California Supreme court rulingon GIS

California Supreme Court issued the opinion July 8,2013.

"The issue in this case is whether the OC Landbaseis subject to disclosure in a GIS file format at the

actual cost of duplication under the CaliforniaPublic Records Act or whether, as the County

contends, it is covered by the statute‘s exclusionof ―[c]omputer software‖ (Gov. Code, § 6254.9,

subd. (a)) — a term that ―includes computermapping systems‖ (id., § 6254.9, subd. (b)) —

from the definition of a public record.

We hold that although GIS mapping software fallswithin the ambit of this statutory exclusion, aGIS-formatted database like the OC Landbase

does not. Accordingly, such databases are publicrecords that, unless otherwise exempt, must be

produced upon request at the actual cost ofduplication."

President’s Message

Dear Fellow Surveyors,

I wanted to mention some items for discussion in this letter and a few events:

Membership – State CLSA and Chapter membership are the topics of the month. We need our chapter members

to also be members of the state CLSA. Chapters within CLSA get representation on the CLSA Board of Directors

based on our official count of members of our chapter that are also State Association members. One director for

every 20 members. We have four directors this year and we were just one away from having five. There are 400

(approx.) licensed surveyors in Riverside and San Bernardino Counties yet we struggle to reach 80.

NSPS 100% Membership – So far about half of the states have approved this measure and are working toward

signing a Memorandum of Understanding (MOU) with NSPS regarding this membership drive initiative. NSPS is

offering a rate of $40 per year for every member of a state association (currently $225 per year). Our membership

dues are currently $159 for corporate membership with the Association and CLSA has not raised the dues in at least

40 years if not longer. A CLSA Webinar explaining this is available to CLSA members for free. Go to the CLSA

website and to sign up for the webinar, which will be on June 20, 2013 at 12 PM. CLSA members may also watch a

recording of the webinar in the members section of the CLSA website later.

Bill Young Memorial Golf Tournament – The golf tournament this year was extremely successful. I would

like to thank the golfers, sponsors, students and volunteers for making this a huge year for us and our scholarship

drive. Our accounting of the event shows we had about $7100 in profit leading to what I believe is our biggest year

ever. The Chapter Board has decided to look at adding an extra scholarship or two this year so we can use the

money sooner to support land surveying education.
