Sub: Clarification for revision of pre-2006 pensioners- delinking of revised pension fromqualifying service of 33 years- Regarding

Sir/Madam,

I am directed to refer to DOP&PW O.M. No. 38/37/08- P&PW (A), dated 06-04-2016regarding delinking of 33 years of qualifying service for revision of pension of pre-2006pensioners and to say that some references have been received from Circles/ (DA{P) on thisissue for clarification.

2. The matter was consulted with DOP&PW. It has been advised by the DOP&PW, videI.D. No. 38/6/16- P&PW, dated 08-08-2016 to take action in light of DOP&PW O.M. dated06-04-2016 and CPAO's O.M. dated 13-06~2016. Accordingly, following clarifications areissued:-

i) The revised consolidated pension of pre-2006 pensioners shall not be lower than50% of the minimum of the pay in the pay band and grade pay (whereverapplicable) corresponding to the pre-revised scale as per fitment table withoutpro rata reduction of pension even if they had qualifying service of les than 33years at the time of retirement,

ii) In accordance with CCS (Pension) Rules, pension is admissible if the retiring/absorbed employee has completed a qualifvlng service of 10 years at the time ofretirement/absorption. Therefore, all those pensioners who were drawingmonthly pension after completion of 10 years qualifying service before 01-01-2006 are eligible for benefit in terms of DOP&PW O.M. dated 01-09-2008 and06-04-2016. These orders are however not applicable to those absorbeepensioners who had got 100% lump sum in lieu of their monthly pension onabsorption in PSUsduring 1973-1995 and are eligible for restoration of 1/3'd oftheir pension in respect of such absorbee pension. However, the absorbeepensioners, who are receiving 'full monthly pension, would continue to becovered by the O.M. dated 01-09-2008 and 06-04-2016.

iii) In respect of Government servant who had drawn lump sum paymEf'n'f~nabsorption in CPSU/ Autonomous Bodies, DOP&PW, vide O.M. No. 4/38/2008-P&PW(D), dated 04-08-2016, has further clarified that the notional full pensionof absorbee pensioners would also be revised in accordance with instructionscontained in DOP&PW O.M. dated 06-04-2016 with effect from 01-01-2016 anddearness relief and additional pension! for old pensioners would be admissibleon such notional revised full pension. There will however be no change in theactual t/s" restored pension determined. in accordance with O.M. dated 15-09-2008 read with O.M. dated 11-07-2013.

iv) Cases for compulsory retirement penslon and compassionate allowance underRule 40&41 of CCS(Pension) Rules, 1972 are not to be revised as they are notcovered by the O.M. dated 06-04-2016.
