ask for (Allah's) forgiveness for

them; and consult them in affairs (of moment). Then them; and consult them in affairs (of moment). Then

when thou hast taken a decision, put thy trust in Allah. when thou hast taken a decision, put thy trust in Allah.

For Allah loves those who put their trust (in Him).” For Allah loves those who put their trust (in Him).”

“And thou (Muhammad) standest on an exalted

standard of character.”

(Qur’an: al-Qalam: 68:4)



“ “Verily I have not been raised (as a Prophet) except

to perfect the noble nature (akhlaq) of mankind''.


Prophet Muhammad s.a.w. said:Prophet Muhammad s.a.w. said:


As to these (perfecting life-style and customs by making

available all that which benefits society) – the Shari’ah

must aim to affect positively to the customs and life-style

in others based upon universal moral value inherent in all

religion or humane , so that life can be an expression of

praising and glorification of God.

MAHASIN-AL-’AADAHMAHASIN-AL-’AADAH: : ““perfecting customs or life-style”perfecting customs or life-style”


The right or freedom to choose religion being upheld,

does not prevent positive interaction amongst various

people of different race or religion to be done.

Islamic Da’wah (call, invitation or propagation) is most

effectively done , by providing a practical examples. Even

if others do not accept to embrace Islam, it wish to share

the universal human morality inherent in people so that

life becomes better if not the best.




““Allah commands justice, the doing of good, and the giving Allah commands justice, the doing of good, and the giving

to kith and kin (their dues), and He forbids all shameful to kith and kin (their dues), and He forbids all shameful

deeds, and injustice and rebellion: He instructs you, that ye deeds, and injustice and rebellion: He instructs you, that ye

may receive admonition.”may receive admonition.”

My message to my brothers and sisters

“What! do you enjoin men to be good and neglect your

own souls while you read the Book; have you then no

sense? “

“There has certainly been for you in the Messenger of

Allah an excellent pattern for anyone whose hope is in

Allah and the Last Day and [who] remembers Allah

often.”

(Qur’an: Ahzab: 33: 21)


““So direct your face toward the religion, inclining to truth. So direct your face toward the religion, inclining to truth.

[Adhere to] the [Adhere to] the FITRAHFITRAH (natural disposition of) Allah upon which (natural disposition of) Allah upon which

Prophet Muhammad s.a.a.w. said:

And Allah affirmed :



“TRUTHFUL” Strive to be a person who is truthful, never to lie, and this

reflect a most basic but important attributes, towards developing

one’s credibility.


““O you who have attained to faith! Remain conscious of O you who have attained to faith! Remain conscious of

God, and [always] speak with a will to bring out [only] God, and [always] speak with a will to bring out [only]

what is just and true - [whereupon] He will cause your what is just and true - [whereupon] He will cause your

deeds to be virtuous, and will forgive you your sins. And deeds to be virtuous, and will forgive you your sins. And

[know that] whoever pays heed unto God and His [know that] whoever pays heed unto God and His

“TRUSTWORTHY” Strive to be a person who can be always depended upon, to be

trusted to fulfil whatever entrusted. This reflects the attribute of

honesty and justice, because the opposite is “khiyaanah” to

“betray a trust” is to dishonestly usurping or misappropriating a

right (HUQUQ) of others.

trust of Allah and the Messenger, nor trust of Allah and the Messenger, nor

misappropriate knowingly things entrusted to you.”misappropriate knowingly things entrusted to you.”

“CONVEYING” To have the drive, passion, empathy and courage to deliver the

message, not just conveying good news and niceties, but to be as

steadfast and determined even if to convey the TRUTH which others

may dislike. Thus a Muslim must have good communicative skills,

committed to speak the Truth even in the presence of an unjust ruler.

This relates to an indispensible virtue of SHAJA’AH (Courageous)


““So do not fear the people but fear Me, and do not So do not fear the people but fear Me, and do not

exchange My verses for a small price. And whoever does not exchange My verses for a small price. And whoever does not

judge by what Allah has revealed - then it is those who are judge by what Allah has revealed - then it is those who are

the disbelievers.”the disbelievers.”

““[and such will always be His way with] those [and such will always be His way with] those

who convey Allah’s messages [to the world], who convey Allah’s messages [to the world],

and stand in awe of Him, and hold none but and stand in awe of Him, and hold none but

Allah in awe: for none can take count [of man’s Allah in awe: for none can take count [of man’s

“ASTUTE, SAGACIOUS, DISCERNING, etc.” This quality must be reflected in us, as Islam values

knowledge, wisdom, learning, thoughts, reasoning etc. In fact the

first FARDH (Obligation for Muslim) is for every male and female,

to seek knowledge and learning, from the cradle to the grave.

In fact Islam sensible and for those who think, It is not for the

fools and the unreasonable.


““He (Allah) gives wisdom to whom He wills, and He (Allah) gives wisdom to whom He wills, and

whoever has been given wisdom has certainly whoever has been given wisdom has certainly

been given much good. And none will been given much good. And none will

remember except those of understanding.”remember except those of understanding.”

“Now then, for that (reason), call (them to the Faith), and

stand steadfast as thou art commanded nor follow thou

their vain desires; but say: "I believe in the Book which

Allah has sent down; and I am commanded to judge justly

between you. Allah is Our Lord and your Lord. For us (is

the responsibility for) Our deeds, and for you for your

deeds. There is no contention between us and you. Allah

will bring us together, and to Him is (Our) final goal.”

(Qur’an: ash-Shura: 42: 15)



The word “The word “IslamIslam” - literally means “” - literally means “surrendersurrender; ;

WA-ASH-HADU – AN-NA- MUHAM-MADAR –WA-ASH-HADU – AN-NA- MUHAM-MADAR –ROSUU-LULLAAHROSUU-LULLAAH

““O ye who believe! Give your response to Allah and His O ye who believe! Give your response to Allah and His

O our Lord! Make us to benefit from what You have O our Lord! Make us to benefit from what You have

O Lord! Teach us whatever that is beneficial for us.

O Allah! Make us to be people who guide (others) O Allah! Make us to be people who guide (others)

and who are (always) Guided (by Your Guidance) .and who are (always) Guided (by Your Guidance) .


Not of those who are astray and Not of those who are astray and

who lead people astray.who lead people astray.


O Allah! Guide us all O Allah! Guide us all

with Your Guidance.with Your Guidance.


And make us people who hasten And make us people who hasten

towards what pleases You.towards what pleases You.


And do not let us be protected (by others) except And do not let us be protected (by others) except

only with Your Protection (as our Guardian).only with Your Protection (as our Guardian).


And do not make us to be of those who differ And do not make us to be of those who differ

from Your command and who are disobedient from Your command and who are disobedient

towards You.towards You.


And sufficient is Allah for us, And sufficient is Allah for us,

for He is the Best Protectorfor He is the Best Protector


And there is no power nor strength except And there is no power nor strength except

with Allah The Most High, the Most Esteem.with Allah The Most High, the Most Esteem.



““Our Lord, and make us Muslims [in submission] to Our Lord, and make us Muslims [in submission] to

You and from our descendants a Muslim nation [in You and from our descendants a Muslim nation [in

submission] to You. And show us our rites and submission] to You. And show us our rites and

wrongdoing (oppressive) people. And save us by wrongdoing (oppressive) people. And save us by

Your mercy from the disbelieving people."Your mercy from the disbelieving people."
