  4. 4. 1 December 2014 Babies expected on or after 5 April 2015 Parents can share up to 50 weeks of leave SPL is NOT in addition to maternity leave 52 weeks can be taken as maternity leave or shared parental leave Mother must notify their employer that they wish to bring their maternity leave to an end 2 weeks compulsory maternity leave (4 weeks for factory workers) Can be taken at the same time or consecutively Can be continuous or discontinuous Shared Parental Pay (flat rate) available for up to 39 weeks (minus the 2 mandatory weeks which the mother must take) Up to 20 SPLIT days The New Rights

Shared Parental Leave Pay Available if M was entitled to Statutory Maternity Pay Up to 39 weeks available (less 2 weeks compulsory maternity pay) Eligibility same as for Statutory Maternity Pay Paid at flat rate only (138.18 pw) Eligibility Mother/adoptive mother Father/adoptive father/ mothers spouse, partner or civil partner Adoptive parents where placement due after 5th April 2015 26 weeks continuous employment (at 15th week before EWC) Partner must meet the Employment and Earnings test Partner must be economically active Worked for 26 weeks in the previous 66 weeks Earning at least 30 in each of 13 of those weeks

Curtailment notice M gives 8 wks notice of intention to end SML Written notice of entitlement M gives 8 wks before taking ShPL Parents names and NI numbers Start/end date of SML taken by M and maternity pay received Actual/expected date of birth Total ShPL available Confirmation they are sharing childcare responsibility A non-binding indication of how much ShPL each parent intends to take A declaration from each parent Period of leave notice 8 wks before ShPL period Start and end dates requested One continuous period or several discontinuous periods Up to 3 requests can be made (including requests to vary) Requests for continuous periods of leave cannot be refused Requests for discontinuous periods can be refused Must be reviewed and an alternative agreed within 14 days 3 Step Approach
