September 2, 2020. The undersigned requests that copies of all filings this matter be served upon

Petition for Par Status

Richard and Sandra Conway are the sole members ofAshmal Properties, LLC, which

owns a Mobil gas station, convenience store and deli at the intersections of Route 7 and Route 3,

in the Town ofPittsford, Vermont. Exhibit 1, Location Map. The station has been at this

location for 65 years and the property has been owned and operated by the Conway family for

over 40 years. The captioned Act 250 Application seeks to reconstruct and replace a bridge

across Furnace Brook in the immediate vicinity of the Conways' property but also seeks to make

problematic changes to the Route 3/7 intersection (the "Intersection") which will jeopardize

traffic safety at that intersection and make entrance to and exit from the Conway property by

members of the general public highly problematic:

1. Currently, the vicinity of the Intersection consists of a single southbound lane on Route7 which turns to two lanes just south of the Intersection. Exhibit 2 Google Maps Photo ofCurrent Intersection. However, the proposed plan calls for converting southbound Route 7 to twolanes to the north of the Intersection. This means that northbound traffic turning left from Route3 onto Route 7 will have to cross two lanes of traffic of heavy traffic instead of one to completethis turning movement. Given the level of traffic in this area, the Conways are concerned thatthis redesign will have undue adverse impacts under at least Criteria 5, Traffic Congestion andUnsafe Conditions and 9K Impacts on Public Investtnents of Act 250.

2. Petitioners' station, convenience store and deli is at the same grade as the Intersectionand Routes 3 and 7 and access to the station, convenience store and deli from Routes 7 and 3 hasnever been impeded in any way. However, the pending Act 250 Application appears tocontemplate installing guardrails immediately between the intersection and the Conway'sfacility. The extent of the guardrails is such that with the orientation of gas pumps on theConway property, access by trucks or vehicles pulling ti-ailers from southbound Route 7 inparticular may be highly problematic, especially during the winter months if the guardrails arenot substantially shortened or eliminated. See Exhibit 3, Marked Excerpt from Project Plans.Although it is difficult to ascertain from the Plans, it also appears that curbing may becontemplated for areas that are presently used for access to Petitioners' service station. Both ofthese proposals would have undue adverse impacts under at least Criteria 5, Traffic Congestionand Unsafe Conditions and 9K, Impacts on Public Investments of Act 250.

3. The construction plans for the Project show a line of barricade barrels going along mostof the property's frontage along Route 7. Exhibit 4, Marked Plan re: Barrels. This will have theeffect of making access to the Conways' property from Route 7 extremely difficult andpotentially hazardous during construction. This proposal will also have undue adverse impactsunder at least Criteria 5, Traffic Congestion and Unsafe Conditions and 9K Impacts on PublicInvestments of Act 250.

4. Sheet 66 of the Project plans indicates that an existing plugged stormwater pipe whichruns under Route 7 will be reopened and all stormwater drainage from the Route 7 hill adjacentto the Conways' property will be diverted directly onto the area of the Conways' leachfield.Exhibit 5, Marked Drainage Plan. This will have an undue adverse impact at least under Criteria1, Water Pollution, 4, Erosion, and 5 and 9K, Traffic and Public Investments.

5. Contrary to the application representations, the Project and the Conway property arelocated in the Pittsford Village Center. Exhibit 6, Village Center Maps. The Town and RegionalPlan and applicable Vermont law provide that the approaches to Village Centers merit specialaesthetic protection and careful planning to preserve the special sense of place these areasprovide. The Project provides no aesthetic enhancements for the new bridge in the sense ofattractive railings or light fixtures with potential ramifications under Criterion 8, Aesthetics. Italso provides no pedestrian connectivity with the existing sidewalk network in Pittsford withpotential ramifications under Criterion 9K, Public Investments, and 10, Town and Regional Plan.

As noted above. Petitioners are adjoining property owners to the Project. The Project has

direct potential adverse impacts on their property and interests under at least Criteria 1, Water

Pollution, 4, Erosion, 5, Traffic Congestion and Unsafe Condition, Criterion 9K, Impacts on

Public Investments, and 10, Town and Regional Plan of Act 250. They therefore have a

sufficient particularized interest under at least these Criteria to qualify for party status under 10

V. S.A. § 6085(c)(l)(E).

WHEREFORE, Ashmal Properties, LLC, and Richard and Sandra Conway request that

the Commission call a hearing in this matter and grant them party status as requested above.^
