Flexible Working Rights Extended to All

What is the right to request flexible working?

Under provisions set out in the Employment Rights Act 1996 and regulations made under it, all employees have a statutory right to ask their employer for a change to their contractual terms and conditions of employment to work flexibly provided they have worked for their employer for 26 weeks continuously at the date the application is made. An employee can only make one statutory request in any 12 month period. Employees who have been employed for less than 26 weeks, agency workers and office holders do not have a statutory right to request flexible working. Nevertheless, employers may still wish to consider a request from these groups as flexible working can bring business benefits as well as benefits to the employee.

Before June 2014 the right only applied to the parents of children under 17 or 18 in the case of parents of disabled children or to those caring for an adult. Now any eligible employee can apply to work flexibly for any reason.

The government expects the extension of flexible working rights to be of particular interest to elderly workers approaching retirement and to young workers looking for additional training while they work (BBC News, June 2014).

Sky Releases Its 2014/2015 Rates

Sky increased its prices by 5 per cent on August 1 after a three-year price freeze. At the same time it has announced the launch of Sky Sports 5, the first TV channel dedicated to European football. The new channel will show the Champions League- though it will be moving to BT Sport in 2015

GROWTH VOUCHER PROGRAMME

This government programme helps small businesses get strategic business advice on:

Some businesses will be randomly chosen to get a voucher of up to £2,000 to help finance strategic business advice. It is possible that our clubs could benefit from this programme.

The voucher can pay for up to half of the cost of the advice. The supplier will claim this fee from the programme.

LEGISLATION UPDATE

Update: Late Night Levy and Early Morning Restriction Orders Cheltenham Licensing Authority brought in a late night levy from the 1st of April 2014. Islington Borough Council is the first London borough to impose a levy (from 1st November 2014). The City of London, Chelmsford and Southampton have been consulting on a levy for introduction later this year.

Licensing Act 2003: Impending Amendments The Home Office has now decided against going ahead with its original proposal to abolish personal licenses. However, the Deregulation Bill, currently with the House of Lords, aims to repeal the requirement to renew personal licenses every 10 years. The Bill also looks to increase the maximum number of Temporary Event Notices per premises from 12 to 15 p.a., to take effect from 2016.

Licensing Act Fees The Police Reform and Social Responsibility Act 2011 amended the Licensing Act 2003 to give the Home Secretary power to prescribe that fee levels should be set by individual local authorities so as to properly enable them to recover their costs.

The Home Office has since consulted widely on introducing locally-set fees based on actual cost recovery. The Government seems determined to get away from centrally set fees because it recognizes that for quite legitimate reasons cost vary from area to area; and because the present ratable value based banding system needs replacing. The Independent Fees Review Panel looked into the question of fees son after the Licensing Act 2003 came into force and found that there was an estimated shortfall of £43 million in local authority full cost recovery; that any replacement system ought to avoid becoming more complex; and should not benefit one group of license holders at the expense of another. The Home Office supports the avoidance of such "cross­ subsidization". However it will be quite a challenge to devise a new system that ticks all the boxes i.e. simplification, full cost recovery and equitable charging across the range of licensed and club premises. There will no doubt be a further consultation round when the Home Office puts forward definitive proposals.

MACHINE GAME DUTY AFFECTIVE FROM 1 MARCH 2015 Legislation will be introduced in Finance Bill 2014 to create a new rate of machine games duty that will apply in respect of machines where the charge payable for playing can exceed £5. The change will have affect from 1 March 2015. Further details will follow nearer the time.
