SouthCarolinaDepartmentofSocialServicesABCQualityRating&ImprovementSystem

QualityComplianceAgreementASACONDITIONOFPARTICIPATIONANDPAYMENT,IUNDERSTANDANDAGREE:

• EnrollmentintheSouthCarolinaDepartmentofSocialServicesABCQualityRating&ImprovementSystem(ABCQuality)isvoluntary.

• ThisAgreementshallnotbeassignedortransferred.

Ø Itisonlyvalidattheaddressenrolled.Shouldtheprovidermoveorrelocate,thisagreement

becomesnullandvoid.Ø TheprovidershallimmediatelynotifyABCQualityofanychangesinownershipoftheprogramor

facilityincluding,anymanagementagreements.AchangeinownershipwillrenderthisAgreementnullandvoid,andpaymentwillceaseforanycurrentchildrenbeingservedwithSCVoucher.

• AllinformationprovidedontheProviderEnrollmentFormandtheRateCertificationFormisincorporated

asapartofthisAgreement,andtheprovidercertifiesthatallinformationistruetothebestofitsknowledge.

• ThisAgreementshallbeineffectforaperiodof________beginning______________________.ABC

Qualitycaninitiateterminationofthisagreementbydeliveringwrittennotificationtotheprovider.ThenaturalendingofthisAgreementisnotappealable.ItisnotaguaranteeorarightthatABCQualitywilloffertheprovideranotherAgreement.

• TheprovisionsofthisAgreementandperformancehereunderaresubjecttoallapplicablelaws,

regulations,ordinances,andcodesofthefederal,state,andlocalgovernments.AlltermsoftheAgreementshallbeconstruedinamannerconsistentwiththeaforesaidlaws,regulations,ordinances,andcodes.Shouldanyofthetermsorconditionsofthisagreementconflictwithanyoftheaforesaidlaws,regulations,ordinances,orcodes,thenonlythosetermsshallbedeemedinoperativeandnullandvoidtotheextentoftheconflictandshallbedeemedmodifiedtoconformtherewith;theremainderoftheagreementshallbeunaffected.

• TheproviderwillcomplywithPublicLaw103-327,PartC,EnvironmentalTobaccoSmokeAct,alsoknown

asthePro-ChildrenAct,whichprohibitssmokinginanyindoorfacilityusedroutinelyorregularlyfortheprovisionofhealth,daycare,education,orlibraryservicestochildrenundertheageof18years.

• IfanydisputeshallariseunderthetermsofthisAgreement,thesoleandexclusiveremedyshallbethe

filingofaNoticeofAppealwithin30calendardaysofreceiptofwrittennoticeoftheABCQualityactionordecisionwhichformsthebasisoftheappeal.AdministrativeappealsshallbeinaccordancewiththeDSSregulationsR.126-150,etseq.,CodeofLawsofSouthCarolina(1976,asamended),Volume27,andinaccordancewiththeAdministrativeProceduresAct,Section1-23-380,codeofLawsofSouthCarolina(1976,asamended).

• NonewSCVoucherchildrenwillbeallowedtoconnecttomyfacilityduringanappealwithABCQualityorDSSChildCareLicensing.However,theprogrammaycontinueservingcurrentchildrenforthedurationoftheireligibilityperiodunlessthehealthandsafetyofthechildrenarejeopardized.

SouthCarolinaRegulationsForChildCareFacilities

• ThefacilitymustmaintainacurrentSCDepartmentofSocialServices(DSS)license/approvalor

DepartmentofDefenseCertificate,atalltimes,ifrequired,byStateorFederallaworregulations,andmeetallapplicablestateandlocalhealthandsafetyrequirementsinordertoprovideservicesunderthisAgreement.

• Thefacilitymustmaintainahistoryofcompliancewithregulations.Historyofcomplianceisdefineda

having:Nofrequentormultipledeficienciesorasignificanteventposingsubstantialthreattothehealthorsafetyofthechildrenthatinvolvessupervision,compliancewithratios,orhealthandsafetyviolations.

• Allstaffsupervising/caringforchildrenmusthaveCardiopulmonaryResuscitation(CPR)certificationandpediatricfirstaidcertification.

• Allstaffsupervising/caringforchildrenmustmeetthehealthandsafetypreservicerequirementwithin90daysofhire.

• Ifthehealthandsafetyofchildrenarejeopardizedanddependingupontheseverityofthecircumstances,

ABCQualitymayinitiateterminationoftheprogram’senrollmentandimmediatelywithdrawchildrenreceivingSCVoucherfromtheprogram,eveniftheprogramispursuinganappealwithChildCareLicensing.

ServiceCosts,PaymentandClientFees

• TheactualratechargedforchildrenunderthisAgreement,includingtheRegistrationFee,shallnot

exceedtheactualrateschargedtoallotherchildrenexceptwhentherearedifferentactualrateschargedfordifferentageswithincaretypes.Whentherearedifferentactualrateschargedfordifferentageswithincaretypes,SCVoucherwillpayaccordingtotheSCVoucherMaximumPaymentScheduled.

• AnyavailablediscountswillbeextendedtochildrencoveredunderthisAgreementtothesameextentandinthesamemannerasallotherchildren.

• IftheactualrateschargedtoprivatepayingclientsexceedthemaximumratepaidbySCVoucher,the

providermaycollectthedifferencefromtheclient,inadditiontotheclientfee.

• TheclientfeesestablishedbySCVouchershallbecollectedfromeachclientwhosechildiscoveredunderthisAgreementinadvanceofserviceunitdelivery.SCVoucherassumesnoresponsibilityforcollectionorpaymentofclientfeesincludinganyadditionalassessedclientfeeschargedbytheprovider.

• RequestedchangesintheservicecostsshallbesubmittedtoSCVouchersixty(60)dayspriortothe

effectivedateoftheincrease.SCVoucherhasthesoleandexclusiverighttoacceptorrejectanychangeintheservicerate.

• Allservicesprovidedandclaimssubmittedshallbeinaccordancewith45CFR98(1998),Provider

BusinessProceduresissuedbyABCQuality,andallapplicablefederalandstatelaws,rules,andregulations.

• ClaimsforpaymentshallbehonoredbySCVoucheronlyforactiveeligibleclientsasverifiedbythechild

careproviderandauthorizedbySCVoucher.

• SCVouchermaynothonorpaymentrequestsforservicessubmittedbytheproviderwhicharemorethansixty(60)calendardayslaterthantheserviceendingdates.SCVouchershallnotbeliableforpaymentofvoucherssubmittedbytheproviderthatexceedthistimeframe.

ChildCareRecords• ThefollowingrecordsshallbemaintainedforeachchildreceivingSCVoucherfromthetimeofenrollment

untilthefacilityhasbeenmonitoredandtherecordsreviewed,orforaperiodofthreeyears,whicheveristhelongest:

o Dailyattendance-maintainedinsupportofpaymentvouchers;ando CopiesofServiceVoucherLogs[SVL].

• Theprovidershallreportserviceunitsnotprovidedandabsencesastheyoccur.Failuretoreportbothof

thesemayresultinrecoupmentoffunds.• TheprovidershallnotifySCVoucherwhenachildmissesten(10)consecutivedayswithoutawaiver.

• Iftheprovidercontinuestoserveaclientbeyondtheallowablenumberofabsencesforthechild,SC

Vouchermayrecoupfundsfromtheprovider.

• Recordsand/orreportsrequestedbyABCQualityshallbefurnisheduponrequest.

• Duringnormalbusinesshours,ABCQualityand/ortheirdesigneeshallhaveaccesstoallrecordsrequiredunderthisAgreement.Theyshallhavetherightto:examineandmakecopies,excerptsortranscriptsfromallrecordsunlessprecludedbyfederalorstatelaw;contactandconductprivateinterviewswiththeproviderand/oritsemployees;andconducton-sitereviewsofallmattersrelatingtothisAgreement.

• OncetheprovideracceptsachildusingSCVoucher,theprovidershallnotterminatethechild’s

attendancewithoutpriornotificationtoSCVoucher.Suchnotificationmustincludethereasonforrequestedtermination,suchasfailuretopayanyclientfees,andmustbeproperlydocumented.

• TheprovidershallbenotifiedifSCVoucherterminatesaclient.Theprovidershallbereimbursedonlyfor

serviceunitsprovidedtothechilduntiltheeffectiveterminationdategivenbySCVoucher.TheprovidermustreportanyserviceunitsnotprovidedandabsencestoSCVoucher.

• ClientswillbeallowedtofinishanyweekthatpaymenthasbeenrequestedforontheSVL.

Discipline• Corporalpunishmentisstrictlyprohibitedforanychildreninthefacility,regardlessofwhethertheyare

childrenusingSCVoucher,privatepayingchildren,orchildrenoftheowneroremployees.Corporalpunishmentistheuseofphysicalforcetothebodyasadisciplinemeasure.Physicalforcetothebodyincludes,butisnotlimitedtospanking,slapping,biting,andshaking.Theprovideragreestohaveawrittenpolicythatcorporalpunishmentisnotallowed,thatissignedbyparentsandstaff,andthatisupdatedyearly.

GeneralIssues• Theprovidershallsafeguardtheuseanddisclosureofinformationconcerningapplicantsfororrecipients

ofservicesinaccordancewithallapplicablefederalandstatelawsandregulationsandshallrestrictaccessto,anduseanddisclosureof,suchinformationincompliancewithsaidlawsandregulations.

• ABCQualitywillnotifytheappropriateChildCareLicensingRegionofallfindingsofnon-complianceto

LicensingRegulations.

• ABCQualityassumesnoresponsibilitywithrespecttoaccidents,illnesses,orclaimsarisingoutofanyworkundertakenwiththeassistanceoffundspaidunderthisAgreement.Theprovidershalltake

DiscontinuationofServicetoClients

necessarystepstoensureorprotectitself,itsclients,anditspersonnel.Theprovideragreestocomplywithallapplicablelocal,state,andfederalacts,rules,andregulations.

• TheprovidermustcomplywithTitleVIoftheCivilRightsActof1964andSection504oftheRehabilitation

Actof1973whencenter-basedandgrouphomecareisprovided.

• Iftheproviderreceiveseightypercent(80%)ormoreofitsoperatingbudgetfromstateandfederalfunds,itshallnotdiscriminateastoreligionintheadmissionofanychildnorintheemploymentofpersonnel.

• TheproviderwillserveanychildrenenrolledthroughthisAgreementonlyatthefacilityandaddress

enrolled.

• TheproviderwillnotifyABCQualityofanyintentionstorelocateitsfacilitypriortothemove.TheprovidershallnotserveanychildrenunderthisAgreementatthenewlocation/facilityuntilithasmetregulatoryrequirementsandbeenenrolledbyABCQuality.

• TheproviderwillmaintainaworkingLAN(LocalAreaNetwork)telephoneatitsfacilityatalltimesandwill

notifyABCQualityofanychangeinphonenumber.CellphonesmaybeusedonlyinadditiontotheLANline.

• TheproviderwilladheretotherequirementsoftheABCQualityStandards.

• Iftheproviderreceivesagrant,itagreestoremainenrolledinABCQualityfortheperiodrequiredbythe

grantorfundsmayberecouped.

• Iftheprovider’senrollmentagreementisterminatedbyABCQualityoranyagegroupisde-enrolled,theprovidercannotreapplyforenrollmentinABCQualityforaminimumofonecalendaryearfromthedateofterminationorde-enrollment.

ABCQualityiscommittedtoacodeofethicsthatguidestheperformance,conduct,andbehaviorofitsparticipantsincludingchildcarefacilities,owners,directors,andteachers.ThiscodeoffersguidanceforresponsiblebehaviorandwillensurethehighestlevelofprofessionalismintheoperationandactivitiesofABCQualityproviders.ABCQualityparticipantswilladheretothiscodeofethicsandrelevantprogramstandardsandwillbeheldaccountablefortheiractions.

1. Participantswillnotharmchildrenandwillnotparticipateinpracticesthatareemotionallyorphysicallyharmful,disrespectful,degrading,dangerous,exploitive,orintimidatingtochildren.

2. ParticipantswillrespectcolleaguesinearlychildcareandeducationandsupporttheminmaintainingtheABCQualityCodeofEthics.

3. Participantswillpromotesafeandhealthyworkingconditionsandpoliciesthatfosterrespect,cooperation,collaboration,competence,well-being,confidentiality,andself-esteeminstaffmembers.
