RBI governor...“There were apprehensions about the cor-porate bond market freezing up, but it has,as if, received a new life,” the governor said, admitting that most of the issuances werefrom the AAA segment.

After consulting the RBI, the govern-ment announced a series of measures, suchas the first loss guarantee of up to 20 percent of the bonds, which have helped thelower-rated borrowers as well, he said.

“I do see renewed activities even belowthe AAA-rated bonds,” Das said, adding theRBI remained “extremely vigilant” on theliquidity needs of the private sector and asand when needed, it would take measuresto ease the conditions.

Nevertheless, targeted mega projects, such as the golden quadrilateral, could“reignite the economy”. “This could beginin the form of a north-south and east-westexpressway together with high speed railcorridors, both of which would generatelarge forward and backward linkages forseveral other sectors of the economy andregions around the rail/road networks,” Dassaid, adding that both public and privateinvestment would be key to financing theinfrastructure investments.

The RBI governor did not commit onqueries or suggestions on one-time settle-ment, creating a sovereign wealth fund, ora national renewable fund of trillions forlong-gestation projects. There was also asuggestion of increasing the external com-mercial borrowing (ECB) limit beyond $750million, so that industries could take advan-tage of the low interest rates abroad.

“Such ideas do get internally discussed

at the RBI. And we are also engaged with thegovernment in discussing these issues,” thegovernor said. To a query on the rupee’sfair value, he said the RBI’s stance was tocheck undue volatility and not to defendany level. The governor also tried to defendbanks for reneging on their funding prom-ises to industries, and said any fundingdecision should be left to banks.

“There’s an extent to which credit riskcan be assumed. At the end of the day, banksare driven by their commercial decision, but as I have written in my foreword to theFinancial Stability Report, extreme risk-aver-sion can also create problem for all,” Dassaid. Das told Indian industries to get intothe global supply and value chain, as even 1per cent increase in participation increasesper capita income by over 1 per cent.

Brokers...Shares hit the lower circuit of 10 per cent at~12.3 on Monday, following the listing. Asthere were only sellers and no buyers in thecounter, several investors were stuck withthe shares allotted in the FPO. “If brokersallowed clients to sell non-FPO YES Bankshares last week, then there is no violation. However, if they facilitated the sale of sharesissued in the FPO, before Monday, then it isclear violation,” said a regulatory official.

YES Bank’s FPO closed on July 17, allot-ment was finalised on July 22 and shares gotcredited in demat accounts on July 24.People in the know said brokers might havetaken advantage of the ‘T+2’ trading cycle tofacilitate trades on Friday — or even onThursday. ‘T’ denotes the day of execution, while ‘2’ is the number of days taken forshares to move in or out of the demat

account.“It will be difficult to establish

violation. Even though brokersallowed the sale of shares onFriday, these would only move outof the demat account on Mondayor Tuesday, when the ISIN of FPOshares would get merged with theregulator’s ISIN,” said an industryplayer. On Thursday, shares end-ed at ~15.7 after touching an intra-day high of ~16.

A query sent to Sebi didn’t elic-it a response immediately.Exchanges narrowed the circuitfor YES Bank from 20 per cent to10 per cent, on Friday.

Chinesetelecom...It has also tightened the ForeignDirect Investment (FDI) policy, sothat Chinese investment in Indiacannot come through the auto-matic route, but has to be scruti-nised by the government.

The government is also lookingat whether the leasing of spectrumcan be made conditional on coun-try of origin restrictions. Says RKBhatnagar, former advisor, tech-nology, at the Department ofTelecommunications: “Manda-

tory and security testing has already beennotified through the Indian TelegraphAmendment Rules and the existing uni-fied licensing condition on security canalways be used to bring private players inline and restrict Chinese.”

India bans...The government invoked its powers underSection 69A of the Information Technology(IT) Act and relevant provisions under ITRules, 2009, to block these apps.

The fresh ban has been welcomed byseveral Indian app service providers.

Some have gone to the extent of pledg-ing not to tap Chinese funds while remain-ing committed to user data privacy.

Sumit Ghosh, chief executive officer(CEO) and co-founder of short video-shar-ing app Chingari, says the company - intalks to raise funds — has decided not to bebeholden to Chinese investors.

“We need to be very concerned aboutour data, and make sure it remains withinIndia. We, at Chingari, have always beenon top of this. Hence, we decided to nevertake any funds from China or use any of itstechnology in our app,” says Ghosh.

Chingari is being touted as the TikTokalternative in India and has seen over 25million downloads so far.

Hyderabad-based short-video appRizzle says data security is its topmost pri-ority. “We are pleased to support millions ofTikTok users with a positive and secureplatform that will help them in enhancingtheir social presence while becoming finan-cially independent. National security andcitizen privacy will be a critical componentRizzle will abide by,” says Vidya Narayanan,CEO and co-founder, Rizzle.

It has been reported that around 275apps of ‘Chinese origin’ are on the govern-ment’s radar. This list includes Tencent-funded PubG, AliExpress by Chinese e-commerce giant Alibaba, and Zili bysmartphone manufacturer Xiaomi.

Cash-rich IT...“We have a list of possible acquisition can-didates,” Infosys Chief Executive Officer(CEO) Salil Parekh said during an earningscall this month.

TCS has hinted at another big acquisi-tion. “Our largest M&A was executed at thepeak of the global financial crisis. We are notshy of M&As and we believe that the besttime to execute it is when nobody else isbuying,” Rajesh Gopinathan, CEO, said.

“During this time of slowdown, bothtop- and mid-tier IT firms are doing strate-gic investment, which is likely to give themgrowth dividends in the coming years. Theinvestment strategy of most domestic firmsis focused on capacity building, maybethrough taking over firms or opening cen-tres,” said Pareekh Jain, an IT outsourcingadvisor and founder of Pareekh Consulting.

Among mid-tier firms, L&TTechnology Services announced acquir-ing Texas-based Orchestra Technology for$30 million last week.

MUMBAI | TUESDAY, 28 JULY 2020 BRAND WORLD 13. <

VIVEAT SUSAN PINTOMumbai, 27 July

Misleading claims havelong been the bane ofthe advertising indus-

try, with government and regu-lators struggling to rein in falseand obfuscating claims in ads.The problem has been com-pounded in part due to theextensive use of celebrityendorsers in advertising. Whilestars remain the safest bet formost brands, offering massreach and credibility, their famealso sets the relationship withconsumers and advertisers, ona vulnerable pitch.

Consumers tend to trustcelebrities easily, says NChandramouli, chief executiveofficer of brand advisory firmTRA Research, which makesthem more vulnerable andcelebrities, a party (even if inad-vertently) to misleading claims. To address these concerns, theConsumer Protection Act, 2019,which was notified last week, has sought to make celebritiesliable for the endorsementsthey undertake.

This is the first time, saylegal experts, that celebritieswill be held accountable for thewords they mouth or the mes-sage they endorse. The penal-ties for being a conduit forfalse claims are stiff, from afine of ~10-50 lakh to a jail-term of five years. The act canalso bar a celebrity from endors-

ing a product for up to a year, extending it to three years forrepeat offences.

Celebrity managementcompanies are predictablyunhappy with the new law, arguing that holding celebri-ties accountable is an over-reach. “I am not saying thatcelebrities should not do duediligence before picking up anendorsement. But holdingthem responsible for the mis-leading claim is not correct,”the chief executive of a popularcelebrity management firmbased in Mumbai said, request-ing anonymity.

But the AdvertisingStandards Council of India(ASCI), which is the sector reg-ulator, says that it was timethat misleading claims espe-cially in categories such aseducation, health care, digitalservices and teleshopping arechecked. “We expect to see asignificant impact in the con-trol of misleading ads with the

new Consumer ProtectionAct,” Rohit Gupta, chairman,ASCI, said. “We will soon belaunching a monitoring serv-ice of potentially misleadingads appearing in digitalmedia, in addition to printand TV surveillance thatalready exists. We see our roleas being complementary andpromoting responsible adver-tising,” he said.

The importance of celebri-ty endorsements is on the rise(see box) as the pandemic hasintensified the rush for trustedfaces whose words carryweight. A recent report byTAM AdEX shows that therewas a 63 per cent rise in vol-umes of celebrity-endorsedads on television in June 2020versus April of this year.

Experts say that the depend-ence on celebrity endorsers willonly grow as consumers seekfamiliar labels and trustednames. “These are tough timesand brands that have high

recall and resonate with con-sumers will find greater trac-tion,” says Arvind Singhal, chairman, Technopak.

This means that brands thathave already built a name in themarket will advertise more, butwith messages that signal theirrelevance in the current crisis(either as a means of preven-tion or as a source of succor). Ifan actor or a sports star canback the claims that the brandsmake, the message will reachwider and be more acceptable.

Hence the rush for a famousface to helm the brand. TAMAdex says that in the month ofJune, cricketer Virat Kohlitopped the list of most-visiblecelebrities on television, spend-ing an average of 10 hours perday across TV channels. ActorAkshay Kumar followed, whileactor Kareena Kapoor Khanwas the third-most visiblecelebrity on television.

Chandramouli says thatwhile advertisers will increas-ingly turn to celebrity endorsersin the post-Covid-19 world, scrutiny and debate of endorse-ments will also grow, followingimplementation of the newconsumer protection law. “Foronce, I believe, there is a seriousendeavour to keep the con-sumers’ interest in mind whenit comes to misleading claims,”he says. How far this initiativewill go is anybody’s guess. Tillthen, endorsers and brands willerr on the side of caution.

Newconsumer lawrealignsthe endorser trackWill brands and stars rethink the endorsement game as the new law seeksgreater accountability from all stakeholders?
