Legislative Response• Passage of an opioid legislative package in the 115th Congress
remains unclear
• Senate “minibus” legislation included additional funding for combating the epidemic, but policy priorities to be included in comprehensive opioid legislation are still being debated
• A bill signed by the President would have to move quickly given the limited Congressional scheduled
• Proposals under consideration include:
‒ Additional grants to states for treatment and prevention
‒ Funding research for alternatives to opioids for treating chronic pain
‒ Increased efforts to detect illicit drugs shipped into the United States
‒ Military Health System efforts toward opioid management

Trends in Telemedicine
• Congress pushes telemedicine as a significant component to combat the opioid crisis
• Federal budget passed in February expands use of telemedicine (stroke and kidney dialysis patients)
• CMS Proposed Rule looks to create additional uses for technology-based services within the Physician Fee Schedule
• All private health plans, Medicare, state Medicaid and VA cover some e-visits

Occupational Licensing Board Antitrust Damages Relief and Reform Act of 2018 (H.R. 6515)• Result of efforts led by FSMB and the Professional
Licensing Coalition and the Office of Rep. Mike Conaway (R-TX)
• Seeks to protect board members and staff from personal liability and treble antitrust damages for actions they may take as part of their service on boards to protect the public
• Requires that boards meet certain criteria to be eligible for relief
• Includes a GAO study to look at other issues in the occupational licensing reform arena
