Staff Report ACCEPTANCE OF EASEMENT AND ROAD IMPROVEMENTS

GILLMAN HILL ROAD July 7, 2008

Background: On December 11, 2007 the Planning Board granted Robert Hale Andrew and Phyllis Eldridge Trust a conditional approval for a 5-lot subdivision on the corner of Gillman Hill Road and Old Center Harbor Road. The review process included recommendations from DPW regarding road improvements to Gillman Hill Road and Old Center Harbor Road. The applicant has agreed to pay a $10,000 contribution towards additional gravel for these roads. The applicant has also agreed to provide the town with a 17’ wide easement along the west side of Gillman Hill Road to allow for future road widening and associated work. These agreements reached during the review process were subsequently incorporated into the Planning Board’s conditional approval. 1. The acceptance of the 17’ wide easement by the Board to facilitate the future

widening of Gillman Hill Road; and

2. Approval by the Board of Selectmen for work proposed in the Gillman Hill Road and Center Harbor Road ROWs associated with the subdivision.

Issue: The applicant is in agreement with the above referenced conditions of subdivision approval. The applicant has requested that the Board of Selectmen act on the both items in order for the subdivision to proceed with final approval. Discussion: Easement: The form of the proposed easement deed has been reviewed by the Town Manager, Director of Public Works and Town Counsel. The form of the easement deed is acceptable (attached for reference). Comments from Town Counsel have been incorporated into the deed. In addition, the applicant’s attorney has certified the owner has good title and can convey the easement free of liens and mortgages. Road Improvements: The scope of work associated with widening the road is described in the DPW Staff Review Comments dated 8/8/07 (attached for reference). Sharing road improvement costs between the applicant and the Town has previously occurred under similar circumstances. The contribution

made by the applicant allows the Town of Meredith to upgrade the roads with a reduced cost to the taxpayer. Additionally, the new subdivision will directly benefit from the improved access on Gillman Hill Road and Center Harbor Road. The payment will be made directly to the Town and allocated for this specific purpose. The DPW will manage the project and provide project oversight. The additional gravel will be added as needed prior to and following development of the house sites. The Board raised a question at the June 16th workshop regarding additional funds for road improvements. Following the meeting, Carol contacted Tim Bates regarding the possibility of additional funds above that required in the Planning Board’s decision. It was advised that the Selectmen accept the contribution amount set by the Planning Board because a deviation from the conditions set in the Notice of Decision could revoke the subdivision approval. Approval by the Selectmen of Road Improvements: Town Counsel has previously advised the Planning Board it has the authority to require, by way of a conditional subdivision approval, applicants make proportionate offsite improvements necessitated by their development. However, the Board of Selectmen is ultimately the custodian of public roads and has the authority to authorize improvements in the public ROW that are required pursuant to the Planning Board’s decision. Fiscal Impact: The applicant is not seeking financial compensation for the value of the 17’ wide easement along Gillman Hill Road. The applicant has agreed to pay a $10,000 contribution towards the Town’s improvements of Gillman Hill Road and Center Harbor Road. A performance guarantee and insurance is not required for the proposed improvements, as it will be the Town performing the work. Recommendation: Assuming to be no significant concerns raised by the Board at the July 7, 2008 meeting, it is recommended that the request by the applicants Andrew and Eldridge Trust be acted on favorably. Town Manager Recommendation: I concur with the staff review and recommend the Board consider adoption of the following Sample Motion: “Mr. Chairman, In light of our discussion and the review comments of the Town staff and Town Counsel reviewed this evening, I would move the following:

1. The Board of Selectmen accept the proposed 17’ roadway easement and authorize the execution and recording of the document; and

2. The Board of Selectmen authorizes improvements to Gillman Hill Road as recommended by the Department of Public Works and pursuant to the Planning Board’s conditional approval granted on December 11, 2007.”

Staff Report ACCEPTANCE OF GIFT

Background: RSA 31:95-b: Appropriation for Funds Made Available During Year – This RSA requires a Municipality to legally accept funds whether as a gift, grant or donation in amounts over $5,000 at a public hearing, or by the Board of Selectmen if under $5,000. RSA 31:95-e: Acceptance of Personal Property Donated to Towns – This RSA allows the Selectmen to accept a gift of personal property with a value under $500. Issue: The Board of Selectmen needs to accept the gift of a used washing machine, in working order, and a gift certificate for a dryer. Discussion:

Attached is a memo received from Chief Morrow that indicates an anonymous donor desires to donate to the Police Department a used washing machine (value $50) and a $400 gift certificate for a dryer.

When the new Police Station was built, a hookup for a washer and dryer was installed. However, units were not purchased.

I have confirmed with legal counsel the ability of the Town to accept a gift from an anonymous donor. There is no conflict of interest in the acceptance of this gift.

Fiscal Impact: There is no fiscal impact to the Town other than the use of water and electricity when the washer and dryer are utilized.

Town Manager Recommendation: It is recommended that the Selectmen make the following motion: “I make a motion to accept the donation of a used washing machine and a gift certificate for a dryer, with a total value of $450, from a donor who desires to remain anonymous per RSA 31:95-b and e.”

I have recently been before the Board of Selectmen in Moultonborough and looking to meet with the Meredith and Center Harbor Selectmen. We are looking for support of the boards to send a letter of request to the NHDOT bike coordinator Jerry Moore to support the placement of a couple of strategically placed share the road signs on the most dangerous stretch of the Rt. 25 corridor between Meredith and Center Harbor. My question is what do I need to do to get on the agenda for the Meredith selectmen's meeting? Subject: Re: Moultonborough Cycling Club // Lakes region bike plan 2008 Hello Carol, A letter of support would be appreciated as soon as possible if the board is supportive of the effort to improve awareness and safety for cyclists that use the route around the lake. As far as locations of the signs, the DOT engineers would determine the strategic locations based on the criteria they have defined for share the road signs. There are several areas around the lake that certainly qualify. We are looking for a couple signs one east bound one west bound between the Center Harbor and Meredith. The other area would be the Top of the Hill at the Rotary heading east and one coming back up the hill into Meredith westbound. I have been speaking and working with LRPC regarding this and they are supportive of this effort. The Moultonborough Board has approved this along with Chief Scott Kinmond for the areas specified in Moultonborough. We want the signs to be in strategic locations and only where needed as we do not want to add to sign clutter. Increasing safety is the primary goal of this effort. The information below is in the Bike warning sign document that I have attached. If the board would like more information I would be glad to meet with them and provide more specific information regarding this.

Hello Lisa, Here is the sign request document. Essentially we are asking for two signs "Share the road"; one

heading westbound towards Center Harbor, and one eastbound towards Meredith on Rt. 25. This is a stretch of road that is a corridor for bike and heavy auto traffic with a very small shoulder. A sign would help raise awareness. I am out of town on vacation on Monday and am working to get a club representative to attend the meeting. If I cannot get a representative, please express my regret for not being able to be at the meeting to the selectmen. I have kept the email thread on this email as it has some background from the Moultonborough meetings.

Topic: Guideline for Bicycle Warning Signs

Description and Purpose: To provide guidance for the installation of bicycle warning signs to

be used on State maintained highways. The subject signs are oriented toward vehicular and

bicycle traffic along the highway.

General:

Bicycle warning signs are generally installed and maintained by the New Hampshire

Department of Transportation, Bureau of Traffic for the specific situations and conditions

described herein. Per the New Hampshire Statewide Bicycle and Pedestrian Plan (May,

2000), the NHDOT adopted the statewide bicycle route system as its primary network of

routes for inter-regional bicycle travel. Furthermore, the NHDOT will “develop standards …

for appropriate signage of the network”, “identify deficiencies and initiate appropriate

corrections within financial constraints for routes on the network,” and “actively provide for

the needs of bicyclists and pedestrians in all highway projects where possible.”

The primary means to meet these stated goals and objectives will be through project

development and implementation. In addition, the NHDOT will work to identify portions of

the adopted statewide bicycle route system that warrant additional traffic control measures as

described herein and will provide said devices where warranted through normal maintenance

operations. Implementation of these measures will be by the Bureau of Traffic through the

NHDOT Bike/Ped Coordinator.

Anyone wishing to bring specific concerns relative to bicycle traffic to the attention of

the NHDOT should forward them in writing to the Bicycle and Pedestrian Program

coordinator as follows:

system, bicycle specific warning signs will be considered on a case by case basis, depending

on need and available resources.

Procedures:

1. Per the MUTCD, Warning signs call attention to unexpected conditions on or adjacent to

a highway or street and to situations that might not be readily apparent to road users.

Warning signs alert road users to conditions that might call for a reduction in speed or an

action in the interest of safety and efficient traffic operations.

2. The need for specific warning signs as described herein will be determined by an

engineering review as described in the MUTCD 2003, 1A.09.

3. Placement of warning signs shall be erected in accordance with the general requirements

for sign position as described in the MUTCD 2003 .

4. The signs shall be black legend and border on a yellow Type III retroreflective

background.

5. The Department may approve the installation of bicycle warnings as noted below:

a. “Share the Road” (W16-1) may be installed on State maintained roadways for

designated bike routes on the New Hampshire Statewide Bicycle Route System map

prepared by the NHDOT Bureau of Transportation Planning. This type of sign is used

on a roadway with less than a four (4) foot wide paved shoulder to warn motorists to

watch for bicyclists traveling along the highway. These signs will be installed with

the “Bicycle Warnings” (W11-1) signs. The signs are to be used at points where the

paved shoulder width is reduced or where regular bicycle traffic (i.e. separate bike

route) is introduced. The signs should not be used as a reminder along the length of a

route.

b. “Bicycle Warning” (W11-1) signs along with one of the supplemental plaques

“distance” (W16-2a) or “arrow” (W16-7p) or “ahead” (W16-9p) shall be installed at

designated crossings of a designated bike route as noted above. The signs should only

be used at locations where bicycle traffic is the primary crossing mode. For multi-use

paths that include bicycle and pedestrian traffic, the pedestrian warning signs (W11-2)

should be used.

c. “Steel Grid Deck” (W8-10a) or “Steel Grid Shoulders” (W8-10b) supplemental

plaque signs will be installed prior to all steel grid bridges on the State maintained

highway. These signs will be installed with the “Bicycle Surface Condition” W8-10

signs.

d. “Angled RR XING” (W8-10d) supplemental plaque sign shall be installed prior to

all railroad crossings that are less than a 45 degree angle to a State maintained

highway. This sign will be installed with a “Bicycle Surface Condition” warning

(W8-10) sign.

Discussion: The current Chair, Ginny Lovett, has recommended the appointment of three people: Carol Gerken, Liz Lapham, and David Sias. (There are no term limits for this Committee.) Fiscal Impact: None. Town Manager Recommendation: Concur with recommendations of the Village Pathway Chair. Background: The Zoning Board of Adjustment has four vacant positions for Alternate members. Issue: To make the necessary appointment to the ZBA. Discussion: The current ZBA Chairman, Jack Dever, has suggested the appointment of Donald Hampton to serve as an Alternate through March 31, 2011. Fiscal Impact: None. Town Manager Recommendation: Concur with recommendations of the ZBA Chair. The following sample motion is provided: “Motion to appoint Donald Hampton as an Alternate member of the ZBA through March 31, 2011.”
