Sell the House Now and Divide Up the ProceedsYour primary consideration under these circumstances is to maximise your home’s selling price. We can help you avoid the common mistakes most homeowners make which compromise this outcome. As you work to get your financial affairs in order, make sure you understand what your net proceeds will be - i.e. after sale/legal costs, and after determining what your split of the proceeds will be. Note that the split may not be 50/50, because it may depend on the matrimonial settlement. So you may need the advice of a good matrimonial lawyer or mediator.
Buy Out Your partner If you intend to keep the house yourself, you’ll have to determine how you’ll continue to meet your monthly financial obligations, if you now only have one wage. If you used two incomes to qualify for the old mortgage, refinancing on your own might be a challenge. Getting advice from an independent mortgage broker will be key.

Have Your partner Buy You OutIf you are the one who is leaving, you have the opportunity to start again in a new home with cash in your pocket. However, be aware that if the mortgage is not re-financed, your mortgage lender will consider both you and your partner as original co-signers to be jointly liable for the mortgage until it is repaid in full.
So you need to make sure that the following take place as part of any matrimonial settlement:
• Your partner remortgages the property into their sole name (Part of this re-financing may be used to pay towards your settlement), or;
• You must obtain the consent of your mortgage lender to remove your name from the mortgage. In doing so, you’ll lose your interest in the house
Retain Joint OwnershipSome couples postpone a financial decision with respect to the home and retain joint ownership for a period of time even though only one partner lives there. This might occur to avoid disruption to children for example. While this temporary situation means you have no immediate worries in this regard, you need to make sure that your position is protected by a matrimonial agreement, which may include a restriction being placed on the property.
