55 Preparation of Detailed Cost Estimates & Technical Specifications for Phase 1 of NIMZ
Detailed technical specifications shall be prepared and the consultant shall prepare the tender Documents for the works execution, in consultation with Client. The consultant shall coordinate with PMC agency appointed by Client during tender evaluation (s) and selection of contractors (s). Any modifications suggested by Authority/PMC shall be carried out by the Consultant. The consultants shall attend the pre‐bid meeting and provide necessary assistance in clarifying the queries of the bidders.
As per RFP, the consultant has to support the authority during stage 3 – Construction stage and Stage 4 – Completion stage and accordingly 30% of the total consultancy fee is linked with the above stage. Whereas the first sentence of page 56, indicates that the consultant has to coordinate with PMC appointed by the authority. In this regard, we request TSIIC to clarify the expected role play from the master plan and the design consultant. In case if the authority requires the support of the design consultant then the payments due at stage 3 and stage 4 shall be paid on monthly basis.
Scope of services under Stage 3 and 4 is detailed out in the RFP ToR clause 2.2.3 & 2.2.4. Consultant has to carry out all the services as mentioned in the ToR. The payments for services under stage 3 will be made on the pro rate basis as per the actual work executed (in terms of actual expenditure incurred) with the following payment structure.

57 Considering the nature of the assignment and the extent of the cash outflow during the stage I of the project and the clarification sought on the role play of the consultant, the payment schedule has to be revised. Secondly, engineering survey and investigations are required during stage I of the assignment, which will have substantial financial implications on the consultants. It is therefore requested to include payment stage i.e Inception report in the revised schedule.

TEFS report that was submitted to GoI at the time of final approval (2014‐15) is available with TSIIC. The same shall be provided to the selected consultant.

17 2.28 30 Execution of agreement After acknowledgement of the LOA as aforesaid by the Selected Applicant, it shall execute the Agreement and provide irrevocable Bank Guarantee for Performance Security. The irrevocable Bank guarantee for Performance Security shall be 10% (Ten Percent) of the agreed professional fee. The Bank Guarantee shall be from any Nationalized / Scheduled Commercial Bank in favour of the Chief Executive Officer, M/s. Medak National Investment & manufacturing Zone Limited. The Selected Applicant shall not be entitled to seek any deviation in the Agreement.
As per RFP, the irrevocable Bank guarantee for Performance Security shall be 10% (Ten Percent) of the agreed professional fee. Generally, Performance Security value will be 5% of the payable contact / agreement value. Therefore, we respectfully request to you to consider reducing the Performance Security to 5% accordingly.

46 Preparation of Overall conceptual master Plan – Topographic Surveys
Kindly confirm the area and Specification. Also exclude the timeline for conducting the topographic survey from Schedule of Services.
The project area is about 12,635 acres. As stated in RFP, the consultant shall undertake physical topographic survey of the entire project site in order to prepare the comprehensive base map. The timeline is included in the schedule of services.

47 Preparation of Overall conceptual master Plan – Geotechnical Investigations ‐ The number of boreholes and trial pits shall be in accordance with the stipulations of the relevant IS (Indian Standards) codes.
We request client to provide estimated quantities for Geotechnical investigations. It will help the consultants to justify the cost of Geotechnical surveys for the project area. Any extra quantity shall be payable extra, please clarify. Also confirm the area of Geotechnical survey. Also exclude the timeline for conducting the geotechnical survey from Schedule of Services.
Based on the similar projects experience of this scale, the consultant shall indentify the required number of bore holes & trial pits in accordance with the stipulations of relevant IS codes. The timeline is included in the schedule of services.

47 Preparation of Comprehensive Base Maps for Overall Site (i) Site boundary obtained from the Topographic Survey and co‐related with the (Digitised Cadastral Maps).
We assume that the client will provide Cadastral Map in digitised (soft copy) form. Please confirm.
TSIIC shall provide the available data in the form of scanned images. It shall be the responsibility of the consultant to digitise and geo‐reference the same as part of the preparation of comprehensive base map.

We would request that this clause is removed. Based on our industry experience, the scope, scale and complexity of such assignments require the clients to recognize change during the duration of the assignment. Such changes that are currently unforeseen and will have an impact requiring design rework will need to be compensated for by the client. Adequate clauses and protection for escalations caused by extension of project duration for reasons beyond control of the consultant may please be included in the contract.
