Introduction to Metropolitan Region Scheme major amendments

The Western Australian Planning Commission (WAPC) is responsible for keeping theMetropolitan Region Scheme (MRS) under review and initiating changes where they areseen as necessary.

The MRS sets out the broad pattern dined use tor the whole Penh metropolitan region. TheMRS Is constantly under review to best reflect regional planning and development needs.

A proposal to change land use reservations and zones in the MRS is regulated by thePlanning and Ooeloparant Act 2006. That legislation provides for public submissions fa bemade on proposed amendments.

For a substantial amendment. often rcketel to as a major amendment (made under sectionAl of the Act), the WAPC consider all the submissions lodged, and publishes itsrecommendations in a report on aubmis ions. This report is presented to the Minister forPlanning and to the Governor for approval. Both Houses of Parliament must then scrutinisethe amendment before it can take Ir g A s tress.

In the process of making a substantial amendment to the MRS. information is published as apublic record under the following lilies:

Amendment reportThis document is available from the start of the public advertising period of the proposedamendment. it SOS out the purpose and scope of the proposal, explains why theamendment is considered necessary, and informs people how they can comment throughInc submission process.

Environmental review reportThe Environmental Protection Authority must consider the environmental impact of anamendment to the MRS before it can be advertised. Should it require formal assessment, anenvironmental review is undertaken and made available for information and comment at thesame time as the amendment report.

Report on submissionsThe prancing rationale, deformation of submissions and the recommendations of llmWAPC for final approval of the amendment, with or without modification, is documented inthis report.

SubmissionsThis document contains a reproduction of all written submissions received by the WAPC onthe proposed amendment.

Transcript of hearingsA person who has made a written submission may also choose to appear before a hearingscommittee to express their views, The hearings proceedings ate recorded and transcribed,and the transcripts of all hearings are reproduced in this volume.

I understand our previous letter has been mislaid so write again to advise thatCouncil considered this matter at its meeting on 23 September 2000 andresolved:

1. In regards to the proposed Metropolitan Region Scheme amendmentfor the Claremont North East Precinct, specifically the following:

Thank you for the information regarding the Metropolitan Region Scheme ProposedAmendment 1162/41 Claremont North East Precinct (Amendment).

I have reviewed all the relevant information and I can confirm that there are currently no sitesregistered with the Department of Indigenous Affairs (DIA) within the Amendment area.

Nevertheless, it is possible that there are sites that have not yet been reported to the DIAand entered on the Register of Aboriginal Sites, Tre Aboriginal Heritage Act, 1972, (AHA)protects all Aboriginal sites in Western Australia, whether they are known to this Departmentor not. It would be prudent for anyone Involved in ground disturbing works In the Amendmentarea to ensure that they have sufficient knowledge of the Aboriginal heritage values withinthe area 60 that they do not commit an offence (alum the AHA.

As it stands any developt r, at o re ed to be cognizant that the Amendment area is located inclose proximity to DIA 3162 (Lake Claremont) and they need to be aware that any impact toa site will require prior pr rmemon from the Minister for Indigenous Affairs under section 18of the AHA to avoid committing in off( nee under section 17 of the AHA.

The DIA advises that anyone proposing to undertake works within the Amendment areanotify the Aboriginal community and/or Native Title claimants about their current workprogram, to ensure the community is aware of the project. In addition, it is recommendedthat they undertake Aboriginat heritage surveys, to include examinations of the ethnographicand archaeological heritage values of the area prior to undertaking their work program, if thishas not already been done. This will ensure that they avoid Aboriginal sites not previouslyreCOrderi. If any new sites are identified within the Amendment area, these should be

recorded and lodged with the DIA so that we can update our information and place thesetiles on the Register.

As mentioned above, any developers need to be aware that if they are unable to avoidAboriginal sites they will need to submit a notice under section 18 of the AHA to obtain theprior consent of the Minister for Indigenous Affairs to use the land on which the site islocated, 01A cannot provide consent; only the Minister grants consent to use the land onwhich Aboriginal sites have been recorded,

Finally, all persons employed or engaged in the project should be made aware of theirobligations under the ANA. Should cultural material be discovered during the project, workshould cease immediately and the site should be recorded and DIA notified. Additionalinformation on MO ACM can be found on the DIA waste), under Heritage and Culture.

On this remit. we are of the opinionthat the proposed MRS Amendment has considerable merit and should be approved by the WAPCand the Hon. Minister for Planning.

Liveable Neighbourhoods is an operational policy of the WAPC which provides parameters for thedesign and assessment of mixture plans, the subdivision of new urban areas and the development ofurban infill sites. The delivery of liveable Neighbourhoods is also an Integral element in achieving thedelivery of strategies and actions contained within the Network Cities Framework. LiveableNeighbourhoods therefore an important consideration in respect of the proposed MRSAmendment,

The land thesubject of proposed MRS Amendment 1162/41 is located directly north of the Claremont TrainStation and is located within walking distance to the Claremont retail/entertainment precinct whichiz identified as a Regional Centro under WAPC's State Planning Policy 4.2 "Metropolitan Centres PolicyStotoutent for the Perth Metropolitan Region".

I have been informed that car parking around the Claremont Train station maybe reduced forother purposes. Everyone that uses this parking is aware of the recent Increase usage and thespare bays are becoming further away from the station.

If parking bays are to be reduced, patrons of the train will certainly be Inconvenience andpossible atop using the train.If the government want people to use the train they must provide appropriate convenientparking. In fact the parking requires upgrading with proper ground surfacing with bays marked,the complete area requires more lighting to enable safety and covered walkways from parkingareas to the station.

As long as the train stays In operation, there must be adequate parking. I disagree that any ofthe parking bays be allocated to any ether purpose. In future years the car pork will becomeInadequate and will require a multirstorey to enable enough parking.

I wish to add my name to the long list of people who are appa led at the Claremont Town Council's applicationto the WA Planning Commission to abolish the free park n dde at the Claremont railway station, This park nride is very popular and used extensively on a daily basis.

I have no problem with development around Claremont Over however this should not impinge on the park nride facility that is at the railway station now. Indeed Make it better and upgrade II vs it is pot hole riddled butdo not diminish the number of free park to ride spots, This Is what has made the trains ao popular not only forwork purposes but for going to Suhiaco oval and out at night.

As frequent train travellers, we regularly use the Park and Ride at the ClaremontRailway Station. Our only problem with the facility is its popularity, which sometimesrequires us to park in the shadow of the mulch pile!

It is therefore with comae that we leant that the well patronised Rae parking atClaremont Railway Station is likely to become a casualty of the planned ClaremontNoah Cam Precinct development.

The use of our excellent train serviee has grown over recent years- presumably partly inresponse to the public's increasing environmental Gomm& Such positive change inpeople' r behaviour is not easily achieved, but regression to past habits occurs when theprocess beanies too difficult. The unavailability of free, conveniently located parkingcould prove to be too difficult for many people.

In its publications Claremont Council aligns itself with the "green" image. The loss ofthe free Park and Ride I:wallies would deny some current train patrons the possibility ofasserting traffic on the already overused Stirling Highway.

As I have always accepted that the 1.15'0 of Public Transport is much preferred to taking a privatecar into the city, it Is really Important to have ample car parking available (FREE) endconveniently located. The proposed rezoning will negate both thew points.

Claremont Is a major train station - all trains stop here. Local people (and I regard myself aslocal), have Increasingly begun to take on board the State Government message to make ourstreets/roads less congested and catch teeing. Thin proposal Is very disturbingly anti - railwayand Its' customers!

feel that the timing of Re North East Precinct proposal is extremely unfortunate beao° ofthe school holidays and many people are not aware of this proposal and submission timetherefore a must be extended.

Today, I counted 330 care parking on the north side or the car park and on a normal day INScar park is full to capacity carrying approximately 400- SOO cars. The proposed commercialIwo storey building (in blue shown on the Town of Claremont submission) to the loll of thesingle storey shed, is to be built over the existing car park which would Increase the total oncars to 500. rte number of cars to Claremont oration has Increased dramatically for the past3 years.

The three storey car park to be built at the comer of Ornylands and Shenton Roads with aminiman of 200 cars Is obviously not going to be large enough. Apart from full day parkingfor people who commute by train every day there has to be some consideration for shoppersto padsand ride to either Perth or Romantic.

Most week,enda there are several exhibitions held at Ira Royal Showgrounds and every carpa* space Is used, Including ovary open private land around Claremont, therefore theproposed now car park will not help this situation at all.

People who live on the Joondelup line am complaining That there are not enough car parkaand they now have to be there by 7.30em every morning lo gel a car apace.

A distance of approximately 300 moires to Claremont train station from the proposed nt w rarpark Would not be safe especially at night because there are no bates running nth r a Ca daintime from certain areas. This submission is Inrespeese to the proposed changes to the North Cast Precinct (NEP).

After examining the proposed changes I wish to make the following comments.

1. It appears that tire Police and Citizens youth recreation area and skate board area has been

replaced with residential housing and no replacement of a slmllar size and nature has been

shown en the NEP plans. It is Imperative that the youth of he area are catered for and as a

socially responsible government; facilities and programs for youth reduce crime, boredomand substance abuse. Youth are part of society and need to be catered for.

2. The densityof the proposed housing Is too high. Six storeys are not of character forClaremont and surrounding suburbs. The noise Factor and neighbour disputes will occur due

to the close proximity of homes to each other.

3. The significant high rise concept will turn Claremont Into a "gentrified ghetto" not the village

and community atmosphere that currently exist.

4. The Increased traffic In the north east precinct due to the Increased number of residents,

commercial and fetaservices will cause bottlenecks in traffic accessing these facilities and

also significant traffic along Davies Road to Mt Claremont. This will result In traffic lightsbeing needed at the Shenton Road and Davies Road Intersection and also the Shenton Road

and Graslands goad intersection. Additionally there will be increased noise, accidents androad Argo resulting from the Increased use of this land, Drivers may resort to bypassing this

area when driving them Claremont f o Mt Claremont causing Increased traffic in Swanhourne

and other areas north of the railway line which has the predictable increased traffic,

associated noise and nuisance.

5. People will park in other areas to be closer to the train station or other businesses tel the

area which will cause other traffic problems in these areas.

6. There appears to be very little or no parking specific for the COMITIO Oa' or retail areas

shown on the NEP draft structure plan. Where are customers for these retailers meant to

park?

7. There is no parking for those using the football oval and the gym attached to the football

dub.

8. There Is a serious lack of open space, which we all know will lead to Increased use of existing

limitetl open space.

9. The location of the proposed parking for the train station is too far, although the concept ofpeople walking to the station from their car in commendable it is not practical in these days

of high crime, especially against women, single people not to mention those with a dkability.

10, if people are encouraged to park a significant distance from the train station the carrying ofchildren, shopping and pushing elderly and people with disabilities In wheelchairs will be n

real burden.Eventually those that choose to live In the new residential area will complain of the noise

coining from the showground area especially when concerts are held. There is also are high

likelihood that they will complain about the noise of the trains. This will eventually putpressure on the government to put the train line Undefettnind and to move the showground

to other areas.12. The western suburbs have a scarcity of community services with every piece of Int bile land

being sold for residential development, the existing schools and facilities cannot manage

current demand never mind an Increase Widen Will arise from those living In this new

would be extremely upset if the Claremont car park she is reduced. I use the car park reguiarrY, not only toPavel to and from work, but also on weekends when parking in Claremont is severely limited.

Reducing the Wee of the paNIng lot would not ensure that Nom who really need the Parking receive it.Rather, it would give these living close to the gain station an advantage because they aro more likely to boattraffic in the mornings and secure a parking bay before those net have to travel further, In traffic, reachClaremont in time.

III yeas forced to pay park elsewhere every morning because No park-and-ride in full it would place a hugestrain on my budget. In these economic conditions, our local government should be supporting our ability totravel to and from work without additional financial hardship.

Further, Clermont parking is currently quite difficult and taking away the free park and ride would simplyconflate the problem. The new parking at Claremont Quarto/ Is insufficient because it requires me to ems thetrain line which can add up to twenty minutes to my journey. This ear park is en asset to the community.

I am horrified to learn that the Claremont Connell Is considering abolishing a large number of the freeClaremont Park in Ride car bays and replacing them with a very small amount of paid parking. As far as I cansee, on most daye the parking is used to a maximum. I was under the impression the Government wasencouraging people to catch public transport Instead of &Ming cars.

Without the Park in Ride, haw are people supposed to catch the train. Not everyone lives near enough to thestation to walk to it. Other railway linos to Perth have largo regional Park in Rides for commuters. I cannotsee how eliminating such a largo number of Park 'n Ride bays for the Western Suburbs Is Pad planning.Surely this conflicts with the policy announced by the WA Premier fa maintain all Park in Rides.

I have worked In Claremont for 2 years now and pork In the car parks surrounding the trainstation every day. from all my oxporlonces with the car parks surrounding Claremont stationthey are full gal% of the time. This has not changed oven though now parking has opened atClaremont Quarter. Why would the council oven bo considering Inking away a service that iswall unused and obviously required? Thank you for the opportunity to comment on the above. I did comment to theTown of Claremont on the proposal and attached for your information are therange of concerns and queries I used to prepare That submission. Thesehave been Ignored by the Town of Claremont.

Indeed, the height and bulk of past and current prop.. de have bbbnresoundingly opposed by the majority of residents responding Thie i.admitted in the Town's own documentation as exempttle d by the tronqresponse to the Urban Design's Centre's option for 6-6 eturcy building...

The more recent NEP I understand received over 300 public submissions willsresounding opposition as the numbers opposed were 2:1. Yet the Councilchooses to ignore these findings, which begs the question why shouldresidents bother to comment, especially atter virtually no consultation duringthe all-important stage when the NEP was being developed?

I trust that the WAPC will not ignore the community's input and propose lessheight and bulk. I would appreciate the WAPC's subsequent advice in thatregard after it hoe midr it derrian. t am also deeply concerned as toparking issues. The Teem assured me that there will be no multi storeyparking yet from IL achnq The Post' newspaper it appears that the StateGovernment is promoting euch t proposal. This would be out of context withthe charm and villager atmosphere of the Claremont Town Centre.

As the WAPC will appreciate, this is a most important issue and I would askthe Commission to critically examine the poor consultation process associatedwith the NEP and also if it is to be approved, make it conditional at a lowerbuilding height.

Attachment

1 Height & Density

Reference to "Claremont Junction" at p. 5. The key reason not to proceedwas due to the height and bulk proposed, consistent with the community Input(proposal was to rezone to "Inner city"). Significantly that reason has not beenincluded at p.5.

Note the reference at p.8 to the Urban Design Centre's (UDC) work andextensive and successful community consultations reflected in a significantlevel of community response (626 responses). That response did not supportproposals that involved excessive density and height. This hr been ignoredin the Structure Plan. (Also note that at p.35 the Plan (claims to reflect theprinciples of the UDC work, yet ignores the UDC's outcome e on der ity andheight). Indeed figure 12 (p.37) directly Ignores the principle of sensitivebuilding height" by promoting six storey. Six storey banks of buildings socalled "announcements"- dominate at the cnr of Shenton and Davies, alongthe newly aligned Shenton Rd and in the north west corner. Five storeyssurround the north eastern corner.

So previous concerns regarding height and density by the communityhave been totally ignored resulting in buildings x 3 storeys now beingproposed.

Reference to the Plan and "close consultation" (p.9.) There has been noconsultation with rosidentsfratepayers until the call for submissions bythe Town of Claremont. They have merely been "informed" from time totime and at no stage have they been asked to "review" their previous positionson height and density, i.e. their fundamental issues. The new proposal isnot an extension of the UDC work- it is totally different in scale and hasnot been prepared in an inclusive manner.

Note reference to the Plan's "development guiding principles" (p. 40). Thesewill define the development yet have been prepared without communityinput, but rest on being "rigorously tested and reviewed by Town ofClaremont technical staff, informal Elected Member briefings, relevantgovernment agencies and the consultation team" (p.40)

Notes "a maximum population ratio has been sought" (p.41). Also quitewrong/scurrilous to state that the 6 storeys reflect the consultation outcome ofthe UDC process and to suggest it's "a moderate building height" (p. 41).

Note reference to height being needed to "take advantage of high visualamenity god...views of the lake and golf coarse' (p.42). So what is it? Height

for TOD reasons or for maximising views and economic return. (If the tatter.ToC should rezone the foreshore high density to maximise return.)

Note reference to the figure of 627 dwellings being a minimum yield, withany flexibility being directed only towards increasing the yield, (p.52)

Misleading- note reference to height- "Building height- should aim to create alow to mid-rise urban form character with a structured arrangement of tallerbuildings to announce key landmarks". p69 This infers that most housing wiltbe in low to mid rise bracket but it remains unclear as to what is the proportionof 5.6 storeys.

2 Parking

Note reference to a "multideck facility" was proposed at the first designworkshop meeting 6 May 2008 (Appendix 1, p2) Note this "workshop" wasnot open to the community.

Figure 10 labels quite clearly a "possible multi dock car park" (twice)P.33

And what is the proposed "park and ride with roof top garden above" mean atfigure 14, p.42? How tall-no reference to this on heights map. Is this anotherparking structure?

Plaza Design area- see map p. 45. Has the multi storey car park beendeliberately left out? If so, why? Or is it #3, consistent with figure 10? If so,note the misleading language at point #3 at ff 46 to disguise the multi storeycar park.

Note limited parking for retail (p.73) . And where will the retail employeespark??

So given that parking for (300) rail patrons and retail employees and shoppersin the precinct for all on and off street wi,l be charged at commercial rates(see p74-75) where will the cars that use the PTA land now "spill to"? Thefirst residential streets that offer "free" parking will suffer.

This submission on the above MRS Scheme Amendment 1162/41 is madeon behalf of the Federation of Western Australia Police and Communityyouth Centres (WAPCYC) Inc by its Properly Advisory Committee.

The Federation is o significant landowner in the precinct. and one of only9 within the project area.

The Properly

The PCYC properly (plan attached) is held in freehold and bounded byLapsley Road to the north. Davies Rood to the west, Graylands Road tothe east and Reserve 8002 to the south (Lo161S6, plan 207374,Volume1313, Folio677).

The site is 8.003m2 and contains Industrial style buildings fronting LapsleyRoad, with a large area of hardslanding to the south, and a skalepark tothe south east.

Federation of WAPCYC

The federation WAPCYC is a non-profit organisation and commenced inWestern Australia In 1941 to support and provide guidance and structureto young people for the purpose of reducing crime within thecommunity. 11 Is a partnership between the community and the WesternAustralia Police dedicated to conducting recreational activities andaddressing juvenile crime issues through proactive targetedprogramming.

There are approximately sixty PCYC and Blue Light Centres In WesternAustralia and each Centre provides a significant contribution to the WAPolice's crime prevention strategy.

In addition to the delivery of traditional activities involving communityparticipation, the primary role of PCYC centres Is the Implementation of"crime prevention" programs within local communities and working withyouth especially those who are identified and considered 'at risk'.

Engaging youth at risk and the Implementation at early interventionprograms is linked directly to the WA Poke Frontline strategy. This is whatmakes PCYC uniquely different to all the other youth clubs.

Programs and activities are designed to locus on anti social behaviourand youth engagement with the objective of educating and instillingpositive attitudes and behaviour and addressing causal factors leadingto juvenile crime.

The North East Precinct Development Project

The PCYC property is proposed ler residential development in theClaremont North East Precinct structure Plan in the form of Iwo proposeddevelopment sites:

Sub Precinct 0 proposed lorl 2, 2 storey cottage lots with rear lanewayaccess:Sub-Precinct C: adjoining to the east with 58 dwellings in 3.4 storeyapartments: and

A new access road is also proposed to the sculls of the property runningbetween Davies Road and Graylands Road, that provides access toadditional apartments to the north of Ihe existing Claremont Oval.

Relocation of Existing PCYC

In order to realize the planning objectives for the northern section of theprecinct It will be necessary for the existing PCYC activities on the propertyto be relocated elsewhere within the area.

In ascertaining the suitability of o proposed location. the following factorsare considered.

Freehold title to landSize of site to it enclosed floor space of approximately 2520m2excluding car park:Adequate land area to facilitate outdoor activities:Relevancy to community needs, e.g. demographics:Exposure to young people and community users:Unabstruc led e Ifeefive delivery of programs and services;Capacity to or commodate a variety of programs includinggymnastics rnentoring. drop-in centre, boxing, technical trainingworkshop for 'at risk' school aged students and indoor air riflerange.Accessibility by young people relying on public transport:Car parking availability;Impact on surrounding residents and use of arterial suburban roads:Close proximity to shopping centres and local facilities;

II is the Intention and view of the Property Advisory Committee that thereis a strong need and demand for a PCYC centre in the Claremont andwestern suburbs area.

Project Management

The PCYC properly is a key site in the overall project as it provides newdevelopment opportunities that screen and complement existingproperties an Lapsley Road, and also allows a new access and interfacewith high density development to the north of the Claremont Oval.

The current project management structure is unclear. It is noted that theTown of Claremont has developed a Draft MOU with the stolegovernment (former Minister for Planning and Infrastructure) with regard toIts role in progressing the local planning. structure planning and designaspects of the planning process. II is understood that Londcorp has beenproviding project and feasibility advice on the project. The Federation isalso aware that a working group including the Town of Claremont andslate government agencies hos been overseeing the project to dale.

If is nevertheless concerned that as a significant landowner within theproject area the WAPCYC has not been adequately Involved In theevolution of the project. and In particular:

has not been invited into the project management group;has not received clarification on:

o which agency will be leading this project on behalf ofgovernment;

o how key sites are to be assembled and acquired;o by whom, and by which process

If is noted that the Town of Claremont has resolved to amend theClaremont North Post Precinct Structure Plan to remove reference inSection 12,6 to lemdcorp being the assumed land purchaser developerfor the project.

Uncertainty with regard to the implementation of the project has majorimpacts on the Federations' current ability to menage, and plan for theexisting PCYC, and to meet its future needs. II is essential that agreementsare reached that will allow these uncertainties to be overcome.

MRS Amendment 1162/41

The Federation has had briefings on the project to date from the Town ofClaremont, and has expressed its general support for the planningproposals to introduce a development zone, and develop a structurepion for the precinct. The following response Is provided by the Property Advisory Committee onbelt' of the Federation to the proposed MRS Amendment 1162/41:

1. The Federation is supportive of the proposed urban zoning with regardfo the precinct. It regards Ihis as a necessary step in providing a deartown planning framework for the future development:

2. It nevertheless remains concerned at the implications of the project anPCYC activities, and for youth in the wider area:

It wishes to express its concern that, whilst the urban zoning willcontribute to facilitate these Important regional planning objectives forthis transit oriented development, this will require the relocation of theexisting PCYC and acquisition of this properly. It is of considerableconcern to the Federation, end essential to the realization of theproject, that en alternative property Is found in the locality. In theabsence of an alternative site being found, the facility will have toremain on the current site. This may have serious implications for theImplementation of the project:

It therefore seeks the support and cooperation of the Town ofClaremont, WAPC and t,andcorp to work constructively with theFederation to assist in finding a suitable site on government land in thelocality. In this respect it seeks a commitment from the parties to aprocess to secure an alternative site:
